The criminal justice system that Pakistan adopted in 1947 was tailor-made by the British colonial rulers that fits their needs and suits their colonial designs. The Pakistan Penal Code, 1860 and other laws creating offences and fixing punishments (substantive criminal law), the Code of Criminal Procedure, 1898 and other adjective laws including the law of evidence are classical examples of the British legacy. The march of civilization has loaded society with multiple complexities. Twenty-first century society is markedly by different from nineteenth century society. Technology, information explosion, rapid socioeconomic cum-scientific changes have made the social and cultural norms at once multi-layered. This has rendered P.P.C. and Cr.P.C. inadequate, occasionally outdated and in many cases redundant. The change became imperative. President General Zia got promulgated Qisas and Diyat and Hadood Laws in 1979 and the Qanun-e-Shahadat Order in1984. This was a half-hearted effort. The inadequacies of P.P.C. and Cr.P.C. are more than to meet the procedural practices of day to day need. Though the Code of Criminal Procedure,1898, is the principal criminal procedural law of Pakistan yet we find some provisions relating to criminal safeguards provided to the accused in our Constitution of 1973 in the form of different articles such as right to life and liberty (Article 9), safeguard as to arrest and detention (Art. 10), protection against retrospective punishment (Art. 12), protection against double jeopardy and self-incrimination (Art. 13). Now after the 18
th Amendment, a new Art. 10-A has been inserted to ensure fair trial. In spite of all that some radical changes are required for the overhauling of the existing criminal justice system of Pakistan. The purpose of this paper is to point out the main lacunas or shortcomings of our criminal justice system and provide viable recommendations to the legal fraternity so that necessary steps may be taken for its improvement. This chapter maintains that the adversarial and inquisitorial categories have been more central to comparative criminal procedure than it has been previously acknowledged because they have contributed to constitute it as a transnational field by reflecting and restricting its main theoretical trends and thematic interests. The article identifyies the main theoretical traditions of this field by mapping commentators' and courts' uses of the adversarial and inquisitorial distinction, and shows that even the main comparative criminal procedure alternative approaches are operating within these same theoretical traditions. The article suggests that the adversarial-inquisitorial dichotomy has also contributed to limit the type of themes that the field has covered. Finally, the article sketches a number of ways in which comparative criminal procedure may transcend the long theoretical and thematic shadow of the adversarial and inquisitorial categories and thus expand the type of positive and normative insights it can bring to our understanding of the criminal process. This review examines the rising challenge of self-represented litigants in America's courts. It begins with a history of the right to represent oneself and the right to counsel and then considers the dearth of empirical information about those who proceed on their own-in other words, pro se. The article examines the shortcomings of the available data about how pro se litigants are treated as compared with those represented by counsel. It then considers the importance of how the unrepresented feel about their experience-most particularly regarding their opportunity for 'voice.' The article then explores judicial attitudes about pro se litigants, arguing that judges may be resistant to reforms to help these parties because such reforms raise fears about judicial neutrality and fair resolution of the merits. The review concludes by briefly considering the cost of not addressing the pro se challenge. [ABSTRACT FROM AUTHOR]

Gordon Tullock critiques two specific aspects of the common law system: the adversary system of dispute resolution and the common law process of rulemaking, contrasting them with the inquisitorial system and the civil law systems respectively. Tullock’s general critique is straightforward: litigation under the common law system is plagued by the same rent-seeking and rent-dissipation dynamics that Tullock famously ascribed to the process of legislative rent-seeking. The article concludes that Tullock’s critique of the adversary system appears to be stronger on both theoretical and empirical grounds than his critique of the common law system of rulemaking. This article deals with the reform of the Spanish criminal justice, which began almost 20 years ago from the emergence of democracy and the Constitutional Text of 1978 in force and has been a majority restoration or vindication of the specialized doctrine and society itself. No one approaching the situation of our criminal justice with a minimum of objectivity can disagree with the need of this reform that, in a partial way, has been carried out in the most recent amending legislative initiatives to the "Criminal Indictment Law" "Ley de Enjuiciamiento Criminal"), with technical solutions that turn to be almost evident for themselves. Perhaps better than any other legislative initiative of all those having emerged from the State Covenant for the Reform of Justice ("Pacto de Estado para la Reforma de la Justicia"), the so-called Fast Judgment Act ("Ley de Juicios Rápidos" 38/2002 of October 24) of Amendment of the Criminal Indictment Law ("Ley de Enjuiciamiento Criminal") and its supplementary L.O. 8/2002, summarizes the two great objectives designed by the Ministry of Justice: On