On 27 July 2024, the International Tribunal for the Law of the Sea declined Luxembourg’s request for provisional measures in the
‘Zheng He’ case. Following two orders of the International Court of Justice, this marked the third consecutive decision in which provisional measures were denied. The question asked in this Note is whether this signals the end of a low threshold for granting provisional measures. Two points of view are possible: either the undertakings given by the respondents are being taken more seriously, or international courts have grown at least somewhat frustrated with the frequent requests for provisional measures. Depuis l’introduction de l’assurance obligatoire des soins en 1996, les controverses sur l’organisation et le financement de l’assurance-maladie, les coûts croissants du système de santé ou encore les relations tendues entre assureurs et professions médicales, constituent autant de points d’achoppement majeurs de la politique suisse. Malgré cette actualité brûlante, l’histoire du système de santé demeure largement méconnue. En s’appuyant sur des archives jusqu’alors inexploitées, ce livre éclaire pour la première fois l’histoire de longue durée des caisses-maladie, qui forment le socle institutionnel du système de financement des soins. Il révèle la façon dont les myriades de sociétés de secours mutuels du XIXe siècle, à fort ancrage local et s’adressant en premier lieu aux hommes de la classe ouvrière, se sont transformées au cours du XXe siècle en caisses-maladie opérant sur l’ensemble du territoire national. La diffusion de l’assurance-maladie auprès de couches toujours plus larges de la population a modifié la gouvernance et le fonctionnement des sociétés mutuelles, qui ont progressivement adopté les technologies commerciales issues du monde de l’assurance-vie. Cet effacement des anciens idéaux mutualistes et leur remplacement par des mécanismes de marché se sont accompagné d’une concentration sectorielle croissante et ont conduit à l’émergence, après la Seconde Guerre mondiale, de l’assurance-maladie en tant que produit de consommation de masse.

The problem of mitigating uncertainty in self-adaptation has driven much of the research proposed in the area of software engineering for self-adaptive systems in the last decade. Although many solutions have already been proposed, most of them tend to tackle specific types, sources, and dimensions of uncertainty (e.g., in goals, resources, adaptation functions) in isolation. A special concern are the aspects associated with uncertainty modeling in an integrated fashion. Different uncertainties are rarely independent and often compound, affecting the satisfaction of goals and other system properties in subtle and often unpredictable ways. Hence, there is still limited understanding about the specific ways in which uncertainties from various sources interact and ultimately affect the properties of self-adaptive, software-intensive systems. In this SoSym expert voice, we introduce the Uncertainty Interaction Problem as a way to better qualify the scope of the challenges with respect to representing different types of uncertainty while capturing their interaction in models employed to reason about self-adaptation. We contribute a characterization of the problem and discuss its relevance in the context of case studies taken from two representative application domains. We posit that the Uncertainty Interaction Problem should drive future research in software engineering for autonomous and self-adaptive systems, and therefore, contribute to evolving uncertainty modeling towards holistic approaches that would enable the construction of more resilient self-adaptive systems. The article is devoted to the study of the existing positions in the Russian doctrine regarding the institution of precontractual liability. The ambiguous position of the legislator, the controversial explanations of the judges of the Supreme Court of the Russian Federation do not reduce the relevance of the problem of the unified nature of pre-contractual liability. In this article, the author points out the shortcomings of the legal regulation of determining the time and grounds for applying pre-contractual liability measures, as well as issues of determining a specific mechanism for protecting bona fide negotiators, in particular in the field of identifying the rules for calculating losses incurred.

La dernière évolution législative en droit des assurances n'a pas constitué un changement majeur, en ce qu'elle a pour l'essentiel repris les dispositions de la loi du 25 juin 1992. Désormais, les dispositions relatives à la prescription sont les articles 88 et 89 de la loi du 4 avril 2014. Ces dispositions soulèvent toutefois de nombreuses questions pratiques, lesquelles sont en partie tranchées par les différentes juridictions du pays, et notamment la Cour de cassation qui multiplie les arrêts en cette matière. Il apparaissait dès lors opportun de procéder à l'analyse des arrêts les plus récents.

