Voor de oplegging van tbs is vereist dat de dader aan een stoornis lijdt en recidivegevaarlijk is. De aanname dat daders die aan een stoornis lijden in het algemeen een bijzonder recidivegevaarlijke groep vormen, wordt echter niet bevestigd door empirisch onderzoek. Dat doet de vraag rijzen in hoeverre het gerechtvaardigd is om alleen verdachten met een stoornis voor tbs in aanmerking te laten komen. Ook is daardoor de vraag of de tbs haar beveiligingsdoelstelling voldoende kan waarmaken. In dit artikel worden drie richtingen geschetst om onderzoek naar de wenselijkheid en normering van een alternatieve preventieve vrijheidsbenemende maatregel vorm te geven.

Prison is by its nature a deliberately impoverished environment, with few physical, mental and social activities. Various studies have shown negative effects of an impoverished environment on animal as well as human brain functions. A recent study in a Dutch remand prison showed that brain functions connected with self-regulation decline after 3 months of imprisonment. Reduced self-regulation appears to be a risk factor for recidivism. In this article, we examine the legal implications of these neuropsychological findings in a European context. Firstly, we analyse these results in the light of the principle of rehabilitation as interpreted in case law of the European Court of Human Rights. Secondly, we explore how the neuropsychological insights could be relevant in the context of the prohibition of torture, inhuman and degrading treatment (Article 3 of the European Convention on Human Rights (ECHR)). We argue that if the impoverished prison environment hampers rehabilitation, states are positively obliged to take appropriate measures to counter these effects. Ultimately, negative effects on brain functioning by impoverished prison environments could even raise an issue under Article 3 ECHR. Furthermore, we argue that neuropsychological insights have to be taken into account when establishing the threshold according to which the European Court on Human Rights judges prison conditions. We conclude that in the light of these considerations further research on the neuropsychological effects of the prison environment is required.

Background: Forensic psychiatric practices and provisions vary considerably across jurisdictions. The diversity provides the possibility to compare forensic psychiatric practices, as we will do in this paper regarding Italy and the Netherlands. Aim: We aim to perform a theoretical analysis of legislations dealing with the forensic psychiatric evaluation of defendants, including legal insanity and the management of mentally ill offenders deemed insane. This research is carried out not only to identify similarities and differences regarding the assessment of mentally ill offenders in Italy and the Netherlands, but, in addition, to identify strengths and weaknesses of the legislation and procedures used for the evaluation of the mentally ill offenders in the two countries. Results: Italy and the Netherlands share some basic characteristics of their criminal law systems. Yet, forensic psychiatric practices differ significantly, even if we consider only evaluations of defendants. A strong point of Italy concerns its test for legal insanity which defines the legal norm and enables a straightforward communication between the experts and the judges on this crucial matter. A strong point of the Netherlands concerns more standardized practices including guidelines and the use of risk assessment tools, which enable better comparisons and scientific research in this area. Conclusions: We argue that there appears to be room for improvement on both sides with regards to the evaluation of mentally ill offenders. More generally, a transnational approach to these issues, as applied in this paper, could help to advance forensic psychiatric services in different legal systems.

Als verdachten weigeren mee te werken aan het onderzoek pro Justitia kunnen gedragsdeskundigen soms geen stoornis vaststellen, hetgeen aan tbs-oplegging in de weg kan staan. Dit acht de Minister voor Rechtsbescherming onwenselijk en hij wil in de wet expliciteren dat voor tbs-oplegging een juridisch stoornis concept geldt, dat ruimer is dan het medisch stoornisbegrip. Dat wil zeggen dat voor de vaststelling van een psychische stoornis geen medische diagnose zou zijn vereist. In dit artikel wordt ingegaan op enkele knelpunten die door de aangekondigde wetswijziging kunnen ontstaan. Deze hebben betrekking op artikel 5 lid 1 onder e EVRM, de verdedigingspositie van verdachten en de consistentie tussen oplegging en tenuitvoerlegging van de tbs. Vanwege deze knelpunten zouden volgens de auteurs ook andere voorstellen moeten worden onderzocht om de samenleving te beschermen tegen gevaarlijke personen van wie geen psychische stoornis kan worden vastgesteld door de gedragsdeskundige.

