本研究は、第１に協同組合による高齢者介護や生活支援の現況を示す。第２に協同組合による社会福祉経営の特徴について考察する。最後に、協同組合の今日的意義について、政府の役割・位置づけを踏まえて検討する。, First, this study presents what is occuring in the provision of long-term care or livelihood support for the elderly by the co-operative sector. Second, it considers what makes the co-operative sector different from for-profit corporations in social welfare management. Third, it examines the significance of co-operatives today while also considering the role of the governments.

本稿は，非営利・協同組織における持続可能な内部通報制度の構築に向けて，2022（令和4）年６月に施行予定の改正公益通報者保護法を踏まえながら，非営利・協同組織の特性や役割等に鑑み，通報者保護の観点から通報者や通報対象事実の範囲，内部通報手続の在り方等について具体的考察を進めたものである。特に，非営利・協同組織の社会的役割や存在意義に基づき，社会全体（構成員）の福祉や生活向上に対する貢献性，さらには公益的価値を守る役割も担っていることなどを踏まえて，地域社会にとって持続可能な組織運営のための内部通報制度の実効性の具体的方策を論じた。

マリでは、農業は重要な収入と経済開発のセクターである。また、女性農業従事者は、この分野の主要な主体である。しかし、植民地時代後の土地所有制度と慣習法の影響により、ジェンダー不平等は続いている。これは、女性の財産権へのアクセスが制限されていることにも表れている。女性の権利の保障とジェンダー的な貧困緩和を達成するためには、ジェンダー格差を縮小することが重要である。このような背景から、マリ政府は2006 年に農業促進法を制定し、主に農業の近代化と女性の土地所有権の強化を試みた。本論文では、バギネダの女性農業従事者への聞き取り調査内容と現地調査から得られたデータを分析し、農業協同組合が小規模な女性農業従事者の土地所有と資源へのアクセスの拡大にどのように貢献したかを検証する。本研究では、バギネダの女性によって形成された農業協同組合は、収入の増加、慣習的な権力をもつ地域リーダーとの交渉、土地問題発生時の地方自治体へのロビー活動を通じて、女性の土地と資源へのアクセスと所有権を改善することに貢献したことが明らかになった。またそれによって女性へのエンパワーメントが見られることを結論した。, In Mali, agriculture is a significant income and economic development sector. Women farmers are one of the main actors in this realm. However, due to the influence of post-colonial tenure and customary law practices, gender inequalities persist. This is evidenced by women's limited access to property rights. The importance of reducing the gender gap is necessary to achieve women's rights and gendered poverty. Against this background, Mali's government enacted the Agricultural Orientation Law in 2006, which mainly attempted to modernize agriculture and enhance women's land ownership.Through the oral accounts and realities of women farmers in Baguineda, this article examined whether agricultural cooperatives have contributed to expanding small-scale women farmers' land ownership and access to resources. The study concluded that agricultural cooperatives formed by women in Baguineda had empowered them by significantly improving women's access and ownership of land and resources through increasing their incomes, negotiating with customary leaders, and lobbying local authorities during land disagreements.

本稿の目的は、社会的企業のマネジメントの独自性とその課題について、高齢者生協の事例を用いて明らかにすることにある。, This study clarifies the management characteristics observed in social enterprise through a case study of an Older Person's Co-operative., 本研究の一部はJSPS科研費15K03703の助成によっている。

途上国の農業融資制度は一般に未発達である。その原因のひとつに，情報の非対称性の下での信用審査の困難が挙げられる。本稿は，協同組合を中心に発展してきた戦前日本の農業金融制度のなかで，組合員のソフト情報（人格など）やハード情報（経済力など）を体系的に蓄積した『信用程度表』の役割に着目し，優良産業組合におけるその運用を詳細に検証する。分析の結果，地縁的関係に基づいて収集されるソフト情報は，ある程度有効活用されており，人格の優れた小農がより融資を受けやすくなっていたことが明らかになった。しかし，相対的にみると，資産など外部からの観察が容易なハード情報が，信用審査においてより重視されていたことも明らかになった。この結果は，『信用程度表』のような社会技術の存在によって，観察しにくいソフト情報が体系的に蓄積・可視化されたとしても，それだけでは，資産の乏しい小農向け農業融資が容易には進まないことを示唆している。

