Image-based sexual abuse (IBSA) is a growing, global problem. This article reports on a mixed-methods, multi-jurisdictional study of IBSA across the United Kingdom, Australia and Aotearoa/New Zealand. Attitudes of blame and minimisation of harms among a sample of the general population ( n = 6109) were analysed using two multiple regression analyses that assessed the ability of three demographic and three experiential characteristics to predict attitudes. Interviews were also conducted with 43 stakeholders and analysed thematically. Survey respondents who attributed more blame and minimised harms to a greater extent tended to be men, heterosexual, and had experienced or perpetrated more IBSA behaviours. Those who reported greater engagement in sexual self-image behaviours were also more likely to minimise harms. Interview participants suggested attitudes of blame and minimisation may be linked to broader problematic attitudes around sexual violence and sexual double standards, with women more likely to experience blame for IBSA. Our findings are of international relevance and highlight the need for multifaceted policies, education campaigns and training that challenge these attitudes.

This study examined image-based sexual abuse (IBSA) victimisation in the United Kingdom, Australia, and New Zealand (n = 6,109). Findings showed that 37.7% (n = 2,306) of respondents had at least one IBSA victimisation experience since 16 years of age. Logistic regression analyses further identified that demographic characteristics (age, sexuality, disability/assistance), attitudes towards IBSA, and experiential variables (online dating and sexual self-image behaviours, IBSA perpetration) were each predictors of IBSA victimisation. Though gender did not predict the overall extent of IBSA victimisation, the relational contexts and impacts of IBSA remained gendered in particular ways. Implications of the study are discussed with respect to conceptualising gendered violence and future research.

Deepfake and digitally altered nude and sexual imagery is a serious and harmful emerging form of image-based sexual abuse (IBSA). This article reports on a multi-methods and cross-country study of IBSA across the United Kingdom, New Zealand and Australia, with a specific focus on the creation, distribution and threat to distribute deepfake and digitally altered imagery. Our findings suggest this abuse involves poly-victimization and poly-perpetration, and is disproportionately experienced and engaged in by those with mobility and/or communication assistance needs, members of the LGB+ community, males, young people and racial minorities (perpetration only). In this article, we discuss the pervasiveness and harms of deepfake and digitally altered imagery abuse, as well as challenges in legal responses, policing and prevention.

This paper explores the symbolic and instrumental impacts associated with labelling particular groups of young people as perpetrators of organised gang activity. Using case studies from two Australian cities, we point primarily to the constitutive and damaging nature of much media and public discourse about youth gang crime and show how young offenders’ disadvantage and disenfranchisement is rendered largely invisible or immaterial to understanding the causes and solutions to such problems. In an era of “fake news”, social media “echo chambers”, civil conflict, mass international migration / forced diasporas, as well as the reassertion of strong sovereign borders, we ask: how might one de-escalate the “monstering” of young people whose identity (and presence and place in society) is known primarily, if not exclusively, through the “noise” and visibility of their offending? Despite media suggestions that youth violence is the result of an epidemic of young thugs “out of control”, this paper argues that youth violence is emblematic of complex political, economic and socio-cultural conditions. This introductory paper discusses some of the key themes and articles from our special issue on Youth Violence: De-Escalation Strategies and Socio-Legal Responses, which is the result of a workshop held at the Oñati International Institute for the Sociology of Law in July 2019. It seeks to reflect the rich tapestry of factors, contexts and processes that can place young people at risk of offending, or, perhaps even more importantly, at risk of criminalisation, as presented in the special issue collection. We reflect on the range of perspectives presented across the special issue on youth violence and the de-escalation of such violence, which seek to advance knowledge, and identify strategies for regulating and preventing this behaviour. Image-based abuse (IBA) refers to the non-consensual taking, sharing or threat to share nude or sexual images. Research suggests people who witness IBA behaviours can reduce the extent and impacts of its harm by taking action to intervene. However, there is limited research available on the attitudes, experiences and role of bystanders in the prevention of IBA. This paper presents findings from a national study examining bystanders’ experiences of, and responses to, witnessing IBA. Informed by a survey of 245 Australian adults in four jurisdictions, this paper shows that while witnessing IBA is common, few respondents reported taking action to intervene, and there are gender differences in bystander readiness to intervene. The findings have important implications for the development of bystander intervention and education programs.

