Without downplaying the importance of the dialogue that takes place among the ordinary domestic courts and the ECJ, the authors deem the interaction among the highest courts to be even more significant for the nature of European constitutional democracies, since it also impinges upon the way that constitutional courts affect the constitutional setting of national democracies in the European Union. In fact, the dialogue among the highest courts can heavily impact upon the balance between the democratic and the constitutional principle. Although different courts show a different propensity to engage in such interaction, a point that will be considered again in the concluding remarks, the intention of this paper is to analyse the institutional and cultural conditions that can be considered as important conditions in influencing positively or negatively the development of extra-systemic (voluntary) references. This will lead the authors to present an overview of the appointment mechanisms and the professional profiles of justices in six European constitutional courts: France, Italy, and UK (old Member States); Poland, the Czech Republic and Hungary (new Member States). Some conclusive remarks will then be offered to point to the institutional mechanisms that should be put in place in order to make constitutional courts accountable, given the different patterns of judicial appointment and the different professional profiles displayed by judges sitting in those courts.

57. From Constitutional Body to Policy Arena: Politics, Inescapable Companion of the Italian Judicial Council

The new architecture of the Italian Republic, set up in 1948, foresaw the creation of a High Judicial Council, entrusted with full competences in recruiting, promoting, assessing, and training judges and prosecutors. The new body began what has been called a long process of institutionalisation, which ended around the end of the 1970s. Such a process expanded its capacities to steer and govern the whole court system. Whereas it is fairly common to see scholarly works addressing the conflict that exists in Italy between the judiciary and the executive branch, the organisational behaviour of the Council has been much less analysed. This article considers this aspect in detail and points to the development of the Council from a constitutional body – ensuring the independence of members of the judiciary – to a policy arena, in which practices of governance, competence and know how, ways of solving problems and conflicts have been developed over the years.

Si argomenta che tale ricerca debba riguardare non solo la forma del governo di un paese, i modi attraverso i quali sono adottate e implementate le regole di governo, ma anche il grado in cui tali regole sono interiorizzate da parte degli attori preposti alla tutela del nomos (giudici, governanti, burocrati e detentori di cariche pubbliche in genere) e degli attori i cui comportamenti sono parte costitutiva del nomos, i cittadini.

L'articolo intende contribuire a comprendere questo fenomeno proponendo una analisi comparata delle politiche adottate nell’ambito dell’organizzazione del sistema giudiziario dai paesi nuovi membri dell’UE nel periodo compreso fra il 1997 e il 2007. Tale analisi permette di mostrare sia le tendenze di carattere organizzativo emerse nel settore della governance giudiziaria durante l’allargamento dell’UE, sia gli effetti non intenzionali indotti dal processo di cooperazione giudiziaria che questi paesi hanno aperto con i paesi vecchi membri. Tali effetti possono essere colti con particolare pregnanza attraverso la ricostruzione dei meccanismi di socializzazione attivati dall’UE.

A triadic structure is key to ensure the legitimacy of the judge, that is, a prototype of the mechanism of dispute settlement adopted in complex and advanced societies. In order to promote the enforcement of the rule of law in the new member States, the European Union and the Council of Europe enacted several policy instruments, all of them aiming at providing judges and prosecutors with new arenas where they may socialize, exchange views and information, share ideas. Lawyers and private attorneys are almost absent from the targets addressed by the European policy of rule of law promotion. Therefore, knowhow and capacities are strengthened on one side of the bench – the side of the judicial actors – whereas the private side – the lawyers – seemed to be neglected. Relying on an innovative data set constructed alongside a five years of research conducted by the author, this paper addresses the issue whether or not these policy instruments will prove able to positively influence the legitimacy of the adjudication in the new members. In the last section, some hypotheses are suggested to set down a tentative research agenda for the very next future.

Questo lavoro si occupa dei gemellaggi amministrativi svolti fra il 1998 e il 2005 nel settore della politica giudiziaria. L’analisi di questi progetti permette di evidenziare che i cambiamenti giuridici, organizzativi e gestionali introdotti con le politiche giudiziarie dagli stati candidati sono stati guidati da diversi meccanismi. A livello internazionale2, si sono attivate forme di apprendimento sociale e di argomentazione tecnico-scientifica che hanno indotto processi di convergenza cognitiva sui principi normativi che hanno ispirato i leader nazionali nel disegno delle riforme. La legittimità delle sedi nelle quali sono state scambiate queste argomentazioni ha avvalorato gli standard sulla base dei quali valutare l’adeguatezza delle proposte di riforma. Le élite nazionali hanno potuto così ancorare le loro attività di riforma alle norme e agli standard condivisi dai network creati da organizzazioni intergovernative, come il Consiglio d’Europa, e da organizzazioni non governative specializzate nel settore della cooperazione giudiziaria.

