This paper examines the debate on labor standards between neoclassicals and institutionalists from a feminist perspective and elaborates on some key elements of a feminist approach to labor standards. It argues that both neoclassical and institutionalists share a gender-based definition of labor. Rejecting the notion that upward harmonization can be achieved by reliance on deregulated markets or labor standard regulation alone, the feminist perspective calls for new approaches to policy and politics.

The National Organization for Women has pointed out the implications of mandatory arbitration policies implemented by different companies. Employees are forced to avail of arbitration to settle work-related complaints. This policy allows companies to escape the stringent requirements of civil law. Cases such as those concerning employment discrimination or sexual harassment will not have to deal with a court trial. Another law has diminished the gravity of punishment for unfair labor practices by putting a specific limit of one year's compensation to punitive damages.