Beyond ‘scandals’ and the public testimonies of victim-survivors, surprisingly little is known about the nature and extent of the harms of ‘image-based sexual abuse’, a term that includes all non-consensual taking and/or sharing of nude or sexual images. Accordingly, this article examines the findings from the first cross-national qualitative study on this issue, drawing on interviews with 75 victim-survivors of image-based sexual abuse in the UK, Australia and New Zealand. We adopt a feminist phenomenological approach that permits more nuanced and holistic understandings of victim-survivors’ experiences, moving beyond medicalised, trauma-based accounts of harm. Our analysis develops five interconnected accounts of the harms experienced, that we have termed social rupture, constancy, existential threat, isolation and constrained liberty. Our findings shed new light on the nature and significance of the harms of image-based sexual abuse that emphasises the need for more comprehensive and effective responses to these abuses.

Image-based sexual abuse (IBSA) is a form of technology-facilitated abuse in which intimate (nude or sexual) images of a person are taken, distributed, or threats are made to distribute the images, without a person’s consent. It is an increasingly criminalized form of sexual abuse, and yet little is known about the perpetrators of these harms, including the extent, relational nature and correlates of perpetration. This article reports on the first multi-country survey study to comprehensively investigate IBSA perpetration. An online panel survey of the general community (aged 16–64 years) in the United Kingdom (UK), Australia, and New Zealand (NZ) ( n = 6109) found that self-reported IBSA perpetration was relatively common, with one in six (17.5%, n = 1070) respondents engaging in at least one form of IBSA. Logistic regression analyses identified nine characteristics that significantly increased the odds of having engaged in IBSA perpetration during their lifetime, namely: residing in the NZ as opposed to the UK or Australia, being male, having disability/assistance needs, holding attitudes that minimize the harms and excuse the perpetrators of IBSA, engaging in online dating behaviors, engaging in sexual self-image behaviors, and experiencing IBSA victimization (images taken, images distributed, and images threatened). Policy and prevention implications of the findings, as well as directions for future research are discussed.

This article explores the influence of victim-survivors as change agents through the examination of the case of domestic and family violence advocate Rosie Batty. Utilizing public policy and criminological theories, and drawing from interviews with Batty and policy actors, the article examines the “Batty effect” and the convergence of factors that helped drive significant social and policy reforms in Australia. The article considers how Batty reflects characteristics of the policy entrepreneur and ideal victim, and how the sociopolitical context at the time provided the conditions for change. We conclude by exploring the implications for victim-survivor led policy change.

Defendants in rape trials rely on narratives of “implied consent,” situating women’s ordinary behavior as having indicated consent. Such narratives ignore women’s experiences, instead describing a male perpetrator’s subjective interpretation or inference of the woman’s actions. Implied consent narratives should have been eliminated by law reform introducing affirmative consent that redirected attention to steps that the perpetrator took to ensure the other party was consenting. Drawing from an Australian study, this article uses rape trial excerpts from the state of Victoria to argue that implied consent narratives endure in rape trials and form the key factor shaping a reasonable belief defense. Rape law allows men to interpret women’s behavior without restriction, providing evidence of the persisting influence of misogynistic views of women in law and legal practice. This article contributes to feminist jurisprudential and theoretical efforts to generate understandings of the ways rigid gender norms are enacted and performed in rape trials.

This article investigates the nature and scope of image-based sexual abuse (IBSA) material on 77 high-volume online websites. On the majority of these sites, users appeared to be motivated by sexual gratification and proving masculinity to a sexually deviant peer network, rather than revenge against the person depicted in the image. We argue that nonconsensual image exchanges are contextualized within ever-expanding digital environments, characterized by dislocation of time and space, overvisualization, and hypersexuality. We argue that IBSA is a vehicle for the construction, performativity, and negotiation of hypermasculinity and heteronormativity, within the bounds and structures of existing gendered power relations.

