Abstract

The Convention on Biological Diversity (CBD) is a major international agreement to ensure the conservation of biological diversity, the sustainable use of various components of biological diversity, and fair and equitable access and benefit sharing of advances arising from the use of related genetic resources. The CBD excludes human genetic resources. In light of the rapid advances in biotechnology, genetic resources are increasingly being utilised by different types of users and in different industries. This usage is not confined to plants, animals or micro-organisms but includes human genetic resources and sometimes a mix of such resources. In the absence of any international agreement, various national governments are framing their own rules and guidelines. This patchwork of regulation may eventually impede global research efforts. This chapter argues that the CBD is qualified to be the central agency at the global level for the advance of broader benefit sharing frameworks. By implication, the scope of the CBD should be expanded to include human genetic resources.

Abstract

Benefit sharing is a relatively new area in international law, given that the Convention on Biological Diversity (CBD) was only adopted in 1992. However, the history of formal benefit-sharing agreements between the users and the providers of traditional knowledge goes back beyond the adoption of the CBD. This chapter outlines indigenous peoples' rights in the context of access to plants, animals, micro-organisms and associated tradtional knowledge, and discusses four paradigm cases: The Kani people (India); Niprisan (Nigeria); the Inteernational Cooperative Biodiversity Group project (Mexico), and the San/Hoodia case (southern Africa). These cases straddle the historical boundary between unregulated and regulated access to non-human biological resources, and are thus highly instructive in terms of lessons learned, best practice and emerging policy challenges for the access and benefit sharing regime of the CBD.

Abstract

Drawing on the lessons from India and China in Bt cotton, this paper argues that emerging linkages between regulation, promoting innovation and access to innovation call for a new approach. Intellectual property rights and regulatory regimes may constrain diffusion and usage of technology. In the new approach, state’s intervention through appropriate policies for promoting innovation is important and Socio-Economic assessment of technologies should also play a role in policy formulation. The emerging concept of Responsible Research and Innovation (RRI) can be useful in framing the new approach. The paper points out that understanding of access to and availability of innovations can be linked with the RRI framework, and a coherent policy framework that promotes both access and responsible innovation can be developed. It also points out that this framework will facilitate development of socially relevant innovations and will also be useful in addressing controversies in development and use of innovations. 118. The Development Compact: A Theoretical Construct for South–South Cooperation*

Abstract

India’s development cooperation efforts began soon after the country gained its Independence in 1947. Indeed, there are some incidences that date back to even pre-Independence days. India is a strong believer of the fact that developing coun- tries should not be entirely dependent upon assistance from the developed world; they must pool their own resources and capabilities to help each other. This article examines the larger framework of Indian external assistance through the concept of ‘development compact’. The new development compact is between actors of the South, rather than the North–South exchange that characterized earlier arrangements; it is no longer about the imposition of conditionalities for recipient countries but more on the principles that govern South–South Cooperation (SSC) such as mutual gain, non-interference, collective growth opportunities and indeed an absence of conditionalities. The modern concept of a development compact provides for development assistance that works at five different levels, namely trade and investment, technology, skills upgrade, lines of credit (LOC) and, finally, grants. The engagement of emerging economies with other Southern countries has provided a major pull factor for a wider engagement across these five elements, which emphasizes the comprehensive support for economic development. These factors are discussed in this article to provide an analytical taxonomy with some illustrative evidence from the Indian experience.

Abstract

Although Article 26 of the Cartagena Protocol enables countries to take into account socio-economic aspects in decision-making with respect to Living Modified Organisms (LMOs), translating that into practice has not been easy. Countries have followed different approaches; while some countries have chosen to use a comprehensive list of socio-economic impacts they want to assess, some countries have not given to this much importance. This article explains the need for taking socio-economic aspects into account and analyses the practices followed in this. It suggests a model that differentiates technology regulation from decision-making taking into account the socio-economic aspects. This model takes into account the socio-economic aspects in four stages of commercialisation and it is suggested as a suitable model for developing countries. [ABSTRACT FROM AUTHOR]
