15. False Impression: How a Widely Cited Study Vastly Overstates the Benefits of Charter Schools. Issue Brief

Abstract

This issue brief focuses on one particular report, released in September 2009, that has been widely cited by charter school advocates because it appears to show remarkable results. In the report, "How New York City's Charter Schools Affect Achievement," Stanford University professor Caroline Hoxby and her colleagues Sonali Murarka and Jenny Kang probe the academic achievement of 30,000 New York City students who had applied to charter schools and had been randomly separated by lotteries into charter schools (the "lotteried-in" students) and traditional schools (the "lotteried-out" students). Hoxby and her colleagues made the headline-grabbing assertion that, on average, for students that attended from kindergarten through grade eight, New York City charter schools could close the "Scarsdale-Harlem gap"--that is, the achievement gap between students in Harlem and students in the much more affluent suburb of Scarsdale--by 66 percent in English and 86 percent in math. This is a shocking finding that, if true, would suggest that charters could be a magic bullet after all. But Hoxby's colleague at Stanford, Sean Reardon, the education researcher and expert in social sciences methodology, scrutinized Hoxby's report and uncovered serious design flaws in the study. Reardon's analysis largely undercuts the claims of dramatic gains that have attracted so much media attention. Reardon found that the design of Hoxby's study destroyed the way in which the lottery randomly separated students into charter schools and traditional schools. A second problem Reardon finds with the design of the Hoxby study for grades four through eight is its implicit assumption that a charter school student will continue to make the same amount of academic gain each year throughout the student's educational career. These two concerns would not be problematic if the study was a truly longitudinal one, following the performance of a single cohort of students from an initial lottery before kindergarten through eighth grade. However, the data for the majority of subjects in the study were for students who had been in charter schools for only three or four years. Reardon's review of Hoxby and colleagues' study highlights further points of concern. These further concerns are also presented in this brief. (Contains 12 endnotes.

Abstract

With textualism's ascendancy, courts increasingly invoke the canon to assume "ordinary meaning" unless the context indicates otherwise and the rule to enforce "plain meaning" regardless of extratextual considerations. Yet the relationship between ordinary meaning and plain meaning can become confused in practice. Courts use the terms interchangeably, and they conflate them doctrinally. Ordinary meaning and plain meaning are distinct. Ordinary meaning is what the text would convey to a reasonable English user in the context of everyday communication. Plain meaning refers to a judgment that whatever the text conveys in context is clear from the text. Thus, a term's ordinary meaning is also its plain meaning only when it is clear from how the term is used in the statute that its context is ordinary, as opposed to technical. Courts conflate the two, however, when they assume ordinary meaning under the ordinary meaning canon and then conclude that they are therefore bound to enforce that meaning under the plain meaning rule. As a result, they end interpretation prematurely, excluding extratextual aids that might well show that the ordinary meaning assumption should give way. This Article is the first to investigate the relationship between ordinary meaning and plain meaning. It clarifies their differences, identifies the ways in which they are conflated, and evaluates when they should converge. For textualists, greater clarity on this score illuminates when and how to bring ordinary meaning and plain meaning together in a principled manner. For methodological pluralists, understanding the gap between ordinary meaning and plain meaning opens opportunities to argue beyond the text in our increasingly textualist world. 34. Atrial Flutter After Radiofrequency Ablation for Barrett's Esophagus: A Case Report.

