This article questions the absence of clear reflexivity and positionality in EU migration law research and it explores how they could be integrated through the real-life example of its author. While they are not usually part of the methodological tools of researchers in EU migration law, this article intends to show that they might be crucial to better understand its underlying processes. As EU migration law has a major influence on the lives of both migrants and those who research it, reflexivity and positionality could be a way for a dialogue to be acknowledged between them as part of the research itself. This article is presented as an ‘exploration’ rather than a theoretical contribution strictly following regular academic structures. As such, it is mostly articulated as a narrative using extended metaphors to convey the entanglement between the state of mind of the researcher and the evolution of her research process. Purpose: This review aimed to characterise and map: (1) what type of evidence and what dominant study characteristics are available regarding acquired brain injury (ABI) survivors' experience of occupation and activity in hospital? (2) How are occupation and activity conceptualised in the literature? (3) How are ABI survivors experiencing occupation and activity while in hospital? (4) What factors create barriers or opportunities for engagement in occupations or activity in hospital? (5) Are there any knowledge gaps identified? Materials and methods: A scoping review was conducted examining literature published between 2017 and 2022. Relevant studies were systematically retrieved from electronic databases. Results: Thirty-four publications were included. There were more quantitative studies (n = 18). Much of the research has been conducted outside of the UK. The populations studied were principally stroke (n = 22). The concept of activity rather than occupation predominates. Patients spend their time alone and inactive. Structural and contextual barriers for engaging in activity are identified. Qualitative study designs exclude ABI survivors with communication or cognitive impairment. Conclusions: There is a paucity of research with ABI survivors in hospitals in the UK. Alternative methodological approaches such as ethnography would ensure those with communication or cognitive impairment are not excluded from research. Implications for rehabilitation: Rehabilitation professionals, especially occupational therapists, need to lead acquired brain injury (ABI) research in acute hospital settings in the UK. Conceptualisation of meaningful activity and occupation needs a clearer focus in ABI research. Qualitative studies frequently exclude participants with cognitive or communication impairments so methodologies that are more inclusive and representative of brain injury survivors are needed. The right to mobility is a fundamental human right that must be accessible to all individuals, regardless of their disability. To disabled people, the right of mobility is closely related to their survival such as labor and employment, and access to public transportation systems is especially crucial in their ability to fully join the society. This article explores the state of the mobility and accessibility of people with disabilities in public transportation, focusing on the challenges faced by disabled individuals in South Korea and their advocacy efforts aimed at dealing with these challenges. The recent wheelchair demonstrations of disabled people at Seoul subways has attracted widespread social debate over disabled mobility rights, along with increased awareness and governmental declaration of further support. After the World Summit on the Information Society and the United Nations Convention on the Rights of Persons with Disabilities, states translated the global vision of digital inclusion into local policies at the national and regional levels. This article examines how state agencies in China, a technologically advanced country with a large disabled population, have leveraged the agenda of web accessibility over the course of the last two decades. By carrying out an analysis of 93 national policies and 21 technical guidelines issued between 2001 and 2021, this article critically examines how and why the Chinese state's embrace of the term 'barrier-free information' (信息无障碍) does not result in a coherent policy paradigm but might instead engender new barriers which in fact have the potential to disorient disabled people. Points of interests: Using the case of contemporary China, this article illustrates the problems of implementing the United Nations' Convention on the Rights of Persons with Disabilities in a particular national context. We provide an overview of the Chinese state's use of the term 'barrier-free information' (信息无障碍) as used in 114 national policies. While 'barrier-free information' has become a new buzzword in China, we show that its legal definitions are unclear, and its related policies are often in conflict with each other. Organisations of Persons with Disabilities (OPDs) are critical to promoting and protecting the rights of people with disabilities. However, little is known about the extent to which people with disabilities are aware and members of OPDs. This study uses data from nine population-based surveys in low- and middle-income countries to explore OPD awareness and membership. Across settings, about a third of people with disabilities were aware of OPDs and fewer than 15% were members. Awareness and membership were lower amongst older adults, women, people with difficulties communicating, remembering and with self-care, people with less education, in poverty and in rural areas. Underrepresentation of certain groups may indicate a need to seek out the voices of people less likely to be associated with OPDs. Further, low total membership may be a cause for concern in settings where OPDs are relied upon to deliver essential services in the absence of state structures. Points of interest: Organisations of Persons with Disabilities can serve many roles, including advocacy, policymaking and service provision. The increasing involvement of Organisations of Persons with Disabilities in direct