This chapter begins with an introduction to the statutory framework governing the admissibility of bad character evidence. It goes on to consider the statutory definition of ‘bad character’ and to discuss the admissibility of evidence of bad character in criminal cases under the Criminal Justice Act 2003, namely: the admissibility of the bad character of a person other than the defendant and the requirement of leave; the admissibility of evidence of the bad character of the defendant under various statutory ‘gateways’, including the gateway by which evidence may be admitted if it is relevant to an important matter in issue between the defendant and the prosecution; and safeguards including the discretion to exclude evidence of bad character and the judge’s power to stop a case where the evidence is contaminated. Procedural rules are also considered, as is the defendant’s right to challenge evidence of bad character.

This chapter first discusses cross-examination, the questioning of a witness immediately after his examination-in-chief by the legal representative of the opponent of the party calling him, or by the opposing party in person, and by the legal representative of any other party to the proceedings or by any other party in person. The object of cross-examination is to elicit evidence which supports the cross-examining party’s version of the facts in issue and to cast doubt upon the witness’s evidence-in-chief. It then turns to re-examination. A witness who has been cross-examined may be re-examined by the party who called him. The object of re-examination is to repair damage that has been done by cross-examination.

The public interest in efficient and fair trials may be seen as underlying the rules of disclosure in civil litigation, whereby a litigant is obliged to make pre-trial disclosure of the documents on which he relies and the documents that adversely affect his own case or adversely affect, or support, another party’s case, even though such documents may not be admissible evidence at the trial. There is also a public interest in enabling material to be withheld where its production would harm the nation or the public service. Where these two kinds of public interest clash and the latter prevails over the former, relevant and otherwise admissible evidence is excluded at trial. Such material is said to be withheld by reason of ‘public interest immunity’. This chapter discusses the development of the modern law on public interest immunity; the scope of exclusion on grounds of public policy; and related procedural issues in civil and criminal cases.

Evidence is information by which facts tend to be proved, and the law of evidence is that body of law and discretion regulating the means by which facts may be proved in both courts of law and tribunals and arbitrations in which the strict rules of evidence apply. This introductory chapter discusses truth and the fact-finding process and explains how getting to the truth in court is hampered by practical constraints, the adversarial system, the rules of evidence themselves, and the fact that litigation is a human endeavour that necessarily provides scope for differences of opinion, error, deceit, and lies. The chapter also contains a brief history of the development of the law to date.

Eight new zinc complexes of bisguanidine ligands have been structurally characterised and tested for the polymerisation of lactide. Initially this necessitated the preparation of the new six bisguanidine ligands (TMG2thf, DMEG2thf, trans-TMG2(1,2)ch, trans-DMEG2(1,2)ch, R,R-TMG2(1,2)ch, R,R-DMEG2(1,2)ch). With these ligands in-hand zinc chlorido complexes could be obtained, which were characterized by X-ray crystallography and NMR spectroscopy. Furthermore, two new zinc chlorido complexes are reported, based on previous bisguanidine ligands ((1,3)TMG2ch, (1,3)DMEG2ch). All complexes show a distorted tetrahedral coordination geometry. These eight complexes are utilised as catalysts in melt polymerization of unsublimed, technical rac-lactide at 150°C. The most promising complexes were tested with different purities of lactide (technical and recrystallized) and with or without the addition of a co-initiator. The conversion was determined via 1H-NMR or FT-IR spectroscopy. Kinetic measurements show first-order behaviour with respect to lactide. The end group of the polymer was determined by MALDI-ToF measurements. Moreover, the impact of chiral complexes was examined with regard to the tacticity of the polymer. Complexes containing a thf-backbone show the highest polymerisation activity with recrystallized rac-lactide and benzyl alcohol as co-initiator.