Endometrial cancer (EC) with Mismatch Repair deficiency (MMRd) is characterized by the accumulation of insertions/deletions at microsatellite sites. These mutations lead to the synthesis of frameshift peptides (FSPs) that represent tumor-specific neoantigens (nAg) proved to be shared across patients/tumors with MMRd. In this study, we explored the feasibility of a nAg-based cancer vaccination design in EC with MMRd. We adopted a whole exome sequencing approach and ad hoc bioinformatics pipelines to characterize FSPs in 35 patients with EC. A mean of 146 mutated mononucleotide repeats (MNRs) was identified with enrichment in the patients' group with MLH1 impairment. A high coverage emerged from the comparative analysis of the EC FSPs with the content of the previously validated NOUS-209 vaccine. We obtained pieces of evidence of FSPs translation as expressed proteins from Ribo-seq, supporting the potential as the target of vaccination. - Abstract
Tumor heterogeneity refers to the diversity observed among tumor cells: both between different tumors (inter-tumor heterogeneity) and within a single tumor (intra-tumor heterogeneity). These cells can display distinct morphological and phenotypic characteristics, including variations in cellular morphology, metastatic potential and variability treatment responses among patients. Therefore, a comprehensive understanding of such heterogeneity is necessary for deciphering tumor-specific mechanisms that may be diagnostically and therapeutically valuable. Innovative and multidisciplinary approaches are needed to understand this complex feature. In this context, proteogenomics has been emerging as a significant resource for integrating omics fields such as genomics and proteomics. By combining data obtained from both Next-Generation Sequencing (NGS) technologies and mass spectrometry (MS) analyses, proteogenomics aims to provide a comprehensive view of tumor heterogeneity. This approach reveals molecular alterations and phenotypic features related to tumor subtypes, potentially identifying therapeutic biomarkers. Many achievements have been made; however, despite continuous advances in proteogenomics-based methodologies, several challenges remain: in particular the limitations in sensitivity and specificity and the lack of optimal study models. This review highlights the impact of proteogenomics on characterizing tumor phenotypes, focusing on the critical challenges and current limitations of its use in different clinical and preclinical models for tumor phenotypic characterization.