10. Automatisation du pré-traitement des données par l'optimisation métaheuristique

Depuis quelques années, plusieurs entreprises ont commencé à exploiter les données qu’ils ont emmagasinées pour pouvoir extraire des connaissances et faire des prévisions. Une bonne utilisation de ces données permet aux entreprises de comprendre leurs clients et pouvoir améliorer leurs services. Les techniques d’intelligence artificielle se présentent comme des moyens pour révolutionner les prises de décisions. Plus d’entreprises embauchent des data scientists pour concevoir des modèles de prédiction. Le but des data scientists est de concevoir des modèles et de les performer. L’un des défis majeurs rencontré par ces data scientists est le prétraitement des données. Le prétraitement des données impact la qualité du modèle mis en place. Ce problème est dû au fait qu’il n’existe pas une seule bonne manière de prétraité les données. Les techniques utilisées dépendent du problème et du type de donnée. Ce mémoire a pour objectif d’évaluer la possibilité de développer une solution qui permet d’automatiser les opérations de prétraitement des données pour les acteurs de données (data scientistes, chercheurs, etc.). Nous utiliserons le terme pipeline afin de nommer la chaîne de pré-traitement et de traitement des données (de la donnée brute jusqu’à la classification de la donnée). En effet, nous proposons un pipeline qui permet de choisir les meilleures techniques de prétraitements en fonction du problème. Plusieurs techniques sont répertoriées et nous utilisons des techniques d’optimisation métaheuristique pour minimiser le temps de recherche du meilleur modèle. Ces techniques sont par la suite comparées avec des techniques d’optimisation standard comme la recherche par grille. Le pipeline est par la suite testé sur des données d’une entreprise d’assurance automobile du Canada. Les résultats nous montrent que les méthodes d’optimisation métaheuristique sont plus efficaces sur des big data. Elles ont permis de diminuer d’environ 30% le temps nécessaire pour retrouver un bon

Twenty years ago, the International Social Security Review published an article that introduced a new term to the vocabulary of development and social protection: Microinsurance. Now, twenty years later, it is suitable to take stock of the contribution of microinsurance towards promoting coverage and social security. The article reviews the main insights gained from 20 years of implementation, including a clear expression of the value proposition of health microinsurance, understanding the demand for microinsurance, the business process for successful implementation, and conditions that must be satisfied for scaling and sustainable operations. It also explains the context that led to a considerable divergence in the microinsurance space. The article offers a discussion of unresolved issues and thoughts about the future of microinsurance. The conclusion of this article is that microinsurance can flourish when the necessary four pillars for its implementation exist, namely mainstreaming through political support, enhanced insurance literacy of the customers, technical assistance to self‐administer the schemes, and availability of seed capital. The sufficient additional condition is that customers perceive microinsurance as offering welfare gains that cannot be obtained by other means. [ABSTRACT FROM AUTHOR]

L’objectif de cet article est de comparer la gestion que les entreprises d’assurances et de réassurance des zones Maghreb et CIMA font de leurs portefeuilles d’actifs financiers afin d’en tirer des conclusions voire des recommandations pour la zone la moins performante notamment. Pour y parvenir, nous avons élaboré un travail en trois temps: la collecte des données, le tri et la consolidation des données puis l’analyse des résultats. Nos résultats ont montré que les assureurs de la zone Maghreb font une gestion beaucoup plus offensive de leurs portefeuilles que ceux de la zone CIMA. Ainsi, dans le Maghreb les investissements sont principalement dans des actifs obligataires et dans les actions alors que dans la zone CIMA, les OPCVM et le monétaire prédominent. Par conséquent, la gestion de portefeuille dans la zone Maghreb donne de meilleurs rendements par rapport à celle faite dans la zone CIMA. Partant de ces résultats, nous pouvons conclure d’une part qu’une digitalisation de l’activité d’assurances par les acteurs de la zone CIMA pourraient leur permettre d’améliorer leur taux de pénétration et d’autre part ces assureurs devraient revoir leur politique de placement afin d’oser beaucoup plus en investissant dans les classes d’actifs de type actions.

