Copyright plays a central role in numerous activities within higher education, and educating a university community about copyright law should be a priority, if only to protect the institution from lawsuits. But, based upon a literature review, institutions devote a more resources to other intellectual property activities - plagiarism detection, technology transfer and illegal file sharing management - than for general copyright education activities. Utilizing Mintzberg's organizational model and its discussion of organizational placement and legitimacy as a conceptual framework, this study explores the current copyright education structures among the universities that comprise the Consortium on Institutional Cooperation, otherwise known as the CIC or the Big Ten, to determine whether organizational placement, credentials of individuals, and resources devoted to this activity affect the legitimacy of the office and the authority of copyright officers to fulfill their responsibilities. The results of this study suggest that organizational placement, while it plays a role, is not nearly as important as the credentials of the individual in the position in conveying legitimacy. Copyright and special collections share an intimate relationship gone awry. This article explores copyright principles, their underpinnings and origins in the United States, and contemporary applications of them. The contemporary limits impose unreasonable barriers to the widespread sharing of special collections and reflect unnecessarily broad protections of and limits on an enormous range of creative works regardless of the social consequences of that protection or any demonstrable inherent or remaining economic value in those works. UK and Ireland Zine Librarians began as a small JiscMail list created to share resources, skills, and advice for all zine librarians regardless of professional status or job title. While our US counterparts had already made great strides regarding acquisitions, cataloguing, and copyright guidance, UK and Irish zine libraries were still grappling with some of the more basic elements and finding ways to adapt these ideas to our own collections. How can institutional librarians and DIY community grassroots collections learn from each other? What happens when libraries begin to use ILL to request items that they already own in their home collection? The goal of this multiyear study involving 9565 ILL requests to the Joint Library Facility in Bryan, Texas, is to examine whether or not the shared storage facility was becoming an ILL hub for some libraries. This paper reports the results of the study and how individual requesting and lending interlibrary loan policies and procedures might be altered to address these developing issues. Cultural heritage institutions increasingly consider Creative Commons licences as a useful model for overcoming the barriers created by traditional copyright frameworks and for opening up archives, databases and collections for public use. However, there is little empirical evidence to support this claim. This article therefore focuses on the use of Creative Commons among cultural heritage institutions in Flanders (the northern part of Belgium) and presents the results of two sector surveys held in 2008 and 2012. Using two data points, the study provides an overview of the evolution of the use of Creative Commons and reveals the copyright policies of cultural heritage institutions. [ABSTRACT FROM AUTHOR]

This article explores copyright law and issues of fair use in for-profit academic libraries. For-profit academic institutions are seeing a steady increase in applicants and enrollment, and libraries related to these institutions exist in a legal gray area in terms of copyright law, specifically with regard to fair use. The law must be more clearly defined and applied with regard to these institutions, so that academic librarians can adequately enforce copyright laws and fair use within the confines of the for-profit academic library scheme. This paper presents the results of a survey of 110 ARL institutions regarding their copyright policies for providing electronic reserves. It compiles descriptive statistics on library practice as well as coding responses to reveal trends and shared practices. This article recommends that the UK Higher Education Funding Councils adopt a policy requiring that they will in future only consider outputs that are available under a Creative Commons licence when assessing the quality of UK academic research. Such a policy would offer many benefits for universities, for researchers, and for society at large. Although incidentally such a policy would reduce costs for libraries, the primary reason for the recommendation is to benefit society at large. The article discusses U.S. copyright laws and the impact of an individual's substantial compliance with copyright exceptions on the fair use doctrine as of April 2012, focusing on an analysis of the legislative history of the nation's Copyright Act, as well as an assessment of the relationship between fair use and the other copyright law exceptions. The application of the fair use exception to American library and education practices and procedures is mentioned, along with digital copies.