provision of essential services, particularly in low- and middle-income countries, is often a result of poor availability and quality of inclusive public services. This study explores awareness and membership of people with disabilities across nine low- and middle-income countries using population-based surveys. About a third of people with disabilities were aware of Organisations of Persons with Disabilities across settings, ranging from 12% in Lesotho to 73% in the Maldives. Fewer than 15% of people with disabilities were members across settings, ranging from 3.5% in Zambia to 14% in Vietnam (Cam Le district). Awareness and membership were generally lower amongst older adults, women, people with difficulties communicating, remembering and with self-care, people with less education, in poverty and in rural areas. Given the increased role of Organisations of Persons with Disabilities in direct service delivery, low total membership may indicate that many people with disabilities – particularly the most marginalised or experiencing the greatest need – are not being reached. Additional efforts may also be needed to seek out the voices of groups underrepresented in Organisations of Persons with Disabilities, particularly for advocacy and policymaking. The relationship between race, disability and criminality is complex and poorly understood. Scant information, and lack of action, exists on how to best keep Indigenous people with disability out of the justice system, and support this cohort while in the system. This systematic scoping review collates grey and peer-reviewed literature in Australia, Aotearoa (New Zealand), the United States and Canada, to gain insight into the current practices in place for justice-involved Indigenous people with disability, and list promising principles which may inform future practice. We identified 1,301 sources, and 19 of these met the inclusion criteria. Across these sources, nine key principles emerged: need for Indigenous designed, led and owned approaches; appropriately identify and respond to disability/needs; appropriate court models; appropriate diversionary options; therapeutic, trauma-informed, strengths-based and agency-building responses; facilitate connection to family, community and support networks; break down communication barriers; protect human rights; and provide post-release support. Points of interest: Internationally, Indigenous people with disability are over-repre.sented in criminal justice systems. The reasons for this are complex and not well understood. Existing evidence suggests that long-lasting effects of colonisation; discrimination on the basis of race and disability; problems identifying and reporting disability; and lack of proper services contribute to this issue. Often, criminal justice systems do not recognise or support a person's disability until they reach crisis point. There is a critical need for culturally-appropriate and disability-appropriate interventions, such as diagnostic tools; training programs for police, correctional officers and other service providers; community court models; and more accessible communication. There is some evidence that Indigenous-led programs – involving country, culture, art, social connection and holistic healing – help prevent Indigenous people with disability from entering and re-entering justice systems. The terms 'indices' and 'indicators' may immediately cause eyelids to droop. How, then, might they serve to impassion publics and, ultimately, promote social change? This paper examines the extent to which indices and indicators can be considered communication tools for social movements and social change. The analysis is based on a 2018 evaluation of one index based in the United States – the Ranking Digital Rights Index, which assesses privacy and freedom of expression in the ICT space – and incorporates interviews with civil society stakeholders. Bringing theory from the fields of journalism and social movements together with the data from the evaluation, the findings suggest indices can serve as useful communication resources for social movements under certain circumstances. In particular, the analysis suggests three communication resources – legitimate information, newsworthy information, and flexible information – that human rights indices are most likely to provide. The notion of vulnerability is gaining traction in EU border protection. On the one hand, the concept refers to vulnerable migrants and their affectedness by insecurity and violence. On the other, it indicates the susceptibility of borders to irregular crossings and cross-border crime. Both forms of vulnerability are assessed through dedicated procedures under the umbrella of the European Border and Coast Guard Agency Frontex. To make sense of these seemingly contradictory conceptual and practical uses of vulnerability, we draw on feminist postcolonial scholarship in security studies and political geography. We argue that a shared colonial matrix of gendered and racialised meanings and problematisations enables analogies between borders and bodies as (un-)deserving of protection. In a discourse-theoretical analysis of Frontex documents, we show how the ambiguous use of vulnerability legitimises the EU border regime and its security practices by constructing EU bordering as neutral and objective and EU borders as objects of care. We conclude that vulnerability becomes increasingly important for normalising the EU's violent borders in the context of the EU's broader claims to liberal values of freedom, protection, and human rights. The policy documents of the European Union underline its self-image as a leader in promoting and protecting human rights in multilateral fora. The leadership claims are based on the EU's example in domestic human rights protection and willingness to promote externally the same set of values and norms. However, drawing on interactionist role theory, this article emphasises the extent to which the roles depend on recognition by others. Hence, leadership claims need acceptance from other stakeholders. The article studies external perceptions of EU's leadership in the Human Rights Council framework using data from interviews of