application/pdf, 「出資義務を課すと、持分があるものと想定される」との発想は、いわゆる公益法人制度改革でも強く意識されている。出資（にあたる財産の拠出）を義務づけた団体においては、団体財産に対する出資（拠出）者の持分があるものと解し、当該団体の事業維持の要請を実質的に検討しつつ、退社に伴う持分払戻をできるだけ認めるのが相当である。 旧民法に基づいて設立された（かつて出資を義務づけた）公益社団法人が、社員の退社時に出資の返還を拒むのには、積極的な理由づけを要する場合があると考える（出資を限度とする返還請求である場合には特に）。 脱退（退社）に伴う持分払戻請求を、定款によっても剝奪できない権利と解するかどうかは問いとして成立する。非営利性を形式的に捉え、演繹的に結論を導くのは妥当でない。定款変更が行われていたとしても、（かつて）義務づけた出資（拠出）は、基金として受け容れたものと解釈し、法人法第一四一条等を類推適用する余地があると考えたい。（長期）預り金といった定款規定を設けるのは、基金制度の利用と解することができ、法人法の基金制度の条文を類推適用するべき場合にかぞえられる。

2004年から毎年1本の法案を作成する自主講座「法案作成講座」を開催しているが、2013年は「エネルギー協同組合法案」を作成した。農業協同組合法をベースとしつつ、組合員間でのエネルギー供給に関する規制緩和、市町村による分散的エネルギー事業への支援措置、政策金融公庫資金を活用した低利融資などを盛り込んだものである。講座は、11月2日、12月6日、12月13日、12月20日の4日間にわたって、18:30-21:00という時間に東京・田町のキャンパスイノベーションセンターで行われた。参加者は一部参加を含め12名であった。

本論文では、人類が国民国家間の葛藤を乗り越え、相互理解と相互協力に基づく開かれた優しさの共同体を構築することは如何にして可能であるのかという問いを立てている。次に、本論文の論文構成の論理の流れを概観してみよう。１章の序では、この論文の目的と全体の論文構成について述べている。２章の世俗逃避的キリスト教平和主義では、世俗を避け、平和主義と相互扶助愛を実践しているプロテスタント宗派のアーミッシュとフッターライトを取り上げ、その共同体活動について論究している。これらの世俗逃避的共同体では、その共同体作りの理念を貫きやすいが、反面、外に対して閉鎖的な側面を持っている。３章では、この閉鎖性を克服し広げていくための試みとして、ガンジーの非暴力の農村連合政府構想と柳田国男の相互扶助精神に基づく協同組合的農村連合国家構想について論じている。4章の世俗内的キリスト教平和主義では、この開放性を更に進展させていく試みとして、プロテスタント宗派のクェーカーの開かれた共同体作りとその超国家主義的国連思想・ピューリタン系譜の思想家、賀川豊彦の世界協同組合思想と同じくピューリタン系譜の思想家、マックス・ヴェーバーの対外的農業政策思想と国際政治社会学的思想について論究している。5章では、この論文のまとめと現代の平和についての傾向性と今後の展望について述べ、その論述の結びとしている。本稿では、4章のクェーカー以降の箇所である賀川豊彦から論を説き起こし、マックス・ヴェーバーを経て、5章の結びまでを論じている。

[概要] 本稿ではジョン・スチュアート・ミルの協同組合に対する考え方をミルの代表的著作である『経済学原理』を中心に考察する。その著作においてミルは共同組織を資本主義改良の手段として考えていた。特に労働者階級が協同組合を組織することで自分の利益よりも組合全体の利益を考えるようになり, 依存的状況から自立化することで状況の改善がなされることを期待した。また労資協調的共同組織では資本家と労働者が協力して運営にあたり, 利潤を公平に分配することで労資間の状態を改善できると考えた。この様なミルの協同組合観は組合社会主義的であり非現実的要素が強いといえる。 [Abstract] In this paper, we study on John Stuart Mill's views of cooperative society in his works, especially Principles of political economy. In his works, he consider cooperative society as a means of reforming of capitalism. Mill expects working conditions to improve and become independent within an organized cooperative society. Mill thought that the fair division of profit improve the relationship between labour and management in a labour-management cooperative society. Therefore it might be said that Mill's view of cooperative society is associationist socialism.

