琉球大学の建学の精神は1951年に「自由・平等・寛容・平和」とされた。この琉球大学の建学の精神にもかかわらず本学では人権施策，特に性的マイノリティに対する施策が十分に行われていない。性的マイノリティにかんしては文部科学省が2015年に性的マイノリティの児童・生徒にかんする通知を出している。しかし先行研究では小中高の教員の性的マイノリティ生徒に対する理解が十分でなく，その一因として教員養成機関での性的マイノリティ関連の教育が不十分な点があげられている。本稿ではこのことにかんがみ，建学の精神を体現する優秀な教員を輩出するためにも性的マイノリティにかんする教職員研修が喫緊の課題であることを論じる。

論文, 本稿は、米国の人権運動とリベラル・カトリックの関係、人権問題・生命倫理とカトリックの世俗化の関係、そして、非カトリック信徒のモンデールがどうして協働していたのかを明らかにしたものである。そのために、ケネディ大統領以降、米国のリベラル ・ カトリックの有力者達と民主党の有力政治家のウォルター・モンデールが協働した事柄を時系列に追うことで、ケネディ大統領による人権擁護と自らの信仰を職務に持ち込まない姿勢（第1章）、生命倫理の世俗化（第2章）、1984年大統領選挙での女性初の副大統領候補の誕生（第3章）がその後どのような影響をもたらしたのか（第4章）を論じている。, This study examined the special relations between the Human Rights Movement and liberal Catholics, and the human rights/bioethics and the secularization of Catholic, as well as the reasons Walter Mondale cooperated with liberal Catholics and the matter in which he did so. Furthermore, this study defined President Kennedy’s human rights politics and an attitude that did not interpose the objections from Catholic hierarchy to his office (Sect.1), the secularization of bioethics (Sect.2), the birth of the first female vice-presidential candidate (Sect.3), and some influences (Sect.4). Finally, this study posits that there are certain affairs that indicate the relationship between some Liberal Catholics and Mondale.

application/pdf, 本稿で取り上げる東京地裁令和3年2月17日判決（平31(ワ)7514号）は，離婚後の単独親権を定めた民法の規定を改廃する立法措置を執らない立法不作為について国家賠償法上の違法性を否定した初めての判決である。本件は，日本人同士の日本での離婚により親権者とされなかった父親による訴えであり，事実関係に渉外性はないが，裁判上の離婚により親の一方のみが親権者として指定される離婚後の単独親権制度（民法819条2項）の改廃の必要性について，憲法13条，14条1項，24条2項のほか，自由権規約，児童の権利条約，子の奪取に関するハーグ条約といった国際条約の諸規定（ハーグ条約については条約の理念）を取り上げており，また，外国で離婚した父母の戸籍上では離婚後の共同親権が記載される現行の戸籍実務につき，外国裁判の承認による結果にすぎないと述べている点で，国際私法の観点からの検討に適うところがあると思われたため，判例研究として検討を行ったものである。

コンゴ民主共和国東部など紛争地域においては、企業は、深刻な人権侵害など、重大な悪影響に手を貸すことになったり、巻き込まれたりする危険にも晒されている。OECDは2011年に「紛争地域および高リスク地域からの鉱物の責任あるサプライチェーンのためのデュー・ディリジェンス・ガイダンス」を制定し、企業が紛争地域における人権侵害や紛争に手を貸してしまうことを回避するための枠組みを提示した。これを受け、米国及びEUでは、企業が使用する紛争鉱物が紛争地域において軍事組織に対し資金又は利益を与えていないかをデュー・ディリジェンスを用いて調査し、その結果を公表することを義務化する法規制が導入された。日本においては、法的措置は導入されていないが、企業の社会的責任（CSR）として紛争鉱物に関する調査が行われている。 本研究は、OECDガイダンスを基にした米国とEUの法規制が導入されることによって、コンゴ東部において紛争鉱物に係る人権侵害などにどのような影響を与えたのか、今後日本としての紛争鉱物に対しどのように取り組むべきかを明らかにすることを目的とする。 本研究では、紛争鉱物に関する米国とEU 規制の概要、これらに関する先行研究の概要をレビューした後、日本企業の紛争鉱物に対する取り組みの調査を行い、その成果を基に考察した。 日本では、紛争鉱物に関する法規制はなく、企業の社会的責任として自主的な取り組みがされているため、日本企業は欧米企業に比較して取り組みが遅れている可能性がある。このため、日本企業の紛争鉱物に関する取り組みを欧米企業と比較して客観的に評価するとともに、日本において紛争鉱物に関するデュー・ディリジェンスを法的義務化することを含め、今後の対策についての検討が強く望まれる、と結論付けた。