Geneva-based, non-EU diplomats and human rights experts. The findings present a variable picture; while structural and exemplary leadership is recognised, incoherencies diminish EU's credibility. The EU has improved its cognitive leadership, but its agenda is contested by others. The restitution of colonial cultural property, which is currently the subject of much debate in Europe, raises several challenges. At first glance, it requires recognizing the injustices associated with coloniality itself and determining how restitution can occur. This requires an in-depth understanding of certain aspects that are particularly challenging, for example, the complexities related to the ways in which provenance research is conceived and conducted or the role that human rights play in postcolonial contexts. At the heart of such debates seems to be the need for legal reforms and greater respect for the interests and rights of the communities of origin. Taking into account the Latin American context, this paper critically examines how colonial cultural property restitution policies in some European countries have attempted to address some fundamental aspects underlying the consideration of the Indigenous peoples involved but, at the same time, have overlooked other aspects. Arms-exporting countries – even those that are liberal democracies – sell weapons to governments that violate human rights. Does the public support the provision of weapons to human rights violators? We examine public attitudes on arms exports through a survey experiment in Israel – a major arms exporter that is often criticized for arming repressive governments. Our analysis finds that human rights violations substantially increase the public's opposition to the sale of arms – by 21 percentage points. Furthermore, opposition to the arms sale arises even when the recipient country carries economic or strategic importance. Overall, we find a public preference for arms exports constrained by ethical concerns – a preference that is often at odds with governments' export practice. This study enhances our understanding of the domestic politics of the arms trade, which has received little scholarly attention, but increases in importance with rising public scrutiny and criticism of arms sales. Context: The European Union (EU) governs global health through its constituent laws, institutions, actors, and policies. However, it is unclear whether or how these political factors interact to position the EU as a political determinant of global health. Methods: The authors conduct a case study of the political factors influencing the adoption of the EU's Biotechnology Directive 98/44/EC and Orphan Medicines Regulation 141/2000. Findings: The European Commission (EC) generally framed both of its proposals around economical and biomedical paradigms aligned with the needs of the EU's industry and patients, whereas the European Parliament (EP) contested some of these frames and proposed amendments supporting global access to medical products. The political factors influencing the adoption (in the Biotechnology Directive) or rejection (in the Orphan Regulation) of the EP's amendments include the complementarity between the EP and EC proposals, the EP's power in the intra- and interinstitutional negotiating process, the existence and support of civil society, and the alignment with member state priorities in the Council. Conclusions: In the late 1990s, the EU was an internally fragmented and politicized player concerning global health matters. Context: This article examines the EU's function as a political determinant of health (PDoH) in national-level regulation of forced migrants' access to health(care), with a focus on Germany. It sheds light on the role the EU has come to play—and has been assigned—in national policy making under the impact of different crises. Methods: By applying the concepts of claims and frames/framing, the article examines in a document analysis how and to what end(s) the EU as a polity and specific EU legislation were invoked in German draft legislation. Findings: Increasing Europeanization in the areas of health and migration has not only forced national legislators to adapt legislation to abide by EU rules and standards, it has also prompted governmental actors to shift responsibility for policy reforms to the EU—even in cases where not all of these reforms were legally required. Conclusions: The EU's role as a PDoH must be considered from two angles: the EU's active potential to determine public health through its policies and laws, and its passive—to some extent involuntary—potential to do so through the strategic invoking of EU norms, rules, and (in)competences by actors across the EU multilevel governance system. Can a human right to good mental health be justified? This is an under‐explored question: until recently, rights in relation to mental health have been framed and debated primarily in terms of their relevance to psychosocial disability and mental ill‐health/mental distress. By contrast, in this article, I propose the basis of a normative justification for a population‐wide right to good mental health, focusing in particular on individuals who do not experience mental ill‐health/distress or do not have (or may never have) a psychiatric diagnosis or a psychosocial disability. The article is structured into three parts. First, I will outline the emergence of a population‐wide right to good mental health in mental health discourse, led by recent reports published by the former United Nations Special Rapporteur on the Right to Health, Danius Pūras. I will then go on to explore what we might understand by 'good mental health'. Finally, I will explain how a right to good mental health may be justified, drawing on insights from compassion, 'vulnerable agency', and James Wilson's account of 'a right to public health'. I then respond to feasibility and demandingness concerns about such a right, which together inform the basis of the qualified public health right to good mental health I propose. According to the United Nations Convention on the Rights of the Child, children have the right to voice their opinions and participate in decision-making in matters