Lorsqu'un geste suicidaire est imputé au travail, outre la qualification d'accident du travail, la faute inexcusable de l'employeur, fondée sur son obligation de sécurité, peut être retenue, si celui-ci avait conscience du danger encouru par son subordonné et n'a pas pris les mesures nécessaires pour l'en préserver. Deux points ressortent. D'une part, le risque suicidaire n'est pas toujours prévisible, ce qui amène à une réflexion plus générale sur sa prévention. D'autre part, depuis 2015 et jusqu'à présent, coexistaient deux conceptions de l'obligation de sécurité, nouvelle en droit du travail et, constante, en droit de la sécurité sociale, le contentieux relevant de deux chambres distinctes de la Cour de cassation. Trois arrêts, en date du 8 octobre, rendus par la deuxième chambre civile de la haute juridiction semblent s'orienter vers une harmonisation de la jurisprudence. En conséquence, il convient d'apprécier leur portée, notamment quant aux mesures préventives attendues de l'employeur. When a suicidal act is attributed to work, in addition to the qualification of a work accident, the employer's inexcusable fault, based on his obligation of safety, can be retained if the latter was aware of the danger incurred by his subordinate and did not take the necessary measures to protect him. Two points stand out. On the one hand, the risk of suicide is not always predictable, which leads to a more general thinking on its prevention. On the other hand, since 2015, two conceptions regarding the obligation of security have coexisted, new in labour law and, constant in social security law, with litigation falling under two separate chambers of the High Court. Three judgments from October 8, issued by the second civil chamber of the High Court appear to be moving towards a harmonization of case law. The patrimonial liability is the most common form of liability, being attracted in case of non-compliance with the legal norms, in order to protect the social values indispensable for the normal functioning of a company. Legal employment relationships are one of the most common areas in which joint and several liability is applied, namely in the case of work accidents resulting in personal injury to employees, which can cause them including permanent disabilities and can be caused by deficiencies in specific equipment used, as well as the lack of effective training in the field of labour protection. Establishing guilt and attracting civil liability is done in relation to the concrete conditions of the accident, the duties of employees according to job descriptions, but also the concrete actions they performed during the program or in connection with work duties. The article presents the applicability of the legal norms in the matter of civil liability to a practical case in which the courts have held joint and several liability of employees and employers in case of accidents at work, referring to the legal conditions to be met, with implications in criminal law. - Abstract
The purpose of this study is to determine the attitudes of vocational school students who go to hospital application on occupational health and safety. This descriptive study has been performed with 249 students in the Vocational School of a Cappadocia University between 24 September and 30 October 2019. "Question Form" created by the researchers through literature review have been used in the collection of data. Data has been analyzed using descriptive statistics, number, percentage, median, min, max, mean and standard deviation. The mean age of the participants is 20.22 ±21.45 years and 68.5 % (n=168) of them are female. 68.2% (n=167) of the students defined the work accident as "the accident occurred while the insured was at work". 37.8% (n = 91) of the students went to the occupational health and safety unit of the hospital when they had an occupational accident, 24.1% (n = 58) to the head of the unit they worked in the hospital, 20.3% (n = 49) 14.5% (n = 35) of the infection control nurse stated that they reported the internship to the responsible teacher. Although students receive education, they are exposed to occupational accidents and apply to different units when a work accident occurs. The students' knowledge on the definition and scope of occupational accidents is insufficient. Students should be informed more effectively by health institutions about occupational health, risks and unit orientation, and should be supported in the use of personal protective equipment. 107. The experimental reconstruction of a complicated case of work accident due to a scraper.

Background: Workplace safety is a global public health issue. Re-constructing an accident can prove extremely complicated, especially when the event occurs without direct witnesses or when the scene is altered. In these cases, it is essential to adopt proper investigation pro-tocols in order to ensure the correct reconstruction of the dynamics., Case Report: A man was found unconscious on the ground, having fallen from a height of approximately 2 meters, where there was a cabin in which a conveyor belt of raw materials for the production of cement ran. At the end of the path of this belt a scraper was found. An autopsy was carried out and the scraper present at the scene was examined and compared with the injuries on the victim. After the autopsy, the investigators returned to the scene and collected the traces found in the cabin. At the end of collecting the traces, the investigators simulated the dynamics of the event by turning on the conveyor belt and placing a scraper of the same dimensions and characteristics as the one found at the scene inside the cabin., Conclusion: The autopsy showed a maxillofacial trauma with multiple bruises on the face and a serious fracture of the epistropheus tooth. This trauma was therefore incompatible with a simple fall from 2 meters. The investigators created an experimental model that demonstrated a very high energy rebound of the tape when placed in contact with the scraper. This reconstruction made it possible to carry out a single report with the data collected by the medical examiner and the investigators, which was effective and exhaustive, allowing the Authority to be provided with the evidence to continue the investigations about the responsibilities of the worker and the employer.

108. Trend analysis and projection of work accidents cases based on work shifts, workers age, and accident types

Objective: To assess the case of work accidents during period (2009–2022) based on work shifts, workers age, and accident types. Method: The study design was a time series design with data on work accidents at the company period 2009–2015 as the population. Results: The variable work shift in 2009–2015 was dominated by work accidents on morning shift and night shift of 0.47%. After a projection, it was found that work accidents occurring during the shift will drop from 0.22% to 0.11%. For the years 2009–2015, accidents were dominated by age group of >50 years with a percentage of 0.52%. In 2022 for that category fell by 0%. For work accidents that occurred in 2009–2015, the most cases were falling from a height with a percentage of 0.76–0.17%. In the next seven years, the projection results obtained the highest results turned into work accident with dangerous substances with a percentage of 0.17% in 2016 and increased to 0.30% in 2022. Conclusions: The trends and predictions from 2016 to 2022 were a decrease in work accidents based on work, a decrease in accidents based on the workers age, and also a decrease on the variable type of accident.

