Abstract

This thesis examines the ways in which the occult and its practitioners are represented in British novels from 1850-1900 and asserts that their representations are racialized in each case. Specifically, this thesis analyzes how the practice of the occult is portrayed in Cranford by Elizabeth Gaskell (1854), A Strange Story by Edward Bulwer-Lytton (1861), The Moonstone by Wilkie Collins (1868), Strange Case of Dr. Jekyll and Mr. Hyde by Robert Louis Stevenson (1886), Trilby by George Du Maurier (1894), The Blood of the Vampire by Florence Marryat (1897), The Beetle by Richard Marsh (1897), and Cleo the Magnificent by Louis Zangwill (1899). I argue that these novels are emblematic of the ways that British novels participated in, contributed to, and commented on the racialization of the occult that occurred across different genres of fiction published in the second half of the nineteenth century, emphasizing that while individual characters are shaped more specifically by the prevailing discussions of race and the occult that existed during the time of their publication. To demonstrate how pervasive this trend was, this thesis deliberately incorporates a range of canonical and non-canonical texts across several genres that participate in the racialization of the occult, organized by the type of occult practice being racialized. This racialization is accomplished through an emphasis on five key elements regarding occult characters in the novel: physical darkness, a comparison to dangerous animals, a threat posed to the white characters, the framing of the occult character as representative of their entire race, and the eventual removal of the occult character from the story. The novels I examine here contain these elements with minor variations. They are also present in representations of different races, classes, and genders, reinforcing the association of "the Occult" with "the Other".

THE ABA PROHIBITION ERA: FROM WATERGATE TO [...], Is it professional misconduct for a lawyer to record lawyer-client conversations without providing notice? When this question hit the national headlines with the summer 2018 release of Michael Cohen's recordings of Donald Trump, an unresolved area of legal ethics doctrine was brought to public attention. The ABA's current position is that the Standing Committee is "divided" and unable to offer a disciplinary standard on secret client recordings. This ambivalence is reflected in the lack of consensus across U.S. jurisdictions. Amid recent transformative developments in recording technology, and heated public debate about the risks and benefits of secret recording, the bar can no longer afford to avoid this issue. In the prevailing doctrinal framework, secret client recordings are prohibited when they constitute deceit in violation of the widely adopted Model Rule 8.4(c). As recording technology has grown more pervasive, the bar has increasingly concluded that secret recording is no longer deceitful--under the assumption that people no longer feel that they were deceived when they learn that they were recorded without notice. Yet, even if the deceit rationale for prohibiting secret recording is in decline, this Article argues that secret recording of clients deserves a separate analysis drawing on client-specific professional duties that weigh heavily against the practice. The Article concludes by assessing the exceptional circumstances where such recordings might be justified by exigent public-interest purposes. This analysis revisits and sheds new light on the fundamental tension between lawyers' duties to clients and the public.

18. Institutional Commitment to Sustainability: An Evaluation of Natural Resource Extension Programs in Universities in Alabama and Oregon

Abstract

Purpose: The purpose of this research is to determine institutional commitment to sustainability by examining Natural Resource Extension program inputs, activities, and participation. Design/methodology/approach: A document analysis of Natural Resource Extension planning and reporting documents was conducted to provide contextual and historical data for the study and 58 in-depth interviews were conducted with Natural Resource Extension personnel in the Alabama Cooperative Extension System and the Oregon State University Extension Service. Findings: This research moves beyond the familiar teaching and research functions of higher education institutions and focuses on Cooperative Extension, which is the outreach arm of universities. The paper discusses challenges and opportunities associated with implementing sustainability through these outreach education programs. In both Alabama and Oregon, the Agriculture, Home Economics, and 4-H programs dominate human and economic resource investment in Cooperative Extension. Natural Resource Extension programs in Alabama and Oregon represents 6 and 14 percent, respectively, of all program expenditures in Cooperative Extension. Both states have educational programs that address sustainability of natural resources and those programs were interdisciplinary in nature. Little evidence is found extensive participation in Natural Resource Extension programs by environmental groups, minorities, and other non-traditional clientele. Lastly, Oregon's political context was more conducive to broadening Natural Resource Extension program work in sustainability. Practical implications: Educational institutions such as Natural Resource Extension programs at universities play a significant role in educating private landowners, the public, and professionals about various aspects of forestry and natural resources. Based on this study of Natural Resource Extension programs in Alabama and Oregon, the following are needed for extension to address natural resource sustainability through its educational programs: sufficient intellectual and financial commitment to sustainability, diverse and inclusive participation in programs, and collaborative interdisciplinary programming. The analysis presented here can aid other educators as they explore sustainability through educational programming. Originality/value: Since, Natural Resource Extension programs address societal concerns through problem solving, grassroots education, and research and technology dissemination, they are poised to do work in the sustainability arena. No study to date has examined sustainability from the aspect of Natural Resource Extension educators in Oregon and Alabama. An understanding of current investment in sustainability through education is fundamental to building a strong Extension program in this area. (Contains 1 figure and 4 tables.)

22. The Dynamics of the Professional Self: Findings from Law School and Early Law Careers

Abstract

The empirical literature on U.S. legal education suggests that learning to “think like a lawyer” requires students to bifurcate personal values and the professional self. Legal scholars perennially debate whether this bifurcation results in an alienated and “bleached out” professionalism or a relatively benign sacrifice of personal preferences in favor of the client-centered principle of “neutral partisanship.” This dissertation brings these normative and empirical perspectives into conversation through an exploratory microdynamic study of lawyers’ professional identity formation at an elite law school. Drawing on 153 longitudinal interviews, a novel identity mapping method, and ethnographic observations, I examine how law students conceive of their emerging professional selves relative to other roles in their lives, how these conceptions change over the course of legal education, and how this empirical analysis may alter normative debates on professional socialization.