Two series of ligands based on diaminocyclohexane (DACH) have been prepared and successfully complexed to Al(III) and Zn(II) metal centres. Solution and solid-state studies reveal a tendency to form mono- or bis-ligated forms depending on the steric bulk of the ligand. These complexes have been tested for their ability to ring open rac-lactide. Al(III) based complexes generally gave atactic PLA after a polymerization time of 1-2 days. The Zn(II) complexes, were found to be more active and furnished PLA with a slight heterotactic bias.

A series of Zn II complexes, based on propylenediamine Schiff bases, have been prepared and fully characterized. X-ray crystallography and NMR spectroscopy identified significant differences in the solid and solution state for the Zn II species. All complexes have been applied to the ring-opening polymerization of l-lactide with emphasis on industrial conditions. High conversion and good molecular weight control were generally achievable for Zn(A–D) 2, and high-molecular-weight poly(lactic acid) (PLA) was prepared in 1 min at a 10 000:1:33 [lactide]/[Zn]/[BnOH] loading. The more active Zn II catalysts were also applied to PLA degradation to alkyl lactate under mild conditions. Zn(A–B) 2 demonstrated high activity and selectivity in this process with PLA being consumed within 1 h at 50 °C. Zn(C–D) 2 were shown to be less active, and these observations can be related to the catalysts’ structure and the degradation mechanism. Initial results for the degradation of poly(ethylene terephthalate) and mixed feeds are also presented, highlighting the broader applicability of the systems presented.

In this paper a series of 7 salalen ligands based on an aminopyrrolidine backbone have been prepared and characterised. Several systems have been reduced to the salan ONNO type-ligand. All ligands have been complexed to Al III with Al(1–7)Me, Al(2a)(OiPr) and Al(7a)Me being characterised by single-crystal X-ray diffraction. In general the Al III centres are best described as being in a trigonal bipyramidal geometry. The solution and solid-state structures are discussed. All complexes have all been trialled for the production of PLA from rac-lactide, the salalen complexes had a preference for heterotactic PLA (P r = 0.71), whereas the salan had a more isotactic bias (P m = 0.72). In all cases PLA with low dispersities and predictable molecular weights were prepared. The activity of the two classes of ligands is compared with the salan complexes appearing to be significantly more active than the salalen systems.

A range of ligands based upon 2-(aminomethyl)piperidine have been successfully complexed to Mg(ii), Zn(ii) and group IV metal centres. These complexes have been characterised both in solution and solid state with different coordination geometries realised dependant on the nature of the ligand. For the Mg(ii) and Zn(ii) complexes, M(1-2)2, were isolated and analysed by DOSY NMR spectroscopy. These ligands also furnished diastereomeric group IV complexes, M(1-2)2(OiPr)2. Group IV salalen and salan complexes, M(4-5)(OR)2 were also found to be diastereomeric in nature, with either β-cis or α-cis geometriesrespectively. The tridentate ligand, 6H2, yielded five coordinate complexes with both Ti(iv) and Zr(iv). All complexes were screened for the ring opening polymerisation of rac-lactide under both solvent and melt conditions. For the Mg(ii) and Zn(ii) complexes, good activity was observed with Zn(1-2)2 demonstrating immortal polymerisation characteristics.

A range of simple ethylenediamine based Zn(II) and Mg(II) complexes have been prepared and their structures determined via NMR spectroscopy and X-ray crystallography. Preparation of these complexes was also demonstrated to be scalable, with 25 g of Zn(1)2 being readily produced. These complexes were trialed for the ring opening polymerisation (ROP) of lactide under industrially relevant conditions. Their reactivity has been related to their structure in solution. Incredibly high activity is achieved in the majority of cases including low catalytic loading and high temperatures, under industrially relevant conditions (180 °C 10 000 : 1 : 100 [LA] : [Zn] : [BnOH]), with high conversion achieved within 10 minutes and TOFs in excess of 100 000 h−1 achieved. The performance of these initiators for polymer production is supported by GPC, DSC and IR spectroscopy which all highlight the excellent control achieved.

