Afirma que mudanças no processo legislativo internacional e europeu são perceptíveis e geram diversos desafios regulatórios.

International institutions and international law have a relevant role not only in the provision of Global Public Goods, but also in their maintenance and administration. Community interests are related to GPG, as they tend to transcend States’ individuals’ interests and ensure the protection of the international community. The protection of human rights can be considered the most prominent among other expressions of community interest. As a component of the international governance structure, international courts and tribunals (ICTs) can be considered a key element to the promotion of the international rule of law, including the provision of GPG. As the principal judicial organ of the UN, the ICJ is able to promote GPG by adjudicating inter-State claims. However, the Court’s intrinsic tension between State consent and global values may undermine its capacity to promote public interest. One may wonder whether procedural law could be used as an obstacle for the achievement of substantive rights, in particular, for the protection of GPG. Backlashes include situations where international adjudication prioritises procedures to the detriment of community interests. Procedural reforms in cases involving GPG have been advanced, in particular of the rules regarding fact-finding and evidence. They aim at ensuring the normative and democratic legitimation of ICTs, and in particular of the ICJ. Os interesses da comunidade estão relacionados ao GPG, pois tendem a transcender os interesses individuais dos Estados e garantir a proteção da comunidade internacional. A proteção dos direitos humanos pode ser considerada a mais proeminente entre outras expressões de interesse da comunidade. Como um componente da estrutura de governança internacional, os tribunais e tribunais internacionais (TICs) podem ser considerados elementos-chave para a promoção do estado de direito internacional, incluindo a provisão de GPG. Como o principal órgão judicial da ONU, o ICJ é capaz de promover o GPG ao julgar reivindicações interestaduais. No entanto, a tensão intrínseca do Tribunal entre o consentimento do Estado e os valores globais pode comprometer sua capacidade de promover o interesse público. Pode-se perguntar se o direito processual poderia ser usado como um obstáculo para a obtenção de direitos substantivos, em particular, para a proteção do GPG. Retrocessos incluem situações em que a adjudicação internacional prioriza os procedimentos em detrimento dos interesses da comunidade. Reformas processuais em casos envolvendo GPG foram avançadas, em particular das regras relativas à apuração de fatos e evidências. By developing international law, international courts can also contribute to the protection and promotion of community interests, by adjudicating inter-state claims. The aim of this project is, particularly within the International Court of Justice, to appreciate the relentless demands involving community interests and present a non-traditional response to its challenges. The main obstacle faced by the ICJ relates to the existing tension between the bilateral nature of its own proceedings and the multilateral nature of the conflicting substantive law. Whereas the rules of that protect community interests are considered to be substantive law, those guiding international adjudication are of a procedural nature. As procedure may guide and shape the application of substantive law, it should itself be interpreted and developed in a manner to ensure community interests. Our proposal is that using its power to ‘frame rules for carrying out its functions’ (Art. 30 of the Statute of the ICJ), independently from consent, the Court should assume expanded procedural powers in order to ensure the effective application of substantive law whenever community interests are at issue. Most procedural rules can be adjusted and tailored for multiparty aspects (enhancing participatory mechanisms) with the aim of protecting community interests and enhancing international court’s legitimacy. It is up to the Court to find the balance between State’s rights and commonly aspired goals, acknowledging the relation between the emergence of soft international law-making (procedure) and its role of addressing the provision of community interests (substance). Resumo Ao desenvolver o Direito Internacional, os tribunais internacionais também podem contribuir para a proteção e promoção dos interesses da comunidade internacional, ao julgar demandas interestatais. O objetivo deste projeto é, particularmente no âmbito da Corte Internacional de Justiça, apreciar as contínuas demandas envolvendo interesses da comunidade e apresentar uma resposta não tradicional aos seus desafios. O principal obstáculo enfrentado pela CIJ diz respeito à tensão existente entre a natureza bilateral de seus próprios procedimentos e a natureza multilateral da lei substantiva conflitante. Enquanto as regras que protegem os interesses da comunidade internacional são consideradas como uma lei substantiva, as que orientam a adjudicação internacional são de natureza processual. Nossa proposta é que, usando seu poder para “criar regras para o desempenho de suas funções” (Art. 30 do Estatuto da CIJ), independentemente do consentimento estatal, a Corte deveria assumir amplos poderes processuais para assegurar a efetiva aplicação da lei substantiva. sempre que interesses da comunidade internacional estiverem em questão. The Mercosur dispute settlement system possesses several limitations, which are linked to its transitory aspect and include, in particular, the limited access of individuals who are only able to present their demands via the National Section of the Common Market Group of the member state in question. The application of the advisory opinions’ mechanism embodies a possible alternative in order to overcome the lack of access of individuals and civil society to Mercosur Tribunals. The referred mechanism enables national courts to question the Permanent Review Court exclusively with regards to the interpretation of Mercosur law. Therefore, it guarantees an indirect access of individuals to Mercosur Tribunals. However, there is still a very low number of advisory opinions solicited to the PRC, which are due, among other factors, to the lack of knowledge of Mercosur law and its mechanisms by lawyers and national judges. This challenged is combined with a normative limitation, i.e., the double non-binding character of the advisory opinions, thereby contributing to legal uncertainty. Some alternatives have been envisaged, notably with the creation of a permanent court for Mercosur.