Image-based sexual abuse (IBSA) involves three key behaviors: the non-consensual taking or creation of nude or sexual images; the non-consensual sharing or distribution of nude or sexual images; and threats made to distribute nude or sexual images. IBSA is becoming increasingly criminalized internationally, representing an important and rapidly developing cybercrime issue. This paper presents findings of the first national online survey of self-reported lifetime IBSA perpetration in Australia (n = 4053), with a focus on the extent, nature, and predictors of perpetration. Overall, 11.1% (n = 411) of participants self-reported having engaged in some form of IBSA perpetration during their lifetime, with men significantly more likely to report IBSA perpetration than women. With regard to the nature of perpetration, participants reported targeting men and women at similar rates, and were more likely to report perpetrating against intimate partners or ex-partners, family members and friends than strangers or acquaintances. Logistic regression analyses identified that males, lesbian, gay or bisexual participants, participants with a self-reported disability, participants who accepted sexual image-based abuse myths, participants who engaged in or experienced sexual self-image behaviors, and participants who had a nude or sexual image of themselves taken, distributed, and/or threatened to be distributed without their consent were more likely to have engaged in some form of IBSA perpetration during their lifetime.

Technology-Facilitated violence and abuse is a truly global problem. As the diverse perspectives and experiences featured in this book have shown, the deep entanglement between technologies, inequality, marginalization, abuse, and violence require multi-faceted and collaborative responses that exist within and beyond the law. When this chapter was written, society was (and continues to be) facing an unprecedented challenge in COVID-19 – a global pandemic. At the same time, a renewed focus on racist police and civilian violence has occurred following the killings of George Floyd, Ahmaud Arbery, and Breonna Taylor in the United States. As we describe in this chapter, these two major moments are ongoing reminders of the profound social inequalities within our global communities, which are grounded in systemically discriminatory oppressions and their intersections. This chapter draws together some thoughts on Technology-Facilitated violence and abuse in an era of COVID-19 and antiracist protest. It explores these within the context of the book as a whole, highlighting the importance for improved understanding of, and responses to, Technology-Facilitated violence and abuse as part of a broader push for social justice.

While digital technologies have led to many important social and cultural advances worldwide, they also facilitate the perpetration of violence, abuse and harassment, known as Technology-Facilitated violence and abuse (TFVA). TFVA includes a spectrum of behaviors perpetrated online, offline, and through a range of technologies, including artificial intelligence, livestreaming, GPS tracking, and social media. This chapter provides an overview of TFVA, including a brief snapshot of existing quantitative and qualitative research relating to various forms of TFVA. It then discusses the aims and contributions of this book as a whole, before outlining five overarching themes arising from the contributions. The chapter concludes by mapping out the structure of the book.

In practice, victim-survivors are being consistently failed: by the law, by the police and criminal justice system, by traditional and social media, website operators, and by their employers, universities and schools. Drawing on data from the first multi-jurisdictional study of the nature and harms of, and legal/policy responses to, image-based sexual abuse, this article argues for a new joined-up approach that supports victim-survivors of image-based sexual abuse to ‘reclaim control’. It argues for a comprehensive, multi-layered, multi-institutional and multi-agency response, led by a government- and industry-funded online or e-safety organisation, which not only recognises the diversity of victim-survivor experiences and the intersection of image-based sexual abuse with other forms of sexual and gender-based violence and discrimination, but which also enables victim-survivors to reclaim control within and beyond the criminal justice system.Despite apparent political concern and action – often fuelled by high-profile cases and campaigns – legislative and institutional responses to image-based sexual abuse in the UK have been ad hoc, piecemeal and inconsistent. Digital technologies are increasingly being used as tools for the perpetration of domestic violence. Little empirical research to date has explored the nature and impacts of technology-facilitated domestic violence (TFDV), and even less attention has been paid to the experiences of immigrant and refugee women. This article examines the nature and impacts of TFDV as experienced by immigrant and refugee women. Drawing on interviews with 29 victim-survivors and 20 stakeholders, we argue that although immigrant and refugee women may experience TFDV in similar ways to non-immigrant and refugee women, they face unique challenges, such as language barriers, cultural bias from support services, lack of financial resources, lack of trust in state institutions, and additional challenges with justice and migration systems. Immigrant and refugee women also face multiple structural layers of oppression and social inequality. Accordingly, we argue that a multifaceted approach is required to address TFDV that includes culturally sensitive and specific law reform, education, and training.