Facts in issue and relevant facts are treated as established by the courts only insofar as they are proved by evidence. This chapter discusses three exceptions to this general rule: (i) some facts may be presumed in a party’s favour in the absence of proof or complete proof, including marriage, legitimacy, death, the regular and proper performance of public or official acts, sanity and negligence; (ii) a fact will be treated as established where the court takes judicial notice of it either (a) without enquiry, in the case of facts that are beyond serious dispute, notorious or of common knowledge or (b) after enquiry (usually political facts, customs, professional practices and historical and geographical facts); and (iii) a fact ceases to be in issue when a party has formally admitted it.

This chapter discusses several well-established principles whereby relevant evidence is excluded because of extrinsic considerations which outweigh the value that the evidence would have at trial. Three types of privilege are considered: (i) the privilege against self-incrimination (including statutory withdrawal of the privilege, compatibility with Article 6 of the European Convention on Human Rights, the compulsory production of pre-existing documents and materials, and substituted protection); (ii) legal professional privilege, which enables a client to protect the confidentiality of (a) communications between him and his lawyer made for the purpose of obtaining and giving legal advice (known as ‘legal advice privilege’) and (b) communications between him or his lawyer and third parties for the dominant purpose of preparation for pending or contemplated litigation (known as ‘litigation privilege’); and (iii) ‘without prejudice’ privilege, which enables settlement negotiations to be conducted without fear of proposed concessions being used in evidence at trial as admissions.

This chapter examines the circumstances in which a judgment in a civil case or a verdict in a criminal case is admissible in subsequent proceedings as evidence of the facts on which it was based. It analyses the rule in Hollington v Hewthorn & Co Ltd, which has been widely criticized, that judgments are not admissible as evidence of the facts on which they are based. Its effect, in both civil and criminal proceedings, has been largely removed by the Civil Evidence Act 1968 and the Police and Criminal Evidence Act 1984 respectively. Concerning civil proceedings, consideration is given to previous convictions generally, previous convictions in defamation proceedings, previous findings of adultery and paternity, previous acquittals, and other previous findings. Concerning criminal proceedings, consideration is given to previous convictions of the accused, previous convictions of persons other than the accused, and previous acquittals.

This chapter discusses the law on documentary evidence and real evidence. It addresses the following key issues: Where a party to litigation wishes to adduce in evidence a statement contained in a document, (a) should it be open to proof by production of a copy of the document and, if so, (b) in what circumstances and subject to what safeguards? Where a party to litigation wishes to admit a document in evidence, (a) should he be required to establish that it was written, signed, or attested by the person by whom it purports to be written, signed, or attested and, if so, (b) how should these matters be established? When should material objects be admissible in evidence and why do they need to be accompanied by oral testimony? When, and subject to what safeguards, should a court inspect a place or object out of court?

This chapter considers the following categories of hearsay: statements in public documents, works of reference, evidence of age, evidence of reputation, and statements forming part of the res gestae, statements which are admissions made by an agent of a defendant. All of these categories were established at common law as exceptions to the rule against hearsay, and all of them have been preserved by statute. All of the cases considered, apart from evidence of age and res gestae statements, have been expressly preserved and given statutory force in both criminal proceedings and civil proceedings (by s 7(2) and (3) of the Civil Evidence Act 1995).

This chapter discusses the admissibility of confessions under the Police and Criminal Evidence Act 1984 (the 1984 Act). It considers how, under s 76(2) of the 1984 Act, confessions may be excluded as a matter of law where it is represented that a confession has been obtained by oppression or in consequence of something said or done which was likely to render it unreliable. It also considers the discretion to exclude confession under s 78(1) of the 1984 Act; the effect of breaches of the Codes of Practice issued under the 1984 Act; the voir dire; statements made in the presence of the accused; and facts discovered in consequence of inadmissible confessions.