Kecelakaan kerja merupakan suatu kejadian yang tidak terduga saat kapan akan terjadi dengan banyaknya penyebab yang dapat menyebabkan kecelakaan kerja tersebut. Salah satu penyebab terjadinya kecelakaan kerja adalah unsafe action (tindakan kerja tidak aman). Tujuan dari penelitian ini adalah untuk melihat hubungan antara faktor unsafe action dengan terjadinya kecelakaan kerja pada pekerja proyek konstruksi. Penelitian ini bersifat deskriptif observasional dengan rancang bangun penelitian yang digunakan adalah cross sectional. Populasi dalam penelitian ini berjumlah 179 responden, namun dilakukan metode sampel secara random sampling dengan (α=0,05) sebanyak 122 responden. Data dikumpulkan melalui kuesioner dan hasil wawancara yang dilakukan. Variable independent yaitu unsafe action (membuang sampah sembarangan, tidak menggunakan APD, melewati batas aman, tidak mematuhi aturan, melewati batas berat angkat beban, duduk di area yag berbahaya, meletakkan barang sembarangan, bekerja sambil bergurau, kurang pengetahuan, emosi tidak stabil, perilaku tidak baik, posisi yang dipaksakan, kurangnya istirahat, pengoperasian alat tanpa izin). Hasil penelitian menunjukkan bahwa faktor duduk dan berdiri di area yang berbahaya merupakan faktor yang memiliki risiko bahaya tinggi terjadinya kecelakaan kerja dengan persentase 64,8% dan memiliki adanya hubungan antara faktor berdiri di area yang berbahaya terhadap kecelakaan kerja. Disarankan pada perusahaan untuk terus meminimalisir penyebab terjadinya kecelakaan pada kondisi lingkungan kerja.

110. Status of Health Discipline Students to Receive Training on Occupational Health and Safety and Exposure to Occupational Accident

INTRODUCTION: The study was conducted to determine the level of awareness and knowledge of occupational health and safety for health discipline students who were admitted to practice at health facilities and to plan and direct training activities to prevent occupational accidents at health facilities. METHODS: The study was descriptive and included 452 health discipline students, aged 18 years and over, who were continuing clinical practice training at 12 health facilities affiliated to the General Secretariat of Istanbul Beyoğlu Region Public Hospitals Association between 23.11.2016 / 23.02.2017. he data were collected using the "Structured Information Form" which was developed under the guidance of literature and composed of 23 questions. RESULTS: It was found that 90.5% of the students (n = 409) were educated about "Occupational Health and Safety" before the clinical practice in the school or the institution they were going to practice, and who were exposed to work accidents at the rate of 80.9% (n = 51) 76,1% (n = 48) of them were students in Nursing department. Of the trainees (n= 409) 12.46% (n = 51) were exposed to work accidents while 27.90% (n = 12) were injured among untrained students (n = 43). DISCUSSION AND CONCLUSION: As a result, it was found that the occupational accident exposure of the students who received Occupational Health and Safety education was less.

111. Percepción de calidad de vida en trabajadores víctimas de accidente laboral que terminó en amputación.

Objective: to describe the perception of quality of life of people who have suffered amputation due to a work accident. Methodology: qualitative research with the application of a 10 open questions semi-structured interview to six workers who had suffered an occupational accident that ended in amputation. The information was collected, analyzed and classified manually in emerging categories. Results: the participants are 34 and 52 years old males from the municipalities of the coffee triangle area and north of the Department of Valle del Cauca. Their marital status is 5 married and 1 separated, their educational level is 2 primary school, 3 secondary school and 1 professional technician. All of them are affiliated to the health system. The body segments amputated are: 3 upper limb amputees and 3 lower limb amputees. Conclusions: their quality of life, according to the central human functional capacities defined by Nussbaum, reflects that after the accident they were affected by the loss of security and self-confidence, preventing social activities. Their current condition limits them from improving their income due to their disabling condition. Chronic pain and prosthetic maladjustment are common, as well as the use of accessories and the difficulties to move. The strengthening of the primary family support network is evident but, at the end of their rehabilitation, there is a lack of interest in social activities. Participants have concrete future projects that involve their family. Finally, their rehabilitation process was limited to the basics and they did not have any other type of support. 113. Assessment of Quality of Life in Patients with Lower Limb Amputation after Work Accidents.

Amputation is the intentional removal, by surgery, of a limb segment or part of the body. By increasing the degree of urbanization and automation around the world, accidents are the most important cause of morbidity and mortality. Lower limb amputation is a life-changing event and has an impact on functional, work, social and recreational activities. Amputation can lead people to lose self-esteem, independence and work. Quality of life it is as a wide range of human experiences related to one's general well-being. For the specific psychosocial and functional testing of people who have undergone an amputation TAPES is more frequently used. The study included 7 patients with amputation of lower limbs, prostheses, who underwent unilateral or bilateral amputation of traumatic genesis at work. Patients filled in the Trinity Amputation and Prosthesis Experience questionnaire in order to estimate quality of life and Rosenberg scale to assess self-esteem. The adaptation to wearing the prosthesis is reported by 71.42% and more than 50% of the subjects are satisfied with their prosthesis. The factors with the greatest impact on functional abilities proved to be: the level of amputation, the duration of living with the amputation limb, the presence of other pathologies and psycho-emotional status. Medical rehabilitation programs improve the functional and psycho-emotional abilities of patients with lower limb amputations. [ABSTRACT FROM AUTHOR]

