This article is about Aquinas’ practical doctrine on two great current philosophical difficulties that lie at the basis of contemporary ethical debate. Such as Hume’s Is-ought thesis and Moore’s radical synthesis, the Open question. The thomistic possible solution can be found in the triple function of the human intellect, theoretical and practical at the same time: a) To apprehend the ontological or intellectual notions ens, verum and bonum; b) To formulate the first theoretical and practical principles; c) And to rule that the ontological and intellectum good be done and the opposite avoided., Este artículo trata sobre la postura práctica de Aquino ante dos grandes dificultades filosóficas actuales que se encuentran en la base del debate ético contemporáneo. Como son la Is-ought thesis de Hume y la síntesis radical de Moore, la Open question. La posible solución tomista se puede encontrar en la triple función del intelecto humano, teórico y práctico a la vez: a) Aprehender las nociones ontológicas e intelectas ens, verum y bonum; b) Formular los primeros principios teóricos y prácticos; c) E imperar que se haga el bien ontológico e intelecto y se evite lo contrario.

4. Do we die alone?: A philosophical exploration into the lonely nature of dying with implications for palliative care

Given that all human beings are bound to their own biological and thus perishable body, everybody dies – ultimately – alone. Although it is widely recognized that dying can be accompanied with loneliness, the current concepts of social, emotional and existential loneliness do not give insight in what it means in the face of death to be fundamentally thrown back on oneself as a finite human being, i.e., as a human being that is involved in (dealing with) his own imminent death. Because death annihilates all relationships with others, the world and oneself, ‘ultimately dying alone’ means that in the face of death there remains nothing to which – with regard to our own end – we can hold on, except to the meaning of our own death. Given that aloneness refers to a factual state of being separated, and loneliness to the negative perception of this state, loneliness of dying refers to a lack of relatedness to (aspects of) a life-transcending perspective in which one’s own death has a meaningful place, or – put shortly – to a lack of meaningful relatedness to one’s own death. Adequate support for the loneliness of dying implies that caregivers (1) are aware that people may suffer from the lonely confrontation with death without being able to express and communicate their suffering to others. It is important that caregivers (2) understand death not only as a state of non-being, but also as an (ontological) possibility of the dying to give meaning to his ow (ontic) death. In this respect, it can be helpful to see the meanings that people attribute to death not ‘merely’ as illusions, but as the ‘natural’ outcome of what it means to be a finite human being and – hence – of what it means to relate understandingly to one’s own death. Further, it is important that caregivers (3) develop a sensitivity for the broad variety of meanings that the dying attribute to death. 5. On what a theory of natural law is supposed to be.

A theory may properly be called a theory of natural law, if either it functions as such a theory is expected to function; or it has the expected content; or it is a plausible interpretation of a theory generally acknowledged to be in the tradition of natural law. It functions as such a theory if it supports appeals to natural law intended to 'contextualize' human law. It has the expected content, if it adverts to providential, natural teleology as the basis for a law given to us prior to convention. It would clearly be located in the tradition, and rightly accounted as such a theory, if it were a plausible interpretation of Aquinas' Treatise on Law, which is the locus classicus for the philosophical treatment of natural law. But the 'New Natural Law,' first expounded in Natural Law and Natural Rights (NLNR) of John Finnis, meets none of these criteria. NLNR seems best construed, then, as a contribution to the «law and morality » debate, not a theory of natural law. It gives merely another 'method of ethics' along with the many others put forward in the 20th c. The Joint Statements and declarations on the establishment, promotion, and strengthening of strategic partnership by the leaders of Japan and the Philippines since 2011 indicate an ardent desire toward making security and defense cooperation a salient feature of their 21st century bilateral relationship. Scholars would point to the 'China factor' as a convenient reason to explain the strategic trajectory of this evolving relationship. While this study does not discount the 'China factor' as a motivating force behind this change, it asserts that both nations were able to extend their partnership into the security realm because of some enabling domestic factors. Although Thomistic philosophy has often been equaled to a Christianized Aristotelianism, Eleonore Stump weakens this common conception through the unraveling of the notions of virtue and passion within the Thomistic ethics, and comparing these with their Aristotelian counterparts.The exposition of the Thomistic theory of virtue serves as a starting point to the development of the classification of the passions that Thomas Aquinas presents. Given their different cultures, one pagan and the other Christian, Aristotle and Thomas Aquinas construct two different theoretical apparatus, dependant on their own fundamental final realities: non-personal metaphysics for the former, and Trinity for the latter. In the case of Aquinas, the perfection of virtues and the passions do not only depend on rationality, but God plays a main role in this respect.

