At the Paris climate conference (COP 21) in December 2015, the first global climate agreement was adopted, under which all Parties participate in climate change mitigation through nationally-determined contributions (NDCs). The first round of negotiations concerning the implementation of the Paris Agreement was held in Bonn, Germany, in May 2016. During this meeting, the three subsidiary bodies - the SBI, SBSTA and APA - launched discussions on how to create the necessary rules, modalities and procedures to implement the Paris Agreement. This work continues as the three bodies meet in context of COP 22 in Marrakech, Morocco, in November 2016. This report assesses the tasks to create the rules related to all key parts of the agreement: mitigation and adaptation, climate finance, transparency, land use and forestry, technology, capacity building, cooperative approaches, loss and damage as well as facilitating implementation and compliance. In addition to describing the tasks for each topic, the report analyses the role of Finland in implementing the Paris Agreement, and how Finnish know-how can be used in enhancing climate action worldwide.

Pariisin sopimus on oikeudellisesti sitova, globaalisti kattava ja se asettaa kunnianhimoisen tavoitteen hillitä ilmaston lämpenemistä 1,5-2 °C tasolle esiteolliseen aikaan verrattuna. Maailman ilmastotyön kunnianhimoa on parannettava jo ennen vuotta 2020, jotta nämä tavoitteet voidaan saavuttaa. Tapoja parantaa kunnianhimoa on monia. Päästösitoumuksia voivat asettaa maat, joilta ne vielä puuttuvat. Muut maat voivat laajentaa tai kiristää sitoumuksiaan. Päästöjä voidaan vähentää sitoumusten ulkopuolisilla aloilla. Lisäksi voidaan edistää kansainvälisiä yhteishankkeita ja ripeyttää ilmastoratkaisujen käyttöönottoa. YK:n ilmastosopimuksen liepeillä olevia käytännön ilmastoratkaisuja edistäviä, yhteistyötä kannustavia ja lisätoimista keskustelevia foorumeja on mahdollista vahvistaa. Suomi voi olla aktiivinen näissä kaikissa toimissa. Suomi voi myös moninkertaistaa myönteisen ilmastovaikutuksensa tarjoamalla muun maailman käyttöön päästöjä vähentäviä ratkaisuja. Näistä ratkaisuista esitellään sata ratkaisua kattaen laajan kirjon suomalaista osaamista energiantuotannosta maatalouteen, teknologiasta poliittiseen ohjaukseen ja yritysten tuotteista kansalaisjärjestöjen hankkeisiin. Pariisin sopimus on yleisesti otettu positiivisesti niin suurimmissa päästäjämaissa, ilmastoneuvotteluja seuraavissa kansainvälisissä järjestöissä kuin mediassa. 12 suurinta päästäjää ovat hyvin tyytyväisiä sopimuksen tasapuolisuuteen ja vain hieman varauksellisia sopimuksen uskottavuuden suhteen. Järjestöissä ja median reaktioissa suhtautuminen on kuitenkin hajaantuneempaa. Raportissa tarkasteltujen 12 päästöiltään suurimman neuvotteluosapuolen INDC-tavoitteiden kunnianhimon taso, päästökehitys, päästöarvioiden laatu ja politiikkatoimet eroavat toisistaan hyvin paljon. Ilmastopolitiikan kunnianhimon tason vertailua kuitenkin hankaloittavat mm. joiden maiden päästöarvioiden huono luotettavuus sekä ns. yhteisten mutta erilaisten vastuiden periaate. Näihin haasteisiin vastaaminen on yksi merkittäviä kehitystehtäviä Pariisin sopimuksen jatkotyössä.

This paper explores possibilities to strengthen the global climate change negotiations by improving the efficiency of the negotiations process under the United Nations Framework Convention on Climate Change (UNFCCC). The negotiations are taking place against the backdrop of continuing growth of global greenhouse gas emissions and already observable impacts of climate change. Given the urgent and multifaceted nature of the climate change problem, the expanding international climate policy agenda and the various new institutions and processes created under the UNFCCC in recent years, the efficiency of the negotiations process is an important challenge. This working paper was commissioned by the Nordic Working Group for Global Climate Negotiations (NOAK) to serve as a discussion paper for a workshop “Strengthening the Global Climate Change Negotiations” that took place at the Nordic Council of Ministers in Copenhagen, Denmark, in April 2012. The paper was subsequently updated to reflect discussions at the workshop on the basis of the Chatham House rule. It aims to address the state-of-play in the UNFCCC negotiations, identify some of the main problems and develop concrete proposals to enhance the effectiveness of the climate regime. In doing so, the paper focuses on three main clusters of procedural issues: organization of the work, institutions exercising oversight of the negotiation process, and the decision-making of the COP. Inputs from outside the regime are also briefly addressed. The paper does not intend to give mature suggestions on the way forward, but rather, it seeks to identify issues and themes concerning the efficiency of the UNFCCC negotiations for further discussion.

This contribution seeks to explain the innovations and broader implications of the EU Climate and Energy Package from the viewpoint of general EU law and international law. It provides an innovative analysis of the Package through the lenses of the principle of environmental integration, highlighting the complex web of internal and external legal tools that the EU uses to pursue its climate change objectives.
