It takes complexity to beat complexity. —Uhl-Bien and Arena 1 Nursing professional governance (NPG) is one of the most significant advances in nursing practice in the last 50 years in the United States and abroad. Although there have been advances in how NPG is designed and operationalized, in many health care organizations, NPG essentially operates as a complicated rule-bound bureaucracy, mimicking the organization's overall operational architecture and processes. This traditional bureaucratic design was appropriate, given its relatedness to the hierarchical structure in which health care systems flourished for many years, yet the evolving health care landscape demands a new approach to the governance of professional nursing practice. The purpose of the article is to demonstrate that NPG, if reimagined and operationalized as a complex adaptive system (CAS), can become the nexus for nursing and interprofessional engagement, experimentation, and innovation.

Reconstruction of ruptured anterior cruciate ligaments (ACLs) is limited by the availability and donor site morbidity of autografts. Hence, a tissue engineered graft could present an alternative in the future. This study was undertaken to determine the performance of lapine (L) ACL-derived fibroblasts on embroidered poly(l-lactide-co-ε-caprolactone) (P(LA-CL)) and polylactic acid (PLA) scaffolds in regard to a tissue engineering approach for ACL reconstruction. Surface modifications of P(LA-CL)/PLA by gas-phase fluorination and cross-linking of a collagen foam using either ethylcarbodiimide (EDC) or hexamethylene diisocyanate (HMDI) were tested regarding their influence on cell adhesion, growth and gene expression. The experiments were performed using embroidered P(LA-CL)/PLA scaffolds that were seeded dynamically or statically with LACL-derived fibroblasts. Scaffold cytocompatibility, cell survival, numbers, metabolic activity, ultrastructure and sulfated glycosaminoglycan (sGAG) synthesis were evaluated. Quantitative real-time polymerase chain reaction (QPCR) revealed gene expression of collagen type I (COL1A1), decorin (DCN), tenascin C (TNC), Mohawk (MKX) and tenomodulin (TNMD). All tested scaffolds were highly cytocompatible. A significantly higher cellularity and larger scaffold surface areas colonized by cells were detected in HMDI cross-linked and fluorinated scaffolds compared to those cross-linked with EDC or without any functionalization. By contrast, sGAG synthesis was higher in controls. Despite the fact that the significance level was not reached, gene expressions of ligament extracellular matrix components and differentiation markers were generally higher in fluorinated scaffolds with cross-linked collagen foams. LACL-derived fibroblasts maintained their differentiated phenotype on fluorinated scaffolds supplemented with a HMDI cross-linked collagen foam, making them a promising tool for ACL tissue engineering.

Modernes Recht ist positives Recht. Es gilt kraft Entscheidung. Dies ruckt die Machtfrage in den Blick der Rechtssoziologie: als Machtgeneration durch Recht und als Rechtsgeneration durch Macht. Dass positives Recht aufgrund von Entscheidung existiert verweist auf seine Veranderbarkeit. Positives Recht – auch Kirchenrecht – ist veranderlich. Anlasse, um uber Rechtsveranderungen nachzudenken, bilden haufig wiederkehrende Normverstose. Rechtsbruche konnen rechtliches Lernen auslosen. Die Lernprozesse sind gleichwohl heikel, insoweit sie Ordnungen destabilisieren konnen. Es besteht die Herausforderung, Rechtsnormen so auszutauschen, dass die Rechtsadressatinnen und -adressaten ihre Erwartungen enttauschungsarm auf die neuen Normen ausrichten konnen. Anderte die Kirche wesentliche Normen des Kirchenrechts, entstunde Kontingenzverdacht. Man kann die geringe Beweglichkeit des Kirchenrechts daher als strategisch motiviert verstehen, die kirchliche Ordnung nicht zu destabilisieren. Rechtssoziologisch ist freilich zu bedenken, dass Reformverweigerung nicht nur stabilisiert, sondern auch destabilisiert, wenn sie Legitimitatsprobleme erzeugt.

