Fifty years ago, this was less true, but linguistic study has expanded rapidly since that time and it is now possible for you to call a local university for a linguist and be asked what kind you want. Some specialize in semantics, some in phonology, some in syntax, some in one or more of the many other areas of linguistics now offered and taught, including applied linguistics.

Diskrepanzen zwischen IQ und Lese-/ Schreibleistung sind logisch unvermeidlich, da beide Leistungen nur mäßig korrelieren, Schulerfolg hängt generell nur lose mit Intelligenz zusammen. Dies gilt für alle Leistungen und wird in anderen Fächern ohne größere Umstände oder gar Ausflüge in die Hirnforschung und Entwicklungsbiologie akzeptiert. Es wird je nach Verwendung unterschiedlicher IQ- und Lese-/ Rechtschreibtests zu unterschiedlichen Differenzen und damit auch Klassifikationen von Legasthenie vs. LRS kommen. Der unvermeidliche und nur für Gruppenaussagen statistisch begrenzbare Messfehler führt bei der Anwendung von Tests auf Einzelfälle zu erheblichen Unschärfen der Abgrenzung. Unterschiedliche Erscheinungsformen bzw. Ursachen von "Legasthenie" bzw. "LRS" konnten bisher weder empirisch aufgewiesen noch theoretisch erklärt werden. Insbesondere hat die Hirnforschung bisher keine "normalen" Gehirne beschreiben oder gar eindeutige Beziehungen zwischen Anatomie bzw. physiologischen Funktionen einerseits und intellektuellen Leistungen andererseits nachweisen können. Es hat sich auch keine differenzielle Wirksamkeit spezifischer Fördermaßnahmen für (angeblich) "erblich" oder "sozial" bedingte Lernschwierigkeiten gezeigt.

In ihm sind Prozesse des Doing Gender ebenso verankerbar wie Gender als Institution. Mit dem Habitusbegriff wird Geschlecht sowohl als vergeschlechtlichtes Merkmal wie als vergeschlechtlichende Praxis faßbar. Dabei dürfen Machtverhältnisse jedoch nicht außer Betracht bleiben. Vor allem in den Ansätzen der hegemonialen Männlichkeit bzw. der männlichen Herrschaft lassen sich Bedingungen aufzeigen, die erklären, wie die Sozialisation der Geschlechter sich vollzieht und zugleich, wie Geschlechterverhältnisse veränderbar sind. Neben Etablierungs- und Qualifizierungsmomenten lassen sich ebenso immanente Schwachpunkte, Begrenzungen und offene Fragen ausmachen. Der Beitrag will letzterem auf die Spur kommen. Aus diesem Grund werden Selbstverständlichkeiten der Geschlechterdebatte in der Jugendhilfe kritisch in den Blick genommen. Es werden zum einen die diskursbestimmenden theoretischen Konstruktionen der Geschlechterrealitäten untersucht, zum anderen die daraus abgeleiteten praktischen Arbeitsprinzipien. Welche Vorstellungen zu Mädchen- und Jungenwelten bestimmen den Mädchenarbeits- und Jungenarbeitsdiskurs? Wie »passend« sind diese Vorstellungen? Welche Fragwürdigkeiten produzieren sie theoretisch und praktisch? Die Besonderheit des Programms liegt in der weiteren innovativen Aktivierung und Verbesserung der Leistungsfähigkeit der Einzelschulen und der sie tragenden Schulsysteme. Dieser umfassende und anspruchsvolle Arbeitsansatz bedarf einer umsichtigen Durchführungsplanung, die sich auf Elemente von hoher Entwicklungsrelevanz konzentriert. Wird dies im Laufe der fünfjährigen Entwicklungs- und Erprobungsphase flexibel durchgehalten, dann sind Erkenntnisse und Ergebnisse zu erwarten, die einer pädagogisch wirksamen Weiterentwicklung von Einzelschulen und Schulsystemen dienen können. Es handelt sich um ein komplexes Entwicklungs- und Erprobungsprogramm, das angesichts der unterschiedlichen bildungspolitisch-planerischen sowie fachlichen Ausgangslage jeweils auf die Ebene der einzelnen Länder heruntergearbeitet werden muß. In diesem Vorgang sollte eines der Ziele des Programms gesehen werden. In einem solchen Transformationsweg können innovationsplanerische Reflexion und Willensbildung der Länder zum Tragen kommen. 'In der Öffentlichkeit wird im Zusammenhang mit Verwaltungsformen häufig die Frage gestellt, ob viele externe Gutachten überhaupt notwendig sind. Kritiker behaupten, die Gutachten würden 'bestellt, bezahlt und kaum beachtet'. Politiker, so wird kritisiert, bestellen Gutachten, wenn sie nicht mehr weiter wissen oder sich vor einer Entscheidung drücken wollen. Millionenbeträge werden für externe Gutachten ausgegeben. In den letzen Jahren wurden immer häufiger Gutachten und externe Studien in Auftrag gegeben. Manche kritische Beobachter sprechen schon von einer 'Konzeptionalitis', also einem übermäßigen Einsatz von Konzepten und Gutachten. Successful ageing has been associated with maintenance of activity, focusing on both individual aspirations to engage in personally meaningful activities, and on roles and functions that challenge, facilitate and motivate individual activity in a given society, culture and continuity in lifestyles and competences. Old age must be considered in a cross-generational context, namely, in the sense of taking responsibility for younger generations. Sophisticated knowledge systems and strategies are bases for a productive and creative life in old age. Creativity is not a matter of age, but of a history of creativity. In analyzing religiousness and spirituality, this expert report differentiates between an ‘intrinsically’ and an ‘extrinsically’ motivated religiousness, pointing to the significance of the former (but not the latter) for not only chances, challenges and boundaries of development in old age but also for readiness to forgive. Moreover, the report emphasizes the maintenance of intergenerational justice, in the sense of equal possibilities for all generations to live a ‘good life’. Engagement of older people is believed to contribute to the maintenance of intergenerational justice, which could be further supported by flexibility in age limits.

