The industrial hemp sector is growing and, in recent years, has launched many novel hemp-derived products, including animal feed. It is, however, unclear to what extent individual cannabinoids from industrial hemp transfer from the feed into products of animal origin and whether they pose a risk for the consumer. Here we present the results of a feeding experiment with industrial hemp silage in dairy cows. Hemp feeding included changes in feed intake, milk yield, respiratory and heart rates, and behaviour. We combined liquid chromatography–tandem mass spectrometry-based analyses and toxicokinetic computer modelling to estimate the transfer of several cannabinoids (Δ9-tetrahydrocannabinol (Δ9-THC), Δ8-THC, Δ9-tetrahydrocannabinolic acid, Δ9-tetrahydrocannabivarin, 11-OH-Δ9-THC, 11-nor-9-carboxy-Δ9-THC, cannabidiol, cannabinol and cannabidivarin) from animal feed to milk. For Δ9-THC, which has a feed-to-milk transfer rate of 0.20% ± 0.03%, the acute reference dose for humans was exceeded in several consumer groups in exposure scenarios for milk and dairy product consumption when using industrial hemp to feed dairy cows.

Consumer protection shifts risks from consumers to businesses. This raises marginal costs and equilibrium prices. It is justified when markets are not strong enough to allocate contractual risks or accident risks efficiently, especially in cases of severe asymmetric information between suppliers and consumers. Consumer protection can then increase the consumer’s expected welfare from a contract. We test these considerations in a theoretical and empirical study on consumers' right to early repayment of mortgage loans without damage compensation to the creditor in the European Union. We show in a formal model that such a right can lead to an impairment of consumer welfare, compared with the traditional rule of expectation damages for breach of contract. This applies if the consumer is risk averse and repays a loan with a high interest rate in a low interest period to take up a new loan for the same project at lower interests. From a theoretical point of view, this right has no solid economic underpinning, if it is not restricted to cases of personal hardship of the consumer and serves an insurance purpose. We present empirical evidence supporting this argument. In a panel study on monthly mortgage interest rates of 23 EU Member States between 2005 and 2017 we show how interest rate spreads change with the level of consumer protection.

The central thesis of Katharina Pistor's book is that private law, in conjunction with its increasingly global outreach, serves the interests of the rich and enables “rule by law” (p. 205) rather than a “rule of the law”. The rules of contract law, corporate law, insolvency law, property law and private international law are of particular importance in this regard. According to the author, these areas of the law shape or "encode" the domination of resources and capital in ways that increase wealth and inequality. The book seeks to understand, from a jurisprudential perspective, disruptive economic developments such as the Lehman crisis, rising inequality and the lagging of wages behind general economic development in the US and Western industrialised economies, and it makes proposals for legal policy. The English version, published in 2019, has been widely discussed and largely positively reviewed. This essay presents a decidedly critical perspective. It does not doubt important lines of thought in the book but questions central statements and hypotheses made in it.

3-Chloro-1,2-propanediol (3-MCPD) and its fatty acid esters (FE) are present as contaminants in different processed foods. Based on the available toxicological data the potential risk of 3-MCPD and its FE to human health was assessed by risk assessment authorities, including the European Food Safety Authority (EFSA). Considering the available data, EFSA concluded that 3-MCPD is a non-genotoxic compound exhibiting secondary carcinogenic effects in rodents. A tolerable daily intake of 2 μg/kg body weight and day was derived by EFSA for free and ester-bound 3-MCPD in 2018. However, there are still different pending issues that have remained unclear until now. Here, we summarize the current knowledge regarding 3-MCPD and its FE with a focus on pending issues regarding exposure assessment via biomarkers as well as the identification of (toxic) metabolites formed after exposure to FE of 3-MCPD and their modes of action.

The negotiations between the European Union and the United Kingdom about their future legal and economic relations are not only about economic gains, but also about the compatibility of legal cultures. The Brexiteers defend British law and British parliamentarism against progressing supranational integration driven not only by the European legislature but also by its jurisprudence. The British government rejects, for the future, any role of the European Court of Justice in shaping relations with the EU. This increases the chances of incurring economic losses from Brexit.