Die Legitimitat von Recht spiegelt sich in der Rechtssoziologie in der Frage, ob Recht anerkannt wird. Die Kirchenrechtssoziologie notiert diesbezuglich Schwierigkeiten. Die weitgehende Nichtbeteiligung der Laiinnen und Laien an Rechtserzeugung und -anwendung schwacht die Anerkennung des Kirchenrechts. Rechtsstaatlichkeitskriterien finden keine durchgangige Anwendung. Der kirchliche Grundrechtsschutz bietet nicht den Schutzumfang, den Burgerinnen und Burger demokratischer Rechtsstaaten gewohnt sind. Kirchliche Autoritaten werden in geringerem Mas mit den Mitteln moderner Machtbegrenzung konfrontiert. Den wachsenden kirchlichen Antijuridismus kann man daher als in der Auffassung vieler Kirchenglieder begrundet ansehen, dass in der Kirche illegitime Macht Recht und illegitimes Recht Macht erzeugt.

Normen sind wirksam, wenn sie befolgt werden oder ihre Nichtbefolgung sanktioniert wird. Die Wirksamkeit kirchlicher Normen ist gering ausgepragt. Sie werden haufig missachtet. Nur selten zieht dies eine Sanktion nach sich. Kirchenrechtlich eroffnete Moglichkeiten werden wahrgenommen, aber in abnehmender Weise. Um die hierfur verantwortlichen Grunde zu verstehen, ist nach den Bedingungen der Rechtsbefolgung zu fragen. Die Rechtssoziologie nennt vor allem Rechtskenntnis, Sanktionserwartungen und Legitimitatsvorstellungen. Viele Normen des Kirchenrechts sind kaum bekannt. Die Kirche verfugt uber keinen Zwangsapparat, um mithilfe der Rechtspflege Rechtsbefolgung oder Substitute der Anspruchserfullung durchzusetzen. Der Grad an normativer Abweichung zwischen den kirchenrechtlichen und nichtkirchlichen Normen wird als stark erlebt, insoweit das Kirchenrecht ein geringes Freiheitsrechteniveau aufweist, als theologisch defizitar und als kulturell unsensibel empfunden wird. Dies schlagt sich vielfach in einer Ablehnung des Kirchenrechts nieder.

Ordnungstheorien verstehen Recht als Kraft der Sozialgestaltung, Konflikttheorien sehen seine Rolle primar in der Vermeidung und Befriedung von Konflikten. Beide Funktionen kann man ineinandersetzen: Recht erzeugt Ordnung – unter anderem durch Konfliktvermeidung und -bearbeitung. „Recht und Konflikt“ bildet ein eigenes Feld der (Kirchen)Rechtssoziologie. Es thematisiert Merkmale rechtlicher Konfliktbearbeitung: Beratungsstrukturen, Instanzen der Rechtspflege und (auser)gerichtliche Vermittlungspraktiken. Wie weltliches Recht ist Kirchenrecht eine Spezialmaterie, deren Durchdringung rechtliche Beratung voraussetzt. Eine Polizei fehlt in der Kirche durchgangig. Dies wirft die Frage auf, ob und unter welchen Bedingungen Kirchenrecht Wirkung verzeichnen kann, ohne von einem Rechtsstab gestutzt zu werden. Im Zentrum weltlicher und kirchlicher Justizforschung stehen (auser)gerichtliche Vermittlungspraktiken zwischen Konfliktparteien. Vor allem das Gerichtswesen spielt in modernen Rechtsordnungen eine bedeutende Rolle, in Staat und Kirche.

