Abstract

Die Freizugigkeit der Arbeitnehmer war die erste Vereinbarung, die 1957 durch den Vertrag von Rom in Bezug auf den freien Verkehr von Personen eingefuhrt wurde. Diese Masnahme verfolgt das wirtschaftliche Ziel, die freie Zirkulation von Produktionsfaktoren innerhalb eines Binnenmarkts ohne Grenzen zu ermoglichen. Seit seinen ersten Urteilen hat der Europaische Gerichtshof einen ‚autonomen Begriff’ des Arbeitnehmers entwickelt, d.h. eine gemeinschaftsrechtsspezifische Definition, die fur jedes Arbeitsverhaltnis mit auslandischem Element gilt, sowohl hinsichtlich des Zugangs des Arbeitnehmers zum Arbeitsmarkt eines Mitgliedstaats als auch hinsichtlich seiner Rechte. In diesem Beitrag soll aufgezeigt werden, wie der Gerichtshof der Europaischen Union durch eine teleologische Auslegung, die darauf abzielt, den wirtschaftlichen Zielen der Vertrage Vorrang zu geben, den Begriff des Arbeitnehmers von der Person des Arbeitnehmers selbst und dem Arbeitsverhaltnis nach und nach abgekoppelt hat. Der Begriff des Arbeitnehmers stellt letztlich ein wirtschaftliches Instrument dar, das beispielsweise die Beibehaltung des Rechts auf Fortsetzung der Ausbildung der Kinder des Arbeitnehmers nach seiner Ausreise aus dem Hoheitsgebiet des Mitgliedstaats und die Gewahrung des Aufenthaltsrechts an den geschiedenen Ehegatten mit Sorgerecht erlaubt, auch wenn dieser keine wirtschaftliche Tatigkeit ausubt.

Abstract

This study focuses on the mechanical behaviour and performance of connections in the timber gridshells. Two different forms of timber beams are used, the first was consisting of timber beam of gridshells without connection, and the second was with steel connection that was fabricated by the Quaternion company in France. These two forms of timber beams are those most widely used as a main beams in gridshells structures. In this paper, an experimental investigation of large-scale timber beam of the gridshells with dimensions (2.8m length) are used. The timber beams were tested under four-points flexural test at the laboratory of LMDC in Toulouse. Abstract

The in situ (U‐Th‐Sm)/He and U/Pb laser‐ablation double‐dating procedure is a valuable method that can provide a large dataset relatively efficiently in contrast with conventional bulk helium thermochronometry. In this study, we evaluate the potential age error associated with the double ablation procedure and report the in situ (U‐Th‐Sm)/He double‐ablation dating of 249 zircons from the Fish Canyon Tuff locality. With LA‐ICP‐MS pseudo‐depth profiling and 3D numerical modelling, we show that the concentric double‐ablation procedure in minerals with U‐Th‐Sm zoning can generate a significant (U‐Th‐Sm)/He age error (positive or negative), resulting in over‐scattering and/or an offset of the mean age. Pseudo‐depth profiling is insufficient to predict the individual age error, partly because of the superimposed ablations. To evaluate the consequence of this inherent bias, we confront a synthetic age distribution to the error expected for U‐Th‐Sm zoned zircons analysed with double‐ablation (U‐Th‐Sm)/He thermochronometry. As expected, a strong age bias causes the spreading of peak ages, downgrading the original signal. Yet, the throughput of the ablation‐based method can allow intra‐ and inter‐sample peak age identification and comparison, and the coupling of (U‐Th‐Sm)/He and U/Pb ages extends our ability to deconvolute a multimodal age spectrum. Abstract

The Beauvoir granite (Massif Central, France) represents an exceptional case in the European Variscan belt of a peraluminous rare-metal granite crosscutting an early W stockwork. The latter was strongly overprinted by rare-metal magmatic-hydrothermal fluids derived from the Beauvoir granite, resulting in a massive topazification of the quartz-ferberite vein system. This work presents a complete study of primary fluid inclusions hosted in quartz and topaz from the Beauvoir granite and the metasomatized stockwork, in order to characterize the geochemical composition of the magmatic fluids exsolved during the crystallization of this evolved rare-metal peraluminous granite. Microthermometric and Raman spectrometry data show that the earliest fluid (L1) is of high temperature (500 to >600°C), high salinity (17–28 wt.% NaCl eq), and Li-rich (Te100 m) and interaction with external fluids.