Under the common law rule against hearsay, any assertion, other than one made by a person while giving oral evidence in the proceedings, was inadmissible if tendered as evidence of the facts asserted. The Civil Evidence Act 1968 constituted a major assault upon the common law rule in civil proceedings by making provisions for the admissibility of both oral and written hearsay subject to certain conditions. In June 1988 the Civil Justice Review recommended an inquiry by a law reform agency into the usefulness of the hearsay rule in civil proceedings and the machinery for rendering it admissible. The recommendations were put into effect by the Civil Evidence Act 1995. This chapter discusses the admissibility of hearsay under the Civil Evidence Act 1995; safeguards; proof of statements contained in documents; evidence formerly admissible at common law; and Ogden tables.

This chapter discusses the circumstances in which relevant evidence can be excluded, as a matter of law or discretion, on the grounds that it was obtained illegally, improperly, or unfairly. The principles for exclusion of evidence are considered, and exclusion in both civil and criminal cases discussed. In respect of civil cases, discretionary exclusion under the civil procedure rules is discussed. In respect of criminal cases, discretionary exclusion at common law and under statute is discussed. The chapter also considers the circumstances in which criminal proceedings should be stayed as an abuse of the court’s process, where a trial would undermine public confidence in the criminal justice system and bring it into disrepute.

This chapter discusses exceptions to the general rule for corroboration of evidence. There are three categories of exception (i) where corroboration is required as a matter of law (speeding, perjury, treasons and attempts to commit these offences) and a conviction cannot be based on uncorroborated evidence; (ii) where neither corroboration in a technical sense nor supportive evidence is required as a matter of law, but the tribunal of fact may need to be warned to exercise caution before acting on the evidence of certain types of witness, if unsupported; (iii) five cases in which corroboration is not required as a matter of law, and there is no obligation to warn the tribunal of fact of the danger of acting on the unsupported or uncorroborated evidence, but there is a special need for caution. The five cases are confessions by mentally handicapped persons, identification evidence, lip-reading evidence, cases of Sudden Infant Death Syndrome, and unconvincing hearsay. This chapter discusses the admissibility of evidence of character. A number of factors govern the admissibility of character evidence, including whether the proceedings are civil or criminal and whether the evidence relates to the character of a party or non-party. It is also necessary to consider the nature of the character evidence in question. It may relate to either good or bad character and, in either event, may constitute evidence of a person’s actual disposition, that is his propensity to act, think, or feel in a given way; or evidence of his reputation, that is his reputed disposition or propensity to act, think, or feel in a given way. Thus, the character of a person may be proved by evidence of general disposition, by evidence of specific examples of his conduct on other occasions (including, in the case of bad conduct, evidence of his previous convictions), or by evidence of his reputation among those to whom he is known.

This chapter discusses the law on experts and opinion evidence. As a general rule, opinion evidence is inadmissible: a witness may only speak of facts that he personally perceived, not of inferences drawn from those facts. However, there are two exceptions to this general rule: (i) an appropriately qualified expert may state his opinion on a matter calling for the expertise that he possesses; and (ii) a non-expert witness may state his opinion on a matter not calling for any particular expertise as a way of conveying the facts that he personally perceived. Experts may also give evidence of fact based on their expertise.

This chapter discusses the meaning of hearsay in criminal proceedings and the categories of hearsay admissible by statute in such proceedings. It considers the relationship between the hearsay provisions of the Criminal Justice Act 2003 (the 2003 Act) and Article 6 of the European Convention on Human Rights as it relates to hearsay; the definition of hearsay and its admissibility under the 2003 Act, including admissibility under an inclusionary discretion (section 114(1)(d); and safeguards including provisions relating to the capability and credibility of absent witnesses the power to stop a case and the discretion to exclude. Also considered in this chapter are: expert reports; written statements under section 9 of the Criminal Justice Act 1967; and depositions of children and young persons under section 43 of the Children and Young Persons Act 1933.