De snelle ontwikkeling van artificiële intelligentie werpt een aantal prangende vragen op voor strafrecht-juristen en forensisch gedragsdeskundigen. Risicotaxatie met behulp van AI heeft de potentie om een relatief betrouwbaar middel te worden om inschattingen van recidivegevaar te maken. Een belangrijk vraagpunt is tot hoeveel vals-positieven (precision) en vals-negatieven (recall) de inschatting leidt. Door de ‘kosten’ van verschillende fouten te bepalen en in het algoritme te verwerken, kan het belang van de maatschappelijke veiligheid worden afgewogen tegen het belang dat burgers niet ten onrechte door strafrechtelijk ingrijpen moeten worden getroffen. Een tweede vraagpunt is hoe omgegaan moet worden met biases. Er zijn technische manieren om vooroordelen in de algoritmes tegen te gaan, maar daarbij moet wel de normatieve vraag onder ogen worden gezien hoe dat op een rechtvaardige wijze kan gebeuren. Ten derde zijn AI-algoritmes relatief ondoorzichtig, waardoor zij niet altijd mogelijkheden aanwijzen voor interventies die gericht zijn op rehabilitatie van de veroordeelde.

The insanity defence is intensely debated. On one side, it is considered an expression underlying the practical motivations (Robinson, 1998) and the moral integrity (Meynen 2016) of the criminal law. On the other side, the very existence and the specific components of this defence have been criticised (Meynen, 2016). A recent legal ethical debate has focussed on the issue whether the mental illness clause should be included in the formulation of the insanity defence (Slobogin, 2015). Several formulations of the legal criteria for the insanity defence contain, in fact, two elements (Simon & Ahn- Redding, 2006). One is the presence of certain incapacities when committing the act. Let us call it the incapacity clause. The other is the mental illness clause that requires that these exculpatory incapacities are due to a mental illness (or disorder or disease). In this paper we offer a balanced argument to motivate (re-)thinking about the mental illness clause in the insanity defence. We maintain that we should not take for granted that the insanity defence includes an illness clause. Depending on other safeguards in a legal system, we argue that a balanced decision should be made to either include or exclude the clause. However, our main line of argument is that any attempt at removing this clause from legal formulations of insanity defences should offer alternative ways to preserve some advantages that we think follow from including the mental illness clause. Background: The aim of this study was to explore perceptions of free will in the repetitive behaviors of patients with obsessive-compulsive disorder (OCD) and to explore their relation with core clinical characteristics. Methods: Experiences of free will were assessed with the Symptomatology And Perceived Free will rating scale (SAPF) in 295 subjects with a lifetime diagnosis of OCD. Patients' scores on the SAPF were subjected to an explorative principal axis factor analysis (PAF). Factor scores were regressed on five OCD symptom dimensions and on seven clinical variables: illness duration, severity of OCD, insight, anxiety and depression, suicidal ideation and quality of life. Results: The PAF revealed three factors: the perceived ability to control and change one's course of action when faced with an obsession or compulsion (the "alternative possibilities" factor); the experience of obsessions or compulsions as intentional (the "intentionality" factor); and the experience of being the source or owner of the obsessions or compulsions (the "ownership" factor). Lower scores on the "alternative possibilities" factor were associated with lower scores on the washing dimension (β = 0.237, p = 0.004) and higher scores on the precision dimension (β = - 0.190, p = 0.025) and independently associated with longer illness duration (β = - 0.134, p = 0.039), higher illness severity (β = - 0.298, p

Recent neuropsychologisch onderzoek suggereert dat detentie leidt tot achteruitgang van belangrijke hersenfuncties bij gedetineerden. Een mogelijke verklaring voor die achteruitgang is de verarmde (versoberde) detentieomgeving, waarmee een omgeving met weinig lichamelijke, geestelijke en sociale activiteit wordt bedoeld. Verschillende hersenfuncties zijn cruciaal voor een succesvolle resocialisatie. Een andere onderzoekslijn binnen de psychologie onderzoekt de relatie tussen voeding en agressie bij gedetineerden, waarbij ook de mogelijkheid van voedingsinterventies wordt onderzocht. In deze bijdrage worden de mogelijke implicaties van dergelijk (neuro)psychologisch onderzoek voor de Nederlandse detentieomgeving geanalyseerd in het licht van het resocialisatiebeginsel.

Het gerechtshof Den Haag heeft op 16 maart 2017 uitspraak gedaan in de zaak Bart van U. Anders dan de rechtbank acht het hof Van U. niet ontoerekeningsvatbaar. In het arrest formuleert het hof een criterium voor ontoerekeningsvatbaarheid dat het Nederlands strafrecht voorheen niet kende. In deze bijdrage wordt het door het hof ontwikkelde criterium besproken waarbij wordt ingegaan op een drietal punten. Ten eerste wordt betoogd dat het criterium in feite een opeenstapeling is van twee criteria die in de Amerikaanse rechtspraak worden gehanteerd bij de beoordeling van de vraag of sprake is van legal insanity. Ten tweede wordt ingegaan op het causaal verband dat het hof vereist tussen de psychische stoornis en het delict als voorwaarde voor ontoerekeningsvatbaarheid. Ten derde worden de implicaties van de door het hof gekozen term ‘wederrechtelijkheid’ besproken. We besluiten met een aanbeveling.
