A series of regulations envisaged by the New Consumer Agenda announced by the European Union Commission in November 2020 included also various measures to combat planned obsolescence. The proposal, which the Commission announced to the public on March 30, 2022 in line with the Agenda, consists of proposals for changes regarding planned obsolescence, in the regulations on unfair commercial practices, consumer rights and ecodesign law. This study focuses on the ones proposed in the Unfair Commercial Practices Directive and the Consumer Rights Directive. Within this framework, it has been seen that the main change proposed to be made is the inclusion of explanations regarding the durability and reparability of the product within the scope of the consumer’s right to receive information. On the other hand, instead of acknowledging planned obsolescence as one of the unfair commercial practices, misleading information or misleading omission about planned obsolescence on products at the point of sale have been included in the per-se prohibitions. The Guidance on the Interpretation and Application of the Unfair Commercial Practices Directive published in December 2021 also includes explanations as to how planned obsolescence should be evaluated.