The questioning of witnesses, which generally falls into three stages known as examination-in-chief, cross-examination, and re-examination, is central to the English adversary system of justice. This chapter focuses on the first stage, examination-in-chief. In this stage the party calling a witness, or counsel on his behalf, will seek to elicit evidence that supports his version of the facts in issue. The discussions cover young and vulnerable witnesses; the rule against leading questions and the exceptions to the rule; refreshing the memory in court and out of court; the rule against previous consistent or self-serving statements and the common law exceptions to the rule (complaints in sexual cases, statements admissible to rebut allegations of recent fabrication, statements made on accusation, previous identification, statements admissible as part of the res gestae and statements in documents used to refresh the memory and received in evidence); and unfavourable and hostile witnesses.

This chapter considers the risk of mistaken identification, and the law and procedure relating to evidence of visual and voice identification. In respect of evidence of visual identification, the chapter addresses: the Turnbull guidelines, including when a judge should stop a case and the direction to be given to the jury; visual recognition, including recognition by the jury themselves from a film, photograph or other image; evidence of analysis of films, photographs or other images; pre-trial procedure, including procedure relating to recognition by a witness from viewing films, photographs, either formally or informally; and admissibility where there have been breaches of pre-trial procedure. In respect of evidence of voice identification, the chapter addresses: pre -trial procedure; voice comparison by the jury with the assistance of experts or lay listeners’; and the warning to be given to the jury (essentially an adaption of the Turnbull warning, but with particular focus on the factors which might affect the reliability of voice identification).

Following the reduction in the scope of legal aid as a consequence of the Legal Aid, Sentencing and Punishment of Offenders Act 2012, the courts in England and Wales have seen a rise in the number of litigants in person. This article explores whether there is a role for Higher Education institutions in addressing the problem.

In this paper we have prepared a series of Ti(IV), Hf(IV) and Al(III) complexes based on bipyrrolidine salan pro-ligands. The Hf(IV) complexes have all been characterised in the solid-state, the chiral ligands coordinate to Hf(IV) in an α-cis manner whereas the meso ligand coordinates in a β-cis geometry. The Hf(IV) complexes are all active for the ROP of rac-lactide in the melt, with the fluxional meso complex affording a strong isotactic bias Pm = 0.84. As expected Hf(3)(OiPr)2 polymerised L-LA faster than rac-LA (kapp = 5.9 x 10-3 mins-1 vs 3.8 x 10-3 mins-1). For Ti(IV) complexes atactic PLA was formed. The salan pro-ligands have also been complexed to Al(III), with the complexes being characterised in the solid and solution state generating a series of novel Al-Me and Al-OiPr species. Al(1)(OiPr) was fluxional on the NMR timescale, whereas Al(3)(OiPr) was locked in solution with no exchange. Interestingly, the Al(III) complexes of 3H2 produce PLA with a very strong heterotactic bias Pr upto 0.87, whereas atactic PLA is produced with 1H2. For Al(3)(OiPr) a linear relationship is observed with Mn and conversion. Experiments with the addition of an equivalent of rac-LA to the selective initiators have also been performed and are discussed.

New zinc guanidine complexes with N,O donor functionalities were prepared, characterized by X-Ray crystallography, and examined for their catalytic activity in the solvent-free ring-opening polymerization (ROP) of technical-grade rac-lactide at 150 °C. All complexes showed a high activity. The fastest complex [ZnCl2(DMEGasme)] (C1) produced colorless poly(lactide) (PLA) after 90 min with a conversion of 52 % and high molar masses (Mw=69 100, polydispersity=1.4). The complexes were tested with different monomer-to-initiator ratios to determine the rate constant kp. Furthermore, a polymerization with the most active complex C1 was monitored by in situ Raman spectroscopy. Overall, conversion of up to 90 % can be obtained. End-group analysis was performed to clarify the mechanism. All four complexes combine robustness against impurities in the lactide with high polymerization rates, and they represent the fastest robust lactide ROP catalysts to date, opening new avenues to a sustainable ROP catalyst family for industrial use.