Les médecins sont de plus en plus confrontés à des demandes de certificats médicaux de la part de patients victimes de situation de harcèlement ou parfois à la demande des autorités sur réquisition. Le harcèlement est un phénomène complexe, couvrant un large éventail de comportements et de situations. La rédaction de ces certificats médicaux est difficile, et source régulière de poursuites, notamment disciplinaires à l'encontre de médecins qui ont parfois pu manquer de précaution dans leurs écritures. Cette rédaction est d'autant plus complexe que la qualification des faits nécessite parfois une évaluation du retentissement sur la victime sous la forme d'une durée d'incapacité totale de travail, mais pas dans toutes les formes d'harcèlement reconnues en droit français. Dans cet article, nous proposons d'aborder quelques notions générales concernant la rédaction du certificat, la notion d'Incapacité Totale de Travail (ITT), puis de réaliser une revue systématique des différentes évolutions du droit pénal, du droit du travail, et de la jurisprudence à l'aune des situations de harcèlement les plus courantes. Enfin, nous proposons d'aborder la question de l'évaluation des victimes dans ce contexte, notamment au regard de l'évaluation de l'ITT, qui ne nous apparaît pas être un outil adéquat à l'évaluation de ce type de violences, eu égard à leur caractère répétitif et souvent ancien. Medical doctors are often asked by patients victim of harassment, or even by the authorities, to establish medical certificate. Harassment is a complex phenomenon, covering a wide range of behaviours occurring in multiple situations. The writing of such a certificate can prove to be difficult, can be a cause of legal proceedings for clinicians, especially at a disciplinary level. Moreover, the evaluation is all the more complex since the qualification of harassment by the judge sometimes requires an evaluation of the impact on the victims under the form of a Total Work Incapacity (TWI) duration, but not under all the circumstances existing in French law. In this article, we first propose to address general consideration towards the writing of the certificate, before doing a systematic review of the successive evolutions of French penal and labour law regarding harassment in its most frequent forms. Finally, we propose to address the matter of victims evaluation, especially towards TWI duration evaluation, which does not seem to us an adapted tool regarding the fact that harassment is usually a chronical and durable phenomenon. Objective: The work accidents are one of the biggest issues of today’s occupational lives regarding the human losts and economical losts. The humanity lost of this daily issue is pretty huge. Material and Method: At this study, it is aimed to compare the EU’s work accidents resulted with death and SSI Statistical Yearbook datas standardized number of the workers with insurances according to their work accidents, occupational diseases, and death rates from different occupational branches. Results: At the data which are achieved by indirect standardization method of SSI 2008-2017 Statistical Yearbook, it is seen that the mining industry is leading regarding work accidents, occupational diseases and death rates. Although the highest standardization rate belonged to “Activities of Domestic Employees’’ in 2008, between 2009-2017 years, the “Mining coal and lignite’’ placed always at the first place. Regarding the occupatinal disease standardization between 2008-2017 the “Mining coal and lignite’’ and “Metal mining’’ industries are placed at the top. Conclusion: It is expected to increase the feed back quantity by applying 6331th Occupational Health and Security law in the future. Mechanization, which enables the transition from traditional means of production to modern means of production, refers to the industrialization that makes mass production with the effect of bringing more profit and the increasing world population meet their needs. In factories, many people are made to work together and for long working hours. For this reason, working accidents also become inevitable. As a result, the increase of working safety in the field of occupational health and safety on behalf of reducing working risks especially in Germany has developed. Turkey also in this direction under the influence of European Union harmonization law to speed has gained in the scope of work to speed the membership accession process. It is aimed to reveal the results of the legal regulations in the context of preventing work accidents. This descriptive study generally in Turkey and Istanbul in particular the work accidents occurred between 2007 and 2018 as a result of temporary incapacity period, statistical data to be including income and fatal occupational accidents connected to workers or rights holders were examined. Thus, the effects of the Occupational Health and Safety Law (OHS), enacted in 2012, number 6331, on the prevention of occupational accidents were questioned. Finally, from the statistics obtained using secondary data, it is understood that there is no reduction in occupational accidents. Research Background: Occupational health and safety (OHS) is an effort to create a working atmosphere that is safe, comfortable, and the ultimate goal is to create the highest productivity. The higher level of production in the coal industry will be in line with the dangers and risks of work accidents in the coal industry. Occupational accidents are influenced by 2 (two) direct causes namely unsafe action (unsafe action) and dangerous condition (hazardous condition) Research Methodology: The research design used in this study is observational analytic with the cross-sectional approach with a large sample of 80 respondents who in the South Borneo coal industry. Data analysis used the statistical test Chi-Square (α = 0.05). Result: From the results of the bivariable significance test using the Chi-Square test showed that the significant value of age (p= 0.604), years of service (p= 0.544), level of education (p = 0.578) > 0.05. Sugar factory labor was highly vulnerable to get work accident in work place. The objective of this research was to identify the relation between working period and knowledge level to the prevention of work accident through variable of work stress on mill and kettle workers. This research was quantitative in analytical observational method and cross sectional design. Total sample of research were 115 workers in the sugar mill and kettle at sugar factory of Rejo Agung Baru Madiun through total sampling. The research data was tested in SEM (Structural Equation Model) method by exerting instrument of Stata 13 to analyze the data. Based on the finding of research, on the sig value of working period 0.006 and sig value of knowledge level 0.023, it referred the relation in variable of working period through work stress, while no relation in variable of knowledge level through work stress to the prevention of work accident. Thus, it required to more stimulation to the knowledge level and more support to the workers in order to minimize their work stress. [ABSTRACT FROM AUTHOR]