16. Thomas Aquinas’ Universality Argument for the Immateriality of the Intellect : a reconstruction by Gyula Klima

The paper investigates Gyula Klima’s reconstruction of Aquinas argument for the immateriality of the intellect by the concept of human thought and its success to avoid the Content Fallacy. This fallacy, which is coined by Robert Pasnau, describes an illicit inference from a description of the nature of a thought, to what a thought represents, its content. The focus will be on a debate between Klima and Pasnau in Proceedings of the Society for Medieval Logic and Metaphysics, but also on Adam Wood’s critique of Klima. The paper concludes that if Klima is interpreted correctly, the argument is valid and Klima’s reconstruction of Aquinas argument does not fall victim to the Content Fallacy.

18. QUASI EX UNO ORE: LEGAL PERFORMANCE, MONASTIC RETURN, AND COMMUNITY IN MEDIEVAL SOUTHERN ITALY.

Focusing on the charter that contains the first sentence of written Italian, this article explores the return of the Monastery of St. Benedict at Monte Cassino to the Liri valley after seventy years of exile. Central to this homecoming was a legal dispute with the nearest neighbors of the monastery over a large piece of property. During the court case, the monks supported their claim to the lands with the oaths of witnesses rather than the display of documents. The performance of oaths by witnesses conformed to southern Italian norms about legal proof as well as alluded to a body of religious literature about persecution of holy men by secular authorities. The second half of the article discusses the possible afterlife of the charter as a script for future performances as well as the end of this conflict with a second performance and a donation of the land to Monte Cassino. The author examines briefly some texts belonging to the thomistic corpus, in which is shown that tolerance is not a proper value of modernity, but it was practiced and explained by Thomas Aquinas who lived in a rich multicultural pe-riod of history as the medieval age was, where he defended convincingly his own beliefs with respect and toleration in the presence of all kind of thinkers (muslims and jewish thinkers, heretics, unbelievers, etc.) with whom he didn't agree entirely. After concluding that prostitution is inmoral but not illegal according to Aquinas, such any tolerant philosopher would do it, the author determines the nature and limits of this ethic virtue, giving good reasons to be cultivated it by anyone. Una determinada teoría se puede denominar, propiamente, teoría de ley natural, si su operación se verifica de acuerdo con presupuestos o contenidos reconocibles bajo ese adjetivo, o si presenta una interpretación convincente de alguna teoría conocidamente aceptada en conformidad con la tradición de ley natural, en términos generales. Funciona como tal teoría si recoge referencias a la ley natural para ‘contextualizar’ la ley humana. Tiene un contenido reconocible si hace referencia a la teología natural providencial, como fundamento de una ley que figura recibida antes de cualquier acuerdo. Estaría claramente ubicada en la tradición, y correctamente aceptada como tal teoría, si fuera una interpretación convincente del Tratado de Ley de Aquino, que es el locus classicus para el tratamiento filosófico de la ley natural. Pero la Nueva Ley Natural, por primera vez expuesta en Ley Natural y Derechos Naturales (LNDN) de John Finnis, no satisface ninguno de estos criterios. Cabe interpretar mejor LNDN, como una contribución al debate sobre «ley y moralidad,» pero no como una teoría de ley natural. Esta obra solamente ofrece otro «método de ética» como muchas otras obras producidas en el siglo 20. Si esto es así, el trabajo filosófico necesario para provocar el estímulo contemporáneo acerca de la ley natural sigue pendiente de aparecer.

