The patent system is criticized today by some practitioners and economists. In fact, there is a partial disconnection between patent demographics and productivity gains, but also the development of actors who do not innovate and who develop business models that their detractors equate with a capture of annuities or a dangerous commodification of patents. This book provides a less Manichaean view of the position of patents in the system of contemporary innovation. It first recalls that these criticisms are not new, before arguing that if these criticisms have been revived, it is because of a partial shift from an integrated innovation system to a much more fragmented and open system. This shift accompanied the promotion of a more competitive economy. The authors show that this movement is coherent with a more intensive use of patents, but also one that is more focused on their signal function than on their function of direct monetary incentive to innovation.

This book explores the role of patents in today's knowledge economy. We discuss how patents have become a valuable commodity and have a lucrative market of their own. However, to profit from patent monetization, this Patent market must be closely linked to the R&D market and the Product Market.This book offers a systematic approach to patent deployment to maximize profits beginning with data collection from patent, journal and business sources. Readers will be guided through analyses of the patent landscape to identify traps and opportunities for commercialization. This book argues that patents must be aggregated into portfolios to maximize their effectiveness and value in the modern economy. With strong patent portfolios, companies can be engaged in licensing and more sophisticated business models like forming patent alliances and collaborating with IP intermediaries. Finally, the book will provide an overview of the various ways of valuing patents and suggest some simplified approaches for management to value the company's patents.

This book evaluates existing and explores new mechanisms for the adequate payment of copyright owners for the use of their works. The underlying assumption is that adequate rewards to creators and subsequent right holders will continue to be a goal of copyright law (particularly to incentivize further creation and investment). In the search for viable methods it first focuses on the reduction of transaction costs and the role of new technologies. It also discusses the further development and broader application of new mechanisms that might be necessary to enhance the adequacy and efficiency of payment systems, since the more onerous payment systems are, the more irrelevant copyright risks become due to lack of acceptance, and the less likely both are to fulfill their functions.

لم تدخل حقوق الملكية الفكرية في دائرة اهتمام اتفاقية جات 1947م، ومع ذلك اعترفت الاتفاقية بها ودعت كل دولة من الدول الأعضاء لاتخاذ التدابير اللازمة للتوافق مع القوانين التي تنظم حقوق الملكية الفكرية، ولكن مفاوضات الملكية الفكرية أسفرت عن اتفاقية التريبس التي عاجلت حقوق الملكية الفكرية ووضعت أحكاما خاصة بشأن القابلية للحصول على براءة الاختراع، وعلى هذا تناول الكاتب بحثه في أجزاء ثلاثة: براءة الاختراع وشروط منحها ومعايير أخذ البراءة، وحماية الاختراعات الناتجة عن التكنولوجيا الحيوية وحماية الأصناف النباتية.

جاء هذا البحث في الحماية المدنية متناولا براءات الاختراع والأسرار التجارية، من خلال التركيز على دعوى الحماية المدنية ونطاقها ومقوماتها وصورها ووسائل المطالبة بالتعويض عن الضرر الواقع عليهما نتيجة الاعتداء ولن يتم التطرق إلى موضوع الاختصاص القضائي أو الحماية الجزائية إلا في إطار ارتباطها بموضوع الدراسة، كما أنه تم التركيز على الموضوعات المشتركة في البراءات والأسرار التجارية، كما ستجيب هذه الدراسة عن العديد من التساؤلات في معرض المقارنة بين البراءات والأسرار التجارية ووسائل حمايتها، فالتشريعات المقارنة خصت البراءات بحماية جزائية خاصة ويترتب على انعقادها المسئولية المدنية، فما هي مقومات الحماية للأسرار التجارية، وهل يعتبر العقد وسيلة ناجعة للحماية، وفي حال غياب أي رابطة عقدية مع صاحب السر هل يمكن مساءلة الغير عن الاعتداء على سر تجاري استنادًا للقواعد العامة، وهل تستطيع الدعوى الخاصة المتمثلة بدعوى المنافسة غير المشروعة سد ما يعتري نظام الحماية للبراءات والأسرار التجارية من ثغرات؟

When submitting patent applications, patentees are disclosing huge amounts of technical knowledge that can be utilised for development. This book investigates whether it is possible to execute the disclosed technologies just by reading the patent application. Nefissa Chakroun argues that while TRIPS Agreement obliges inventors to disclose full and complete disclosure, patent information users lack the capacity to fully utilise such information for their economic development. Scrutinising the disclosure and the development function of the patent system, the book offers a critical analysis of the disclosure requirements of the patent system and an in-depth examination of ways of accessing and retrieving patent information.