Dans son arrêt du 20 septembre 2021, la Cour de cassation s’est penchée sur les conditions de la cessation de la période d’interruption, prévue à l’article 89, § 5, de la loi du 4 avril 2014 relative aux assurances (L.A.. Pour rappel, en vertu de l’article 150 de la L.A., toute personne lésée dispose d’une action directe contre l’assureur qui couvre la responsabilité civile de l’auteur de son dommage. Cette action directe de la personne lésée est soumise à un délai de prescription quinquennal, sous réserve de dispositions légales particulières. En vertu de l’article 89, § 5, de la L.A., la prescription de l’action directe est interrompue à l’égard de la personne lésée dès que l’assureur est informé de sa volonté d’obtenir l’indemnisation de son préjudice. L’article 89, § 5, de la L.A. dispose que la période d’interruption cesse au moment où l’assureur fait connaître par écrit, à la personne lésée, sa décision d’indemnisation ou son refus.

La transition agroécologique correspond à un changement profond des méthodes culturales pouvant accroître les aléas climatiques qui pèsent déjà sur les exploitants agricoles. Les risques, en particulier associés à la suppression de l’usage des produits phytosanitaires de synthèse, sont généralement perçus comme une entrave majeure à l’adoption de cette trajectoire prônée par les pouvoirs publics. Les agriculteurs craignent, en se passant des pesticides, de voir leurs rendements chuter, leurs charges augmenter et subséquemment leurs revenus affectés. A cet égard, et nonobstant les aides publiques à la transition déjà existantes, il est pertinent de s’interroger sur la possible gestion du risque phytosanitaire dans un contexte de changement de modèle productif. Existe-il, en l’état actuel du droit, des instruments permettant d’atténuer ou de couvrir ce genre de risque ? Et si tel n’est pas le cas, cette perspective est-elle prometteuse pour la recherche compte tenu de notre système de gestion des risques en agriculture ? Pour conduire cette étude, nous avons d’abord voulu revenir sur les outils permettant de gérer en général les risques propres au secteur agricole (Partie 1). Quels types d’instruments sont mis en place par le législateur en fonction des caractéristiques des risques considérés ? Ce droit commun à tous les risques agricoles constitue le cadre dans lequel envisager le traitement des risques particuliers liés aux dégâts causés par les bioagresseurs. De là nous analyserons l’évolution possible des dispositifs de prévention et couverture des risques pour faire face à une plus grande variabilité des récoltes produites plus naturellement (Partie 2). Il s’agira de se demander si notre droit est apte à construire les mécanismes de cette prise en charge et s’il peut corriger les éventuelles conséquences que ces outils auraient sur les comportements des agriculteurs.

El conflicto armado interno en Colombia a pesar de los años hoy en día es un tema que sigue cobrando importancia, pues el querer buscar una paz estable y duradera, llegar a un acuerdo para intentar lograrla y ver como disidencias de las FARC-EP se rearman después de su firma, es bastante polémico. Por lo que resulta interesante conocer el trasfondo de este acuerdo, y más específicamente de aquellos temas que se concertaron en relación a los niños, niñas y adolescentes que pertenecieron a este grupo a causa de su reclutamiento forzado, y que para el momento de la firma del acuerdo ya habían cumplido su mayoría de edad. Hecho que conlleva a cuestionarse, si estos adultos deben ser vistos como víctimas o victimarios del conflicto que desde niños los involucra y que ahora siendo mayores a una sociedad que no conocen los regresó. The internal armed conflict in Colombia despite the years today is an issue that continues to gain importance, since the desire to seek a stable and lasting peace, reach an agreement to try to achieve it and see how FARC-EP dissidents rearm after His signature is quite controversial. During litigation on the international plane, states sometimes will issue assurances either to the other litigant or to the international court directly. This article explores how those assurances interact with applications for provisional measures. The practice of courts varies with regard to how to react to these assurances, though the usual approach is that assurances issued to another state or individual are generally non-binding, while assurances issued to the court directly are binding. At the same time, litigants can apply to the court for provisional measures to prevent actions that would disturb the dispute. When the assurances are considered non-binding, they are treated as questions of fact and can be assessed for credibility and reliability, as a part of the provisional measures analysis. But when the assurances are considered binding, they are treated as questions of law, and the undertaken legal obligation disposes of the request for a provisional measures order. This article will examine the practices of the International Court of Justice and the European Court of Human Rights on this issue, identifying where their practices diverge and converge, and recommending that the dual nature of assurances, as both factual and legal, be considered in assessing their value. 26. The Ironic Impact of Privacy Policies on Perceived Security and Purchase Intent.