While heritage is important to all societies, Indigenous peoples and other minority peoples have long had little control over their heritage as a result of colonialism and other historical disruptions. This is further complicated by the fact that Indigenous conceptions of heritage are generally very different from those of the dominant population. In order to more fully protect and respect their heritage, which is essential to their identity, worldview and wellbeing, we must recognize two things: 1) that heritage must be viewed as an essential human right, and 2) that the disrespect for or loss of Indigenous heritage places must be viewed as a type of violence against people. Also discussed is the impact of cultural appropriation on Indigenous lives. The paper concludes by offering some general recommendations for addressing these challenges., 遺産はすべての社会にとって重要であるが、先住民族やその他の少数民族は、植民地主義やその他の歴史的破壊の結果、長い間遺産をほとんど管理することができなかった。さらに先住民族の遺産に対する概念は、一般に支配的な人々のそれとは大きく異なっており、この問題はさらに複雑化している。彼らのアイデンティティ、世界観、幸福にとって不可欠な遺産をより完全に保護し尊重するために我々は、以下の2点を認識しなければならない。1）遺産は本質的に人権と見なされなければならないこと、2）先住民族の遺産の場所を軽視したり失ったりすることは、人々に対する一種の暴力と見なされなければならないこと。また文化的流用が先住民族の生活に与える影響についても論じること。本論では、これらの課題に対処するためのいくつかの全体的な提言を行なっている。

本研究で、カンボジア農村部におけるSDGs エコビレッジに関するインタビュー調査と報告資料から次のことがわかった。農村部の人々の収入は低く、出稼ぎや貧困の問題がある。村の子ども達は高校までほとんど進学していない。都市部で就職するには高卒でないと厳しい現状がある。その観点から、村で産業が確立し、一定の収入を得ることができればそれらの問題を解消することに期待できる。SDGs エコビレッジは、学歴に関係なく職業訓練的な要素を持っている。さらに、近隣の14ある村において、今後中学校や高等学校の誕生にも可能性があり、将来的に子ども達の就職にもつながるだろう。SDGs エコビレッジの取り組みを、主に「1．貧困をなくそう」「4．質の高い教育をみんなに」「5．ジェンダー平等を実現しよう」「8．働きがいも経済成長も」「9．産業と技術革新の基礎をつくろう」「10．人や国の不平等をなくそう」「17．パートナーシップで目標を達成しよう」の項目との関連性についてまとめた。そして、今後も活動に注視し、持続可能な開発目標を目指していく中で、多くの可能性を模索することが必要であろう。, In this study, the following was found from interview surveys and report materials on SDGs ecovillages in rural Cambodia. Villagers have low incomes and have problems with migrant workers and poverty. The children in the village rarely go on to high school. It is difficult to get a job in an urban area unless you have a high school diploma. From that point of view, if the industry is established in the village and a certain amount of income can be earned, it can be expected that these problems will be solved. The SDGs Ecology Village has a vocational training element regardless of educational background. In addition, there is a possibility that junior high schools and high schools will be born in 14 neighboring villages in the future, which will lead to employment of children in the future.The efforts of the SDGs Ecology Village in this study are mainly "1. No Poverty", "4.Quality Education", "5. Gender Equality", "8. Decent Work and Economic Growth","9.Industry, Innovation and Infrastructure", "10. Reduced Inequalities", and "17.Partnerships". It will be necessary to continue to pay close attention to activities and explore many possibilities while aiming for sustainable development goals.

In formulating theories of global justice, some philosophers emphasise moral truth. They seek to identify principles of morality which must stand irrespective of people’s moral beliefs (what people believe to be morally true). Meanwhile, others also consider the actual circumstances which characterise the real world. Tim Hayward is one of the contemporary philosophers who have emphasised such worldly realities. His theory has not attracted much attention in Japan. But his contributions have been widely recognised in the European and the North American contexts. In this research note, I shall highlight several key elements which constitute Hayward’s theory of global justice: namely, his theory of human rights; his theory of systemic harm; his theory of global finance; and his theory of the state. In each element, worldly realities are taken to be of great importance. I shall close this note by listing the five worldly realities which Hayward has tried to integrate in the philosophy of global justice.

