The article analyses the prospects for the application of artificial intelligence in the delivery of justice by courts. The application of artificial intelligence is increasingly spreading in various different areas of life - both in the daily life of individuals and in the public sector. One of the main areas where artificial intelligence is already being applied is in the area of justice. However, given the complexity and importance of this field, the question arises whether artificial intelligence could really replace the person of the judge. In order to answer this question, the authors first assess what constitutes the delivery of justice. Secondly, the authors analyse the concept of artificial intelligence and the possibilities of its use. Thirdly, the authors assess the potential and risks of artificial intelligence in the delivery of justice. The paper reviews various artificial intelligence models already in use around the world and assesses the application of various technologies (large language models such as ChatGPT) in the court. Finally, conclusions are drawn as to whether artificial intelligence can replace the person of the judge.

Objective: the study analyzes the main factors associated with innovation capacity in courts. Methods: the research design involves a qualitative investigation based on in-depth interviews with 17 judges and 13 staff members of the Brazilian judiciary. Data analysis was conducted using content analysis. Results: the study corroborates previous research on innovation capacity in the public sector and demonstrates the prominence of certain factors in boosting this capacity, namely: leadership, team behavior, collaboration, organizational resources, knowledge management, and information technology. Conclusions: the findings show that having people who are skilled in innovation methods and techniques, with available time, engagement, and participation both as team members and in leadership positions, is important for the innovation capacity of courts. This should be aligned with the collaboration of key actors to promote innovation. Understanding the ideal alignment among the study’s factors can assist in improving judicial services.

The need for the technological continuous improvement of the administration of justice was particularly evident for Colombia, a country used as an example due to its social dynamics and institutional adjustments. Hence, this article focuses on examining and arguing this scenario using a heterodox legal-economic approach.

The importance that data protection has acquired, in general, nowadays, and specifically in the field of the administration of justice, and particularly in matters centered on the right to effective judicial protection, is decisive. The concept of effective judicial protection is one of the bases on which the General Data Protection Regulation is established, especially when we turn to a supervisory authority or against a controller or processor. These data and their impact on our fundamental rights are analyzed. The protection of personal data and privacy, matters that will increasingly acquire a greater virtuality of their own and, above all, in the environment of the administration of justice, are emphasized. Jaroslav Maria’s novels were very popular in the interwar period, even though they were negatively viewed from the aesthetic standpoint; their subject matter was the life of the various social classes, morality, justice and the judiciary. The novel Sword and Scales refers to actual court cases that were tried in Czechoslovakia, subversively presents and distorts some of the stereotypes of the era with its imagery (femininity, racial and social otherness — the topic of the Roma minority) and gets involved in political issues. This study examines the historical context and the contemporary reception of the novel and on this basis analyses the way in which the literary work has been socially utilized. It ensures the rules of law, promotes transparency and accountability, delivers efficient and effective public services, enhances administrative capacity and also contributes to the democratic process and the well-being of European citizens. This paper highlights the importance of bureaucracy in upholding democratic principles, equality, good governance, and social justice in Europe and further examines the strengths and challenges, focusing on the rule of law, transparency, accountability, public service delivery, and administrative capacity. The research seeks to identify the potential areas for improvement within bureaucratic frameworks, providing a nuanced understanding of the mechanisms that can enhance societal well-being. The study employs a multi-faceted methodology, combining qualitative and quantitative approaches, through in-depth case studies, interviews with key stakeholders, and a comprehensive analysis of bureaucratic policies and practices. The expected results include insights into the ways in which bureaucracy influences democratic processes, fosters equality, ensures good governance, and contributes to social justice outcomes in Europe. The paper concludes with recommendations for bureaucratic reforms and innovative approaches to enhance bureaucracies’ effectiveness in fulfilling their democratic and social responsibilities. The findings are expected to have significant implications for policymakers, practitioners, and researchers in public administration extend to the broader global context, offering valuable lessons for regions grappling with similar challenges in promoting democracy, equality, good governance, and social justice.