affecting their lives. Furthermore, professionals working with children have the responsibility to always make the best interests of the child the priority when contemplating decisions that have an impact on the child, including by ensuring that the child's concerns are paid attention to and their opinion is taken into consideration. However, studies indicate that the opposite occurs in practice and that decision-making in child protection cases often excludes children's views, especially in alternative care. In this qualitative study, 31 foster children's perspectives were gathered through in-depth semi-structured and focus group interviews with the aim of exploring the children's participation and perspectives based on their lived experiences within the context of child protection removal practice in Estonia. Findings indicate several obstacles that hinder children's meaningful participation, including not receiving adequate or truthful information about their removal and placement. Furthermore, they had no trustworthy adult to talk to and, therefore, they lacked opportunities to discuss their views or concerns with someone capable of acting on them. These findings suggest that children's active and meaningful participation in alternative care requires more attention and implications in practice. [ABSTRACT FROM AUTHOR]

International law traditionally did not concern itself with States' treatment of individuals, flora, or fauna subject to their jurisdictions. Contemporary international law does. International law recognizes the protection of human rights and the biosphere as community interests, interests that transcend States' interests and demand international regulation. Yet, the treaty regimes that secure the protection of human rights and the biosphere operate in diametrically opposed ways. Human rights regimes rely on international institutions to define objective communitarian norms for States to abide by, whereas the Convention on Biological Diversity regime relies on private markets to internalize the cost of development and thereby preserve the biosphere. This Comment argues that international law's recognition of community interests demands that State obligations be framed as "absolute" ones, owed regardless of the conduct of other States party to a given treaty. The absolute character of human rights obligations disallows States from modulating the scope of their performance based on the conduct of other State parties and justifies international public scrutiny over States' compliance with their international obligations. In contrast, the nonabsolute operation of conservation obligations helps to maintain States as sovereign property owners with no overriding duties to protect the biosphere and limited venues for public scrutiny. This theoretical insight has practical implications. A proper framing of the protection of the biosphere as a community interest under international law demands that States' conservation obligations be framed as absolute ones so as to recognize the biosphere as an object of concern in its own right, regardless of how States value its uses. This Comment describes two models of community interest treaties, evaluates them against the need to subject States to objective communitarian norms and public scrutiny, and identifies treaty design issues that may arise should international biodiversity law be reformed to make States' conservation obligations absolute. This paper examines the current Civil War in Yemen based on Human Needs Theory. Developed by John Burton, Human Needs Theory rests on the premise that certain groups of people resort to violence when their basic needs are not met or when they need understanding, respect, and consideration for their needs. Needs for security and identity recognition are particularly salient in civil wars and devastating identity conflicts. An important conclusion is that many of the human needs violations that the Shia minority group has suffered in Yemen stem from the long-established Sunni-Shia conflict that has fueled this civil war. This has caused Saudi Arabia (i.e., Sunni) and Iran (i.e., Shia) to support both sides of the conflict. As a result, a significant number of Yemenis have had difficulties living out their religious identity and achieve well-being. In particular, not only have their basic human rights been denied (i.e., essential needs to maintain survival) but, also, basic aid to children has been rejected as well. [ABSTRACT FROM AUTHOR]

The Promise of Digital Out-of-School Programs for Supporting Youth in Under-Resourced Communities: Participatory Principles for Human Rights-based Virtual Youth Group Programming This study reports insights from a six-year phase ("Law Under Curious Minds") of a 17-year project (Empowering Counseling Program Participatory Science Initiative) with youth experiencing low income residing in disinvested communities segregated by race in a metropolitan US city. The project offered over Zoom employed a semi-structured emergent curriculum to afford youth maximal self-determination in the intervention experiences. A human rights framework informed by critical pedagogy supported youths' efforts to separate their identities and experiences in social systems from deficit-based social narratives. This paper provides guidelines for groupwork interventions including individually focused care, developing group identity to create a positive social space, and encouraging participation while respecting youths' capacities for online self-revelation. The challenges and opportunities of digital out-of-school programs are described, with a focus on the potential for supporting youth excluded from mainstream opportunities by geographic distance, disability, or income. The purpose of this study was to identify the impacts of perceived stress, neglect, online and offline violence, and respect for human rights on depression. To fulfill the purpose of the study, the data of 6277 middle and high school students (M = 15.64, SD = 1.69) from the Survey on the Human Rights of Children and Youth (2018) were used. The main results of the hierarchical multiple regression analysis are as follows. First, gender and age had significant impacts on depression. Second, neglect, perceived stress, and online violence were positively related to depression, whereas offline violence showed no relationship with depression. Third, respect for human rights, which is the final stage of the hierarchical multiple regression analysis, was negatively associated with depression. This study contributed to the research by verifying that perceived respect for human rights is a protective factor against depression. [ABSTRACT FROM AUTHOR]

