As the largest archipelago, Indonesia should be able to utilize its potential to create prosperity for its people. In fact, the maritime sector has not been fully utilized by Indonesia. Indonesia must prioritize the goal of becoming a maritime country to restore maritime glory. This is in line with Indonesian President Joko Widodo's goal to make Indonesia the world's maritime axis. The research method used is descriptive qualitative. The World Maritime Axis is indeed a decision taken by the government to restore the nature of Indonesia as an archipelago. Until now, the World Maritime Axis has not taken the form of a document equipped with a strategy in it. The strategy becomes an 'extension' of the policy, which currently there is no World Maritime Axis Strategy because the policy is still overlapping. Currently, the World Maritime Axis is categorized as a development policy discourse whose orientation is to realize Indonesia's vision as a maritime country, so it requires a lot of attention to fix and complete this idea so that it can be categorized as a policy and implemented through a strategy.

International Law of the Sea are legal principles governing the rights and authorities of a country over sea areas under its national jurisdiction (national jurisdiction). International Law has reign most interactions between States in the sea. The practice of illegal transshipment is a serious issue as it falls within both theft mode and smuggling through the transfer of cargo from one ship to another that occurs at sea. Including a crime which committed in the territory of one state but involving parties from another state or more. Law enforcement is a major concern when an offence of some kind of illegal transshipment occurs. The study aims to determine the jurisdiction of states in enforcing laws including in criminal matters that occurred over its sea where the country has sovereign rights, especially when the involvement of 3rd states party in the law enforcement on a ship which not entered into its territory, yet indicately committed a violation of the law in some states water area, this paper also study how the responsibility of 3rd states party towards of flag states of ships who feel harmed. This article was written using normative research methods with a statutory. Historical and conceptual approach explaining efforts from international organizations in resolving the issues of accountability of countries involved in the problem of Illegal Transshipment at sea in the 1982 UNCLOS perspective especially the process of law enforcement and dispute resolution by the International Tribunal for the Law of The Sea (ITLOS).

Indonesia is part of the Tokyo MoU and for the first time in history, managed to get the Tokyo MoU white list in 2021. Indonesia's steps to improve the performance of Indonesian-flagged ships and get the Tokyo MoU white list have been seen in the past 3 years. Therefore, there is a view that Indonesia's success in implementing the Tokyo MoU rules through increased supervision and inspection on Indonesian-flagged ships that will sail abroad reflects Indonesia's performance in realizing the vision of the Global Maritime Fulcrum (GMF) which has been designed since 2014. Researchers are interested in proving that there is a link between Indonesia's inclusion on Tokyo MoU’s white list and a reflection of Indonesia's vision as a GMF. This research uses a descriptive qualitative research design, and the data was collected through library research and depth interviews. The results shows that the position of Indonesia in International Maritime Community more became powerful, because Indonesia is being able to ensure the standards of international convention, and this becomes an advantage and stigmatizes or weakens the competitiveness of Indonesian ports. This position also shown that there is a relation between Indonesian performance on Tokyo MoU’s white list with Indonesia’s vision as a GMF.

Indonesia bukan salah satu negara claimant, tetapi provokasi Cina melalui kapal nelayan yang dikawal oleh kapal Chinese Coast Guard telah melanggar hak berdaulat Zona Ekonomi Ekslusif Indonesia di Laut Cina Selatan (LCS) yang berpotongan dengan Nine Dashed Line (NDL).Sampai saat ini sinergi antar instrumen kekuatan maritim Indonesia untuk menjaga hak berdaulat Indonesia di LCS masih terlihat lemah, sehingga rumusan masalah penelitian ini adalah bagaimana sinergi instrumen kekuatan yang berwenang pada domain maritim Indonesia dalam menghadapi Klaim Cina atas LCS. Analisa sinergi dilihat dari tiga aspek yaitu perspektif, kebijakan, dan Rules Of Engangement (ROE) yang diterapkan pada operasional. Penelitian ini menggunakan metode kualitatif untuk mengeksplorasi pertanyaan penelitian secara mendalam, dengan teknik analisa Soft System Methodology untuk melakukan pendekatan terhadap permasalahan dengan perbandingan sistem berpikir dan dunia nyata secara terstruktur, dan dibantu dengan NVivo untuk proses triangulasi data. Hasil penelitian menunjukkan instrumen kekuatan maritim di Indonesia belum memiliki perspektif yang selaras terhadap NDL. Penelitian ini juga menunjukkan bahwa kebijakan dari pembuat kebijakan dan turunan strategi dari pembuat strategi Pemerintah Republik Indonesia belum diharmonisasi, sehingga ROE pada level operasional yang tepat untuk menghadapi provokasi Cina atas LCS belum dirumuskan dengan menyesuaikan antara wewenang dengan kapabilitas instrumen. Secara keseluruhan, penelitian menemukan bahwa sinergi instrumen kekuatan maritim Indonesia masih perlu dioptimalkan untuk menghadapi Klaim Cina atas wilayah yurisdiksi Indonesia di LCS. Despite the fact that Indonesia is not one of the claimant states, China’s provocation through its fishing boats escorted by Chinese Coast Guard has been violating Indonesia Exclusive Economic Zone on South China Sea (SCS) which intersects with Nine Dashed Line (NDL). Up to this day, the synergy among Indonesian maritime power instruments to defend Indonesia’s sovereign rights is still weak, thus the problem identified in this research is how the instrument of power authorized in Indonesia’s maritime domain synergizes to face China’s claim over SCS. Synergy analysis is seen from three aspects: perspective, policy, and Rules Of Engangement (ROE) applied to operational. This research uses qualitative method to further explore the research question, with Soft System Methodology technique to approach the problems through comparison between system of thought and real world in a structured manner, as well as supported by NVivo to execute the process of data triangulation. Research results show that Indonesia’s maritime power instrument have not a harmonious perspective on NDL yet. This study also shows that policy created by policy makers and strategic derivatives created by strategy makers of the Government of the Republic of Indonesia have not been in harmony, thus appropriate ROE at operational level to face China's provocation on the SCS has not been formulated by adjusting authority with instrument capability. Overall, the study found that the synergy of Indonesia’s maritime power instruments is not yet reliable to deal with China’s Claims over the territory of Indonesia in the SCS.Keywords: Synergy, Maritime Power Instruments, Nine Dashed Line, South China Sea, Sovereign Rights