There is an emergent body of research that considers the benefits of introducing legal representation for victims of crime throughout their criminal justice journey. In this chapter, we consider victims’ views on whether they desire legal or advisory representation in the criminal justice process, with a specific focus on plea negotiations. The chapter commences with an exploration of the context surrounding representation or advisory support for victims, before examining victim perspectives on this reform proposal.

Providing information about plea negotiations, both as a general practice and in relation to a victim’s specific case, is a very basic form of engagement with victims of crime. Research has identified a clear distinction between a victim being informed of, or told about, a decision, and being genuinely consulted about that decision. This chapter discusses victims’ perspectives on the provision of information and consultation with them about plea negotiations. It begins by outlining the context and relevant legal provisions pertaining to informing and consulting with victims about plea negotiations, before exploring victim perspectives on the provision of information and consultation in relation to plea negotiations.

Providing victims with the option to complain to a Victims of Crime Commissioner about a plea negotiation decision or the right to request an independent review of a plea negotiation decision raises issues of accountability, enforceability, fairness and transparency. This chapter considers victims’ perspectives on these two victim-focused reforms, which seek to provide some form of redress for plea negotiation decisions that are not supported by the victim. It begins by discussing the context and relevant legal provisions pertaining to complaining and reviewing prosecutorial decisions, before exploring victim perspectives on these two reforms.

Victims do not have the power to make determinant decisions in the criminal justice process. Once the police take carriage of the case, victims are often relegated the status of prosecutorial witness, with little input or participation in the decision-making processes that surround their case. There are no adversarial systems that permit victims a right to veto a prosecutor’s decision. In this chapter, we explore whether victims want the right to veto a plea negotiation. We begin by briefly discussing the context behind this idea, before exploring victim perspectives on the power to veto.

In Australia, judges are not directly involved in plea negotiations and generally have no power to review prosecution decisions regarding the nature or number of offences that the prosecution decides to proceed with. This chapter explores the notion of judicial involvement in plea negotiations. It begins by discussing the context and relevant legal provisions pertaining to judicial involvement in plea negotiations, before exploring victim perspectives on this victim-focused reform.

This article investigates the phenomenon of domestic and sexual violence against adult women using digital communications technologies. The article explores terminological and conceptual challenges and describes the empirical research literature in this field to date in relation to digital dating abuse, intimate partner cyberstalking, technology-facilitated sexual assault, image-based sexual abuse, and online sexual harassment. The article also discusses policy and practice responses to this growing problem, as well as future directions for research. We argue that research and practice need to be guided by existing conceptual frameworks that utilize gender and actor–network theory to understanding the causes and consequences of women’s experiences of abuse and violence facilitated by digital technologies.

Image-based sexual abuse (IBSA) refers to the non-consensual recording, distribution, or threat of distribution, of nude or sexual images. Over the past five years, numerous jurisdictions have amended their criminal laws to respond more effectively to this growing phenomenon, yet increased criminalization has not automatically translated into increased prosecutions. Drawing on stakeholder interviews with 52 Australian legal and policy experts, domestic and sexual violence advocates, industry representatives, police, and academics, this article examines law enforcement responses to IBSA in Australia. We argue that although there is evidence to suggest IBSA is being treated more seriously by police, there are five primary barriers to responding to IBSA, including: inconsistent laws; a lack of resources; evidentiary limitations; jurisdictional boundaries; and victim-blaming or harm minimization attitudes. As digital modes of communication and participation become further enmeshed into everyday lives, so, too, do these technologies feature in shifting enactments of sexual violence. Over many decades, research has examined various aspects of sexual victimization, as well as its extent, gendered nature, and impacts. However, scholarly examination of the ways in which digital technologies contribute to both the cultures and practices of sexual violence has been slow to develop in comparison to the rapid pace of the technologies themselves. Moreover, although the cybercrime scholarship has examined the role of technology in creating new opportunities and tools for criminally motivated offenders in general, less attention has been paid to the development of conceptual frameworks for understanding the role of technologies in gender-based violences. In this chapter, we move beyond a conventional analysis focused on technology as a mere facilitator of sexual offending, towards a more conceptual framing of the intersection of human, social, and technical factors that contribute to technology facilitated sexual violence (TFSV).