Abstract

Objective: Rare coexistence of disease or pathology Background: Barrett's esophagus (BE) is a metaplastic change in the normal esophageal squamous epithelium and is a wellrecognized precursor of esophageal adenocarcinoma (EAC). Nowadays, focal radiofrequency ablation is a valid technique for BE treatment by inducing a superficial and focal thermic destruction of metaplastic tissues. According to the literature, the most frequent patient-related adverse events of this procedure are esophageal iatrogenic stenosis, mucosal laceration or perforation of the esophagus, chest pain, and odynophagia/dysphagia. Postoperative heart rhythm abnormalities have been reported very rarely. Case Report: A 74-year-old patient with HE was treated by radiofrequency ablation (RFA) with the Barrx™ catheter system. He had 2 symptomatic episodes of atrial flutter in the immediate postoperative period requiring an external electrical cardioversion to induce a return to sinus cardiac rhythm. After atrial flutter ablation, 2 more radiofrequency procedures were performed, without adverse events. A laparoscopic Nissen fundoplication was carried out with complete endoscopic and histologic eradication of BE after 12-month follow-up. To the best of our knowledge, this is the first reported case of atrial flutter after esophageal RFA. Different mechanisms acting on an anatomic predisposing substrate can potentially play a role in starting atrial flutter, and include in- flammation, autonomic activation, and myocardial injury. Conclusions: The occurrence of this new type of adverse effect could potentially modify indications and postoperative monitoring of RFA treatment for BE. Endoscopists should know the possibility of this procedural complication in high-risk patients and they should propose alternative techniques or implement close cardiac monitoring in the postoperative period. Questo saggio presenta le riflessioni di un docente e di uno studente sulla preparazione, l'approccio didattico e il valore delle Olimpiadi Internazionali di Filosofia (IPO) come evento culturale ed esperienza personale. Attraverso il duplice punto di vista - dell'insegnante e del discente - si evidenzia con acutezza come l'esperienza delle IPO sia un'occasione di crescita per gli studenti, proprio per il loro riferirsi a conoscenze non immediatamente economizzabili e spendibili nel mondo del lavoro; e d'altra parte, la preparazione necessaria per imparare a comporre in modo appropriato il saggio per la competizione, obbliga i docenti italiani a operare una sintesi nell'insegnamento della filosofia tra l'approccio "storico-narrativo" e quello "tematico". This essay presents the reflections of a teacher and a student on the preparation, teaching approach and the value of the International Philosophy Olympiad (IPO) as a cultural event and personal experience. 48. Decarbonization and Improved Energy Efficiency Using a Novel Nanocomposite Surface Treatment

Abstract

Fouling of heat exchanger equipment through the formation and attachment of hard scale, microbially induced corrosion (MIC) products, or particulate erosion is a serious challenge to reliable production in the oil and gas industry. Exchangers which become fouled in this way perform 15-30% worse than their rated ability, requiring either constant intervention to clean away biofilms, continuous injection of biocides and corrosion inhibitors, or the regular plugging of tubes to prevent leaks, representing a significant operating expense and billions of dollars in lost production time. When an exchanger is unable to provide sufficient heat due to tube fouling, additional sources of heating must be utilized to make up for this deficit and to ensure that facility processes remain within design allowances. This need for supplemental heating is a significant source of carbon emissions in the industry and represents a significant obstacle towards decarbonization efforts. However, it also represents an economically attractive way to simultaneously lower emissions while also lowering a producer's cost per barrel. This work describes an alternate strategy to control and prevent fouling in heat exchangers, through the one-time application of an omniphobic (water- and oil-repelling) nano-surface treatment. Once applied to a heat exchanger, the extremely smooth and low-surface energy material greatly reduces the ability of MIC-causing bacteria to deposit and adhere to the surface. Because it imparts functionality to the surface itself, rather than simply function as a physical barrier, it enables long lasting protection which was validated under laboratory conditions in a pressurized autoclave, as well as two pilot demonstrations. Results from both the laboratory and field evaluations of the treatment's promise showed that treated surfaces showed a corrosion rate over 36-times lower when compared to untreated surfaces, while also completely arresting the formation of corrosion pitting, tube fouling, and erosion of the tube interior. These field-validated results were then applied to the observed heating deficit of a proposed deployment site, resulting in calculated carbon emissions savings of up to 17,000 Tons CO2 per year.

Abstract

Scientists have warned decision-makers about the severe consequences of the global environmental crisis since the 1970s. Yet ecological degradation continues and little has been done to address climate change. We investigated early-career conservation researchers' (ECR) perspectives on, and prioritization of, actions furthering sustainability. We conducted a survey (n = 67) and an interactive workshop (n = 35) for ECR attendees of the 5th European Congress of Conservation Biology (2018). Building on these data and discussions, we identified ongoing and forthcoming advances in conservation science. These include increased transdisciplinarity, science communication, advocacy in conservation, and adoption of a transformation-oriented social–ecological systems approach to research. The respondents and participants had diverse perspectives on how to achieve sustainability. Reformist actions were emphasized as paving the way for more radical changes in the economic system and societal values linked to the environment and inequality. Our findings suggest that achieving sustainability requires a strategy that (1) incorporates the multiplicity of people's views, (2) places a greater value on nature, and (3) encourages systemic transformation across political, social, educational, and economic realms on multiple levels. We introduce a framework for ECRs to inspire their research and practice within conservation science to achieve real change in protecting biological diversity.