本研究の目的は，2017年にノルウェー研究視察で入手した学校教育に係る資料『基本原則－基礎教育の理念と方針』及び『小学校教員養成大学カリキュラム』について，共生・多様性の視点から内容を検討することにある。２つの資料のうち，ノルウェーの小学校から高校で適用されている『基本原則－基礎教育の理念と方針』は，日本における学習指導要領の性質をもったものであることが推察される。その内容からは，教育の土台に人権思想，多様性への理解があることが確認できた。加えて，ノルウェーが協働，対話，傾聴の機会をあらゆる場面に設定するなかで，違いを受け入れ，それを理解できる人を育成しようとしていることも捉えることができた。さらに，『小学校教員養成大学カリキュラム』では，大学教育の全科目にジェンダー，平等，多様性の視点が底流していること，また，学生の専門性を高めるために，多様性理解のための教育が継続的・長期的に行われていることが確認できた。, The purpose of this study was to examine from a viewpoint of coexistence and diversity the contents of the following materials concerned with school education, which were obtained while visiting Norway in 2017: The Basic Principles - The Ideas and Policies of Fundamental Education and The University Curriculum to Train Elementary School Teachers.Among the two materials, The Basic Principles - the Ideas and Policies of Fundamental Education applied from elementary school through high school in Norway seemed to have similar characteristics to Japanese Courses of Study. Its contents present that Norwegian education is based on the understanding to the concept of human rights and diversity. They also show that Norway actively tries to nurture people to accept and understand the differences among them by providing them in every situation the opportunities to cooperate with, to talk with and to listen to others.Furthermore, The University Curriculum to Train Elementary School Teachers revealed that viewpoints of gender, equality and diversity underlie every subject of the university education and that the continuous and long-term education aiming to understand diversity has been given to students to enhance their expertize.

This paper deals with the question, what this means for private enterprises, especially how the indirect effect of international law concerning the protection of human rights works on private business. ネット時代のいま、性教育は、既存の内容だけでは現実に追い付けなくなっている。子ども達の性意識や性行動が、ネット上に氾濫する性情報から大きな影響を受けていることを踏まえれば、性情報リテラシー教育にデジタル・シティズンシップ教育を盛り込む取り組みは急務といえる。本稿は、性教育をめぐる国際及び国内のガイドラインを参照し、性情報リテラシーとデジタル・シティズンシップに関する記述を検討した。また日本において、性情報リテラシー教育とデジタル・シティズンシップ教育を融合させる実践例を報告した。

本報告では、2019 年1 月27 日・2 月11 日に開催された大分大学公開講座「子どもアドボカシーって何だろう? - 子どもの声に寄り添うおとなになるための講座- 」が、児童の権利擁護という観点からどのような貢献を果たしえたのかについて検討し、今後の取組を展望することを目的とする。同講座は、子どもの権利擁護の必要性を意識するための導入として一定の成果を得たものの、実際の権利擁護のための仕組みを具体化するものとしては課題が残されている。今後、講座受講者が、受講後にどのような具体的な行動を起こしていたのかを含めた分析等も重要だと思われる。

In Nevsun Resources Ltd. v. Araya, a Canadian company which developed a mine in Eritrea through its subsidiaries was sued by Eritrean refugees for human rights abuses such as forced labor, torture, slavery, crimes against humanity, and cruel, inhuman, or degrading treatment. The Supreme Court of Canada did not exclude the corporation’s direct liability under customary international law. Multinational companies based in Japan can also be sued for human rights abuses committed by their subsidiaries. This article focuses on Nevsun Resources Ltd. v. Araya in order to explore the possibility of Japanese courts applying customary international law which imposes civil liability on corporations for human rights abuses. This article also focuses on the possibility of indirectly applying international treaties regarding human rights under the public order clause in private international law.