Zusammenfassung In diesem Beitrag wird ein Messsystem vorgestellt, das aus der Kombination eines phasenmessenden Interferometers mit einem Hartmann-Shack-Wellenfrontsensor besteht. Die beiden Sensoren nutzen einen gemeinsamen optischen Strahlengang einschließlich eines Mikroskobjektivs, das auf die zu messende Oberfläche gerichtet ist. Sie unterscheiden sich jedoch grundlegend in ihrer physikalischen Funktionsweise und ihren messtechnischen Eigenschaften. Der Wellenfrontsensor erfasst niederfrequente Ortsfrequenzanteile einer dreidimensionalen Oberflächentopographie mit einer vergleichsweise geringen Anzahl an Stützstellen anhand eines einzelnen monochromen Kamerabildes. Das Interferometer benötigt zwei RGB-Aufnahmen zur Rekonstruktion der Phasenkarte derselben Oberflächentopographie und erfasst dabei deutlich höhere Ortsfrequenzanteile, welche für die Rauheitsmessung erforderlich sind. Eine spezielle Doppelpuls-Beleuchtung in Verbindung mit einer periodischen Phasenmodulation ermöglicht die Akquisition der erforderlichen Interferogramme in ca. 50 µs. Die Kombination der Messergebnisse von Wellenfrontsensor und Interferometer ermöglicht den Verzicht auf störanfällige Unwrapping-Algorithmen und erhöht die Flexibilität und das Einsatzspektrum der Sensorkombination im Vergleich zu einem Einzelsensor. Die geringe Zeitdauer zur Erfassung der Topographie eines mikroskopischen Messfeldes erlaubt Messungen an bewegten Messobjekten und bildet damit eine wichtige Voraussetzung für den Einsatz des Sensorsystems in Produktionsanlagen. Die Funktionsweise und die praktische Realisierung des Sensors werden vorgestellt. Messergebnisse von verschiedenen Messobjekten zeigen das Potential dieser Sensorkombination und die jeweiligen Einschränkungen der beiden Sensoren auf.

Alkenylbenzenes are naturally occurring secondary plant metabolites, primarily present in different herbs and spices, such as basil or fennel seeds. Thus, alkenylbenzenes, such as safrole, methyleugenol, and estragole, can be found in different foods, whenever these herbs and spices (or extracts thereof) are used for food production. In particular, essential oils or other food products derived from the aforementioned herbs and spices, such as basil-containing pesto or plant food supplements, are often characterized by a high content of alkenylbenzenes. While safrole or methyleugenol are known to be genotoxic and carcinogenic, the toxicological relevance of other alkenylbenzenes (e.g., apiol) regarding human health remains widely unclear. In this review, we will briefly summarize and discuss the current knowledge and the uncertainties impeding a conclusive evaluation of adverse effects to human health possibly resulting from consumption of foods containing alkenylbenzenes, especially focusing on the genotoxic compounds, safrole, methyleugenol, and estragole.

The editors’ introductory chapter to this volume deals with the interplay of major legal and economic parameters of Brexit and presents an outlook on the subsequent articles. Most economists expect that any Brexit, but especially its “hard†variant, will entail welfare losses in the EU, but more so in the UK. Although a post-Brexit agreement that emulates much of the Internal Market would be in the UK’s interest, British “red lines†(ECJ, autonomy and fisheries) impede the negotiations, along with the EU’s stubborn insistence on “level playing fields†. The British aspiration to privileged financial market access is as illusionary as seeking salvation in a - dysfunctional - WTO. Although the present odds of a “soft†Brexit are rather low, the mutual dependence of actors geographically so close fuels hopes that both will be drawn back to the negotiation table.

