In het preadvies van Annemarie Drahmann, ‘De Wet open overheid is slechts een tussenstap’, staat de vraag centraal in hoeverre de op 1 mei 2022 in werking getreden Wet open overheid (Woo) een oplossing biedt voor een aantal veel gehoorde kritiekpunten op de voorganger van de Woo, de Wet openbaarheid van bestuur (Wob). Startpunt van haar analyse is de vraag of het openbaar maken van overheidsinformatie een gunst of een recht is en wat eigenlijk het nut van die openbaarheid is. Andere vragen die aan de orde komen, zijn: Welke informatie komt voor openbaarmaking in aanmerking en welke rol speelt de informatiehuishouding van de overheid daarbij? Waarom en hoe moet informatie actief (uit eigen beweging) of passief (op verzoek) openbaar worden gemaakt? Welke uitzonderingsgronden kent de Woo en is de bescherming van persoonlijke beleidsopvattingen ten behoeve van intern beraad nog wel van deze tijd? Ten slotte gaat Drahmann in op de effectiviteit van het toezicht en de rechtsbescherming tegen Woo-besluiten. Het preadvies wordt afgesloten met de constatering dat de Woo een eerste, maar noodzakelijke tussenstap is voor de verbetering van de openbaarheid van overheidsinformatie en met een aantal aanbevelingen voor verdere verbetering.

Abstract

This chapter investigates the role of transparency in controlling the exercise of power by EU agencies. Transparency provides an important tool but offers no one-size-fits-all solutions. Transparency obligations can vary in form and function, and not all forms of transparency are equally appropriate for every type of agency: agencies with rule-making powers should be obliged to provide transparency to the general public, whereas agencies that take decisions affecting individuals should be transparent primarily to those individuals. On the other hand, transparency can have downsides as well. It can have adverse effects on decision-making or may cause harm to other interests, such as public safety or commercial interests. Some agencies operate in areas where transparency is likely to have more disadvantages than benefits. In these cases, alternative forms of control must be sought.

Uit dit onderzoek blijkt dat de juridische speelruimte voor waterschappen om de mogelijkheden van aquathermie te benutten, groot is. Wel is het van belang dat beleidskeuzen goed onderbouwd worden en dat de samenwerking met andere partijen transparant is. Dit betekent dat bestuurders de vraag moeten beantwoorden op welke wijze zij hun water willen inzetten als duurzame warmtebron en in hoeverre zij hierin zelf willen sturen.

Abstract

This chronicle discusses the developments in case law and administrative law that took place from the summer of 2014 till the summer of 2015. Paragraph 2 discusses the decentralisation of the social domain and the entry into force of the Youth Act, the Social Support Act and the Participation Act. Paragraphs 3 and 4 discuss some remarkable rulings on the rule of specialty, state liability for climate change, and the definition of administrative orders. Paragraph 5 discusses the impact of EU law on Dutch administrative law, and paragraph 6 attempts to shed some light on the general direction in which Dutch administrative law is developing. Overall, Dutch administrative law seems to be moving away from its recent infatuation with efficiency towards a more balanced approach.

Abstract

De gemeente Amsterdam heeft de ambitie om het gebruik van restwarmte voor de verwarming van woningen en kantoren in de stad te vergroten van 62.000 nu naar 230.000 in 20140. De gemeente heeft aan het Centrum voor Energievraagstukken UvA gevraagd te onderzoeken welke rechten en plichten eindgebruikers hebben om aangesloten te worden op het warmtenet en welke bevoegdheden de gemeente daarbij heeft. Daaraan verbonden is de vraag welke mogelijkheden zijn er om het gasnet uit te faseren. Deze verkenning geeft zicht op de juridische mogelijkheden en onmogelijkheden daarbij. Het huidige juridische kader, Gaswet, Warmtewet en omgevingswetgeving, is het uitgangspunt van deze verkenning. Ook is het afgestemde wetsvoorstel STROOM in het onderzoek betrokken, omdat de inhoudelijke aspecten van dit voorstel wel in nieuwe wetsvoorstellen kunnen terugkomen.