the one hand, modernizing the Spanish administration of justice by making it more agile, efficient, transparent and close to the citizens and, on the other hand, invigorating the judicial system as a whole as an essential base instrument of the fight against criminality. It has been intended, from some sectors, to convey to the juridical community the idea that the slowness seen in criminal instruction brings guarantees to the accused. However, we understand that the delay of several weeks or even months it takes has nothing to do with the guarantees of procedure inherent to the due process of law, the intimate constitutional value of which (the so-called principle of procedure that so industrially builds the doctrine of the US Supreme Court from the XVI Amendment) we must not pervert. We neither believe that it brings any advantage to the accused or the victims or those third parties having to take part in the criminal process, the indefinite prolongation of the middle phase of the procedure or the several-month delay (between three and five on average) in the determination of the oral hearing, as it has been occurring. Concern about some kind of justice administration where speed is made one of its main informative principles is a historical constant in our country. The Criminal Indictment Law itself in its original wording (more than 120 years ago) did already incorporate certain precepts where the acceleration principle was included, leading to avoid unjustified delays in criminal procedures, as inferred from some of its legal statements. The last great amendment or reform of the Criminal Indictment Law ("L.E. Criminal") carried out, as already said, by Act ["Ley"] 38/2002 under the aforementioned State Covenant for the Reform of Justice, should the modernization process of the major procedural laws be completed, by placing among its aims the speeding up of procedures, is not, as it has been indicated as well, a new end within the Spanish criminal indictment frame. Certainly, lack of reforms attached to this same objective cannot be adduced. Nonetheless, global experience arising under each one of these legislative novelties, though all of them contributed positive aspects, cannot be deemed satisfactory in exact terms. Sometimes, routine in the applicative processes of procedural standards and lack of resources to consolidate some of the most important events contributed to promote more skepticism about the likely actual solution to the problem of immediate indictment with respect to mild infractions that those intended by the most recent reforms that we will analyze.… [ABSTRACT FROM AUTHOR]

'Family law procedure' differs greatly from 'civil procedure.' Canadian jurisdictions and common-law jurisdictions have copied English reforms of merging law and equity. Canada unlike the United States confined legislative authority over divorce to the federal government under the British North American Act. The Canadian federal government enacted the national Divorce Act of 1968, which had a homogenizing effect on substantive family law across Canada in both custody and support matters for a number of years. There are many pressures for fragmentation of procedure specifically, dealing with the provincial courts. Modern family law procedure is much more like civil procedure. If inquisitorial methods are used or if discovery is limited using 'simplified rules' for smaller cases, family law procedure will become two different tiers-one for self-represented litigants and litigants where the stakes are small and the other tier would be one that operated under the 'normal' rules of civil procedure. Porota je neizbežen institut sistemov s tradicijo common law. Tam ima zgodovinsko svojski položaj. Kljub temu pravi porotni sistem izrazito cenijo zgolj še v ZDA, kjer je sojenje po poroti ustavna garancija. Eno izmed najpomembnejših vprašanj, ki zadevajo porotno sojenje, je, ali so končne odločitve porote poštene in pravične. Vsak sodni postopek se mora namreč v celoti izvesti nepristransko, da bi sodba obveljala za pošteno. Potreba po psihološkem preučevanju porote se je razvila v luči tega vprašanja, ob dejstvu, da končno sodbo poda skupina popolnih laikov. Zato je psihološko porotno preučevanje pravzaprav preučevanje dejavnikov, torej vplivov zunaj človeka, ki naj bi učinkovali nanj. Vzporedno z raziskovanjem dejavnikov se znanost osredotoča tudi na kognitivni proces porotnikov. V ta namen so se razvili različni modeli, s katerimi so znanstveniki želeli pojasniti porotnikove psihične procese pri sprejemanju odločitve. Ta magistrska naloga predstavi in kritično ovrednoti tovrstne raziskovalne pristope. Jury seems to be inevitable endowment in systems with Common Law tradition. Only there it holds historically unique position. However, United States remain the only Anglo American country to cherish trial by jury nowadays, lauding and raising it to the level of constitutional guarantee. One of the focal questions concerning trial by jury is whether jury's verdicts can be deemed fair and just. The whole process of adjudication must be impartial should the verdict be fair. In the light of this question a need for jury studies emerged. Such need was amplified by the fact that jurors, composing a body of decision-making laymen, can be influenced in various ways. Thus, psychological jury study amounts to study of considerations, i.e. influences that are beyond man and his psyche. In addition, a special regard is placed upon jurors' cognitive processes. To this end, numerous models have been developed to improve penetration of juror's indiviudal psychic processes. The present thesis hastens to provide an overview of such scientific approaches, with the aim to critically address them.