Since 1991, policies of economic liberalization in Ethiopia have been effective in releasing the economy from rigid state control. At the same time, they have also exposed Ethiopian people to domestic and international free market competition. In African countries, the retreat of governments from rural development due to economic liberalization policies has led to the re-evaluation of the role of cooperatives. Since 1999, in Ethiopia, several coffee farmers cooperative unions have been established to support peasants who are handicapped by their lack of negotiating power in the global economy. Coffee cooperatives have become market-oriented and are now relatively democratic compared to the former Marxist cooperatives of the previous regime. Thus far, these coffee cooperatives have provided higher profits to coffee farmers than have private traders. The actual volume of purchase, however, is limited due to financial constraints. Because of this, the majority of cooperatives continues to rely on conventional marketing channels rather than on unions. Considering their weak financial condition, it is too early to judge the sustainability of the cooperatives because international prices have been high recently, and it is not yet clear how they would survive a downward international price trend.

In case of the creation of eco-villages, it should be taken into account that establishing consumer-owned electric cooperatives for power supply for the villages on renewable base. There are electric cooperatives in the Yakushima island, but it is exceptional in Japan. In the U.S., there are more than 900 electric cooperatives serving 37 million people and supplying 10% of total electricity sales in the US. Electric co-ops are forming decentralized power supply system in the rural areas. It is compatible with nature of renewable energy, then electric co-ops are actively promoting renewable energy, because the introduction of renewable energy contributes both environmentally and economically for the consumers in the rural areas. Electric co-ops are playing a significant role in the promotion of renewable energy in the US. The experiences of US electric co-ops are very suggestive for the introduction of decentralized sustainable power supply system into eco-villages in Japan., 協同組合,再生可能エネルギ-,持続性,エコビレッジ

21世紀の経済社会は,生態系持続の農・工・商複合化産業への転換が人類の基本的課題である。本論文は,その一環として食料政策の転換についてフードシステム論を重視して論考し,さらにNPO(広義)セクターの重要な一翼を占める協同組合の役割を「協同組合のアイデンティティに関するICA声明」を重視して総論的に考察している。食料政策は,政府が「市場に過度に任せる」施策を推進する場合は強者に有利で,弱者に不利に働き,社会的・経済的な公正さを歪め,そのしわ寄せは本格的に育成・支援すべき認定農業者等の先導的な担い手の意欲の後退や次世代づくりの弱体化,自然環境の劣化,さらに水田農業(用水の集落的・集団的管理による稲作農業)の育んできた日本文化のアイデンティティの衰退につながりかねない点を明らかにしている。すなわち,21世紀のフードシステムと持続型政策は,「市場メカニズムの進化」とともに「非市場的諸要素」である「地球規模での人間と自然のあり方,公正さ,生活価値,食農教育価値,健康増進価値」とバランスをとりながら,フードシステムのグローバル化と技術・経営革新の本来的進化を支援できる「行政改革と有機的・循環的評価システムの導入」が大きな課題である点を明らかにしている。, The economy and society in the 21st Century is encountering a basic human challenge in the change toward organic complex of agriculture, and industry and commerce for ecological sustainability. This paper examines the change of food policy based on food system theory and the function of the co-operative as an NPO based on the ICA Statement on the Co-operative Identity. This paper contends that the food system and ecological sustainable policy of the 21st Century is important not only in the evolution of market mechanisms but also non market factors which include equity, living values, agro-food educational values and the values for the improvement of health. In addition,the introduction of the assessment system of government reform and organic circulation system is important in globalization and innovation of technique and management.

わが国の協同組合は,経済的・社会的に非常に大きな役割を果たしている。しかし,法制度面から協同組合制度をみた場合には,いくつかの問題を内包している。本稿では,協同組合における法制度上の重要な問題の1つとして組合員有限責任制度を取り上げ,債権者保護の視点からこれを論じた。協同組合では株式会社と同じように組合員有限責任制度が法定されているが,株式会社に比べて債権者保護の点で十分とはいえない。債権者保護制度は有限責任制度を担保する重要な要素であるので,協同組合において組合員有限責任制度を維持するのであれば,債権者保護の充実を図る必要がある。, Co-operatives are very important as economic and social entities in Japan. However, they have a number problems in aspects of law and the legal side. In this study the author has taken up the limited liability system of co-partners in co-operatives as one major problem, and has descried it in relation to the protection of co-operative's creditors. The Co-operatives Laws have provided a limited liability system which is the same as the Commercial Code of Japan. However, the Co-operatives Laws can not adequately protect the co-operative's creditors in comparison with the Commercial Code of Japan. The protection system of the co-operative's creditors is very important to maintain the limited liability system. If we approve the limited liability system in the co-operatives, we require a more comprehensive protection system of creditors to the co-operatives than the present system.