Abstract

‘The principle of transparency in EU law’ explores a variety of transparency obligations in European law, and offers a comprehensive framework to classify and understand those obligations. The principle of transparency is ubiquitous and multifaceted. The obligations derived from it range from a duty to allow access to documents held by the EU-institutions to a prohibition to change the terms of a contract concluded after a procurement procedure. But although transparency is a diffuse concept, it has a distinct core: the concept refers to the availability, accessibility and clarity of information. However, the concept of transparency does not in itself determine the target and the timing of transparency obligations, nor does it tell us much about the acceptability of exceptions, and whether information should be provided pro-actively or on request. The author provides a method to determine the exact nature of the transparency obligations that can be derived from the principle of transparency in concrete situations. She explains how the application of the EU principle of transparency is affected by the manner in which transparency contributes to the realisation of a variety of goals, the context in which it is applied, and the presence of conflicting interests. The key to understanding the principle of transparency is appreciating its instrumental value. By being transparent, governments can promote democracy and individual rights, and improve economic performance. These goals are realised by means of two related but distinct mechanisms. First, transparency aids people in decision-making. Second, it allows them to see what is going on inside government. As such it is a precondition for any attempt to affect what is going on inside that government. Understanding how transparency functions is insufficient though: whether there is an obligation to be transparent is determined by the normative framework that governs the relation between the government and its citizens. This framework differs depending on whether this relation is perceived as one involving the citoyen, homo economicus, or homo dignus. For the citoyen, the overarching principle governing its relation with the government is democracy. For homo economicus, it is the promotion of the internal market and the Treaty freedoms. For homo dignus, it is the respect for human rights. The contents of the principle of transparency are determined by these higher-order principles. Because of that, we can only derive those particular transparency obligations from it that do in fact contribute to the realisation of the state that is embodied in those higher order principles. Because transparency always functions in the same two distinct ways to bring about its positive effects – it facilitates decision-making and allows outsiders to see what public authorities are doing – our understanding of the manner in which it functions provides us with a way to determine what concrete transparency obligations we can derive from the principle of transparency, provided we know what effects the law requires us to achieve by its observance.

Abstract

The principle of transparency is something of an oddity in EU law. Indeed, some doubt that there is one general principle of transparency. The importance of transparency within the EU can be established beyond a doubt, and it is prevalent in numerous fields of EU law, but the obligations that are derived therefrom vary wildly. This makes it hard to get a good grasp of what the principle requires. It is possible to bring some system into this chaos, though. The author identifies two mechanisms by which transparency brings about the many positive consequences that have been attributed to it and combines them with the normative frameworks that guide the relation between public authorities and EU citizens into six categories of transparency obligations. Each of these categories has a distinct goal, and suggests a different answer to the questions one is faced with when confronted with a demand to be ‘transparent.’

Abstract

In het preadvies van Annemarie Drahmann, ‘De Wet open overheid is slechts een tussenstap’, staat de vraag centraal in hoeverre de op 1 mei 2022 in werking getreden Wet open overheid (Woo) een oplossing biedt voor een aantal veel gehoorde kritiekpunten op de voorganger van de Woo, de Wet openbaarheid van bestuur (Wob). Startpunt van haar analyse is de vraag of het openbaar maken van overheidsinformatie een gunst of een recht is en wat eigenlijk het nut van die openbaarheid is. Andere vragen die aan de orde komen, zijn: Welke informatie komt voor openbaarmaking in aanmerking en welke rol speelt de informatiehuishouding van de overheid daarbij? Waarom en hoe moet informatie actief (uit eigen beweging) of passief (op verzoek) openbaar worden gemaakt? Welke uitzonderingsgronden kent de Woo en is de bescherming van persoonlijke beleidsopvattingen ten behoeve van intern beraad nog wel van deze tijd? Ten slotte gaat Drahmann in op de effectiviteit van het toezicht en de rechtsbescherming tegen Woo-besluiten. Het preadvies wordt afgesloten met de constatering dat de Woo een eerste, maar noodzakelijke tussenstap is voor de verbetering van de openbaarheid van overheidsinformatie en met een aantal aanbevelingen voor verdere verbetering.