The essay seeks to demonstrate that the principle of cooperation is the basic idea of various provisions of the Code of Civil Procedure (CPC) of 1973 and of the Project of the New CPC, including the art. 339 of CPC/1973 and those that discipline the disclosure of documents and things. The dissertation seeks to establish the limits to the principle of cooperation in the Brazilian legal system, in particular the right to privacy (art. 5. º , X, CF/1988) and the right to remain silent (art. 5.º , LXIII , CF / 1988). At last, the dissertation seeks to establish the essence of the principle of cooperation and the way it operates in civil procedure. A dissertação procura estabelecer os fundamentos constitucionais e legais do princípio da cooperação no processo civil, descrevendo-o como um princípio constitucional implícito, decorrente do princípio da solidariedade (art. 3º, I, CF/1988), da isonomia (art. 5.º, caput, CF/1988), do acesso à ordem jurídica justa (art. 5.º, XXXV, CF/1988), do devido processo legal (art. 5.º, LIV, CF/1988), do contraditório, da ampla defesa (art. 5.º, LV, CF/1988) e da duração razoável do processo (art. 5.º, LXXVIII, CF/1988). O trabalho procura demonstrar que o princípio da cooperação é a ideia base de vários dispositivos do Código de Processo Civil (CPC) de 1973 e do Projeto do Novo CPC, entre eles o art. 339 do CPC/1973 e aqueles que disciplinam a exibição de documento ou coisa. A dissertação procura estabelecer os limites do princípio da cooperação existentes no ordenamento jurídico brasileiro, em especial o direito à privacidade (art. 5.º, X, CF/1988) e o direito ao silêncio (art. 5.º, LXIII, CF/1988). Enfim, a dissertação procura estabelecer o conteúdo do princípio da cooperação e a forma como este opera no processo civil.

Savremeno krivično procesno zakonodavstvo karakteriše pojačana zakonodavna aktivnost koja za posledicu ima značajne reforme krivičnog postupka u cilju povećanja njegove efikasnosti. Glavna karakteristika tih reformi se ogleda u tome da mnoge zemlje evropsko kontinentalne pravne tradicije prihvataju i u određenom obimu preuzimaju krivičnoprocesne institute koji dolaze iz anglosaksonske pravne tradicije i koji su karakteristični za adverzijalni krivični postupak. Jedan od takvih instituta jeste i stranačka istraga, odnosno uvođenje zakonske mogućnosti da i odbrana sprovodi sopstvena istraživanja nezavisno od javnog tužioca koji vodi istragu. S obzirom na značaj ovog kompleksnog pitanja u radu će najpre biti predstavljene i analizirane odredbe srpskog Zakonika o krivičnom postupku kojima je regulisano pitanje prikupljanja dokaza i materijala u korist odbrane, kojom prilikom ćemo se kritički osvrnuti na pojedina sporna zakonska rešenja. Zatim će biti izvršena analiza stranačke istrage u Italiji, i to ne samo u delu koji se odnosi na odredbe Zakonika kojima se regulišu istraživanja odbrane, već i sa jednog šireg aspekta. To iz razloga jer je Zakonik o krivičnom postupku Italije iz 1988. godine uneo mnogobrojne i velike izmene u organizaciji krivičnog postupka, i to tako što je evropsko kontinentalni model postupka zamenjen 89 RKK, 1/15, A. Bošković, Strategija istraga i efikasnost krivičnog postupka (str. 89-110) sa adverzijalnim modelom. Takva direktna transplantacija pojedinih anglosaksonskih rešenja je u praktičnom postupanju dovela do niza problema za sve glavne krivičnoprocesne subjekte pa je u određenom domenu morao da interveniše i Ustavni sud Italije. Metodama koje će se koristiti u ovom istraživanju, kritička analiza sadržaja, deskripcija, komparacija, sinteza i dedukcija, nastojaće se da se dođe do relevantnih činjenica koje će omogućiti izvesnu komparaciju u pogledu organizacije stranačke istrage u Srbiji i Italiji, ali prevashodno da se dođe do zaključka u ko, Modern Criminal Proceeding Legislation is characterized by increased legislative activity which results in a significant reform of the criminal proceeding in order to increase its efficiency. The main characteristic of these reforms reflects in the fact that many countries in European continental legal tradition accept and to some extent take over criminal proceeding institute that come from the Anglo-Saxon legal tradition and which are typical for adversary criminal proceeding. One of those institute is the party investigation, or bringing in legal possibility that the defense conducts its own investigations, independently of the public prosecutor who leads the investigation. Given the importance of this complex issue, in this paper will first be presented and analyzed provisions of the Serbian Criminal Proceeding Code which regulates the issue of collecting evidence and materials for the defense, during which we will critically examine particular disputable legal solutions. In addition the analysis of Italian party investigation will be performed, and not just the part referring to the provisions of the Code which regulates defense research, but also from a broader point of view. The reason for this is that the Criminal Proceeding Code of Italy from 1988 introduced a numerus and great changes in the organization of criminal proceeding, in