14. Managing the Legal Proceedings: An Interpretative Phenomenological Analysis of Sexually Abused Children's Experience with the Legal Process

Objective: The aim of this study was to describe how sexually abused children experience the legal process, a process that includes being questioned by the police during the preliminary investigation and by lawyers and the prosecutor in the courtroom, and meeting other professionals from various agencies. Method: Face-to-face in-depth interviews were conducted with 10 children--9 girls and 1 boy between 9 and 15 years old--who had experienced child sexual abuse (CSA). The interviews were semi structured and carried out and analyzed by interpretative phenomenological analysis (IPA). The aim of IPA is to explore the participants' views of the world and to adopt as far as possible an "insider perspective." IPA draws on a tradition of phenomenology and symbolic interactionism in attempting to understand how people make sense of their experiences. Results: Five major themes emerged through the analysis: not being believed, making CSA visible, need for support, sanctions for offenders, and lack of respect for the child's integrity. Almost all the children had a feeling of not being believed. They described feelings ranging from anxiety to dread and even terror when they had to describe the CSA they had experienced. Even though the importance of support for such children is already well understood, the children stated that the support they were given was not sufficient. The children said that they wanted support from a single professional who was well informed about both the legal process and CSA. When the children were asked to reflect on sanctions against the abusers, they said that it was important that the perpetrator got treatment/therapy but they also said that imprisonment was desirable. Financial compensation was not as important to them; the damage had been done and money could not compensate for that damage. The children also said that both the lawyers and the media had treated them with disrespect. Conclusions: It is valuable for children who have been exposed to CSA to learn that they can take part in the legal process as equal partners with the other participants, and it is evident that the quality of psychological care and support needs to be improved. The children want to be participants in the legal process rather than passive objects of that process. (Contains 1 table.)

In 2001 the Ohio Department of Natural Resources (ODNR) initiated a long-term, herbicide-spraying control program of Phragmites australis (common reed), a highly invasive perennial grass, in Sheldon Marsh on Lake Erie's south shoreline. Controlling reed is a priority of many wetland managers because habitat homogenization from reed expansion may adversely affect wildlife habitat and waterfowl. Reed has historically been a minor part of wetland plant communities of the Laurentian Great Lakes bur has spread rapidly since 2000 when lake water levels dropped. Here we examined ODNR records and aerial photographs using ArcGIS software and planimetry from 2000 to 2007 to (1) track annual changes in reed localities and a real coverage, (2) compare short-term effectiveness of glyphosate (Glypro® and AquaNeat®) and imazapyr (Habitat®) herbicides, and (3) estimate control costs. Reed first appeared in a small, isolated patch in 1998 bur expanded to comprise approximately 18 percent of the marsh's emergent vegetation by 2001. Annual change in a real cover was not related to minor changes in already low Lake Erie water levels. However, reed amount decreased from 6.7 ha (= 14.8 percent of emergent vegetation) in 2004 to 2.5 ha in 2007 after a two- to three-fold annual increase in amount of herbicide used. Short-term, post-sprayingnecrosis (browning) was slower for Phragmites treated with a five percent Habitat® solution than with a 30 percent AquaNea® solution. Slowed necrosis presumably prolongs photosynthesis and plant nutrient uptake and delays habitat deterioration for some wildlife, bur provides rime for vegetative spread. Seven years of herbiciding have contained reed to approximately six percent of the emergent plant cover. Estimated control expenditures from 2003 to 2007 were $8475 USD (average approximately $1700/year); a small cost to maintain system ecological diversity. The net-shaping capability in spark plasma sintering (SPS) of ultrahigh-temperature ceramics has been explored in this study. The annular or ring-like shape is considered here as the first step to a more complex geometry compared to a solid cylinder or disk. ZrC powders have been SPS processed in specially designed graphite tooling to achieve the annular shape geometry. Experimental runs have been carried out to determine the optimal processing parameters for producing highly dense ZrC specimens in this geometry. Finite-element modeling framework has been constructed to determine the internal stress evolution, as well as densification, during the SPS of the annular-shaped ZrC. The formulated processing schemes for ZrC have been adapted to process SiC/ZrB
2 composite powder with the purpose of making tooling components for SPS applications. The applicability of the obtained composite SPS tooling has been evaluated at high temperature and high pressure associated with SPS regimes. [ABSTRACT FROM AUTHOR]- Published

Surface‐oxidized molybdenum nanopowders are compacted by spark plasma sintering (SPS). The oxide impurity behavior is analyzed under various sintering temperatures. The densification mechanism of the nanopowders with a melted oxide phase is identified in situ by regression analysis of the experimental data on the temperature‐dependent porosity change and on the SPS multistep pressure dilatometry. To increase the density of the compacted pellets, the nanopowders with the oxide phase are consolidated by SPS using the two in situ oxide removal methods: carbothermic reduction and particle surface cleaning by the electric current flow through the powders. The advantages and disadvantages of these methods in terms of the density, grain size, and mechanical properties of the final products are discussed. [ABSTRACT FROM AUTHOR]