Consumers regularly encounter privacy policies explaining if and how their personal information will be collected, stored, used, and shared. Consumer advocacy groups and regulators who argue for the provision of such assurances typically assume that consumers prefer transparency in data practices. Indeed, past research supports the notion that most consumers favor restrictions on the gathering and use of personal information (Nowak and Phelps 1992) and that when such protections are not communicated via a strong privacy assurance, consumers may respond defensively (Lwin, Wirtz, and Williams 2007). In fact, a recent study reports that 9 in 10 Americans avoid companies they do not believe protect their privacy (National CyberSecurity Alliance, 2016). In an effort to comply with these demands and build consumer trust, organizations regularly provide assurances to consumers about data management practices in the form of privacy policies. In this paper, we document an ironic effect of privacy policies on consumer behavior: although privacy policies are often intended to assure consumers that a firm's use of their personal data will be legitimate, they can instead raise the salience of privacy concerns and paradoxically decrease rather than increase perceived security. Specifically, we propose that due to these decreased perceptions of security, consumers often react to these assurances as if they were warnings, leading to lower purchase intent in the presence (vs. absence) of a privacy policy. In a series of experiments, we examine how the presence (vs. absence) of a privacy policy affects consumers' perceptions of the security of their personal data and their interest in purchasing a product. Study 1 aimed to show that despite the opposite outcomes they are designed to produce, both assurances and warnings can decrease consumer interest in a product. We predicted that instead of promoting a sense of confidence that personal data will not be misused, a privacy policy would ironically decrease perceived security and purchase intent (relative to a condition in which no privacy policy is provided). Data for this study were collected from participants recruited on Amazon Mechanical Turk (AMT) who were randomly assigned to one of six conditions in a 2 (Privacy Policy: Absent vs. Present) × 3 (Prime: Warning, Neutral, No Prime) between-participants design. As a test of the effect of a warning on perceived security and purchase intent, participants in the Warning Prime condition read an article warning them of the potential abuses of geolocation data. As a control condition, participants in the Neutral Prime condition read an article discussing innovative technology in cars. As an alternate version of the control condition, participants in the No Prime condition did not read an article. Following the prime manipulation, all participants were asked to imagine that they were considering a new technology system for their car and shown a description of a new product (called ViewTech), followed by detailed descriptions of various product features. As a test of the effect of a privacy policy on perceived security and purchase intent, participants in the "Privacy Policy Present" condition viewed a privacy policy immediately before the feature descriptions, whereas participants in the "Privacy Policy Absent" condition did not view a privacy policy at all. The privacy policy was designed to make explicit information that was already more subtly conveyed through the description of product features. For example, the privacy policy stated that the exact location of car and mobile devices will be collected and stored. This information may be reasonably and easily inferred from the product features, which include the ability to pinpoint your car's exact location and retrace routes, to stream real-time route data to any mobile device for a live-updating map, and to receive directions to your parked car on your mobile device. Next, purchase intent was measured by asking participants to indicate their level of interest in purchasing the product using a sliding scale (0=Not at all interested; 100=Very Interested). Perceived security was measured by asking participants how comfortable they would be with their data being collected and stored by ViewTech; participants indicated their response using a sliding scale (0=Not at all comfortable; 100=Extremely comfortable). Not surprisingly, the results indicated that participants felt less secure in the warning prime condition relative to both the neutral and no prime conditions. More central to our theorizing, the privacy policy seemed to have a similar effect on perceived security as the warning prime. Specifically, there was a main effect of the privacy policy manipulation, such that those who saw a privacy policy felt less secure than participants who did not see a privacy policy. Average interest in purchasing the product showed an identical pattern in that there was a main effect of both the prime and the privacy policy and no interaction. Study 2 aimed to show that this effect influences downstream consequences, such that the presence versus absence of privacy policies can change consumers' personal willingness to pay for a product (without affecting their perception of the product's value in the marketplace). We also aimed to test whether the effect is robust to the timing of exposure to the assurance and to provide some more direct evidence of the process by analyzing the extent to which privacy concerns influenced consumers' decisions. Data for this study were collected from participants recruited on AMT who were randomly assigned to one of four conditions in a 2 (Privacy Policy Before Descriptions: Yes vs. No) in a 2 (Privacy Policy After Descriptions: Yes vs. No) between-participants design. As in study 1, all participants were asked to imagine that they were considering a new technology system for their car and shown a description of a new product, followed by detailed descriptions of various product features. The product description and feature descriptions were identical to those used in study 1, as was the privacy policy. Depending on their condition, participants viewed the privacy policy immediately before the feature descriptions, immediately after the feature descriptions, both before and after the feature descriptions, or not at all. Participants then indicated their purchase intent using the same scale as in