The perception of risk is associated with the occurrence of occupational accidents. For health companies it is fundamental to know this phenomenon, thus favoring the implementation of coping and prevention strategies, which contribute to the reduction of work accidentality. Objective: To analyze the perception of biological risk and the associated factors with occupational accidents through the ORPE (Occupational Risk Perception Evaluation) method and the RISKPERCEP software of the employees of a hospital in Antioquia, Colombia, in 2019. Methodology: Cross-sectional explanatory study that used the ORPE methodology and the RISKPERCEP software through a structured survey of all the workers (N=50) of the institution. Statistical information was analyzed with SPSSv24 software. Results: An underestimation profile of occupational biological risk is found in the different areas of the institution. Factors such as time developing the same activity and perception of the state of health are associated with work accidentality. Risk assessment is an essential component of the occupational health and safety event prevention activity. The purpose of this study is to choose the most appropriate risk assessment method for hospitals. The main methods were compared. There are many assessment methods, each with its advantages and disadvantages, but none has been adapted to the specificities of hospital activity. We adapted the workplace assessment sheet from the INCDPM (National Research and Development Institute for Labor Protection Bucharest) method to the specific of the hospital units and used this method at the level of jobs, within the hospital's departments, calculating the global risk level per job position, workplace (department), and hospital. The clinical departments global risk level exceeds the average (3.00) for all jobs, but does not exceed, however, 3.50, representing an acceptable security level. For assess the psychosocial risks we used the ELVIE method. Looking ahead, the methods should be adapted to allow both numerical presentation of the results and graphic. [ABSTRACT FROM AUTHOR]

Lean Manufacturing tools were originally developed to improve manufacturing production systems and enhance productivity and quality in organizations. For this reason, they are used more frequently in manufacturing than in service companies. The Ergo-Lean approach applies Lean Manufacturing to the field of Occupational Safety and Health, focusing on reducing activities that do not add value and on reducing the associated muscular-skeletal disorders. The purpose of this study is to integrate Lean Manufacturing tools in risk management to help control work-related accidents. Based on work accident data at a service company, the causes of the accidents were analyzed and the main Lean Manufacturing tools were reviewed and integrated, in order to develop a new methodology for the implementation of these tools to help prevent work-related accidents and diseases and to develop a culture of self-care. Toute personne exerçant son activité professionnelle en milieu extérieur peut développer une hypersensibilité IgE médiée aux hyménoptères sur le lieu ou pendant la durée du travail. La prévalence de l'anaphylaxie et de la mortalité professionnelles liées aux piqûres d'hyménoptères semble peu élevée mais est néanmoins difficile à évaluer et probablement sous-estimée. Certaines professions sont admises comme facteurs de risque mais les mesures préventives restent difficiles à mettre en place. Par ailleurs l'impact de l'allergie aux venins d'hyménoptères sur la vie professionnelle est réel qu'il concerne la contrainte de l'immunothérapie, la capacité de travail voire même la survenue d'un stress post-traumatique. Sa reconnaissance en accident de travail, maladie professionnelle, inaptitude au poste de travail et incapacité de travail peut permettre dans certains cas d'en limiter les conséquences sociales pour les patients. Anyone exercising their professional activity in an outdoor environment can develop IgE hypersensitivity to Hymenoptera venom at the place of work, or during the working hours. The prevalence of professional anaphylaxis and mortality associated with Hymenoptera bites appears to be low, but is nevertheless difficult to assess and probably underestimated. Some professions are accepted as risk factors, but preventive measures remain difficult to put in place. Moreover, the impact of an allergy to hymenoptera venoms on professional life is real, and involves the constraint of immunotherapy, work capacity and even the occurrence of post-traumatic stress. The research carried out a description of the main occupational hazards associated with workers in the agricultural sector in the Buena Esperanza del Norte of Santander Colombia, questioning the forms of their relationship with occupational health and safety structures. To specify this scope, a bibliographic systematization process was carried out that is sufficient to compile a series of essential data that allow us to understand the current dynamics of the agricultural worker in the Buena Esperanza Norte of Santander Colombia. Finally, regarding results and conclusions, a real situation was found of 80% of workers in the field who are vulnerable and exposed to different dangers related to agrochemical exposures, such as pesticides, fungicides, herbicides that can sometimes lead to death. which are the most common within said activity. Its objective is to know the causes of occupational diseases caused by chemical substances in workers in the agricultural sector of the Corregimiento Buena Esperanza Cúcuta, Norte of Santander. Methodology. The research was developed with a population of 150 workers in the agricultural sector in the Corregimiento de Buena Esperanza – Cúcuta, to whom an instrument for collecting duly validated survey-type information was applied, under a qualitative approach. Results. It was evident that farmers in the Buena Esperanza Corregimiento, Norte of Santander, Colombia are exposed to high concentrations of agrochemicals and the risk level is Not Acceptable according to the Colombian Technical Guide (GTC-45). On the other hand, it is observed that it does not have a training program on the use of agrochemicals and possible occupational diseases, and the non-use of personal protection elements in its agricultural activities., La investigación desarrollada realizó una descripción de los principales peligros laborales asociados a los trabajadores del sector agrícola en la zona de Buena Esperanza del Norte de Santander Colombia, cuestionando las formas de relación de estos con las estructuras de seguridad y salud en el trabajo. Para concretar dicho alcance se realizó un proceso de sistematización bibliográfica que es suficiente para recopilar una serie de datos esenciales que permiten entender las dinámicas actuales del trabajador agrícola en la zona de Buena Esperanza Norte de Santander Colombia. Por último, respecto a resultados y conclusiones, se encontró una situación real del 80% de los trabajadores en el campo que son vulnerables y expuestos a diferentes peligros relacionados con exposiciones agroquímicas, como pesticidas, fungicidas, herbicidas que pueden generar enfermedades laborales que con el pasar del tiempo pueden llegar a generar la muerte. Su objetivo es conocer las causas generadoras de enfermedades laborales producidas por sustancias químicas en trabajadores del sector agrícola del Corregimiento Buena Esperanza Cúcuta, Norte de Santander. Metodología. La investigación se desarrolló con una población de 150 trabajadores del sector agrícola en el Corregimiento de Buena Esperanza – Cúcuta, a quienes se aplicó un instrumento para recolección de información tipo encuesta debidamente validada, bajo un enfoque cualitativo. Resultados. Se pudo evidenciar que los agricultores del Corregimiento Buena Esperanza, Norte de Santander, Colombia están expuestos a altas concentraciones de agroquímicos y el nivel de riesgo es No aceptable según la Guía Técnica Colombiana (GTC-45). Por otra parte, se observa que no cuentan con un programa de capacitación sobre el uso de los agroquímicos y posibles enfermedades laborales, y el no uso de Elementos de protección personal en sus actividades agrícolas.