Objective: the traditional Nigerian judicial system has long been associated with a conservative approach and traditional methodologies of justice administration. As a developing country, Nigeria has benefited immensely from the advancement of digital technology, especially in the legal field. This is due to the fact that modern digital technologies are being rapidly adopted in Nigeria's judicial processes for effective justice administration. However, despite the promise of digital technology, there are legal and socioeconomic challenges in Nigeria that may affect its successful utilization in legal proceedings. This justifies the focus of the study - to identify the legal and socio-economic challenges of digitalization of court proceedings in Nigeria.Methods: the study combines doctrinal and non-doctrinal approaches. The former ensures theoretical understanding of the conceptual issues and prospects of court proceedings virtualization. It also allows exploring, based on primary and secondary sources (laws, monographs, research articles and internet resources), the legal and socio-economic challenges of the use of digital technologies in court proceedings. The non-doctrinal approach consists in polling, describing and analyzing the results of a sociological survey. The survey was conducted among Nigeria residents to reveal their attitudes towards innovations in digitalization and virtualization of court proceedings as well as the challenges posed by these processes.Results: the study revealed that the use of digital technologies in court proceedings in Nigeria has several prospects of ensuring effective justice administration and accurate recording and storage of information. Along with the benefits, challenges are shown that may reduce the effectiveness of court proceedings digitalization.Scientific novelty: consists in investigating the use of digital technology in Nigerian court proceedings and identifying the prospects of improving the efficiency of justice administration in Nigeria under digitalization, as well as the challenges arising from this trend.Practical significance: the study will enable stakeholders in the Nigerian legal sector to identify legal and socio-economic challenges that may adversely affect and render ineffective the use of digital technologies in legal proceedings. In addition, the article offers practical recommendations to address these challenges.