Um religioses Recht wie das Kirchenrecht soziologisch zu erfassen, bietet sich ein pluralistisches Rechtsverstandnis an, das neben dem Staat auch andere Gruppen (Staatenbundnisse, Vertragsparteien oder Religionsgemeinschaften) als Erzeugerinnen von Recht wahrnimmt. Wer rechtspluralistisch argumentiert, muss die Frage nach den spezifischen Merkmalen von Recht fur sich klaren. Niklas Luhmann verstand Recht als Kommunikation mit binarer Codierung „recht“/„unrecht“. Rechtsbildung bestehe in der Institutionalisierung von Erwartungen hinsichtlich „rechten“ Verhaltens. Luhmanns Ansatz lasst sich mit anderen verknupfen, die Recht als institutionell gebundene Doktrin verstehen. Wahrend jede soziale Normativitat doktrinare Zuge tragt, stutzt sich das Recht auf Institutionen, die fur doktrinare Konsistenz und Justiziabilitat sorgen.

Die Studie ist die erste Monographie, die aus kanonistischer (kirchenrechtswissenschaftlicher) Sicht eine Soziologie des romisch-katholischen Kirchenrechts, des so genannten kanonischen Rechts, entwirft. Die Studie setzt deskriptiv-soziologisch an. Sie folgt dem Paradigma einer Soziologie des Rechts und formuliert eine verstehende Theorie der Kirchenrechtssoziologie. Hierbei nimmt sie auf bestehende rechtssoziologische Theorien Bezug. Diese werden daraufhin befragt, inwieweit sie zum Verstandnis des gegenwartigen Kirchenrechts beitragen. Der Wirklichkeitsbezug der so erarbeiteten theoretischen Kirchenrechtssoziologie wird durch Erkenntnisse der Rechts- und Religionssoziologie plausibilisiert.

Health care transformation is guided by the triple aim of improving health, enhancing the patient experience, and reducing costs. Experts have recommended the addition of a fourth aim, improving the experience of providing care. They advise that achievement of the triple aim will only be possible if we create the conditions where health care workers can find meaning and joy in their work. Nurses' experiences with meaning and joy in their practice have not been well described. In an effort to fill this knowledge gap, nurses across the nation recently participated in a qualitative study to share their experiences with meaning and joy in their nursing practice. The study utilized a narrative inquiry approach with a lens of appreciation to elicit and interpret nurses' stories. The stories, recorded and archived in StoryCorps, provided rich insight into meaning and joy in nursing practice. The study captured contemporary themes that crossed practice settings and generations across the United States. Four themes emerged from the analysis, including: fulfilling purpose-"I am a nurse"; meaningful connection; impact-the wow factor; and the practice environment. The practice environment theme included 3 subthemes: teams work, leaders model the way, and opportunities to learn and grow. The themes are described and illustrated with participant quotes. The study findings build on published evidence related to meaning in nursing practice and our conceptual understanding of joy. Results align with recommendations for defining and focusing on the fourth aim: To improve the practice experiences of nurses so they can more fully contribute to achieving both the triple aim in health care and their own well-being. Specific implications for leaders and supportive practice environments are discussed.