Ernst Haas was intrigued by the possibility that international governance could promote peace and stability. International human rights regimes are one such system of governance. Haas was the first political scientist to analyse closely, in his 1970 book, an international body for the adjudication of human rights claims. He concluded that the ILO mechanism for hearing claims was ineffective because states largely failed to implement its rulings. Today, three regional human rights courts receive a growing number of petitions and routinely find that states have violated rights contained in the applicable regional and international treaties. Integration in the domain of human rights courts can be tracked along three axes: vertical incorporation of international human rights into national law; horizontal integration as the regional courts pay attention to and cite each other; and effectiveness, evaluated here in terms of state compliance with judgments. The empirical discussion focuses on these dimensions and their development in three functioning regional human rights courts. Linkages across the regional courts have expanded, producing a global human rights commons. But as Haas might have predicted, the degree to which democracy has taken root in a region conditions the effectiveness of its human rights court. [ABSTRACT FROM AUTHOR]

The popularity of Foreign Direct Investment (FDI) stimulates research on its determinants. This paper highlights the importance of political determinants in explaining inward FDI variation across countries. Adopting the argument that no single theory exists for FDI, it identifies the political factors based on the results of related empirical studies. The literature review’s primary concern is to provide underpinnings for further research on inward FDI distribution in the contemporary international political scene. It sets up the theoretical links between political regimes, political determinants, and FDI. The paper focuses on the importance of specific political variables established in all political systems to influence foreign investors’ decision-making process. Currently, schools are not born inclusive, and teachers report feeling that this approach is alien to their practical possibilities, so they constantly ask for training on the subject. However, this training is hardly transferred to the school. This chapter has therefore set out to analyse how training bodies in Costa Rica are doing, and how much of this effort is permeating the educational culture. The methodologies applied were studied, as well as the background of good practices, with the final intention of guiding more effective training to make inclusion a sine qua non condition of being a school. It's now well appreciated that social determinants of health are the strongest predictors of our health and well-being. A good argument could be made that housing is at the top of the pyramid of these determinants. And, surprisingly, housing is also the social determinant that could rapidly turn on a dime—that is, with sufficient political will, creating access to housing could be radically expanded in short order. (Unfortunately, of course, it's true one can also become suddenly homeless, since few protections exist in policy or capitalist economies to prevent it). That alone sets it apart from social factors such as education and racism—conditions that take a long time to change. In contrast to long-term interventions (education) or culturally stubborn and historically rooted problems (racism), housing is rapidly malleable. In this article, we describe the social condition of homelessness in two settings, comparing and contrasting the concepts, causes, and consequences, along with how people are mobilizing to challenge the conditions that create their housing insecurity. As we review the factors that create housing conditions in each setting, we propose some universal international principles for a new approach to the human right of decent and secure housing. This paper analyzes the theoretical foundation and practical implications of recognizing the right to a stable climate as a fundamental human right. Further, it examines the intersection of human rights, right to climate, and the intensification of extreme climate events. Through a bibliometric analysis, the study highlights the increase in scholarly attention paid to this nexus. The intensification of extreme climate events, such as the Cumbre Vieja volcano in Spain, is also analyzed as a catalyst for recognizing the right to climate as a human right, as a fundamental requirement for its enactment. Indeed, it is argued that this recognition is necessary to achieve climate justice. These thoughts about the necessity of recognizing the right to climate as a human right are also based on a similar case, the enactment of the rights to water and sanitation, which is presented as a case study, demonstrating how specific environmental rights can be integrated into human rights discourse. The results and discussion section synthesizes these findings, highlighting the imperative of recognizing climate rights to ensure justice and sustainability amidst escalating climate challenges. A rapid expansion of the computer technology industry, particularly in the field of artificial intelligence, has ignited a global concern that warrants our immediate action. As nurses, our professional values frameworks compel us to protect public health and address national and global health issues. When industry activities adversely affect the social wellbeing of civil society and social institutions, it is important to evaluate them against their industry's 'social license to operate,' which is a measure of public trust, credibility, and