Abstract

Magnetic nanoparticles such as FePt in the L10 phase are the bedrock of our current data storage technology. As the grains become smaller to keep up with technological demands, the superparamagnetic limit calls for materials with higher magnetocrystalline anisotropy. This, in turn, reduces the magnetic exchange length to just a few nanometers, enabling magnetic structures to be induced within the nanoparticles. Here, we describe the existence of spin-wave solitons, dynamic localized bound states of spin-wave excitations, in FePt nanoparticles. We show with time-resolved x-ray diffraction and micromagnetic modeling that spin-wave solitons of sub–10 nm sizes form out of the demagnetized state following femtosecond laser excitation. The measured soliton spin precession frequency of 0.1 THz positions this system as a platform to develop novel miniature devices.

Abstract

The advent of X-ray free-electron lasers (XFELs) has revolutionized fundamental science, from atomic to condensed matter physics, from chemistry to biology, giving researchers access to X-rays with unprecedented brightness, coherence and pulse duration. All XFEL facilities built until recently provided X-ray pulses at a relatively low repetition rate, with limited data statistics. Here, results from the first megahertz-repetition-rate X-ray scattering experiments at the Spectroscopy and Coherent Scattering (SCS) instrument of the European XFEL are presented. The experimental capabilities that the SCS instrument offers, resulting from the operation at megahertz repetition rates and the availability of the novel DSSC 2D imaging detector, are illustrated. Time-resolved magnetic X-ray scattering and holographic imaging experiments in solid state samples were chosen as representative, providing an ideal test-bed for operation at megahertz rates. Our results are relevant and applicable to any other non-destructive XFEL experiments in the soft X-ray range.

Abstract

Femtosecond optical pumping of magnetic materials has been used to achieve ultrafast switching and recently to nucleate symmetry-broken magnetic states. However, when the magnetic order parameter already presents a broken-symmetry state, such as a domain pattern, the dynamics are poorly understood and consensus remains elusive. Here, we resolve the controversies in the literature by studying the ultrafast response of magnetic domain patterns with varying degrees of translation symmetry with ultrafast x-ray resonant scattering. A data analysis technique is introduced to disentangle the isotropic and anisotropic components of the x-ray scattering. We find that the scattered intensity exhibits a radial shift restricted to the isotropic component, indicating that the far-from-equilibrium magnetization dynamics are intrinsically related to the spatial features of the domain pattern. Our results suggest alternative pathways for the spatiotemporal manipulation of magnetism via far-from-equilibrium dynamics and by carefully tuning the ground-state magnetic textures.

Abstract

The paper investigates the Hoeffding-Sobol decomposition of homogeneous co-survival functions. For this class, the Choquet representation is transfered to the terms of the functional decomposition, and in addition to their individual variances, or to the superset combinations of those. The domain of integration in the resulting formulae is reduced in comparison with the already known expressions. When the function under study is the stable tail dependence function of a random vector, ranking these superset indices corresponds to cluster the components of the random vector with respect to their asymptotic dependence. Abstract

Background Fibrotic Interstitial lung diseases (ILD) are a heterogeneous group of chronic lung diseases characterized by diverse degrees of lung inflammation and remodeling. They include idiopathic ILD such as idiopathic pulmonary fibrosis (IPF), and ILD secondary to chronic inflammatory diseases such as connective tissue disease (CTD). Precise differential diagnosis of ILD is critical since anti-inflammatory and immunosuppressive drugs, which are beneficial in inflammatory ILD, are detrimental in IPF. However, differential diagnosis of ILD is still difficult and often requires an invasive lung biopsy. The primary aim of this study is to identify volatile organic compounds (VOCs) patterns in exhaled air to non-invasively discriminate IPF and CTD-ILD. As secondary aim, the association between the IPF and CTD-ILD discriminating VOC patterns and functional impairment is investigated. Methods Fifty-three IPF patients, 53 CTD-ILD patients and 51 controls donated exhaled air, which was analyzed for its VOC content using gas chromatograph- time of flight- mass spectrometry. Results By applying multivariate analysis, a discriminative profile of 34 VOCs was observed to discriminate between IPF patients and healthy controls whereas 11 VOCs were able to distinguish between CTD-ILD patients and healthy controls. The separation between IPF and CTD-ILD could be made using 16 discriminating VOCs, that also displayed a significant correlation with total lung capacity and the 6 min’ walk distance. Conclusions This study reports for the first time that specific VOC profiles can be found to differentiate IPF and CTD-ILD from both healthy controls and each other. Moreover, an ILD-specific VOC profile was strongly correlated with functional parameters. Future research applying larger cohorts of patients suffering from a larger variety of ILDs should confirm the potential use of breathomics to facilitate fast, non-invasive and proper differential diagnosis of specific ILDs in the future as first step towards personalized medicine for these complex diseases.