Kirchenrecht in den Medien – das ist ein wenig wahrge nommenes und doch prasentes Thema, vor allem in den vergangenen Jahren, in denen in der medialen Aufarbeitung des Missbrauchs skandals kirchliches Strafrecht und amterrechtliche Fragen offentlich diskutiert wurden. Doch nicht nur kirchliche Skandale haben einen rechtlichen Bezug; vielmehr lasst sich uber die in der Welt verfasste Kirche – eine Glaubensgemeinschaft in Rechtsgestalt – kaum sprechen, ohne zumindest indirekt auf ihre rechtliche Organisation abzustellen, denn diese durchzieht die Kirche als strukturelle Perspektive. Auch im Kern des medial vermittelten Kirchendiskurses findet sich daher zumeist ein kirchenrechtlicher Gehalt. Kirchenrecht in den Medien – eine Analyse dazu muss exemplarisch bleiben. In der Studie „Kirchenrecht in den Medien“, deren Ergebnisse hier vorgestellt werden, wurde der kirchenrechtliche Gehalt in den zentralen Nachrichtensendungen der offentlich-rechtlichen Fernsehsender ARD und ZDF im Jahr 2010 erhoben. English Canon Law in the Media. Analysis of the Coverage in the News Programs of ARD and ZDF. Canon law in the media – this is a little perceived, yet present topic, especially in recent years during which questions related to Church structures and criminal legal issues have been pub licly discussed. However, not only Church scandals have a legal reference; instead it is nearly impossible to speak about the Church constituted as part of the world – a religious community with an inherent legal structure – without at least indirectly addressing the Church as a legal organization insofar as it pervades the Church from a structural perspective. Therefore, at the core of Church media coverage one can often find canonical content. Canon Law in the media – such an analysis must be exemplary. In the study Canon Law in the Media , the results of which are presented in this article, a survey was made of the canonical content of coverage presented by the main news programs of German public television (ARD and ZDF) in 2010. From A as in “Abendmahl” (Eucharist), B as in Beichtsiegelbruch (breaking the seal of the confessional) to Z as in Zolibat (Celibacy), the year 2010 proved to be filled with controversial topics, dominated by coverage of cases of abuse in ecclesial institutions.

"Political criminals" of the early 20th century were adjudged to be psychopaths, a term which was generally accompanied by a negative moral judgement. However, other more positive appraisals were also made at this time. These contradictory moral judgements by psychiatrists expose the need for an examination of the historical development of concepts, traditions and moral debates associated with political criminals (anarchists, assassins, revolutionaries). This will be undertaken in the context of psychiatry/ criminology, security (and surveillance) policy as well as culture and the arts in German-speaking countries from 1880 to the early 1920s.

One of those SEAs is Sustained Service Delivery for the Poor. This paper is one of two (the second one addresses behavior change) that will develop frameworks and tools to be employed to supplement IEG evaluations in urban transport, water and sanitation, and nutrition. This paper serves three purposes. First, it defines service delivery and its key concepts and features as well as provides examples of how the World Bank Group has supported service delivery. Second, the paper serves a practical purpose within IEG in developing a framework and analytical protocol to evaluate service delivery as part of three ongoing sector evaluations in urban transport, water and sanitation, and nutrition. Finally, the paper discusses how to integrate service delivery when designing and implementing other sector evaluations.

Hahn clearly follows the constructivist research ideology. The interesting aspect of this chapter is that she integrates action research as a technique to become the participatory-phenomenology method. Compare this to the definition and application by Lim and Seok-Chai when using the pragmatist ideology (previous section). Furthermore, consider the interpretative eidetic versus descriptive hermeneutic phenomenology method variations discussed in the previous chapters by McCarthy. This is why action research is both a technique and a method that can be used in interpretative or constructivist ideologies, but phenomenology as a method is generally positioned under the constructivistic ideology. In this chapter, Hahn discusses how a researcher with a constructivist ideology would articulate and then apply the participatory-phenomenology method on a health-care nurse’s experience as an inductive within-group unit of analysis with a group level of analysis (the nurses at a particular hospital).

Three‐quarters of mothers should be breastfeeding their babies in the early postpartum; 50 percent at six months, according to Healthy People 2010. Health care providers often give inconsistent information and messages to mothers about breastfeeding even though most mothers birthing babies say they want to breastfeed their infants. Baby‐Friendly is one initiative that helps providers get "on the same page" when it comes to promoting breastfeeding.

In keeping with the unique visual exciting style of the handbook, we wanted to finish with a thinking-outside-the-box implication for future research design practices to question the status quo rather than summarize what is already articulated in the preface and introductory chapters. Four contributing authors volunteered to collaborate on this final concluding chapter. Each author brings a distinct sociocultural and ideological perspective to the table based on his or her contribution being in different sections of this book and his or her research experience being grounded in diverse epistemological disciplinary roots. In other words, each of us works in a different discipline, and we have different dominant research ideologies and ontological approaches to research.