The overall purpose of this thesis was to study the situation of such children in the legal process. In depth-interviews were carried out on ten children aged 8-18 years old. The interviews focused on the children´s experiences and perceptions of meeting with various professionals in the legal process. In-depth interviews were also conducted with nine parents of children who had been sexually abused and who had entered into a legal process. Parents described how they experienced the situation for their children as victims, but also their experiences as parents whose children participated in a legal process. Seven prosecutors with experience of cases where children were plaintiffs were also interviewed in this study. The interviews were analysed using Interpretative Phenomenological Analysis (IPA). This is an appropriate method to explore the participants´ life-world/personal-world and the individuals´ personal perceptions of objects or events, as opposed to an attempt to produce an objective account. In the first study (study I) on the children, five major themes emerged through the analysis: not being believed, making child sexual abuse visible, need for support, sanctions for offenders and lack of respect for the child´s integrity. Almost all of the children had a feeling of not being believed. In the study (study II) on the parents, three superordinate themes emerged from an analysis of the data: stigmatization, need for support in the parental role and transforming consequences to reality. Three themes emerged from prosecutors study (study III) difficulties with the evidence of crime, children´s special needs and children´s dependence on adults. The informants´ descriptions of how they perceived the children in the legal process were associated with their experience of the difficulty of finding proof of the crime. The aim of study IV was to identify and describe the obstacles that can prevent children from talking about sexual abuse in a police interview. Data consisted of 28 investigative interviews with children and 12 police interrogations with non-offending parents. Data interpretation and analysis were based on content analysis. The following categories were identified: not being believed/telling the truth, need for support and dependence on adults, guilt and shame, fear and difficulty in spatial and temporal characterization. The main conclusion of the thesis is that there are difficulties in confirming evidence when children who have suffered sexual abuse are involved in a legal process. It is also concluded that there is an absence of models with the aim to support children and parents going through the process.

- Abstract
The aim of this study is to demonstrate how parents of children who are victims of sexual assault experience the legal process from the children’s and parents’ perspective. Nine parents, identified in the records of three public prosecution offices in three cities in Sweden, were interviewed. The parents described feelings of shame and guilt over what their children had experienced. They felt stigmatized and had difficulty fulfilling their parental role, perceived a lack of information and support from the professionals involved, and experienced a sense of withdrawal from their role as parents, though they felt the professionals who worked with their children were helpful and influential.

Spark plasma sintering (SPS) has been employed to consolidate a micron-sized zirconium carbide (ZrC) powder. ZrC pellets with a variety of relative densities are obtained under different processing parameters. The densification kinetics of ZrC powders subjected to conventional hot pressing and SPS are comparatively studied by applying similar heating and loading profiles. Due to the lack of electric current assistance, the conventional hot pressing appears to impose lower strain rate sensitivity and higher activation energy values than those which correspond to the SPS processing. A finite element simulation is used to analyze the temperature evolution within the volume of ZrC specimens subjected to SPS. The control mechanism for grain growth during the final SPS stage is studied via a recently modified model, in which the grain growth rate dependence on porosity is incorporated. The constant pressure specific heat and thermal conductivity of the SPS-processed ZrC are determined to be higher than those reported for the hot-pressed ZrC and the benefits of applying SPS are indicated accordingly. Commercial zirconium carbide (ZrC) powder is consolidated by Spark Plasma Sintering (SPS). Processing temperatures range from 1650 to 2100 °C. Specimens with various density levels are obtained when performing single-die SPS at different temperatures. Besides the single-die tooling setup, a double-die tooling setup is employed to largely increase the actual applied pressure to achieve higher densification in a shorter processing time. In order to describe the densification mechanism of ZrC powder under SPS conditions, a power-law creep constitutive equation is utilized, whose coefficients are determined by the inverse regression of the obtained experimental data. The densification of the selected ZrC powder is shown to be likely associated with grain boundary sliding and dislocation glide controlled creep. Transverse rupture strength and microhardness of sintered specimens are measured to be up to 380 MPa and 24 GPa, respectively. Mechanical properties are correlated with specimens' average grain size and relative density to elucidate the co-factor dependencies. [ABSTRACT FROM AUTHOR]

- Abstract
Robust Nuclear-Weapons-Effects Testing (NWET) capability will be needed for the foreseeable future to ensure the performance and reliability, in nuclear environments, of the evolving U.S. stockpile of weapons and other assets. Ongoing research on the use of high-energy lasers to generate environments of utility in nuclear weapon radiation effects simulations is addressed in the work described in this report. Laser-driven hohlraums and a variety of other targets have been considered in an effort to develop NWET capability of the highest possible fidelity in above-ground experiments. The envelope of large-system test needs is shown as the gray region in fig. I. It does not represent the spectrum of any device; it is just the envelope of the spectral region of outputs from a number of possible devices. It is a goal of our laser-only and ignition-capsule source development work to generate x rays that fall somewhere in this envelope., Annual rept.