the legitimacy of their industrial and corporate citizenship status. The central question is, do computer technology companies continue to have a social license to operate in civil society? Nurses are encouraged to evaluate the computer technology industry's recent 'generative artificial intelligence' chatbot activities against its tacit undertaking to be good corporate citizens in return for social acceptance of their operations and behaviour. An evidence-based overview of chatbot impacts on societies, environmental sustainability and human rights provide a basis for evaluation. Basic computer technology terminology and relevant concepts are explained. This article is a direct call to action for clinical nurses and those involved in research, education, management, and policy. We have a duty to critically assess the claims made by chatbot technology vendors in both practice and social contexts. If these vendors integrate chatbot technologies with existing machine learning used in nursing and healthcare technologies it could result in detrimental effects beyond user control. By influencing decisions on technology adoption, we can ensure the implementation of safeguards, protect patient safety and social well-being, and uphold the integrity of nursing values. A closing discussion of impacts of computer industry trust deficits on healthcare and research reflects the author's concerns and conclusions about the central question. In this phenomenological study, we examined the meaning of resilience for seventh generation Pueblo people who took part in the historic Water Protector movement against the construction of the Dakota Access pipeline. Using focus group data from eight Pueblo participants, four themes were developed: (a) Creating Interconnectivity, highlighting the significance of resilience in fostering connections with all living beings and things across time; (b) Cultivating Resilience, emphasizing the role of relationships, especially with women caregivers and role models, in nurturing resilience; (c) Being Resourceful to Overcome Oppressive Hurdles, involving awareness of historical trauma, proactive actions like protests, and patience for change; and (d) A Way of Healing, illustrating how resilience serves as a source of healing through engagement in spiritual practices of prayer, ceremony, love, forgiveness, and sovereignty. These findings may encourage counseling psychologists to reflect Indigenous epistemologies of resilience for genuine decolonization of the psychological literature. [ABSTRACT FROM AUTHOR]

Purpose: The current paper is devoted to the analysis of the mediation of non-heteronormative masculinities within discourses on intimate partner violence (IPV) and domestic violence and abuse (DVA) in contemporary Russian media. Methods: The article presents a discourse analysis of five samples of media texts devoted to IPV and/or DVA among LGBTQ people. The media texts were sampled through a keyword search completed on the websites of two openly pro-LGBTQ media outlets (news and entertainment portals Meduza and Takie Dela) and two media outlets catered for predominantly LGBTQ audiences (the news and entertainment portal Parni PLUS and the website of the NGO SPID-Tsentr). Results: The interpretative qualitative analysis of the sampled texts demonstrated that the IPV/DVA survivors' confessional narratives are framed within wider discourses on non-heteronormative masculinities, which are represented both as transgressing concepts of hegemonic masculinity and as challenging stereotypes about non-heteronormative masculinities. Conclusions: The outcome of the analysis presented in the paper is that there is evidence of the emergence of new media discourses on IPV and DVA among LGBTQ communities. Drawing on feminist discourses on IPV and DVA in heterosexual relationships and using media strategies of LGBTQ coming-out confessional narratives, the sampled media data reveals an ongoing search for a new language of discussing the relatively new societal problem. Further research into mediation of non-heteronormative male survivors of IPV and DVA promises insightful findings concerning the evolution of discourses on non-heteronormative masculinities in contemporary Russian media. BACKGROUND: During the COVID-19 pandemic, low-wage public-facing frontline workers (FLWs), such as grocery store clerks, were required to monitor retail customers and enforce COVID-19 protocols. OBJECTIVE: This analysis aimed to examine FLWs experiences of enforcing COVID-19 pandemic measures. METHODS: Between September 2020 and March 2021, in Ontario and Quebec (Canada), we conducted in-depth interviews about customer-related work and health risks with FLWs who interacted with the public (n = 40) and their supervisors (n = 16). Using a lens of situational analysis, verbatim transcripts were coded according to recurring topics. RESULTS: We found that enforcing public health measures placed already-precarious workers in difficult occupational health circumstances. Enforcement of measures created additional workplace responsibilities, stress, and exposed them to potentially negative reactions from customers. In this article, we critically examine the nature and legal force of interim measures requests (IMRs) issued by the Human Rights Committee (HR Committee) in response to communications received under the Optional Protocol to the International Covenant on Civil and Political Rights (ICCPR-OP1). Despite the lack of express provisions in the Covenant or the Optional Protocol regarding the power of the HR Committee to issue IMRs or the obligation of States to comply with them, the HR Committee has established its own Rules of Procedure to issue purportedly binding IMRs in certain circumstances. This article is the first thorough examination of whether IMRs are binding and, if so, on what basis. We conclude that States parties must comply with IMRs in good faith under Article 26 of the Vienna Convention on the Law of Treaties. However, we note that this interpretation requires a forward-leaning approach that privileges the object and purposes of the ICCPR-OP1. Despite the accepted fact that the ideal family, as the foundation and main cell of