Key to Brooks's vision is the government's clear signal that it understands the magnitude of the atrocity it committed against an innocent people, that it takes full responsibility, and that it publicly requests forgiveness—in other words, that it apologizes. The government must make that apology believable, Brooks explains, by a tangible act that turns the rhetoric of apology into a meaningful, material reality, that is, by reparation. Apology and reparation together constitute atonement. Atonement, in turn, imposes a reciprocal civic obligation on black Americans to forgive, which allows black Americans to start relinquishing racial resentment and to begin trusting the government's commitment to racial equality. Brooks's bold proposal situates the argument for reparations within a larger, international framework—namely, a post-Holocaust vision of government responsibility for genocide, slavery, apartheid, and similar acts of injustice. Atonement and Forgiveness makes a passionate, convincing case that only with this spirit of heightened morality, identity, egalitarianism, and restorative justice can genuine racial reconciliation take place in America.

Race in the Jury Box focuses on the racially unrepresentative jury as one of the remaining barriers to racial equality and a recurring source of controversy in American life. Because members of minority groups remain underrepresented on juries, various communities have tried race-conscious jury selection, termed'affirmative jury selection.'The authors argue that affirmative jury selection can insure fairness, verdict legitimization, and public confidence in the justice system. This book offers a critical analysis and systematic examination of possible applications of race-based jury selection, examining the public perception of these measures and their constitutionality. The authors make use of court cases, their own experiences as jury consultants, and jury research, as well as statistical surveys and analysis. The work concludes with the presentation of four strategies for affirmative jury selection.

There is a unique constitutional relationship between Aboriginal people and the Canadian state – a relationship that does not exist between other Canadians and the state. It's from this central premise that Patrick Macklem builds his argument in this outstanding and significant work. Why does this special relationship exist? What does it entail in terms of Canadian constitutional order? There are, Macklem argues, four complex social facts that lie at the heart of the relationship. First, Aboriginal people belong to distinctive cultures that were and continue to be threatened by non-Aboriginal beliefs, philosophies, and ways of life. Second, prior to European contact, Aboriginal people lived in and occupied North America. Third, prior to European contact, Aboriginal people not only occupied North America; they exercised sovereign authority over persons and territory. Fourth, Aboriginal people participated in and continue to participate in a treaty process with the Crown. Together, these four social conditions are exclusive to the Aboriginal people of North America and constitute what Macklem refers to as indigenous difference. Exploring the constitutional significance of indigenous difference in light of the challenges it poses to the ideal of equal citizenship, Macklem engages an interdisciplinary methodology that treats constitutional law as an enterprise that actively distributes power, primarily in the form of rights and jurisdiction, among a variety of legal actors, including individuals, groups, institutions, and governments. On this account, constitutional law refers to an ongoing project of aspiring to distributive justice, disciplined but not determined by text, structure, or precedent. Far from threatening equality, constitutional protection of indigenous difference promotes equal and therefore just distributions of constitutional power. The book details constitutional rights to Aboriginal people that protect interests associated with culture, territory, sovereignty, and the treaty process, and explores the circumstances in which these rights can be interfered with by the Canadian state. It also examines the relation between these rights and the Canadian Charter of Rights and Feedoms, and proposes extensive reform of existing treaty processes in order to protect and promote their exercise. Macklem's book offers a challenge to traditional understandings of the constitutional status of indigenous peoples, relevant not only to Canadian debates but also to those in other parts of the world where indigenous peoples are asserting greater autonomy over their collective futures.

For well over a decade, critical race theory—the school of thought that holds that race lies at the very nexus of American life—has roiled the legal academy. In recent years, however, the fundamental principles of the movement have influenced other academic disciplines, from sociology and politics to ethnic studies and history. Twice denied admission to a California medical school despite better grades and test scores than successful minority applicants, Allan Bakke took his grievance to court and set off a major controversy over affirmative action. Bakke claimed that he was a victim of reverse discrimination, and his case has been considered by many as the most important civil rights decision since the end of segregation—and also one of the most difficult ever heard by the Supreme Court.Howard Ball now reviews the many issues raised by this case that placed affirmative action on trial. African Americans have experienced life under the rule of law in quite different contexts from those of whites, and they have written about those differences in poems, songs, stories, autobiographies, novels, and memoirs. This book examines the tradition of American law as it appears in African American literary life, from pre-Revolutionary murder trials to gangsta rap. The experience, and the critique it produces, changes our pictures of both American law and African American literature. This study reads the already canonical works of nineteenth- and twentieth-century black literature in the context of their responses to and critiques of American legal history. At the same time, it examines little known texts of African American life, from the urban humor of James D. Corrothers, through the early political essays of Chester Himes, to the adventures of black comic book heroes like Steel, Wise Son, and Xero. These are contextualized within specific legislation and case law, from the slave laws of early Virginia to the Civil Rights Act of 1964, from the case of Phillis and Mark in 1755 to the Simpson trials of the mid 1990s. Finally, the legal texts presented are themselves critiqued by the fictions and legal analyses of the African Americans who lived out their implications in their daily lives. Through a positing of the legal and cultural concepts of privacy, property, identity, desire and citizenship, and the romantic ideals of authenticity, irony, and innocence, Suggs is able to show how our understanding of American law should be influenced by African American conceptions of it as depicted through literature. In this insightful book, he uses his experiences as a mixed Latino Anglo to examine issues of diversity, assimilation, race relations, and affirmative action in the contemporary United States. Johnson also grew up in the borderlands between classes. He spent his childhood with his mother, first on welfare and then with a racist working-class stepfather. As an adolescent, he moved to his father's home in a predominantly upper-middle-class suburb. His educational experiences too extend from a racially mixed elementary school to an all-white high school, and from Berkeley to Harvard Law School. From this vantage point, he analyzes the intersection of race and class in the United States. This book looks not just at the question'Who is a Latino?'but also at the question of where persons of mixed Anglo-Latino heritage fit into the racial dynamics of the United States.