We relate the rules versus standards debate to legal norms of taking law in developing countries and argue in favour of more precise legal norms regulating takings in low-income countries. Clear, specific and exact legal norms should be socially preferred whenever a regulatory law cuts into fundamental rights as this improves the possibilities of supreme courts to check the constitutionality of such norms. This holds equally for rich and poor countries. But in poor countries, precise norms have additional advantages over standards, whose adjudication requires highly qualified and loyal judges and administrators, is information intensive and increases procedural costs for the parties. We argue that in the course of economic development, courts and administrations should be granted more flexibility and rigid rules should gradually be replaced by more adjustable legal standards which are more flexible and can adjust better to the merits of a single case.

1,2-unsaturated pyrrolizidine alkaloids (PAs) represent a large group of secondary plant metabolites exhibiting hepatotoxic, genotoxic, and carcinogenic properties upon bioactivation. To examine how the degree of esterification affects the genotoxic profile of PA we investigated cytotoxicity, histone H2AX phosphorylation, DNA strand break induction, cell cycle perturbation, micronuclei formation, and aneugenic effects in different cell models. Analysis of cytotoxicity and phosphorylation of histone H2AX was structure- and concentration-dependent: diester-type PAs (except monocrotaline) showed more pronounced effects than monoester-type PAs. Cell cycle analysis identified that diester-type PAs induced a S-phase arrest and a decrease in the occurrence of cells in the G1-phase. The same structure-dependency was observed by flow-cytometric analysis of PA-induced micronuclei in CYP3A4-overexpressing V79 cells. Analysis of centromeres induced by lasiocarpine in the micronuclei by fluorescence in situ hybridization indicated an aneugenic effect in V79

The internet technology allows the harvesting, storage, and processing of large datasets about individuals and things. When new datasets are derived from the raw data, new information is generated, which can be both privately profitable and socially productive, serving to realize economies of scope and a better allocation of resources. Or these practices can amount to a mere unproductive transfer of wealth and facilitate unfair trade practices. The raw data often contain protected information on individuals. Internet regulation must therefore achieve three policy goals. It must protect the privacy of internet users, which is derived not from economic goals but from basic human rights. It must incentivize the production and use of derived datasets and open secondary markets for data. And it must effectively prevent the use of data for unproductive purposes. The current global legal situation achieves none of these goals. It allows the internet giants to reap monopoly profits, achieve market dominance, divert income streams, and reduce consumer welfare. And it does not sufficiently protect personal data. The efficient use of information cannot be achieved by competition law but rather through a combination of different property rights, an alienable erga omnes right for the subjects of information to protect their privacy, and an open data rule for depersonalized datasets, which would remove the current de facto property of data controllers. Processed and newly derived datasets should however be protected by copyright law.

Der Leser gewinnt den Eindruck, Privatrecht sei in kapitalistischen Staaten das selbstgemachte von Anwalten kodierte und von willigen Gerichten umgesetzte Recht reicher Leute und groser Unternehmungen, das deren Reichtum und gleichzeitig die die Ungleichheit vergrosere. The reader gets the impression that private law in capitalist states is the self-made law of rich people and large corporations, codified by lawyers and implemented by willing courts, which increases their wealth and at the same time increases inequality. When Pistor writes about wealth through recoding legal norms, she does not distinguish clearly enough between private wealth in a patronage economy, which is made possible only through redistribution, stagnating or making society as a whole poorer, national wealth, which advances a country economically but can produce high and uncompensated harms to many, and national wealth, which produces economic benefits for many or all and harms hardly anyone but at the same time increases inequality. When Pistor also calls for generally abolishing civil recodifications of capital by lawyers and courts that go beyond basic modules, she overshoots the mark.

Am 9. April 2020 einigten sich die Finanzminister der Eurozone auf Kreditlinien beim Europäischen Stabilisierungsmechanismus (ESM), um der Corona-Krise entgegenzutreten. Die ESM-Kredite werden mit 200 Mrd. Euro beziffert. Dieser Wert ist jedoch irreführend, denn nur wenige Staaten hätten überhaupt Vorteile gegenüber einer zehnjährigen Staatsanleihe im eigenen Land. Zudem ist der Umfang der ESM-Kredite begrenzt.