Nuestro trabajo profundiza en la estructura y las formas de la analogía, tal como la concibe Tomás de Vio en su célebre Tractatus de nominum analogia. Sabido es que el Cardenal desestimó la analogía de atribución intrínseca, (rescatada luego por Suárez), y prefirió la de proporcionalidad para los temas propios de la metafísica; como ejemplo, la noción de ente. Por otra parte, Cayetano compone su opúsculo para ofrecer una noción clara de las formas en que éste debería ser comprendida según la doctrina propia de Santo Tomás de Aquino, y del mismo Aristóteles. Así, pues, luego de presentar brevemente el modo en que el Estagirita abordó la cuestión, y tras detenernos en la propuesta del Aquinate, reconduciremos nuestra reflexión hacia el Gaetano, con el fin de poner de manifiesto las diferencias que advertimos. Finalmente, nuestras conclusiones. This work studies the analogy’s estructure and its forms as was conceibed by Thomas de Vio on his Tractatus de nominum analogia. As it is well known, the Cardinal preferred the analogy of proportionality to be used in the fields of metaphysics, i. e. the notion of “ens”, and desestimated the analogy of intrinsic denomination (recovered later by Suárez). On the other hand, Cajetan writes a paper to offer a clear notion about the forms that the analogy should be understood according to Aquinas’ and Aristotle’s original doctrines. After we present the way that the Philosopher studied this topic, and after we had presented Aquinas’ ideas, we will go deeply into the differences between all the mentioned authors. La distinción que establece Tomás de Aquino entre el esse intentionaley el esse naturale es vista por diferentes comentadores como la diferencia entre la existencia mental y la existencia extra-mental de un ente, respectivamente. A menudo se traduce esse intentionale como "existencia mental", incluso se ha llegado a decir que intentio significa "tener una idea". Según las lecturas intencionalistas la existencia intencional es lo que distingue a los seres cognoscitivos de los no-cognoscitivos, esto es, poseer una intentio sería una condición necesaria y suficiente para que un ente sea cognoscitivo. El objetivo del artículo es discutir esta tesis y mostrar que existe un tipo de conocimiento que no implica la presencia de formas que tengan una existencia intencional, como es el caso del conocimiento que los seres cognoscitivos tienen de sí mismos. The distinction that Aquinas establishes between the esse intentionale and the esse naturale is seen by different commentators as the difference between the mental existence and the extra-mental existence of a being, respectively. Esse intentionale is often translated as "mental existence," even saying that intentio means "to have an idea". According to intentionalist readings, the intentional existence it is that distinguishes the cognitive beings from the non-cognitive beings, that is, having an intentio would be a necessary and sufficient condition for an entity to be cognitive. The objective of this paper is to discuss this thesis and to show that there is a type of knowledge that does not imply the presence of forms that have an intentional existence, as in the case of the knowledge that cognitive beings have of themselves.

Tesis leída el 29 de junio 2018. La disertación consiste en un análisis comparativo de la ética general en John M. Finnis y Tomás de Aquino: ontología, antropología y ética. Se investiga en la tesis -analizando y contrastando a continuación con la posición finniana- qué entiende Aquino por: bien universal y ontológico; bien particular y concreto; persona; naturaleza humana; unidad del intelecto humano (teórico y práctico a la vez); voluntas ut natura y voluntas ut ratio; ley natural; inclinación natural; libertad; responsabilidad. Parece que Finnis posee una visión desequilibrada de la filosofía moral tomista, lo cual le llevaría a minusvalorar o sobrevalorar ciertas nociones e ideas fundamentales. Se analiza -contrastando posteriormente con la posición finniana- si la ética integral de Aquino es una consecuencia natural de su ontología. Se analiza -contrastando con Finnis- qué entiende Aquino cuando escribe inclinación natural en el contexto de la ley natural. Esto es, si se refiere exclusivamente a las inclinaciones naturales universales, de la persona en cuanto tal, hacia los bienes ontológicos y universales. O si se refiere a las inclinaciones de una o varias personas hacia bienes concretos; buenos (inclinación natural a ayudar a enfermos), menos buenos (inclinación natural a beber alcohol), o malos (inclinación natural a violar). O si se refiere a las inclinaciones naturales de los animales. Asimismo parece que según Aquino - después se examina la posición finniana- el bien universal y ontológico no sea Dios ni la visión beatífica; pues ambos bienes en esta tierra nos resultan más bien bienes concretos y particulares. El intelecto humano no aprehende naturalmente, en esta tierra, la realidad ni esencia de esos bienes; así la voluntad humana no los desea naturalmente (voluntas ut natura).

