JUDICIAL review , *RULE of law -- Social aspects , *BUSH v. Gore - Abstract
The article discusses the value of judicial review and the American attitude towards the dicta of the U.S. Supreme Court, as is reported in "Making Our Democracy Work: The Yale Lectures," by Stephen Breyer in the June 2011 issue of "The Yale Law Journal." Breyer raises the 2000 U.S. Supreme Court ruling "Bush v. Gore" that stopped the recount of votes in Florida in order to illustrate the acceptance of judicial authority in the U.S. Breyer warns judges not to take judicial review for granted.