Since March 2020, the Act on Special Measures for Pandemic Influenza and New Infectious Diseases Preparedness and Response has been a significant statute in dealing with COVID-19 in Japan. The Act mandates requests and orders for business suspension and shortened business hours, as well as stay-at-home requests. Although there have been no penalties as of January 2021, these requests and orders limit freedom of movement and establishment, guaranteed rights under the Japanese Constitution. This article poses the following research question: "Does the Japanese Constitution allow measures against COVID-19 such as requests and orders for business suspension and shortened business hours, and stay-at-home requests?" It also asks: "Are measures with penalties allowed by the Constitution?" This paper introduces constitutional concepts that guarantee or limit individual freedom. Concepts that guarantee individual freedoms include freedom of establishment and movement. These freedoms derive from the constitutional values of freedom to choose one's occupation and choose and change one's residence (Art. 22) and the right to own or hold property (Art. 29). Concepts that limit individual freedom include the right to life (Art. 13), welfare rights and public health (Art. 25), and public welfare (Art. 13). Individual freedom that threatens right to life, welfare rights and public health, and public welfare may not be guaranteed. This paper argues that since measures against COVID-19 are considered public welfare, the Constitution allows the limiting of freedom of establishment and movement. Furthermore, from the perspectives of the right to life, welfare rights, and public health, the government is responsible for reducing the risk to life from COVID-19. It also argues that the Constitution permits measures with penalties, while proportionality needs to be considered.

For more than twenty years North Korea’s nuclear development and human rights abuses have concerned the international society, particularly the United States, South Korea, and Japan. After the UN Commission of Inquiry on Human Rights in the DPRK released its report in 2014, concerns about human rights in North Korea entered a new phase in relation to Northeast Asia’s multilateral cooperation and inter-Korean relations. Multilateral cooperation on the Korean peninsula and in Northeast Asia, however, has not reached any kind of consensus for improving the condition of human rights in North Korea. This paper reviews the past twenty years of multilateral and bilateral efforts to tackle the problem of North Korean human rights and analyses the disputes between conservatives and progressives regarding South Korea’s policy toward North Korea.

本稿は、地震などの天災の際に登場する法が停止する(もしくは、「特別法」が施行される)非常事態における人権概念の根拠(法源)を、ヴァルター・ベンヤミンとカール・シュミットの思想を取り上げながら検討したものである。ここで、私は、国家を法制度や主権を超えた存在であると考えるシュミットの思考を、法の停止状態の内部において自らの生存の根拠となる予言を探るベンヤミンの思考の参照項として設定している。また、ベンヤミンの思考について、占星術あるいは予言といった従来のベンヤミン研究においてはあまり注目されなかった側面に光を当てている。この作業を通じて、私が問いたいのは、非常事態における人権(生存権・所有権)を、先取り的に保障したり、事後的に救済したりすることによって、すぐさまに「原状回復」できる国家福祉論において語ること自身が帯びる暴力性、ということである。これは、自然災害の多発、難民の拡大などといった、決して今に始まったことではない、非常事態の常態化にかかる緊喫の世界史的課題と言えるのではないだろうか。

フランスでは，一般に憲法院が法律の憲法適合性審査を通じて憲法上の権利の保障を担うと理解されているが，最高行政裁判所であるコンセイユ・デタ訴訟部は憲法院の創設以前から適法性審査によって憲法及び法律上の権利の裁判的保障を担ってきた。本稿は，憲法上の権利の解釈にかんする憲法院とコンセイユ・デタ訴訟部の相互作用を探求する研究の端緒として，主にコンセイユ・デタ訴訟部による憲法適合性審査を通じた憲法上の権利の裁判的保障について分析する。

This article is a study about historical transition of trends of social education practices, especiallyfocusing on social exclusion and inclusion. This study uses a magazine, Gekkan Syakaikyouikuas material, which is one of the leading journals for social education practice. Theanalytical perspective rely on Suzuki (2006). According to him, social exclusion is based on 4types of alienation: ① alienation from abilities as human ② alienation from vigor activities andlabor ③ alienation from products ④alienation from human relations. Adopting this point of view,this study tries to reveal what kind of alienation social education in each period tackled.The findings are as follows. In 195060s, social education aimed at people in rural area, whowere considered alienated from abilities as human and products. In 1970s, it began to aim aturban people especially children, who were alienated from abilities as human, vigor activities andlabor, and human relations. That trend was related to self-reflection of urban people. In 1980s,Academicians tried to connect social education and the word “human rights”. The word includedthe meaning of tackle to all 4 types of alienation. But the mainstream of social education practicesin this period were not trending to human rights issues.