El trabajo reconstruye todos los elementos de la mecánica argumentativa de la quaestio en el célebre artículo 85 de la prima pars de la Suma teológica de Tomás de Aquino, que se interroga sobre si la especie inteligible es aquello que (id quo) es conocido o aquello por lo cual (id quo) algo es conocido. El análisis de la dinámica interna de este esquema argumentativo muestra la plena conciencia que el Aquinate tiene de las dificultades que pueden presentarse a la tesis que allí se defiende. Ello se expresa especialmente en las objeciones o argumentos in contrario, basadas en premisas propias. Se intenta demostrar que la doctrina sostenida en el artículo es perfectamente compatible con otros elementos de la obra de Tomás de Aquino, como la temprana adhesión a la doctrina de la indiferencia de la naturaleza de origen aviceniano, o la distinción entre la especie inteligible y el verbo mental formulada en obras maduras. In opvolging van ’n historiese bydrae in hierdie tydskrif (Van der Walt 2015) van verskillende beskouinge oor die nagmaal gedurende die sestiende eeu, waarin op Bybels onverantwoordbare filosofiese invloede gewys is, wil hierdie artikel op ’n meer sistematiese wyse vanuit ’n Christelik-filosofiese benadering in die lig van die Skrif na nuwe perspektiewe op hierdie sakrament soek. Eers word sekere van die vroeëre beskouinge - wat vandag in baie opsigte na 500 jaar nog voortduur - verder filosofies geanaliseer, om daarteenoor die nodige korreksies vanuit ʼn nuwe visie te kan stel. In ’n vergelyking tussen die Roomse verstaan van die mis en die Gereformeerde kyk op die nagmaal word die aandag op ooreenkomste sowel as verskille gevestig. Dit blyk dat die Katolieke visie vanuit ’n synsfilosofie uitgaan, terwyl Gereformeerdes ’n antropologiese bewussynsfilosofie as vertrekpunt hanteer en dat beide vanuit h Bybels-georiënteerde, Reformatoriese filosofie bevraagteken kan word. Hierdie ondersoek loop dus uit op ’n herbesinning in die lig van wat Christus self by die instelling van hierdie sakrament gedoen en gesê het. Die nagmaal is, van menslike kant beskou, nie ’n ontiese of antropologies-verspiritualiseerde gebeure nie, maar van diep en omvattende religieuse aard. Soos wat ’n moeder nie net vir haar kind sê dat sy hom/haar liefhet nie, maar dit ook met ’n soen bevestig, getuig God van sy kant nie net in sy Woord van sy grenselose liefde nie, maar bevestig Hy dit ook met sy liefdeskus by die nagmaal. This investigation provides a follow-up on a previous contribution in this journal (cf. Van der Walt, 2015) which, from a historical-philosophical point of view, dealt with four different sixteenth century views about Christ's presence at Mass and the Lord's Supper. In the present article, of a more systematic-reflective nature, an effort is made to arrive, from a Christian philosophical perspective, at some new perspectives on the celebration of this sacrament. Since the new can only be clearly stated by contrasting it to the old, the first main section compares the Catholic and Reformed views by indicating some of their major differences as well as similarities. One of the most important differences is that in the first (Catholic) viewpoint an explanation of Mass was attempted from a philosophy of being, while the second in its view on the Lord's Supper tended to employ an anthropological model in which either the intellect (Zwingli) or the emotions of the heart (Calvin) served as a key. The following four similarities are also identified, the first being that both groups tried to theorise and thus comprehend, albeit in different ways, the sacrament. However, in their use of biblically foreign philosophies to do so, the full meaning and power of this sacrament was narrowed and obscured. In their views on the sacrament a second similarity is evident between the Catholic distinction between nature and supernature (grace) and a similar Reformed distinction between a worldly and heavenly kingdom. The third similarity - reducing the meaning of the sacrament to either something bodily or spiritual - is that both groups of thinkers based their understanding on dichotomist anthropologies of body and soul/spirit. A fourth similarity is also evident, because both viewpoints contained (different) mystical tendencies. The second main section provides a more detailed analysis of the philosophical presuppositions of both viewpoints. Regarding the Catholic perspective, attention is given to the following: its philosophy of being, its distinction between a realm of nature and grace and its idea about substance. In the case of the Reformed viewpoint, critical reflection is focussed mainly upon its dichotomist anthropology, emphasising certain faculties of the soul or spirit in order to faithfully understand and be spiritually strengthened by the Lord's Supper. Against this spiritualising tendency the author prefers a holistic, biblically-oriented view of concepts like "soul", "spirit", "body", and "flesh". Since all these concepts indicate the whole human being from different perspectives, the entire wo/man partakes in the Lord's Supper. With this critical review of both Catholic and Reformed views in mind, the third main section outlines an attempt to arrive at a more biblically-sound perspective on the Lord's Supper. This is done by paying careful attention to what Christ Himself did and said when He fulfilled the promise ofthe Passover and introduced the first Holy Communion as recorded in Matthew 26:26-29, Mark 14:22-25, Luke 22:14-20, also referred to by Paul in 1 Corinthians 11:23-26. The fact that Christ did not only officiate at that ceremony but that He also explained its meaning, draws one's attention to the importance that Word and sacrament, in spite of their own distinct nature and purpose, should never be separated or the one regarded as more important than the other. A mother not only tells her child that she loves her/him, but confirms her words with a kiss. Likewise God's words of love in the Bible are confirmed by His kiss of love in the sacrament. We hear God's Word, but also see and taste the bread and wine. Christ's command "eat... and drink" should be regarded as a friendly invitation to participate in something very special. "This is My body... this is My blood" should not be interpreted literally but as symbolic language. Nor should these words be understood in a dichotomist way(referring to a separate bodily component of Christ's humanity) but indicating the sacrificial death of Christ as a full human being. The sacrament also did not strengthen his disciples merely spiritually, but promised the restoration of their full humanity, their total human existence. In Christ's request "do it in remembrance of Me", remembrance should not be understood as a mere rethinking or emotional experience of what He did in our place. Remembrance, for instance, not only tries to explain something, but also to consider its meaning; it is also not confined to the past, but encompasses past, present and future. Finally, attention is asked for Christ's words that the cup symbolises the new covenant. The biblical concept of a covenant is that God in his steadfast love takes the initiative to establish such a relationship, while man as a religious being has to respond in obedience to all God's ordinances, summarised in his law of love. This religious relationship is furthermore fundamental and encompassing, not to be confused with or confined to spiritual personal devotions or worship in church. After man's disobedience to this covenantal relationship, Christ established it anew. This glorious fact is commemorated at His Supper. Understood in the past in a more or less ontic or anthropological (e.g. intellectual or emotional) and therefore mystical way, the Lord's Supper may be viewed more appropriately as a very rich covenantal, religious feast of remembrance, encompassing every aspect of being human, celebrating God's incomprehensible love (Ephesians 3:18-19).

