This paper discusses and assesses two remarkably different (and competing) approaches which are used by contemporary legal anthropologists to study Tswana law and custom. The ideological underpinnings of these approaches are contrasted, and linkages between methods of investigating indigenous law and the “homeland” ideology of separate development are noted.