Eine Form der Nutzung von Ressourcen stellt ihre Verwendung zur Sicherung von Krediten dar. Grundsatzlich kann ein Glaubiger wegen seiner falligen Forderungen auf das Vermogen des Schuldners im Wege der Zwangsvollstreckung zugreifen, um dadurch Befriedigung zu erlangen. Dem Zugriff der Glaubiger unterliegen nach geltendem Recht grundsatzlich alle materiellen Vermogenswerte des Schuldners, soweit nicht ausnahmsweise besondere Beschrankungen eingreifen. Diese Rechtsregel dient dazu, opportunistisches Verhalten des Kreditnehmers nach Aufnahme des Kredits unmoglich zu machen. Konnten Anspruche auf Bedienung von Krediten nicht durch Zugriff auf das Vermogen des Schuldners effektiv durchgesetzt werden, so wurden Kredite nur noch in folgenden Fallen gegeben werden

Wie bereits im Zusammenhang mit dem Coase-Theorem dargestellt, bezieht sich das okonomische Konzept der Property Rights auf die Zuordnung von Kompetenzen bei der Nutzung von Ressourcen. Im Besonderen werden durch Property Rights geregelt

„Vertrauen ist gut, Kontrolle ist besser“. Dieser Ausspruch Lenins wird gerne kolportiert. Aus Erfahrung wissen wir, dass diese Forderung als allgemeine Lebensregel untauglich ist. Immer wieder gibt es Situationen, in denen wir anderen vertrauen sollten und konnen, wahrend es in anderen Fallen wichtig ist, alles selbst zu uberprufen. Dass die zitierte Maxime ihre Probleme aufweist, ist aus okonomischer Sicht selbstverstandlich. Denn Kontrolle fuhrt zum Aufwand von Informationskosten, wahrend Vertrauen die Einsparung derartiger Kosten zur Folge hat. Mit dieser Feststellung ist aber noch nicht die Frage beantwortet, wann es sinnvoll und notwendig ist, anderen zu vertrauen, wann dieses Vertrauen rechtlich geschutzt werden sollte, wann man sich die fur eine Entscheidung notwendigen Informationen selbst beschaffen sollte und wann anderen ein materieller Anreiz verschafft werden sollte, sie aufzuwenden. Die Rechtswissenschaft hat sich mit Fragen des Vertrauens und Vertrauensschutzes intensiv befasst. Dabei hat sie allerdings den engen Zusammenhang zwischen dem Gesamtproblem der Informationsbeschaffung und -ubertragung und der Frage des Vertrauensschutzes nicht hinreichend analysiert. Die traditionelle Mikrookonomie hat sich dagegen mit Problemen der Informationsbeschaffung oder mit funktionalen Aquivalenten wie Vertrauen lange Zeit fast uberhaupt nicht beschaftigt. Sie hat einfach angenommen, dass Haushalte und Unternehmungen die lnformationsbeschaffungs- und Verarbeitungskapazitat eines grosen Laboratoriums besitzen. Erst in den letzten Jahrzehnten, beginnend mit George S. Stiglers l wegweisendem Artikel uber „The Economics of Information“ hat sich die Lage geandert, und es entstand geradezu ein neuer Zweig der Wirtschaftswissenschaft, die Informationsokonomie. Sie versucht, Verhaltensweisen wie Vertrauen, Kooperation und reziproken Altruismus in die okonomische Theorie einzubeziehen, ohne dabei die REM-Hypothese aufzugeben. In dieser Sichtweise ist Vertrauen die Fortsetzung rational egoistischen Verhaltens mit anderen Mitteln. Im Folgenden werden daher einige dieser Entwicklungen dargestellt, sofern sie zur Analyse rechtlicher Probleme nutzbar sind.

Der Schutzbereich des Deliktsrechts bzw. des Schadensersatzrechts i. w. S. (unter Einbeziehung der Gefahrdungshaftung) wird in erster Linie durch gesetzlich benannte Rechte und Rechtsguter bestimmt (s. § 823 Abs. 1BGB). Die haftungsrechtlich geschutzten Interessen werden durch absolute Rechte und durch enumerativ aufgefuhrte Rechtsguter identifiziert.