- Abstract
Background: Prostate-specific membrane antigen (PSMA) is a rational target for noninvasive detection of recurrent prostate cancer (PCa) and for therapy of metastatic castration-resistant prostate cancer (mCRPC) with PSMA-targeted agents. Here we conducted serial measurements of PSMA expression on circulating tumor cells (CTCs) to evaluate patterns of longitudinal PSMA dynamics over the course of multiple sequential therapies., Methods: A retrospective investigation of men with mCRPC undergoing evaluation at medical oncology clinics at our institution assessed the dynamics of PSMA expression in the context of different systemic treatments administered sequentially. Eligibility included patients who began systemic therapies with androgen receptor (AR)-directed agents or taxane agents for whom peripheral blood samples were tested for CTC mRNA of AR splice variant-7 (AR-V7), prostate-specific antigen (PSA), and PSMA (with >2 CTC + results) in a CLIA-accredited laboratory., Results: From August 2015 to November 2017, we identified 96 eligible men. Fifteen had greater than or equal to 2 sequential therapies and evaluable CTC samples, greater than or equal to 1 expressing PSMA (PSMA+). Among the 15 patients included in this analysis, a total of 54 PSMA status evaluations were performed in the context of 48 therapies during a median follow-up of 18 months. At baseline, PSMA signal was detected ("positive") in 11 of 15 (73.3%) patients, while for 4 of 15 (26.7%) patients PSMA signal was undetectable ("negative"). In all but two patients, the baseline collection corresponded with a change in treatment. On the second assessment, PSMA increases were detected in all 4/4 (100%) PSMA-negative patients and 8 of 11 (72.7%) PSMA-positive patients. PSMA significantly decreased in a patient treated with
177 Lu-PSMA-617. Serum PSA declines were seen in 7 of 8 (88%) of the treatment periods where PSMA decreased., Conclusions: PSMA expression in CTCs is a dynamic marker. PSMA transcript declines appear to be associated with concurrent decreases in serum PSA. - Abstract
Background: Inherited DNA-repair gene mutations are more prevalent in men with advanced prostate cancer than previously thought, but their clinical implications are not fully understood., Objective: To investigate the clinical significance of germline DNA-repair gene alterations in men with metastatic castration-resistant prostate cancer (mCRPC) receiving next-generation hormonal therapy (NHT), with a particular emphasis on BRCA/ATM mutations., Design, Setting, and Participants: We interrogated 50 genes for pathogenic or likely pathogenic germline mutations using leukocyte DNA from 172 mCRPC patients beginning treatment with first-line NHT with abiraterone or enzalutamide., Outcome Measurements and Statistical Analysis: We assessed the impact of germline DNA-repair gene mutation status on ≥50% and ≥90% PSA responses, PSA progression-free survival (PSA-PFS), clinical/radiologic progression-free survival (PFS), and overall survival (OS). Survival outcomes were adjusted using propensity score-weighted multivariable Cox regression analyses., Results and Limitations: Among 172 mCRPC patients included, germline mutations (in any DNA-repair gene) were found in 12% (22/172) of men, and germline BRCA/ATM mutations specifically in 5% (9/172) of men. In unadjusted analyses, outcomes to first-line NHT were better in men with germline BRCA/ATM mutations (vs no mutations) with respect to PSA-PFS (hazard ratio [HR] 0.47; p=0.061), PFS (HR 0.50; p=0.090), and OS (HR 0.28; p=0.059). In propensity score-weighted multivariable analyses, outcomes were superior in men with germline BRCA/ATM mutations with respect to PSA-PFS (HR 0.48, 95% confidence interval [CI] 0.25-0.92; p=0.027), PFS (HR 0.52, 95% CI 0.28-0.98; p=0.044), and OS (HR 0.34, 95% CI 0.12-0.99; p=0.048), but not in men with non-BRCA/ATM germline mutations (all p>0.10). These results require prospective validation, and our conclusions are limited by the small number of patients (n=9) with BRCA/ATM mutations., Conclusions: Outcomes to first-line NHT appear better in mCRPC patients harboring germline BRCA/ATM mutations (vs no mutations), but not for patients with other non-BRCA/ATM germline mutations., Patient Summary: Patients with metastatic castration-resistant prostate cancer and harboring germline mutations in BRCA1/2 and ATM benefit from treatment with abiraterone and enzalutamide., (Copyright © 2018 European Association of Urology. - Abstract
Introduction: Cephalothoracopagus is the less common type of conjoined twins (CTs) with an incidence estimated at one in three million births or one in 58 conjoined twins. Maternal gene Vg1, a member of the TGF-beta family of cell-signalling molecules which are implicated in dorsoanterior development, and specific actions of Hox and Pax genes that are implicated in very early embryogenesis may be identified as aetiologic factors., Materials and Methods: A prenatal diagnosis of cephalothoracopagus CTs diagnosed at 17 weeks in a woman undergoing amniocentesis for advanced maternal age is reported., Conclusion: Although first-trimester diagnosis of CTs is feasible and has been reported as early as 8 weeks's gestation, CTs may be misdiagnosed with monoamniotic twins, lymphangioma, teratoma, and/or neoplasm and may be undiagnosed until early second trimester. Three-dimensional and color Doppler ultrasound enabled precise prenatal visualization of the fusion site. Ultrafast MR imaging should be considered an adjunct to ultrasound for antenatal characterization of structural anomalies and for planning surgical separation in selected cases. Echocardiography is mandatory in all cases of CTs as congenital heart defects are seen in 20-30% and polyhydramnios in 50-75%. Neural tube and midline fusion defects, diaphragmatic hernia, and imperforate anus are the frequently associated abnormalities. Prognosis among survivors is usually poor (44% die in the neonatal period) and is dependent upon the type of conjunction, degree of involvement of the shared organs, and presence or absence of associated anomalies, with the worst prognosis in case of twins sharing liver and heart.