[Resumen] La Sentencia del Tribunal Superior de Justicia de Cantabria, objeto de comentario, se inscribe en una tendencia jurisprudencial que se ha ido consolidando con el paso del tiempo y que admite, de manera excepcional, la calificación del suicidio de la persona trabajadora como accidente de trabajo cuando se prueba la causalidad. Psychosocial risks (RPS) are often addressed from the perspective of labor law, but more rarely from that of social security law. However, they pose major problems of legal qualification when it comes to compensating the employees who are victims, the realization of the risk most often resulting in a temporary or permanent work stoppage. What then are the legal qualifications possibly opened up by the Social Security legislation on occupational risks to accommodate these evils resulting from work? What compensation is provided to victims of PSR/professional risks and, above all, to what extent can intentional and inexcusable faults be mobilized to improve the compensation for the damage suffered by these employees who are sick at work? The communication proposes to answer these two series of questions, major from the point of view of legal concepts and practical issues., Les risques psychosociaux (RPS) souvent abordés sous l’angle du droit du travail, le sont plus rarement sous celui du droit de la Sécurité sociale. Ils posent pourtant des problèmes de qualification juridique majeurs lorsqu’il s’agit d’indemniser les salariés qui en sont victimes, la réalisation du risque entraînant le plus souvent un arrêt de travail à titre temporaire ou définitif. Quelles sont alors les qualifications juridiques possiblement ouvertes par la législation de Sécurité sociale sur les risques professionnels pour accueillir ces maux issus du travail ? Law 10/2021, of 9 July, on remote work, defines telework as a form of remote work characterized by the use of technological tools and by the performance of the work activity outside the company's workplace, generally , at the home of the worker or place that he chooses. This new form of work organization brings with it the appearance of new risks and, consequently, the possibility of suffering accidents. For this reason, this article highlights, on the one hand, the existence of certain gaps that the Law suffers from, such as the absence of a specific definition of work accident in the telework modality and, on the other hand, it analyzes the possible extension to teleworking -generally carried out at the worker's home- of the legal concept of occupational accident regulated in Royal Legislative Decree 8/2015, of 30 October -General Social Security Law-, as well as the judicial doctrine existing about it., La Ley 10/2021, de 9 julio, de trabajo a distancia, define el teletrabajo como una modalidad de trabajo a distancia caracterizada por el uso de herramientas tecnológicas y por el desempeño de la actividad laboral fuera del centro de trabajo de la empresa, generalmente, en el domicilio de la persona trabajadora o lugar que esta elija. Esta nueva forma de organización del trabajo lleva consigo la aparición de nuevos riesgos y, por consiguiente, la posibilidad de sufrir accidentes. Por este motivo, el presente artículo pone de manifiesto, por un lado, la existencia de ciertas lagunas de las que adolece la Ley, como es la ausencia de definición específica de accidente de trabajo en la modalidad de teletrabajo y, por otro lado, analiza la posible extensión al teletrabajo -generalmente realizado en el domicilio de la persona trabajadora- del concepto legal de accidente laboral regulado en el Real Decreto Legislativo 8/2015, de 30 octubre -Ley General de la Seguridad Social-, así como de la doctrina judicial existente al respecto.

Introduction: Work accidents can be caused by unsafe action factors in the field, such as not wearing personal protective equipment (PPE), not following work procedures, and not following work safety regulations. The purpose of this study was to analyze the factors related to unsafe actions (unsafe behavior) in oil palm harvesters at PT Priatama Riau. Methods: This is an observational study. The study population consisted of 111 workers in the plantation harvester section. The research sample was calculated using the Slovin formula for as many as 86 workers. The independent variables consisted of OHS knowledge, attitudes, education, length of working period, age, OHS supervision, and OSH training. The dependent variable was Unsafe Action (unsafe behavior). Essential information was obtained through meetings, perceptions, and polls. The information collection instruments used in this study were survey sheets, agenda sheets, and cameras for documentation. Data analysis consisted of univariate and bivariate analyses. Bivariate analysis was performed using the chi-squared statistical test. Results: The factors related to unsafe action/unsafe behavior in oil palm harvesters were sex, years of service, knowledge, attitudes, OHS supervision, OHS training, and unsafe conditions. Conclusion: Judging from the factual test as a whole or together, the factors of tenure, gender, attitude, knowledge, OSH supervision, OSH training, work equipment, and unsafe conditions are related to Unsafe Actions.