本研究は，これまで実施してきた共生・人の多様性理解を深めるユニバーサルデザイン授業にアセスメントの手法を取り入れることで，教員養成系大学の家政教育における授業改善へつなげる示唆を得ることを目的とする。具体的には，授業デザインにおけるアセス メントのための指標を作成し，授業実施の前後に指標の知識・意識調査を行い，授業直後にはワークシートに感想を記述させた。２時間という限られた授業時間であっても，身近な生活用品と社会環境の映像を切り口にした本授業を通して，共生・人の多様性理解を図り，自分も「多様な人・多様な存在」であるという当事者意識を育む可能性，公平意識を引き出すことを確認できた。

本校の生徒は，非常に落ち着いており学習意欲が高い。また，学校生活の中では，自分の意見を持ち，他者にしっかりと伝えることができる。さまざまな学校行事においては，リーダーシップを発揮して学級や学年をまとめ，自分たちで行事を成功させようとする姿勢がみられる。その反面，自分本位な価値観で人と関わってしまう場面が多くみられ，他者の気持ちを推し量りながら関わることができない生徒が多い。 一昨年度は平和学習や異文化理解，昨年度は障害者理解を中心に人権学習の実践がされてきた。本年度も一昨年度，昨年度と，異文化理解について継続して学習させてきたことを踏襲する。それに加え，本校の生徒の実態を鑑みながら，情報通信機器の高度化やSNSなどの発展により，情報を発信する側になることが多くなり，インターネットを介したいじめも増加傾向にあることから，本校でも具体的な取り組みが必要となっている。

application/pdf, 法律学（立法、裁判等の法実務を含む）は利益対立に関わる社会事象についての解説等にとどまる記述学ではなく、社会的紛争を予防するとともに、その実効的解決をもたらす実践学でなければならない。クリムトの有名な絵画（ウィーン大学の天井画）に代表されるが、法律学が医学と対置される所以はこの実践面の強調という点にある。 一国内でのミクロ的紛争に限れば、実効的解決をもたらし得る現代の法律学も、資源エネルギー、食糧、環境保全等の確保といった全地球的課題に関わる企業・国家間の、また国家間の紛争解決にあたってはほとんど機能していない。 小稿は、著名なシェヴロン対エクアドル事件を素材として、これまでの法律学における問題点を具体的に示しつつ、他方で、新たに構想されるべき地球社会法学の在り方を提言したものである。

日本で初めて総合大学の福祉系学部・大学院としてウェルビーイングをその理念に掲げて、2000年 4 月に誕生した法政大学現代福祉学部と同大学院人間社会研究科を取り上げ、そこで行われてきた教育と研究の現状を考察した。具体的にはその学部・大学院の中で、一見、マイナーな学問領域と捉えがちな歴史・文化分野の科目に焦点をあて、その分野の学びと研究の成果を検証した。 その結果、学部における歴史・文化の講義などでは一定の成果を上げ、大学院では修士課程・博士後期課程においてその分野の研究で学位授与者を輩出し研究成果が上がっていたことが明らかになった。そのような状況から歴史・文化分野の学びと研究が「人権」という問題を考えていく上で極めて有効であり、その歴史・文化分野については、21世紀の新しい福祉学を切り拓く学問領域からのアプローチとして継続的にその教育と研究が進められていくことの必要性を指摘した。

ハンセン病は通常の病気とは異なり、たとえ完治したとしても、外的な障害が残れば、杜会的に差別の対象になることもある。事実、世界に数千万存在するといわれるハンセン病回復者のうち、依然低い生活水準での生活を余儀なくされている人々も数多く存在する。ハンセン病の最大蔓延国であるインドでは、近年ハンセン病回復者自らが主導し、複数の州政府と交渉した結果、彼らの生活水準向上のための手段の一つとして、重度の障害を持つ回復者を対象とする「特別年金制度」の創設に成功している。現在は、少なくともデリー首都圈、ハリヤーナー州、ビハール州、ウッタラカンド州、タミル・ナードゥ州、マハーラーシュトラ州、ウッタル・プラデーシュ州、マディヤ・プラデーシュ州、チャティスガル州、オディシャ州で同制度が実施・検討されている。特別年金制度が創設されることにより、物乞いなどで生計を営むハンセン病回復者の生活状況の改善に寄与することは事実である。また、この制度が当事者自らの働きかけにより、各地で実現していることにも犬きな意義がある。一方で、既存の制度に関する運用状況の適切な評価、他州への制度の普及、ハンセン病コロニーではなく一般社会に在住している回復者への制度の適用、回復者の生活環境改善に寄与するためのさらなるアプローチの検討などの課題があることも事実である。