study 1 and were asked to briefly explain the rationale for their answer. Next, participants estimated the retail price of the package (on a sliding scale from $1 to $10,000) and indicated their own willingness to pay in a text box. Perceived security was measured using the same scale as in study 1. Since no significant difference between the before vs. after conditions was observed on any of the dependent measures, they were collapsed into a single condition in the analysis. Consistent with our predictions, participants who did not see a privacy policy felt more secure than participants who saw a privacy policy. Average interest in purchasing the product showed an identical pattern and was higher among participants who did not see a privacy policy than among those who did. Moreover, participants who did not see a privacy policy were willing to pay more for the product than participants who saw a privacy policy. Perceived security mediated the effect of the privacy policy on consumers' interest in purchasing the product. Importantly, our manipulation did not affect expected retail prices; these did not differ regardless of whether the privacy policy was absent or present. Viewed in light of the significant difference on the other measures, this null result suggests that the presence or absence of a privacy policy selectively influences the extent to which an individual consumer personally desires a product, but not the consumer's perception of the objective value of the product in the marketplace. Study 3 aimed to provide further insight into the mechanism underlying this effect by showing that in joint evaluation, where privacy concerns are made salient by exposing all participants to a company with a privacy policy, the effect observed in earlier studies and in separate evaluation would be attenuated. Data for this study were collected from participants recruited on AMT who were randomly assigned to one of three conditions. In the first condition, participants were asked to imagine that they needed to buy some new clothes and had found some items they liked on the website of a retailer with whom they were previously unfamiliar. Participants were then asked to rate on two different sliding scales how interested they would be in making a purchase from this retailer and how comfortable they would be with the way their data are collected and stored by this retailer (0 = Not at all; 100 = Extremely). The second condition was identical except that in addition to the shopping scenario previously described, participants were told that before proceeding to check-out, they noticed a privacy policy, and they were shown the privacy policy on the following screen. Participants in the third condition were told to imagine that they had found items they liked on the websites of two online retailers that they were not previously familiar with, and that before proceeding to check-out, they had noticed a privacy policy on one site, but could not find a privacy policy on the other site. They were then shown the same privacy policy as participants in the separate evaluation condition. After viewing the privacy policy, participants completed the same set of dependent measures as in the separate evaluation conditions, except that they completed one set while thinking about the retailer with the privacy policy and the second set while thinking about the retailer without the privacy policy. Consistent with our predictions, the effect observed in our previous studies was replicated in separate evaluation, but attenuated in joint evaluation. Specifically, interest in purchasing from a retailer with a privacy policy was lower in separate evaluation than in joint evaluation. However, interest in purchasing from a retailer without a privacy policy was higher in separate evaluation than in joint evaluation. This boundary condition to the effect observed in earlier studies illustrates how organizations might present a privacy policy without losing consumer trust. From a theoretical standpoint, our research contributes to the literature on persuasion by highlighting parallels between the unintended ways in which consumers react to warnings and assurances and showing that although most consumers claim to want transparency in privacy practices, they may react negatively to it. By documenting how consumers respond to privacy assurances, we complement prior research that has focused on how consumers respond to warnings (Stewart and Martin 1994), including advertisement disclaimers (Barlow and Wogalter 1993; Herbst et al. 2011; Johar and Simmons 2000), disclosures of conflict of interest (Cain, Loewenstein, and Moore 2010), and product warning labels (Argo and Main 2004). Our findings have important implications for how companies' transparency in data practices can affect consumer trust. Specifically, they suggest that the observed preference to transact with organizations that lack privacy policies is not likely driven by an active aversion to assurances, but rather by a passive ignorance of potential risk when privacy concerns are not made salient. This interpretation is consistent with the notion that privacy concerns (and the lack thereof) are context-dependent (Acquisti, Brandimarte, and Loewenstein 2015; Acquisti, John, and Loewenstein 2013, John, Acquisti, and Loewenstein 2011) and often remain dormant until consumers are prompted to think about them (Marreiros et al. 2016). The rules on the disclosure obligations of insurance applicants are key in determining what information an insurer receives at the time an insurance contract is concluded, and thus the insurer's risk level. All European countries have therefore adopted rules on the disclosure obligations of applicants for insurance. Equivalent rules are found in the Principles of European Insurance Contract Law (PEICL). Provided that the related European political and legislative process reaches a successful conclusion, this optional instrument will offer contracting parties an alternative for the regulation of both national and cross-border insurance contracts. This article examines the PEICL's disclosure duty rules and compares them with the corresponding rules in current Scandinavian (Norwegian, Swedish and Danish) law. The purpose of the article is two-fold: to investigate the impact of the PEICL on Scandinavian insurance contracts and to comment on the PEICL from a Scandinavian perspective. [ABSTRACT FROM AUTHOR]