Uno de los tópicos principales de la teoría clásica del derecho natural es el de la relación entre derecho natural y positivo. Para todos los autores clásicos, el derecho positivo encuentra su origen en los principios universales del derecho, que Santo Tomás ha llamado lex naturalis. Pero estos principios universales del derecho son tan generales e inespecíficos, que para formar parte de un ordenamiento jurídico concreto (en una comunidad política concreta) necesitan de alguna especificación. Este modo de «especificar» los preceptos naturales de moralidad es lo que se llama determinación, que es el tema de nuestro trabajo. One of the main topics of classical iusnaturalism is the relation between natural law and positive law. For all the classics, positive law originates from the universal principles of law, that Aquinas calls lex naturalis. But these universal principles of law are so general and nonspecific, that to be part of a particular justice system (in a particular political community) needs some specification. This form of «specify» the natural precepts of morality is called determination, that is the topic of our work.

Este artículo académico trata sobre cómo Aquino entendía: a) la aprehensión de las primeras nociones intelectas universales: ens, verumetbonumsimpliciter; b) la fructificación de los primeros preceptos y de los segundos preceptos de la ley natural en la persona genuinamente humana o racional; c) la ética como esencialmente derivada de la ontología. Ens, entendido metafísicamente, compuesto de naturaleza humana y acto del ser; d) por tanto, la ley natural solo tiene sentido desde una visión metafísica, no me-ramente física o material. This article explains how Aquinas understood: a) apprehension of the first intellectual concepts ens, verumetbonumsimpliciter; b) establishment of the first and second commandments of natural law in a person, genuinely human or rational; and c) ethics as essentially derived from ontology. Metaphysically understood, Ens is a compound of human nature and act of being; d) therefore, natural law only makes sense from a metaphysical point of view, not a physical or material one.

