Environmental services are essential to guarantee economic and social development. To ensure the maintenance of these services, there are environmental policy instruments, such as Payment for Environmental Services (PSA in portuguese). PSA aims at transferring resources between social actors, aiming to create incentives with social interest in management of natural resources. The State of Minas Gerais is characterized by the pioneering movement of PSA mechanism in Brazil, called the Conservative Plan of Mantiqueira (PCM in portuguese), a proposal to strengthen environmental governance involving 284 municipalities in the Serra da Mantiqueira area of ​​influence. Seeking to understand the process of implementing the public environmental policy proposed by the PCM, a case study in the municipality of Inconfidentes (MG), from the perspectives of development and effectiveness of PES schemes around the notions of design and institutional interactions. A theoretical survey based on documentary analysis, literature review and specific legislation was carried out. The role played by the PCM's partner actors in the study area testified to the induction of local environmental governance and the plural insertion of public and private actors, demonstrating that governance has been increasingly considered in the planning, formulation and implementation of municipal environmental policies proposed by the PCM. Os serviços ambientais são essenciais ao desenvolvimento econômico e social. Para garantir a manutenção destes serviços, há instrumentos de política ambiental, tal como o Pagamento por Serviços Ambientais (PSA). O PSA visa a transferência de recursos entre atores sociais, objetivando criar incentivos com o interesse social na gestão de recursos naturais. O Estado de Minas Gerais caracteriza-se pelo movimento pioneiro do mecanismo de PSA no Brasil, denominado Plano Conservador da Mantiqueira (PCM), uma proposta de fortalecimento da governança ambiental envolvendo 284 municípios na zona de influência da Serra da Mantiqueira. Para entender o processo de implantação da política pública ambiental proposta pelo PCM, efetuou-se um estudo de caso no município de Inconfidentes (MG), a partir das perspectivas de desenvolvimento e eficácia dos esquemas de PSA em torno das noções de desenho e interações institucionais. Realizou-se um levantamento teórico baseado em análise documental, revisão de literatura e legislação especifica. O papel desempenhado pelos atores parceiros do PCM na área de estudo testificou a indução da governança ambiental local e a plural inserção de atores públicos e privados, demonstrando que a governança tem sido cada vez mais considerada nos processos de planejamento, formulação e implementação de políticas ambientais municipais propostas pelo PCM.

The laws are effective means in achieving the plans and programs outlined in the policies of a country. For environmental issues, the legal standards are no exception and serve to guide citizens and organizations regarding the rational use and protection of natural resources, whether by prohibition or direction applied by the respective uses of the same, because every law evolves on behalf of society. The aim of this study is to describe the process of creating laws in order to facilitate to those who militate in the technical environment, a better understanding of how they are made or imposed, making more effective their use in environmental issues. The methodology used is exploratory, ie, it is a review and analysis of existing work and research. As a result of this study highlight that the legislative process as determined by the Constitution of 1988 is the same used for both environmental issues and for other legal common. The Federal level starts with the presentation of the Bill to the House of Representatives that performs all necessary procedures by their approval or rejection. Being approved goes to the Senate for deliberation of the house approved the legislation headed for the President to sanction or veto. The same procedures are performed at state and municipal levels, stressing, however, that these two federal agencies have only one legislative house, the Legislative Assemblies and Municipal Councils, respectively, however the achievement of their legal rules can not supersede federal laws., As normas jurídicas são meios eficazes na consecução dos planos e programas traçados nas políticas de um país. Para a questão ambiental, as normas jurídicas não fogem à regra e servem para guiar seus cidadãos e organizações no que tange ao uso racional e tutela dos recursos naturais, seja pela proibição ou pelo direcionamento aplicado aos respectivos usos dos mesmos, pois toda norma jurídica evolui em prol da sociedade. O objetivo geral deste estudo é descrever o processo de criação das normas jurídicas visando a facilitar aos que militam na área técnica ambiental, um melhor entendimento de como elas são elaboradas ou instituídas, tornando seu seguimento mais efetivo para as questões ambientais. A metodologia usada é exploratória, ou seja, análise documental de trabalhos e pesquisas já existente. Como resultado deste estudo destaca-se que o processo legislativo conforme determinado pela Constituição Federal de 1988 é o mesmo utilizado tanto para as questões ambientais como para os demais ordenamentos jurídicos comum. Em nível Federal inicia-se com a apresentação do Projeto de Lei à Câmara dos Deputados que realiza todos os procedimentos necessários até sua aprovação ou rejeição. Sendo aprovado segue para o Senado para deliberação daquela casa legislativa que o aprovando encaminha para o Presidente da República para Sanção ou Veto. Os mesmos procedimentos são realizados em nível Estadual e Municipal, destacando, entretanto, que estes dois entes federados só possuem uma casa legislativa, Assembléias Legislativas e Câmaras Municipais, respectivamente, porém, a consecução de suas normas jurídicas, não pode sobrepor às Leis Federais.