The provision of assurances for self-adaptive systems presents its challenges since uncertainties associated with its operating environment often hamper the provision of absolute guarantees that system properties can be satisfied. In this paper, we define an approach for the verification of self-adaptive systems that relies on stimulation and probabilistic model-checking to provide levels of confidence regarding service delivery. In particular, we focus on resilience properties that enable us to assess whether the system is able to maintain trustworthy service delivery in spite of changes in its environment. Different categories of services present different policy issues for financing health care. This conceptual paper suggests four categories: (1) public health services for the entire population; (2) basic health care to individuals, where anticipated costs are small and relatively homogeneous; (3) potentially catastrophically expensive services to individuals, where costs are skewed but not predictable; and (4) potentially catastrophically expensive services to individuals, where anticipated costs are both skewed and predictable. Using Canadian and Manitoba data to illustrate some implications of the distribution of health expenditures, we suggest policies suitable for one category of services may not necessarily work for others. The small proportion responsible for incurring high health expenditures are not attractive candidates for voluntary risk pools, particularly in competitive markets. [ABSTRACT FROM AUTHOR]

This study investigates the effects of acute stress on positive and negative relationship behaviors, specifically assurances and attention to alternatives. A sample of 129 college students were randomly assigned to either a high or low stress condition, then were led to believe they had the opportunity to interact with attractive potential relationship partners and list compliments about their current partner. Results indicated that those in the high stress condition gave their partner fewer assurances and paid more attention to alternatives. These results suggest that when individuals experience acute stress, they may engage in fewer positive relationship behaviors and more behaviors that are potentially harmful to their relationship. L’article examine l’émergence d’un marché de l’assurance santé complémentaire en France au cours des vingt dernières années. Nous y développons l’idée que, loin d’avoir suivi une trajectoire univoque, cette évolution résulte de la rencontre de plusieurs séries de réformes partiellement indépendantes : les directives européennes « assurances » et « Solvabilité » ; le développement des réseaux de soins, encouragé par les pouvoirs publics ; et plus récemment, l’obligation faite aux entreprises du secteur privé de fournir une couverture complémentaire à leurs salariés. Si chaque réforme concourt au renforcement d’un marché du risque santé, nous insistons sur le fait qu’elles répondent à des logiques et mobilisent des acteurs spécifiques. Dans ce contexte, l’article montre les tensions induites par cette pluralité de « mises en marché », qui s’accompagne d’une complexification de la régulation de l’assurance santé complémentaire dans le système français. The article examines the emergence of a complementary health insurance market in France over the past twenty years. We develop the idea that, far from having followed an unambiguous trajectory, this evolution results from the convergence of series of partially independent reforms : the European “insurance” and “Solvency II” directives ; the development of managed care, encouraged by the public authorities ; and more recently, the obligation for private sector companies to provide complementary coverage to their employees. While each reform contributes to the strengthening of market for complementary health insurance, we insist on the fact that they respond to different logics and mobilize specific actors. In this context, the article shows the tensions induced by this multiplicity of “marketization” processes, which results in a more complex regulation of complementary health insurance in the French system.

