A liberdade de escolha de tratamentos médicos decorre dos princípios do respeito à dignidade da pessoa humana (art. 1º, III, CF), bem como dos princípios da Bioética e do Biodireito do respeito à'autonomia do paciente'e o'consentimento informado'. Ademais, é reflexo dos Direitos Humanos e de escolhas existenciais – núcleo da dignidade e da existência humana. O ordenamento jurídico brasileiro tutela em diversos dispositivos de sua legislação o direito de o paciente decidir se vai se submeter ou não a um tratamento ou transplante médico. Inclusive, o Código Civil trata tal temática como um direito de personalidade. O Estatuto do Idoso assegura a autodeterminação da pessoa idosa e o Estatuto da Criança e do Adolescente determina que a opinião do menor amadurecido seja ouvida. A Jurisprudência também vem reconhecendo o direito de pacientes realizarem escolhas de tratamentos médicos, o que envolve recusa à transfusão de sangue. Assim, o caso de pacientes Testemunhas de Jeová (muitas vezes vítimas de preconceito e discriminação em instituições de saúde) e sua liberdade de escolha de tratamentos médicos isentos de sangue é objeto de análise nesta obra.

So unvorstellbar die institutionelle Diskriminierung und der soziale Ausschluss der Italiener aus heutiger Sicht sind, so zeigt der Rückblick dennoch, dass sich an der Debatte inhaltlich wenig geändert hat.