society, has a direct impact on the progress of society, today, we are confronted with significant threats to the foundation of the family as a result of the disparity between the performance of certain societies and moral-religious traditions. A hazard that has been significantly de-stigmatized in recent years is the unconventional and unnatural sexual tendencies of individuals toward their own sex. We have observed that numerous international authorities in their jurisprudence do not exhibit discrimination or inequality toward civil institutions that are established based on unconventional sexual tendencies, despite the strong and emphatic prohibition of religions, particularly Islam, against unconventional sexual tendencies. They equate these institutions with the sacred institution of the family. This unnatural perspective has had such a profound impact on them that, in addition to eliminating historical punishments for this immoral activity, they have criminalized opposition to homosexuality as hatred. This has advanced to the extent that certain countries have even acknowledged "marriage," a term that is historically and naturally associated with relationships between men and women, for relationships that are based on aberrant sexual tendencies. This is despite the fact that homosexuality, or unconventional and unnatural sexual tendencies, has been regarded as ugly, disgusting, and unnatural throughout history. In Islamic teachings, it is also referred to as prostitution and is considered one of the major sins that has been assigned the most severe punitive measures. [ABSTRACT FROM AUTHOR]

This article aims to explore the evolution of the debates surrounding human rights in the discourse(s) of major sporting events (MSEs), particularly the Olympics. The paper will first analyse the western-centric origins of the "universality" of the Olympic philosophy and how it affected the protection and promotion of human rights, as well as addressing practical challenges or limitations faced. It will then focus on unpacking the elements of sportswashing and soft power in the multi-discursive context of sport where power, privilege, politics, and position are (re)produced. In doing so it draws upon the emergent field of Sports Diplomacy as the most appropriate explanatory framework to share in this discourse. We offer a framework to assess marketing activities for their relationship to human rights, grounded in the recognition that respect for dignity—the inalienable, inherent, and equal value possessed by all humans—is at their core. Drawing from historical and recent thought in philosophy, management and medicine, we focus on three factors of dignity: recognition, agency and equity. We then integrate academic research from our own field as the basis of a marketing-specific conceptualization of dignity, offering a list of assessment questions for firms desiring to integrate dignity into their marketing activities. Given the nascent state of research on dignity in marketing, we also propose a set of questions for future inquiry. We close with three case studies that highlight organizations' success or failure in affirming dignity in areas relevant to the Sustainable Development Goals, and offer an invitation to esearchers to partner with global dignity-centric organizations to continue this work across cultures and challenges. Purpose: The World Heritage Convention has reached a milestone, and this year, in 2022, it is celebrating its 50th anniversary. The aim of this article is to review whether and how the goals of the strategic action plan (SAP) for the Implementation of the World Heritage Convention (2012–2022) have been reached. Design/methodology/approach: This article starts by considering the outcomes for three of the SAP goals, dealing with protection and management; the credibility of the World Heritage List and sustainable development, using additional information from the final implementation report of the SAP (UNESCO, 2021a), which provides key performance indicators and the implementation status for each goal and associated outcomes. This article then compares and contrasts available data, trends and examples to provide more in-depth analyses of the implementation of the three goals. Data have been gathered from my own research and from the work of other academics and practitioners. Findings: The article finds several key positive changes, including the recent revisions of the Operational Guidelines to include provisions from the 2015 UNESCO Policy on World Heritage and Sustainable Development. However, a number of concerning or worsening trends relating to the protection and management of the World Heritage List, its increasing lack of credibility and sustainable development make it difficult to conclude that the implementation of the goals has been positive. The article concludes with suggestions for addressing these issues. This paper contributes a legal and a South Asian perspective to the emerging scholarship on the materiality of the Qur'an, exploring and analysing the development of the laws and regulations that protect the Qur'an as a sacred object against the risk desecration, defilement as well as heretical translations and interpretations. Starting with the enactment of Indian Penal Code, 1860 in colonial India and ending with amendments to the Punjab Holy Quran (Printing and Recording) Act, 2011 in 2022, this paper identifies multiple layers of statutes and regulations that accompany the life-cycle of the Qur'an from 'cradle to grave'. In analysing the legal developments that have fused the object and the text of the Qurʾan into a legal entity that demands particular interpretations of Islam, this paper identifies an Islamic state doctrine that asks and expects the Pakistani state to protect and promote Islamic law and religion in an increasing number of contexts and occasions, the protection of the Qurʾan being only one of them. This article describes a teaching session focused on the gap between rights-as-law and rights-as-mentality in social work. The session has run in various forms with BSc, MA and PQ social work students, and is based on three allegorical vignettes, each of which illustrates a problem