137. La presunción “tiempo de trabajo” a efectos de la calificación de accidente de trabajo: el infarto de miocardio sufrido por la persona teletrabajadora

The STSJ of Madrid 89/2023 of February 3 examines a controversial case, the classification as a work accident of a myocardial infarction suffered by a remote work at home. The controversy revolves around the examination of labor notes that integrate the concept “work accident” and, specifically, regarding the presumption “working time”. The worker had a flexible work schedule that allowed the workday to start between 08:00 and 10:00 and their workday was recorded by turning on the computer. However, on the day of the events, said record was not produced. For these reasons, the social chamber of the TSJ of Madrid considers that the contingency that caused the death of the worker cannot be classified as a work accident because there is no record that the working day had started after reviewing the data from the time record., La STSJ de Madrid 89/2023 de 3 de febrero examina un supuesto controvertido, la calificación como accidente de trabajo del infarto de miocardio sufrido por una persona teletrabajadora en su domicilio. La controversia gira en torno al examen de las notas de laboralidad que integran el concepto “accidente de trabajo” y, concretamente, respecto a la presunción “tiempo de trabajo”. La persona trabajadora disponía de un horario flexible de trabajo que permitía iniciar la jornada laboral entre las 08:00 y las 10:00 y su jornada de trabajo se registraba con el encendido del ordenador. No obstante, el día de los hechos no se produjo dicho registro. Por tales motivos, la sala lo de social del TSJ de Madrid estima que no puede calificarse como accidente de trabajo la contingencia que causó el fallecimiento de la persona trabajadora porque no consta que se hubiera iniciado la jornada laboral tras revisar los datos del registro horario.

Throughout this project we will analyze the problems that the COOTRASAR company of Cúcuta has been presenting with the drivers assigned to cover inter-municipal routes, based on both international and national references; We can see that this problem not only affects the worker, but in turn also affects the operation of the company; For them we will use a series of resources that will lead us to determine what causes absenteeism due to occupational illness. Aim. Determine the causes that generate work absences of medical origin in the drivers of the COOTRASAR company in the city of Cúcuta. Methodology. To carry out this research, the observation and data collection technique is used and a mixed approach study will be carried out based on the information collected in the INCHECK Software of the COOTRASAR company of Cúcuta. Results. It is evident that absenteeism from work increases in drivers who have been doing this job for more than 15 years, and this is caused by prolonged exposure to the elements and the state of the roads they travel on. Absenteeism in 60% is associated with musculoskeletal disorders, while 30% is due to pathologies associated with psychosomatic disorders., Introducción. A lo largo de este proyecto analizaremos la problemática que viene presentando la empresa COOTRASAR de Cúcuta con los conductores asignados para cubrir rutas intermunicipales, basados en referentes tanto internacionales como nacionales; podemos observar que este problema no solo aqueja al trabajador, si no que a su vez también afecta la operación de la empresa; para ellos emplearemos una serie de recursos que nos llevara a determinar que produce el ausentismo por enfermedad laboral. Objetivo. Determinar las causas que generen ausentismos laborales de origen médico en los conductores de la empresa COOTRASAR de la ciudad de Cúcuta. Metodología. Para realizar esta investigación se utiliza la técnica de observación y recopilación de datos y se realizará un estudio de enfoque mixto con base la información recopilada en el Software INCHECK de la empresa COOTRASAR de Cúcuta. Resultados. Se logra evidenciar que el ausentismo laboral se incrementa en conductores que llevan más de 15 años ejerciendo esta labor, y esto es esto es causado por una exposición prolongada a los elementos y al estado de las vías por donde transitan. Los ausentismos en un 60% son asociados a desordenes musculo esqueléticos, mientras un 30% se debe a patologías asociadas trastornos psicosomáticos.

