Abstract

Traditional patent law theories teach that a patent's rights of exclusion are a patent's key benefit to the patentee and are necessary to make the patent system work. Yet patentees are increasingly giving away such rights, in whole or in part, as part of a growing phenomenon: patent pledges. In these scenarios, patentees voluntarily commit to limit enforcement of their patent rights. This phenomenon seems to contradict traditional patent law theories. After all, if exclusive rights are necessary, why are patentees increasingly sacrificing some or all of those rights? This Article argues that patentees do so because in patent pledging contexts, patents often entail a different value proposition than what traditional patent law theories posit. That is, patent pledgers use patents as tools to signal information about themselves and their innovation preferences to product, labor, and capital markets. This information may then facilitate a variety of economic purposes behind such pledges. This Article uses concepts from signaling theory in other disciplines to identify several patent law features that help make patents valuable as informational tools. It also reviews several recent Supreme Court cases and their possible implications for the informational value of patents identified in this Article. The Article concludes by arguing that these underappreciated informational roles of patents deserve greater consideration in formulating and tailoring patent law and policy, particularly in industries, such as information technology, where patent pledging is more common. Building the system involved algorithmic, analytics, operational, and experimental challenges; operations research and analytics techniques played a key role in resolving these challenges. Abstract

Perceiving is the process by which evanescent sensations are linked to environmental cause and made enduring and coherent through the assignment of meaning, utility, and value. Fundamental to this process is the establishment of associations over space and time between sensory events and other sources of information. These associations provide the context needed to resolve the inherent ambiguity of sensations. Recent studies have explored the neuronal bases of contextual influences on perception. These studies have revealed systems in the brain through which context converts neuronal codes for sensory events into neuronal representations that underlie perceptual experience. This work sheds light on the cellular processes by which associations are learned and how memory retrieval impacts the processing of sensory information. Collectively, these findings suggest that perception is the consequence of a critical neuronal computation in which contextual information is used to transform incoming signals from a sensory-based to a scene-based representation. A great deal of research on the prefrontal cortex (PF), especially in nonhuman primates, has focused on the theory that it functions predominantly in the maintenance of short-term memories, and neurophysiologists have often interpreted PF's delay-period activity in the context of this theory. Neuroimaging results, however, suggest that PF's function extends beyond the maintenance of memories to include aspects of attention, such as the monitoring and selection of information. To explore alternative interpretations of PF's delay-period activity, we investigated the discharge rates of single PF neurons as monkeys attended to a stimulus marking one location while remembering a different, unmarked location. Both locations served as potential targets of a saccadic eye movement. Although the task made intensive demands on short-term memory, the largest proportion of PF neurons represented attended locations, not remembered ones. The present findings show that short-term memory functions cannot account for all, or even most, delay-period activity in the part of PF explored. Instead, PF's delay-period activity probably contributes more to the process of attentional selection. [ABSTRACT FROM AUTHOR]