Unfavorable contractual agreements can be detrimental to the well-being of an organization. The objective of this paper is to examine the acquisition of enterprise software and the perceived importance of various key/critical contractual issues by IT managers within both the manufacturing and service industries. Often software contracts are written to favor the vendor and their terminology is vague and in a high-level language that can make organizations vulnerable. Among all IT applications, enterprise software is particularly critical due to integrating various critical business processes. In addition, ES implementations are among the most expensive types of IT implementations. Thus, enterprise software contracting mistakes can be particularly costly for organizations. Our results through exploratory analysis indicate that rights (right to assign and re-assign, or port the software license), contractual assurance, and responsibilities, indemnities and warranties are among the most important issues while purchasing enterprise software. L’assassinat de 132 captifs africains sur le Zong en novembre 1781 et la visibilité qu’acquit cet événement tandis que l’affaire était portée devant les tribunaux pour une question de dédommagement lié à l’assurance du navire devint une cause célèbre dans l’histoire de l'abolitionnisme au XVIIIe siècle, tant l’événement montrait avec force détails l’inhumanité de la traite négrière. On oublie souvent que les faits se produisirent en mer au sud-ouest de la Jamaïque pendant la Révolution américaine, époque où la Jamaïque était très mal en point. Cet article explore le contexte jamaïcain de cette sinistre affaire et fait le lien entre ce qui se passa à bord de ce navire tristement célèbre et l’évolution de la situation commerciale de la Jamaïque en temps de guerre, soulignant ainsi qu’il s'agit d'un événement aussi important pour l’histoire de la Jamaïque que pour celle de la Grande-Bretagne. The murder of 132 African captives on the Zong in November 1781 and its subsequent publicity as an insurance case which showed the inhumanity of the slave trade in graphic detail was a cause célèbre in the history of eighteenth-century abolitionism. What is often forgotten is that this event occurred in the seas south-west of Jamaica at a period when Jamaica was at its lowest ebb, during the American Revolution. This article looks at the Jamaican context of the atrocity and connects what happened on this infamous ship with changing commercial and wartime conditions in Jamaica, arguing that this is as much an event in Jamaican as in British history.

L’adoption de la directive Solvabilité II, durant l’été 2009, ne clôt pas les débats autour du nouveau dispositif prudentiel. Alors que les discussions se concentrent sur les mesures d’application de la directive, très vite les discussions entre l’industrie européenne, d’une part, le(s) régulateur(s) (CEIOPS puis EIOPA, et Commission) d’autre part se tendent et virent au conflit ouvert. Les discussions autour des nouvelles règles du jeu dureront encore quatre ans. Elles portent sur l’ajout de mesures spécifiques permettant d’atténuer les conséquences de la directive pour l’industrie, dans un contexte économique extrêmement tendu, marqué en particulier la baisse des taux.

48. The need for a structured approach to extradition between China and New Zealand

New Zealand will increasingly be confronted with human rights issues arising from the extradition of individuals to China due to perceived inadequacies in China’s criminal justice system and the practice of using force to extract confessions by China’s law enforcement agencies. This thesis examines the failings of New Zealand’s current ad hoc extradition system with its reliance on diplomatic assurances to guarantee fair trial rights and protection against torture for individuals extradited to China. Due to these inadequacies it is possible that the only way in which New Zealand can fulfil its obligations under the United Nations Convention against Corruption in cases involving corruption is for New Zealand to exercise its extraterritorial jurisdiction as an alternative to extradition. The Law Commission’s approach in its 2016 report recommending changes to the Extradition Act 1999 fails to comprehend the essential role bilateral treaties are likely to play in terms of New Zealand’s extradition relationships with countries such as China in the future. It is argued that a more structured approach is needed by concluding a legally binding treaty with China that provides for specific human rights guarantees and a monitoring regime. This treaty should also allow either state party to offer to try an individual sought for extradition by exercising the requested party’s extraterritorial jurisdiction as an alternative to extradition. Furthermore, consideration should be given to expanding the scope of New Zealand’s extraterritorial criminal jurisdiction in cases involving individuals requested for extradition under the treaty.