The Emergency Room (IGD) is part of the most vital service unit in helping to save the lives of patients who experience medical emergencies when they are first admitted to the hospital. Given the many potential hazards and risks that can cause work accidents, work-related illnesses, sentinel events and other unexpected events, efforts are needed to reduce or control these risks, so that all human resources in the hospital can avoid work-related accidents or diseases. Risk management actions are taken to respond to various risks in business activities or organizations. This risk management activity is carried out before the risk occurs so that it is an anticipatory action that can be taken and makes a plan that can be used if the risk arises so as to reduce negative impacts and avoid large losses. This study aims to analyze risk events, risk assessment, and causes of occupational safety and health (K3) risks for nurses at the Kuwait General Hospital Emergency Room. The approach used in this research is descriptive qualitative method. While the population of this study were all nurses in the Emergency Room at the Kuwait General Hospital. The sample method used is probability sampling. The sampling method or technique above was carried out using simple random sampling. Research data analysis uses the Failure Mode and Effect Analysis (FMEA) method for risk analysis, in calculating the Risk Priority Number (RPN) and making a list of critical risks by calculating the ratio of the total RPN value divided by a number of risks. The results of the analysis show that there are five stages of service activities that pose Occupational Health and Safety (K3) risks to nurses working in the Emergency Room at the Kuwait General Hospital. The five risks in the activity stage are getting there, arriving, being seen, receiving treatment, and leaving. La investigación buscó identificar y describir las principales causas de condena por culpa patronal a consecuencia de accidentes de trabajo que se presentaron en empresas colombianas las cuales debían contar con un sistema de gestión en seguridad y salud en el trabajo debidamente implementado. Para ello, en el diseño metodológico se acude a un enfoque cualitativo y el método es descriptivo, teniendo en cuenta los pronunciamientos de la sala laboral de la corte suprema de justicia; así como la técnica documental al analizar textos de tipo teórico, descriptivo-analítico, sobre el particular desde el análisis de sentencias con condenas por culpa patronal, las cuales se hicieron conforme a una ficha técnica, para responder a la pregunta de investigación ¿Cuál es el factor de atribución de responsabilidad de la culpa patronal? ¿Cuáles son las falencias en las que están incurriendo los empleadores frente a la debida implementación del SG-SST? Por último se realizaron conclusiones a las que se llegaron conforme al análisis realizado y se emitieron recomendaciones para prevenir la ocurrencia de accidentes de trabajo en las empresas colombianas. The investigation sought to identify and describe the main causes of conviction for employer fault as a result of work accidents that occurred in Colombian companies which had to have a duly implemented Occupational Health and Safety Management System. For this, in the methodological design, a qualitative approach is used and the method is descriptive, taking into account the pronouncements of the Labor Chamber of the Supreme Court of Justice; as well as the documentary technique when analyzing texts of a theoretical, descriptive-analytical type, on the subject from the analysis of sentences with convictions for employer fault, which were made in the form of a technical sheet, to answer the research question: Which is the attribution factor of employer fault? What are the shortcomings that employers are incurring in the proper implementation of the SG-SST? Finally, conclusions were reached according to the analysis carried out and recommendations were issued to prevent the occurrence of work accidents in Colombian companies. Fatal or serious occupational accidents occurring in Quebec are analyzed by the body responsible for the management of occupational injuries. After analysis, this organization transmits recommendations intended to correct the dangerous situations at the origin of these accidents. This process has the characteristics of an inter-organizational transfer of knowledge as delivered by several authors (Slaughter and Kirsch, 2006, Ko et al, 2005), That is to say a dyadic exchange process in which the source transmits knowledge to be used by a receiver. According to the different models of interorganizational transfer, this transfer occurs in a unidirectional mode and, by its nature, is carried out based on free choice. However, with regards to the inter-organizational transfer that this organization carries out, it derogates from these models on two points: the collaboration between the sender and the receiver as well as the legal obligation for the receiver to apply the knowledge received. These are until now two untreated aspects of the literature that our empirical study attempts to delineate. The study adopted a descriptive research method, both quantitative and correlational. The data collection instrument used is an online questionnaire. It was completed, completely or partially by 83 out of 97 companies that had agreed to take part in the research. That amounts to an overall participation rate of 85.5%. The results obtained show that the inter-organizational transfer of knowledge from fatal or serious occupational accident investigations is different from the usual models of knowledge transfer. They show, in addition, that the legal obligations to collaborate and implement the transferred knowledge have a positive influence on the effectiveness of the application of transferred knowledge. The SARS-CoV-2 Coronavirus has important effects on the workplace, since it modifies the labor relations system and, in turn, the way work is organized. The objective of the investigation, on the one hand, is to determine if the infection by SARS-CoV-2 could be considered an occupational disease or an accident at work, when workers are exposed by their work activity to contagion with this coronavirus, even if the occupational health and safety standards are met. And, on the other hand, determine the responsibility of the employer before the contagion of COVID-19 of its workers, scenarios and administrative and procedural responses, along with the possibility of claims or lawsuits. It is a legal investigation, of a documentary nature, with a bibliographic design. It is concluded that in Venezuela the SARS-CoV-2 coronavirus disease could be considered as labor, since article 70 of the Organic Law of Prevention, Conditions and Work Environment (LOPCYMAT), defines occupational disease and establishes the possibility of expanding the list of occupational diseases and in the current pandemic situation, they would have this consideration of the infections that occurred in the provision of the service. The most common occupational health and safety problem in scaffolding is falling from a height which is an occupational accident. The works carried out in the facade scaffold specify the requirements such as use at height and the national and international standards sought in the facade scaffold. The place where the highest drop is experienced is the facade scaffoldings. Employers should ensure that their employees are provided with personal protective equipment. They should also ensure that employees are aware of occupational health and safety and are trained in the use of scaffolding. Measures should be taken at each stage in the context of different occupational health and safety. The facade scaffolds vary according to the usage patterns on the façade but also according to their materials. It is important to choose the scaffold in the right material for proper use. The floods are categorized according to the usage stages. Facade scaffolding must be constructed and used according to the standards according to size and load classes. Although the standard facade scaffolds seem to be costly, they do not have any difficulties during the installation phase and the scaffolding is one of the best advantages. In order to prevent accidents in this type of scaffold use, it is necessary to activate occupational health and safety. Hazard evaluations are identified by the reasons why hazards can be identified and which work accidents may occur and it should be tried to prevent obstacles by ensuring that the most appropriate precautions against all of them are taken against all occupational diseases. Employers should pay attention to their health and safety in their employees as much as they should be paying attention. There is a label application on the facade scaffolding of the residential buildings. The label application itself is divided into green, yellow and red. If the use of scotch with a red label is not safe at all, those with a yellow label are required to work on the pier using personal protective equipment. In the case of a green labeled scaffold, it is a fully safe scaffold for compliance with standards and employees are not required to wear belts. Current practices should be searched for adequacy in tests and experiments and in the application of the standard requirements established in the Regulations and Standards. The risk assessment of the facade scaffolding in the construction of the residential building we have researched belongs to the Fine-Kinney method. Informal workers that might have a work accident and require access to the benefits offered by the system must overcome the barriers identified during two moments. The first one is determined by the process of voluntary affiliation to the system given that the requirements are not thought from the reality of this kind of worker. The second moment presents itself when the informal worker is affiliated under the wrong figure. If an accident takes place the difficulty would reside in demonstrating the causal nexus of the harmful fact with the work activity, since the ambiguous definition of a work accident given by the 1562 Law of 2012 links the work accident with a subordinate relation. From the judicial reflection point of view is that the intention of making evident the difficulties faced by the informal workers for voluntarily affiliating comes from, as well as revealing the barriers for accessing the welfare and economic benefits in case of a work accident. - Abstract
Objective Evaluation of patients with corneal injury camed to emergency service in our hospital. Material and Methods Patients who were admitted with eyeball injury in 2018 were evaluated according to age, gender, educational status, presence of work accidents, corneal injury ratings, associated corneal foreign bodies, lens and iris damage, whether or not intraocular foreign bodies were accompanied. Results In 2018, 57 eyes of 57 patients who were admitted with corneal injury and whose mean age was 33,8±12,9 (12-56) were evaluated. Four of the patients (%7) were female and 53 (%92,9) were male. Three patients were under 18, 4 were university graduates, 42 were high school and graduates, 3 were middle school graduates and 5 were primary school graduates. There were 3 (%5,2) adhesive substances, 3 (%5,2) alkaline substance, 6 (%10,5) epithelial defect, 43 (%75,4) corneal foreign body and 2 (%3,5) with corneal injury with intra-vitreous foreign body. Patients with alkaloid substance 2 (%66) housewife cleaning and 1 (%33) cleaning staff. Individuals who were cleaning in the workplace one patient was male (25%) and the other 3 patients were female. (75%). Of the 6 patients presenting with epithelial defect 5 were adult, 2 of them were female, and 1 was child. The two women with epithelial defects coz of the child's finger rubbed to the cornea. Other three male adult patients with epithelial defect coz of metallic foreign body happened during the work. Discussion Eyeball injuries are an eye disease that can affect individuals of all ages and should be treated according to the cause. [ABSTRACT FROM AUTHOR]