with a legalistic concept of rights. These are named ‘The Path of Nettles’, ‘The Snickers Problem’ and ‘The Post Hoc Egg Shield’. The paper has four sections—an explanation of the philosophical rationale for, and pedagogical approach of, the session; a description of the session’s components, including the three allegorical vignettes; a setting out of the session itself; and an evaluation of the session. One of the authors has designed and run several versions of this session; the other is a social work manager seconded to Northumbria University and responsible for the university’s ASYE teaching (initial year in practice for newly-qualified workers). Between 2015 and 2023, authoritarian backsliding triggered significant changes in the Polish judiciary, prompting some judges to adopt a new approach in their interpretation of the European Convention on Human Rights, both on and off bench, taking a more explicit stance as individual applicants against the Polish government in the European Court of Human Rights. This article employs the paradigm of relational legal consciousness, attributing this embrace of human rights law to judges’ interactions and relationships with various actors, including judicial associations, lawyers, human rights activists, and civil society. Furthermore, the article extends the concept of relationality in legal consciousness to encompass the intricate interplay between law and politics as intertwined social relations and practices. The article's original contribution lies in theorizing judicial legal consciousness in relation to authoritarian backsliding and the resultant liminality of structures and strategies for action. A focus on rights consciousness has become a mainstay of the socio‐legal study of law in everyday life. Such research, much of it critical in orientation, generally uses people's sense of grievance as its starting point. The consequent risk is that we elide rights consciousness with a sense of injustice. This article argues that there is merit for critical studies of legal consciousness in keeping these two things separate, and that this represents a dimension of the critical approach to rights consciousness that is largely missing from the field. We present a study of rights consciousness in relation to the imposition of lockdown in the United Kingdom during the early stage of the COVID‐19 pandemic. We show that, despite regarding lockdown as a violation of basic rights, most people did not feel a sense of grievance. Furthermore, rights consciousness was influenced by a range of factors distinct from political orientation, most of which were within the sphere of governmental influence. In this way, governmental power was constitutive of the public's rights consciousness. African literature is a crucial arena for deconstructing norms, and imagining communities or alternative modes of sociality and being. In many postcolonial African literary works, particularly those grappling with the legacy of European colonisation and the challenges of nation-building, the modernist state is frequently depicted as an entity emblematic of violence and dispossession inflicted upon the populace. However, it is also sometimes portrayed as offering a degree of hope and possibility amidst the turmoil. Drawing on literary onomastics and insights from Rights and Feminist theories, the article examines Parkes’ strategic use of names to articulate ethicality in Tail of the Blue Bird. Parkes argues for a true decolonisation by radically replacing and reassessing the patriarchal ideology that creates violence and trauma in postcolonial societies. This should happen by embracing the feminine principles represented by the main female characters in the novel. The article shows that the semiotics and character roles of Esi Mensisi and Yaa Somu as women constitute crucial sites for Parkes’ rumination on human flourishing and ethicality in the postcolonial modernist state. This article examines the regulatory framework related to human trafficking in Hong Kong and identifies its deficiencies as the lack of an accepted internationally compliant definition of trafficking and the absence of any specific criminal offence of trafficking as a result. The article compares the approach taken in Hong Kong to efforts undertaken in Europe by the Council of Europe, the UK, and the European Union and identifies several lessons from the European experience that could help rectify failures observed in Hong Kong. In particular, effective combatting of human trafficking requires not only a definition of the offence that recognises the essential elements--an "act," a "means," and a "purpose" of exploitation--but also the establishment of sufficient state institutions and agencies dedicated to identifying and protecting trafficking victims. Without the detection of trafficking victims, criminals engaged in the act of trafficking perceive their chances of being caught and prosecuted as low and operate with impunity. This necessitates the adoption of a consistent and readily identifiable criminal offence of "trafficking" aligned with the approach taken by the Palermo Protocol, just as the EU and UK have done. This review of Salar Mohandesi's Red Internationalism focuses on the author's contribution to our understanding of a movement of transnational solidarity in the 1960s under the framework of anti-imperialist internationalism as well as of its collapse in the 1970s and of the emergence of the discourse of “human rights.” This was not a case of an evolutionary transformation, with anti-imperialist discourse slowly morphing into human rights, but one of “displacement.” Anti-imperialism entered into a crisis in the early 1970s, and that crisis opened a space for the rhetoric of human rights to ascend as the dominant form of internationalism. Mohandesi further analyzes how “human rights” was quickly reduced to one single meaning, the rights of the individual, which allowed for and coincided with a retreat from forms of collective political engagement. This happened at a time where any space for revolutionary politics seemed to be foreclosed, and capitalist liberal democracy appeared to be triumphant globally. [ABSTRACT FROM AUTHOR]
