105. La coscienza disubbidiente: ragioni, tutele e limiti

Abstract

This study follows four main guide lines: a reconstruction of the moral idea of conscience and its juridical protection, through the liberty of conscience and the conscientious objection as legal rights; an overview on the relations between conscientious objection, civil disobedience and right of resistance,focusing on the political interpretations of conscientious objection given by Anna Harendt, John Rawls and Joseph Raz; a general theory of the right of conscientious objection, meant to give its structure, logic and limits of application; a detailed analysis of conscientious objection in the Italian juridical context (voluntary interruption of pregnancy, medically assisted procreation and animal experimentation) and a dialectic approach to the new possible requests of objection.

106. Conscience and bioethics: what if everybody were objectors?

Abstract

In the last decades, conscientious objection went through a deep transformation. It has aquired a specific legal dimension as the right of conscientious objection. This change has deeply involved bioethics, starting new challanges in contemporary society. The right of conscientious objection was born as an instrument to safeguard people’s liberty of conscience. Its application is particularly sensitive in specific bioethical fields. As a matter of fact, the choice to object can deeply impact on a third person’s rights, as it happens for objection to abortion, medically assisted procreation and vaccinations. But what if everybody were objectors? A good starting point is the objection to abortion in Italy, where in some regions the percentage of objectors is nearly 80% in public hospitals. We could argue that the easiest solution is to forbid people to object. But would it solve the problem? Or could we produce major political and social problems? How can we find a possible solution, in terms of fundamental rights’ balance?

In the last decades the debate on LGBT rights has gained a wide appeal in Europe. With law n. 2013-404, lesbian and gay couples can get married in front of the French State and adopt children under the same conditions as heterosexual couples. But what happens if people in charge of celebrating marriage au nome de l’État do not bear this sort of marriage on ethical grounds? Is it possible to recognize an hypothesis of conscientious objection for them? This article frames the issue starting from a reconstruction of the 2013 French judiciary affair.

Abstract

RACIONAL: O esôfago de Barrett é uma condição na qual a mucosa escamosa esofágica é substituída por metaplasia intestinal especializada, que predispõe o paciente ao desenvolvimento de adenocarcinoma esofágico. Este é precedido por displasia e carcinoma precoce; o rastreamento dessas lesões faz-se através de endoscopias digestivas periódicas com biopsias randomizadas. A incidência aumentada desse, tem despertado interesse no desenvolvimento de novas técnicas endoscópicas, como a cromoendoscopia com azul de metileno, para melhorar a identificação do esôfago de Barrett e suas complicações. OBJETIVO: Determinar se as biopsias dirigidas pela cromoendoscopia com azul de metileno oferecem vantagem em relação ao método convencional na detecção do esôfago de Barrett. MATERIAL E MÉTODO: Estudaram-se 45 pacientes com diagnóstico prévio de esôfago de Barrett, todos submetidos a dois exames de endoscopia digestiva alta com biopsias, em intervalo de 4 semanas, um convencional e outro com aplicação do corante, no período entre abril e outubro de 2002. RESULTADOS: Os resultados histológicos das biopsias de todos os exames foram comparados. Observou-se sensibilidade de 62,5%, especificidade de 15,4%, valor preditivo positivo de 57,7% e valor preditivo negativo de 18,2%. Não houve diferença significativa quanto ao número de biopsias. O tempo de duração da técnica de cromoendoscopia foi significativamente maior quando comparado ao da técnica convencional. CONCLUSÃO: Não se observou vantagem na utilização da cromoendoscopia em relação à técnica randomizada no diagnóstico do esôfago de Barrett.

Abstract

Coronavirus disease has disrupted tuberculosis services globally. Data from 33 centers in 16 countries on 5 continents showed that attendance at tuberculosis centers was lower during the first 4 months of the pandemic in 2020 than for the same period in 2019. Resources are needed to ensure tuberculosis care continuity during the pandemic.

Abstract

El presente artículo analiza el delicado tema de la objeción de conciencia en relación con el tema de la vulnerabilidad. Tras exponer un breve panorama histórico-jurídico, el interés se focaliza en dos mecanismos opuestos del funcionamiento de la objeción de conciencia, haciendo especial referencia al contexto italiano y francés. Así mismo se intenta ofrecer una visión teórico-jurídica de la objeción de conciencia como derecho positivo y se indican algunos límites para su ejecución en el ámbito del Estado constitucional de derecho. This article faces a sensitive issue: the relationship between conscientious objection and vulnerability. After a short legal-historical overview, close attention is given to two opposite phenomena concerning conscientious objection, with specific Italian and French case studies. Moreover, conscientious objection is scrutinized from a legal-theoretical viewpoint as a positive right, whose limits deserve careful consideration within the constitutional rule of law.

L’età dei diritti, secondo Bobbio, può essere considerata l’ultimo atto di una “rivoluzione copernicana” che consiste nella rivendicazione di (nuovi) diritti non più ex parte principis, bensì ex parte populi. Tuttavia, in un momento in cui il linguaggio dei diritti si è imposto come la lingua franca del discorso pubblico globale, all’impossibilità di individuare un fondamento assoluto si affiancano questioni legate al relativismo etico e al pluralismo dei valori. Si corre, allora, il rischio di un imperialismo culturale, portato avanti in nome di principi da taluni ritenuti globalmente dominanti? Il lavoro analizzerà in chiave critica questo profilo, a partire dai contributi di Bobbio, per comprendere sulla base di quali ragioni si possa predicare l’effettiva universalità di alcuni diritti riconosciuti a livello internazionale.

Abstract

This paper aims at analyzing the right to health as a fundamental human right. Firstly, it will give a theoretical clarification of its logic, structure, and peculiarities from a legal viewpoint. Secondly, the paper will pay close attention to the main historical stages of its development as a positive right, from the liberal State to contemporary constitutional democracies. International documents and legal sources will also be considered in this perspective. Thirdly, it will criticize the bare formal protection of health, starting from General Comment number 14 of the Committee on Economic, Social, and Cultural Rights of 2000. Two main points will be scrutinized: the presumed lack of economic resources as a limit for health protection and the monopolies of States on harmful substances retail or addicting practicies. Eventually, the paper will suggest to consider the right to health as a fundamentally fragile right. As a matter of fact, it will be argued that it deserves special protection, especially from potential economic exploitation.

Abstract

In recent decades, conscientious objection has undergone a profound transformation. Indeed, there has been a transition from conscientious objection as a request to conscientious objection as a positive right in specific cases (e.g. military service, abortion). Nevertheless, the moral dimension of such form of resistance is still crucial: to some extent, it maintains itself prior to and complementary with the legal discourse. Within this peculiar perspective, the relationship between conscientious objection and the moral concept of Truth is an authentic challenge. In fact, conscientious objectors as truth bearers and consequently conscientious objection as a testimony of the Truth correspond to a certain view on morals, law and personal disobedience. This paper focuses on these thorny issues. Firstly, this paper will try to analyse dialectically the Truth-based approach to conscientious objection as a testimony or prophecy and the positive law-based approach to conscientious objection as a Legal Instrument for Ethical Consistency. Secondly, it will point out the main implications of these approaches, and their moral premises in terms of theories of conscience. Thirdly, it will scrutinize two possible ‘logics’ of conscientious objection from the legal viewpoint: dualistic logic and monistic logic. Finally, the paper will point out the goals and practical effects of the Truth-based approach and the positive law-based approach to conscientious objection within our democratic political communities.
