The copyright fair use caselaw is more coherent and more predictable than many commentators seem to believe. Fair use cases tend to fall into common patterns, or what this Article calls policy-relevant clusters. The policies underlying modern fair use law include promoting freedom of speech and of expression, the ongoing progress of authorship, learning, access to information, truth telling or truth seeking, competition, technological innovation, and the privacy and autonomy interests of users. If one analyzes putative fair uses in light of cases previously decided in the same policy cluster, it is generally possible to predict whether a use is likely to be fair or unfair. Policy-relevant clustering is not a substitute for appropriate consideration of the statutory fair use factors, but it provides another dimension to fair use analysis that complements the four-factor analysis and sharpens awareness about how the statutory factors, sometimes supplemented by other factors, should be analyzed in particular contexts. Parts I through V mainly provide a positive account of how fair use has been adjudicated in a variety of contexts and suggestions about factors that should be given greater or lesser weight in certain fair use policy clusters. Its articulation of the policy-relevant clusters into which the fair use cases typically fall should not, however, be understood as attempting to limn the outer bounds of fair use or to foreclose the development of new policy- relevant clusters. This Article concludes by offering a more normative account offair use as an integral and essential part of US. copyright law that can, in fact, encompass the wide range of fair uses discussed, by recapping the key lessons from this Article's qualitative assessment of the fair use caselaw, and by pointing to some encouraging trends in recent cases. Academic libraries value the web as being a vital channel for communicating information and policies to their user community. Designing a webpage on copyright is a challenging task that requires a consideration of the medium and the message. This article proposes a conceptual model and proactive approach for integrating policy objectives and goals into the development of a copyright webpage, based on key elements of the library's mission in the academic environment. To complement this theoretical approach, an analysis of Canadian academic library websites was conducted in order to gage the effectiveness of copyright webpages, in the Canadian legal context, as well as related design issues of visibility and access. The aim of the article is to put forward the view of the national library of the Netherlands with respect to the copyright obstacles preventing the construction of digital libraries. It argues that the Dutch Copyright Act is in urgent need of amendment to meet the demands of the twenty-first century. The Act provides that works are protected for a period of 70 years after publication, during which term permission is required in advance from the copyright holder for every (re)use of a work. The severe practical difficulties arising from this discourage the creation of digital libraries. Reviewing copyright legislation elsewhere, the authors argue that in the short term the most cost-effective solution for the Netherlands would be a combination of the Scandinavian and North American models, and ideally would include a special Internet exemption for non-commercial use by cultural heritage institutions. This article will review relevant copyright and contract laws and literature to show that ILL at academic libraries is suffering and will continue to suffer under new laws and legal contracts intended to reduce legitimate access to copyrighted materials. With the combined restrictions that publishers advocate, the question is how effective can libraries continue to be to act as the primary agents to provide access to information for the public good. Academic libraries, in particular, have an important educational and research mission that tightening copyright and contractual restrictions may severely damage. At the end of spring semester, 2001, the authors submitted to the University of Colorado, Boulder Libraries Cabinet a proposal for implementing electronic reserves. Four scenarios were proposed: (1) Limited service in which only materials with no copyright issues would be accepted for electronic reserves; (2) Full service with a broad interpretation of Fair Use; (3) Full service with a limited interpretation of Fair Use; and (4) Full service with no Fair Use claimed. Cost estimates were provided, based upon extrapolation from a pilot project conducted the preceding semester. After considering these four options, Library Administration chose to implement full service with a broad interpretation of Fair Use, and University Counsel approved guidelines reflecting this decision.