In England and Wales, there is an increasing need for the provision of pro bono legal services. Law students may be a resource that can help fill the access to justice gap, whilst at university and onwards in their future careers. Whilst some students are intrinsically motivated towards altruistic behaviour, many are not. This article will consider what motivates students to undertake pro bono work whilst at law school.The article will explore the range of intrinsic and extrinsic motivating factors for student participation in pro bono programmes and consider how students can be encouraged to engage in such activities. The article will also consider whether exposure to pro bono experience can instil a public service ethos in students.In conclusion, the article will highlight experience as an influential factor in encouraging initial participation in pro bono work but also instilling a willingness to undertake pro bono work in the future.

Online quizzes are widely used as formative learning exercises. An important innovation is that online activity log data allow direct measurement of student activity in quizzes, such as time taken and number of attempts. It has previously been shown that participation in quizzes increases dramatically when grades are awarded as incentives. Data from six semesters in an introductory economics course show a significant positive correlation between total quiz activity and final exam marks for a given first test mark. This has implications for the prediction of exam aegrotats. While the results don't necessarily imply a causal link between quiz activity and exam marks, they do provide some evidence to indicate such a link.

The removal of a deposition mass of 8.55 ± 0.43 mg cm −2 of lard from plain-weave cotton fabrics under controlled flow conditions has been investigated using water and a solution containing a non-ionic surfactant. Three distinct flow regimes of cross-flow, through-flow and a 2:1 combination of cross- and through-flow respectively have been studied at three cleaning agent temperatures of 10 °C, 25 °C and 40 °C. The lard removal efficiency has been quantified using weighing and image analysis methods to determine the mass per unit area of lard in the treated region. The hydrodynamic resistance changes of the fouled samples have been monitored during the washing process. A time-dependent colour analysis has been shown to be an effective quantitative method of both showing the kinetics of mass removal and investigating mass re-distribution during cleaning. Computational fluid dynamic simulations have been used to investigate the shear rate distribution on the yarn surface during the flow conditions selected. Results demonstrate that effective removal of lard from fabrics at low temperatures requires a combination of chemical, physical and hydraulic factors as hydrodynamic flow alone is insufficient to ensure complete removal. Trends in hydraulic resistance changes due to fabric swelling during cleaning are also reported.

We report the rationalised design of aluminium initiators and their application for ROP of rac-lactide (rac-LA). A very minor change to the ligand backbone (imine reduction) to give secondary amines was found to have a dramatic effect on activity and selectivity with isotactic PLA being realised.

Herein we report the synthesis and characterisation of a series of salalen and salan ligands derived from 2-(aminomethyl)piperidine. Depending on the choice of starting salicylaldehyde, a bicyclic salan type ligand (1-3H2) or imino salalen type ligand (4-6H, 7-9H2) were prepared. The ligands were successfully complexed to group 4 metals and aluminium; with hafnium and zirconium octahedral complexes, M(1-3)2, were realised; whilst with aluminium tetrahedral and trigonal bipyramidal complexes, Al(1-9)Mex (x = 1,2), were isolated. The complexes have been characterised in solution via(1)H and (13)C{(1)H} NMR spectroscopy and in the solid state by X-ray crystallography. The group 4 complexes were observed to have a fac-fac arrangement of ligands and there were two isomers present when 3H2 was ligated. The imino aluminium complexes Al(7-9)Me were isolated as a mixture of diastereoisomers. The resultant complexes were trialed in the ring opening polymerisation of rac-lactide with both heterotactic and isotactic PLA being demonstrated. Tacticity was found to be dependent on the nature of the ligand and metal used; the M(1-3)2 complexes were generally found to have a heterotactic preference (Pr = 0.67-0.76) and the aluminium polymerisation outcome was dictated more by the steric influence of the ligand, particularly for Al(4/6)Me2/Al(7/9)Me.