149. Evaluation of workplace accident-related admissions: A study of 1-year experience.

Objective: To contribute to the national data on the subject by analyzing WA-related ED admissions during a 1-year period in our center. Method: Cases admitted to our hospital due to a WA during a 1-year period were enrolled in the study. Information regarding gender, age, accident date, injury mechanism, injured body parts, consultations, diagnoses, severity of the injury, outcome of the patient and the services which the admitted patients were admitted to were gathered. p =.05 was considered to be significant. Results: Three hundred and eighty patients were enrolled in the study. A great majority of the victims (88.4%) were male. Mean age of the cases was 34.88±9.74 years. The month with the highest number of admissions was June (11.1%). WA victims mostly presented during day-time period (54.7%). Contact with sharp objects was the most common injury mechanism (34.2%). More than one third of the cases were consulted with at least one department (34.2%). Upper extremities were the most commonly injured body parts (51.3%). The most common diagnosis was mild soft tissue injury (40.0%). Most of the cases (86.6%) were discharged from the emergency department; 12.6% were admitted to our hospital; .8% were referred to another health care facility, and none of the patients died in the emergency department. Conclusions: WAs mostly affect young male workers; most of the WAs occur during day-time period; WAs mostly occur as a result of contact with sharp objects; mostly upper extremities are affected in which hands are the most commonly injured part, and hand fingers form the part which has the highest possibility of injury. Amaç: Merkezimize 1 yıllık dönemde başvuran iş kazası ilişkili olguları analiz ederek konu hakkındaki ulusal verilere katkıda bulunmak. Yöntem: Hastanemize 1 yıllık dönemde iş kazası sonucu başvuran olgular çalışmaya dahil edildi. Cinsiyet, yaş, kaza tarihi, yaralanma mekanizması, yaralanan vücut bölgesi, konsültasyonlar, tanılar, yaralanmanın ciddiyeti, hastanın akıbeti ve yatış yapılan hastaların hangi servislere yatırıldığı ile ilgili bilgiler toplanıp kaydedildi. İstatistiksel analizlerde Windows için Sosyal Bilimler İstatistik Paketi (SPSS) programı kullanıldı. p =0,05 anlamlı kabul edildi. Bulgular: Çalışmaya 380 hasta dahil edildi. Kurbanların büyük çoğunluğu (%88,4), erkekti. Olguların yaş ortlaması, 34,88±9,74 yıldı. En çok olgunun görüldüğü ay, Haziran'dı (%11,1). İş kazası kurbanları çoğunlukla gündüz başvurmuştu (%54,7). En sık yaralanma mekanizması, keskin cisimle temastı (%34,2). Olguların üçte birinden fazlası en az bir bölüme konsülte edilmişti (%34,2). Üst ekstremiteler, en çok yaralanan vücut parçasıydı ve iş kazası başvurularının çoğu üst ekstremite yaralanması nedeniyle gerçekleşmişti (%51,3). En sık tanı, hafif yumuşak doku yaralanmasıydı (%40,0). Olguların çoğu acil servisten taburcu edilmişti (%86,6); %12,6'sı hastanemize yatırılmış; %0,8'i başka bir merkeze sevk edilmişti. Acil serviste hayatını kaybeden olgu yoktu. Sonuç: Çalışmamızda elde edilen bulgulara göre iş kazaları çoğunlukla genç erkek çalışanları etkiler. İş kazalarının çoğu gündüz meydana gelir ve çoğunluğundan keskin cisimle temas, sorumludur. Today, construction industry is one of the main industries that the rate of occupational accidents is high. Taking the significant contributions of the construction industry as a laborintensive industry to the development and economy of the country into consideration, averting occupational accidents taking place and the damages they bring to the society becomes a crucial issue. There are many studies that focus on the causes of such occupational accidents, and it can be seen that various methods have been employed in such studies. In the first stage of this study, it is aimed that the causes of occupational accidents are analyzed through the method of multi-criteria decision-making method. The causes of occupational accidents are taken under review in terms of 3 main criteria and 14 sub-criteria, and each criterion identified is weighted. Fuzzy AHP method is employed to determine the weights of the criteria. When expert opinions are taken into account, it is estimated that the criterion with the highest weight value is "insufficient inspection of machine and vehicle gears". In the second stage, in line with the sub-criteria identified, three construction companies, which have been chosen by taking their status in the relevant industry into consideration, are evaluated with Fuzzy TOPSIS. As a result of the evaluation, when these three construction companies are ranked, it is revealed that the construction company taking a significant place in the industry ranks first, and acts responsibly towards occupational health and safety.