DOI: 10.12957/rdc.2018.32113 O processo brasileiro de conclusão de tratados foi inicialmente caracterizado por uma competência partilhada, conforme previsto na Constituição belga de 1831, que serviu de modelo para o Brasil e outros países. As disposições do texto constitucional brasileiro de 1988 que regem o poder de concluir tratados contrastam com a lógica das constituições anteriores, baseadas na fórmula franco-belga de divisão de poderes. O texto atual confere uma ampla margem de manobra ao poder executivo, sendo este último capaz de decidir quais tratados podem causar gravames ao patrimônio nacional e, portanto, exigir aprovação legislativa. As regras constitucionais não só determinam a competência dos poderes executivo e legislativo no processo de elaboração de tratados, mas também indicam os procedimentos a serem aplicados para a incorporação do direito internacional no Brasil. O processo de incorporação é marcado por um desequilíbrio entre os poderes executivo e legislativo, típico de um país sob regime presidencial. O poder executivo domina todo o processo de conclusão de atos internacionais, sofrendo pouca interferência do legislador. Se a atuação do poder executivo é discricionária e não arbitrária, esta não é imune às críticas. Requisitos históricos, como a promulgação de tratados, não previstos expressamente no texto constitucional, resultam em uma incerteza jurídica que pode comprometer os compromissos assumidos pelo Brasil na esfera internacional. Palavras-chave: Processo de Conclusão de Tratados; Incorporação; Brasil; Tratados Internacionais; Constituição Brasileira Abstract The Brazilian treaty-making procedure was initially characterized by shared competence, as provided for in the Belgian Constitution of 1831, which served as a model for Brazil and other countries. The current Brazilian constitutional text dates back from 1988. Its rules governing the power to conclude treaties contrast with the logic of previous constitutions, which were based on the Franco-Belgian formula of division of powers. The current text confers a large margin of maneuver to the executive power, the latter being able to decide which treaties may compromise the budget of the state and, therefore require legislative approval. Constitutional rules not only determine the competence of executive and legislative powers in the process of treaty-making, but also indicate the procedures to be applied for the incorporation of international law in Brazil. The incorporation process is marked by an imbalance between the executive and legislative powers, typical of a country under a presidential regime. The executive power dominates the whole process with a view to concluding international acts, suffering little interference from the legislature. If the executive’s power on the matter is discretionary but not arbitrary, it is not immune from criticism. Historical requirements such as the promulgation of treaties, not provided for in the constitutional text, results in a legal uncertainty which may compromise the commitments undertaken by Brazil in the international arena. A natureza das obrigações impostas ao Estado que assina um tratado internacional figura na ordem do dia dos debates internacionais. Isso porque muitos Estados têm adotado a prática de assinar tratados internacionais em função de compromissos políticos sem, entretanto, pretender ratificá-los, caso que assumiriam a obrigação de respeitar seu conteúdo. O objetivo deste artigo é analisar a gradação e a importância de tais obrigações no que tange aos tratados em forma solene e aos tratados em forma simplificada. Para isso, recorreu-se à análise de conteúdo cujo ponto de partida foi o texto da Convenção de Viena sobre o Direito dos Tratados de interpretação e a análise do texto da Convenção foram realizadas segundo os critérios gramatical, histórico, teleológico e prático e foram baseadas principalmente nos debates prévios à sua adoção realizados pela Comissão de Direito Internacional da ONU e em textos doutrinários. Ao final, concluiu-se que, como pretenderam os redatores da referida Convenção, a assinatura tem tido crescente importância no que tange às obrigações de um Estado na esfera internacional, podendo gerar, no caso dos acordos em forma solene, uma obrigação de boa-fé que não poderá ser negligenciada, e até mesmo a efetiva responsabilização do Estado no caso dos acordos em forma simplificada, que atualmente dominam o cenário internacional e brasileiro. The nature of the obligations imposed on a State which signs an international treaty is one of the most discussed topics in international debates. This is due to the fact that many States have adopted the practice of signing International agreements in order to satisfy political demands, but without the intention of ratífyíng them, when they would assume responsibility for complying with treaty content. The aim of this article is to analyse the degree and importance of such obligations concerning both treaties and executive agreements. To this end, an content analysis, whose point of departure was the text of the Vienna Convention on the Law of Treaties was utilized. The interpretation and analysis of the text were carried out following grammatical, historical, teleological and practical criteria and were based principally on debates organised by the International Law Commission prior to the adoption of the Vienna Convention, as well as the academic literature. Finally, it is concluded that the signing of a treaty has been of growing importance regarding the International obligations of a State, ranging from an obligation of good faith in the case of treaties to full responsibility for complying with the content of an executive agreement, which dominates the International and Brazilian arena.