such way that the European continental model of the proceeding was replaced with adversary model. Such a direct transplant of some Anglo-Saxon solutions in practice led to a series of problems for all major criminal proceeding subjects so in particular domain the Constitutional Court of Italy had to intervene.With the methods that will be used in this study, a critical analysis of content, description, comparison, synthesis and deduction, the aim will be to obtain the relevant facts that will allow some comparison in terms of the organization of the party investigation in Serbia 109 RKK, 1/15, A. Pur richiamata nel preambolo dell’art. 2 legge-delega c.p.p., solo con le sent. cost. 348 e 349 2007 si è avuto il generale riconoscimento nel nostro ordinamento della disciplina di fonte internazionalistica sui diritti dell’uomo come norma interposta; né può ignorarsi che l’entrata in vigore del Trattato di Lisbona potrebbe far acquisire alla Convenzione europea dei diritti dell’uomo il grado e la forza diritto comunitario. Nel frattempo, sono stati progressivamente ampliati i poteri della Corte europea dei diritti dell’uomo, ai cui provvedimenti viene assegnato l’effetto di cosa giudicata interpretata. La funzione della Corte di Strasburgo di garantire i requisiti del giusto processo, per un verso, non implica l’obbligo di abbassarne il livello di attuazione per gli Stati che maggiormente ne esaltino qualche aspetto (come accade per la regolamentazione del contradittorio nel nostro codice di procedura penale) e, per l’altro, non consente una riduzione della portata innovativa delle sentenze della medesima Corte, quando rilevino inadempienze nel sistema nazionale (come avviene per la disciplina italiana delle dichiarazioni unilaterali)

Esta dissertação tem por objetivo analisar os institutos da decisão monocrática e do agravo interno, sob o prisma de metodologia empírica que busca priorizar a realidade pragmática da aplicação do artigo 557 do Código de Processo Civil. Enfocou-se o instituto da decisão monocrática no contexto das minirreformas processuais brasileiras, que tiveram como alicerce o princípio da efetividade processual. Esse princípio pressupõe a duração razoável do processo, garantida na Constituição Federal Brasileira. A partir da constitucionalidade desse princípio, defendeu-se a constitucionalidade do artigo 557 do Código de Processo Civil, que não pode ser considerado abstratamente inconstitucional. Demonstrou-se que a aplicabilidade do artigo 557 pode ser inconstitucional se não atender à técnica da ponderação de valores, que garante a interpretação conforme a Constituição. Analisou-se o agravo interno, sob a premissa do valor da celeridade em cotejo com o devido processo legal, que permeou a subsequente análise do procedimento desta espécie de agravo. Após uma reflexão sobre os institutos da decisão monocrática e do agravo interno, aliada ao exame dos princípios do devido processo legal, ampla defesa, contraditório e motivação das decisões judiciais, passou-se ao exame empírico desses institutos jurídicos. Nessa análise, foram coletados e examinados dados estatísticos, que confirmaram – e, assim, possibilitaram a conclusão da dissertação – a constitucionalidade do artigo 557 e a importância de sua interpretação conforme os referidos princípios constitucionais. This dissertation has the purpose to analise the institutes of the single verdict and the internal appeal, according to empirical methodology that focus the pragmatic reality of the 557 th. dispositive of Code of Civil Procedure`s enforcement. This dissertation focused the institute of the single verdict in the context of the reformation of the Brazilian Code of Civil Procedure, which had as foundation the principle of procedure efectiveness. This principle presupposes a reasonable duration of the suit, secured by the Brazilian Federal Constitution. From the constitutionality of this principal, this dissertation defended the constitutionality of the 557 th. dispositive of Code of Civil Procedure, which can`t be considered abstractedly unconstitutional. This dissertation proved that the enforcement of the 557 th. dispositive could be unconstitutional if doesn`t suit the technique of the weighing of values, which secures the interpretation according to the Brazilian Federal Constitution. This dissertation analised the internal appeal, under the presupposition of the value of the reasonable duration of the suit in comparison with the due process of law, which motivate the following analysis of the internal appeal proceeding. After a reflection of single verdict and the internal appeal institutes, also with the analysis of due process of law, legal defense, adversary system and the motivation of the judgement, this dissertation analised the empirical enforcement of these institutes. In this analysis, estatistic data have been collected, which corroborate – and, therefore, enabled the conclusion of the dissertation – the constitutionality of the 557 th. dispositive of Code of Civil Procedure and the consideration of its interpretation according to the mentioned constitucional principles.