Judicial delay in Brazil is a severe and persistent problem. This work helps to understand the causes of this issue, by identifying and discussing 12 factors that increase the length of the judicial process in the country. These factors were identified through content analysis of interviews with 15 key players in the Brazilian justice system, including judges, prosecutors, and lawyers. Each factor was discussed based on academic literature, official reports, and performance indicators. The research findings show that factors such as the low cost of filling, the absence of punishment for repetitive litigants, and tax foreclosures promote an overload of processes in the courts. The Judiciary also seems to be burdened with attributions beyond the jurisdictional function, such as collecting evidence and locating debtors and assets. The excess of disputes and assignments has made the Brazilian judicial machine large, slow, and expensive. Public policies to reduce judicial delays in the country are suggested. This article explores how a judiciary organization in Brazil underwent organizational change by implementing the virtualization of lawsuit processes. The virtualization of work processes requires practitioners to understand the organizational structure to implement technological changes effectively. Through a theoretical approach that considers the judiciary organization a professional bureaucracy, the article explains that effective organizational change in the judicial branch requires alignment with organizational structure and context. According to the study, e-government technology significantly impacts how individuals organize and structure their activities. Despite implementing new information and communication technologies during the virtualization of lawsuits, the organization maintained its professional bureaucracy configuration while making necessary changes. In recent years, the digitalization of administrative processes has become increasingly prevalent, promising efficiency, transparency, and enhanced accessibility. The Nordic countries, known for their advanced digital societies, provide a unique perspective to study the effects of digitalization on administrative decision-making processes and access to justice, particularly in the context of advanced welfare states and robust legal systems. This study investigates the multifaceted impact of digitalization on administrative decision-making processes and access to justice with a particular focus on Denmark, Finland, Norway, Sweden, and Iceland. It delves into how digitalization has transformed administrative decision-making processes, analyzing the potential for increased efficiency, streamlined workflows, and enhanced data-driven decision-making. Through a comprehensive analysis of policy frameworks, legal structures, and empirical data, this research seeks to elucidate the ways in which digital technologies are reshaping administrative practices and influencing the delivery of justice. The study begins by examining the evolution of digitalization in Nordic administrative laws, focusing on egovernment initiatives and digital technology integration. It explores its implications for administrative decision-making processes, including procedural fairness, administrative discretion, and automated decision-making algorithms. By adopting a comparative approach, this study aims to identify common trends, challenges, and opportunities presented by digitalization in Nordic administrative systems, offering insights that are pertinent to both regional policymakers and global stakeholders navigating the complexities of digital governance. Ultimately, this research contributes to a deeper understanding of the complex relationship between digitalization, administrative decision-making, and access to justice in Nordic States, offering insights that are pertinent to ongoing debates surrounding administrative modernization and legal innovation in the digital age. The subject of the analyses contained in the study is a phenomenon that raises fundamental controversies in the context of the principle of the tripartite division of powers in Poland, the principle of legal certainty and the principle of certainty of legal transactions. It concerns the tendency of judicial modification of the law for the purpose of a specific case being decided. The extreme and most far-reaching manifestation of judicial lawmaking is the modification of a legal text that is directly understood, i.e. one that does not give rise to any, even the slightest, doubts as to its content. In the current state of the law, there is no basis for modifying a legal text in the process of administering justice. Such modification means exceeding the limits of legal interpretation and is an impermissible normative statement. New legal rules may be formed in the activity of jurisprudence, but they must arise on the basis of a resultant relationship, following a process of restorative interpretation and provided that they are generally accepted by the judicature. Objective: to determine the possibility of professional legal activity automation and to identify the limitations that in a democratic society are associated with the use of software capable of generating effective legal solutions in conflict situations.Methods: the conducted empirical research is based on the methodology of social sciences, sociology of law, principles of communicative and communicational theories of law, and formal-legal analysis of legal documents.Results: the paper presents examples of functioning of computer systems that imitate some specific aspects of human intelligence in decision-making. The concept of algorithm and the main characteristics of tasks performed by artificial intelligence systems are defined. The relevance, methods and achievements of sociology of law are outlined, which underlie the systems or computer programs helping to resolve legal conflicts. It is found that the research tools developed as a methodology within the sociology of law since its emergence will be more widely used in the future, due to the growing use of information and communication technologies in legal activities. It is shown that in the administration of justice it is impossible to generate solutions only on the basis of artificial intelligence, since law and the process of making legal decisions on its basis has more complex characteristics in a democratic society. It is emphasized that obtaining the desired legal result is not limited to the processes of algorithmization, categorization or formal exegetics of legal texts. It rather consists in understanding and thinking in accordance with the accepted values, meanings, evaluative criteria, strategies, perspectives, etc.Scientific novelty: the article reveals the significance of the principles of communicative and communicational theories of law under the development of information and communication technologies in legal activity. The main limitations of the use of artificial intelligence in legal activity and, in particular, in justice are identified.Practical significance: the formulated provisions help, while improving legal regulation, to avoid insufficiently justified decisions on the automation of law enforcement, as well as to take into account the increasing importance of the principles of communicative and communicational theories of law in such types of legal activities as creation, interpretation and application of laws.

Recent historiography has shown how European rule and trade in the colonies shaped the law and the jurisprudence of courts in both the colonies and the metropole. Based on the case law of the highest German courts, in particular the Supreme Court (Reichsgericht), this article traces court practice in Germany and in the German »protectorates« (Schutzgebiete) as it related to colonial trade and rule. First, the article highlights a number of colonial legal issues that were tried in German courts before the German Empire formally became a colonial power in 1884. It then analyses the structure of the so-called »non-native jurisdiction« in the German colonies as an element of colonial state order. A hierarchy of courts was established that reached up to the Reichsgericht in Leipzig. Finally, the article analyses concrete decisions of the senates of the Reichsgericht in criminal matters that were based on colonial facts and / or colonial legal questions. These court decisions indicate how the colonies were exoticised in German jurisprudence or, on the contrary, if necessary normalised in order to correspond to (colonial) political objectives in the Kaiserreich.

The paper aims at developing recommendations for improving procedural laws and guiding case law related to reasons for a supreme court to overrule its universally binding legal opinions with a particular emphasis on relevant Ukrainian legal context as a perfectly illustrative example. This research purpose prompts the reliance on a set of appropriate scientific methods of descriptive and comparative law research including the comparative analysis itself as a fundamental instrument for review of relevant legal material, as well as the structural, analytical and law-in-context scientific methods.