Una determinada teoría se puede denominar, propiamente, teoría de ley natural, si su operación se verifica de acuerdo con presupuestos o contenidos reconocibles bajo ese adjetivo, o si presenta una interpretación convincente de alguna teoría conocidamente aceptada en conformidad con la tradición de ley natural, en términos generales. Funciona como tal teoría si recoge referencias a la ley natural para ‘contextualizar’ la ley humana. Tiene un contenido reconocible si hace referencia a la teología natural providencial, como fundamento de una ley que figura recibida antes de cualquier acuerdo. Estaría claramente ubicada en la tradición, y correctamente aceptada como tal teoría, si fuera una interpretación convincente del Tratado de Ley de Aquino, que es el locus classicus para el tratamiento filosófico de la ley natural. Pero la Nueva Ley Natural, por primera vez expuesta en Ley Natural y Derechos Naturales (LNDN) de John Finnis, no satisface ninguno de estos criterios. Cabe interpretar mejor LNDN, como una contribución al debate sobre «ley y moralidad,» pero no como una teoría de ley natural. Esta obra solamente ofrece otro «método de ética» como muchas otras obras producidas en el siglo 20. Si esto es así, el trabajo filosófico necesario para provocar el estímulo contemporáneo acerca de la ley natural sigue pendiente de aparecer.

It also analyzes the analogy between the light and the soul that Aquinas mentions, which is taken from Aristotle. The main task at hand will be to revisit the question of how Aquinas interprets Plato and Aristotle in this particular section of the Treatise on Human Nature.

Esto proporciona un lugar común donde una interdisciplinariedad diacrónica puede ser de ayuda., This study suggests the benefits of including virtuality as part of the analysis of our experience. Recovery by Deleuze from Aquinas’ use of virtuality is shown "rst by displaying Aquinas’ texts on cognitive and normative virtuality, divine, angelic and human virtuality, followed by Deleuze’ uptake of virtuality into his metaphysical analysis. This provides one commonplace where diachronic cross-disciplinarity can appear helpfully.

Aspectos histórico-evolutivos do jusnaturalismo: da Grécia antiga a Tomás de Aquino. 2011. 74f. – Dissertação (Mestrado) – Universidade Federal do Ceará, Programa de Pós-graduação em Filosofia, Fortaleza (CE), 2011. The jusnaturalism receives of St. Thomas its main feature: a historical contribution in favor of recognizing the fundamental rights of the individual. His thesis jusnaturalist, exposed in the work "Summa Theologica," surpasses all previous formulations on the subject. In the first version of natural law, which was formed in Ancient Greece, was included as a basic characteristic the defense of the polis, identified with the idea of equality between citizens and embodied in the phenomenon that is called: concord. This paradigm jusnaturalist reaches its climax in Aristotle with his conception of political or constitutional law. Making an interpretation in a new light the concepts of Aristotle, Aquinas makes the natural law systematic, covering this system the formulations on this: eternal law, natural law and human law. In this last is contained in what he calls the natural law or law of nations, a concept with which, Aquinas, exposes the greater legacy of natural law, the aforementioned rights and basic guarantees of the person. É no pensamento de Santo Tomás que nasce a marca principal do jusnaturalismo: a contribuição histórica cedida em favor do reconhecimento dos direitos fundamentais do indivíduo. Sua tese jusnaturalista, exposta na obra “Suma Teológica”, supera todas as formulações anteriores sobre o tema. Na primeira versão da lei natural, que se formou na Grécia arcaica, constava como característica básica a defesa de um bem da pólis, identificado com a idéia de isonomia entre os cidadãos e materializado no fenômeno que se denominou concórdia. Tal paradigma jusnaturalista atinge seu ápice em Aristóteles, com sua concepção de lei política ou constitucional. Interpretando sob nova perspectiva o conceitual aristotélico, Aquino dá ao jusnaturalismo uma forma sistemática, englobando, neste, as formulações sobre lei eterna, lei natural e lei humana.