1. The value of summaries is not in doubt. Much of the guidance given by the European Community (EC) on how to prepare an expert report is similar to guidance the FDA gives to sponsors preparing submissions for review by the Food and Drug Administration. 2. What is unique, and hard for FDA staff to understand is the apparent deference given to the expert report when the expert is a sponsor, employee or paid consultant whose task is plainly to support approval. The FDA expects dossiers to be truthful but also expects that on matters of judgement, a sponsor-generated document will reflect the sponsor’s interests. That interest will inevitably lie in supporting an application for marketing; the expert report cannot possibly reflect any other conclusion. 3. Although the expert report must be an advocacy document, it provides the sponsor with the opportunity to confront and explain any potential deficiencies in the application, a useful exercise and one that could well enhance the credibility of the application. Like every part of a dossier, however, the expert report must be considered in light of its content, not the “expertise” of its author.

Atualmente, no Brasil, têm aumentado enormemente as demandas jurídicas impetradas por paciente contra seus médicos. A má prática médica é conceituada como a conduta inadequada, que supõe inobservância técnica, capaz de produzir dano à vida ou agravo à saúde de outrém, mediante imperícia, imprudência ou negligência. A ausência de conhecimento técnico em medicina faz com que a autoridade judicial se utilize da perícia médica para apuração da responsabilidade civil dos envolvidos. O objetivo deste trabalho foi avaliar a importância do laudo pericial médico na formação do entendimento da autoridade judicial em casos de alegada má prática médica na especialidade de cirurgia geral e verificar o impacto da perícia médica na formação de seu convencimento. Estudaram-se os laudos oficiais e as decisões judiciais do ano de 2009 de 100 processos cíveis referentes à má prática médica na especialidade de cirurgia geral, propostas no estado de São Paulo, até a primeira instância. Observaram-se os elementos do laudo pericial e a fundamentação da sentença. Determinaram-se a concordância e a discordância entre os entendimentos médico e jurídico em cada caso. Em todos os julgados mencionou-se a prova pericial médica. Em 96% dos casos o laudo médico-legal influenciou a decisão judicial. 80% das sentenças foi desfavorável aos autores. Em 84% dos casos, o perito não estabeleceu nexo de causalidade. Houve, em 16% das perícias realizadas, elementos que permitiram concluir pela ocorrência de má prática médica. A concordância deu-se, especificamente, em 75% quanto à conduta médica inadequada e em 100% quando se considerou a assistência prestada adequada. Constatou-se que a perícia médica é o principal meio de prova nas ações que versam sobre má prática médica. Demonstrou-se a grande influência do laudo pericial na decisão pela procedência, ou não, das ações. O fornecimento adequado à autoridade competente de esclarecimentos sobre a matéria em tela, com base em conhecimentos científicos, é responsável pela formação do convencimento do magistrado, contribuindo para que se faça justiça.

Introduction Understanding the causes of cancer depends on synthesising epidemiological, clinical and mechanistic evidence. Using this approach, the 2007 WCRF/AICR Expert Report defined the likely causal contributions of factors related to food, nutrition and physical activity to cancer risk, based on systematic literature reviews (SLRs) of evidence published up to 2005. For the Continuous Update Project (CUP) a team at Imperial College London (ICL) updates the previous databases as new studies are published. Methods The CUP follows a similar process to the 2007 Expert Report. Having first combined the separate databases for the 17 cancers reviewed for the 2007 Expert Report into one database, the ICL team conducts SLRs of links between food, nutrition physical activity and specific cancer sites, and displays and analyses the evidence according to peer-reviewed protocols. An independent expert panel draws conclusions based on the updated evidence. The database is currently being updated with papers published since 2005 through a rolling programme. A complete, continuously updated database is expected by 2015. Results An updated SLR for breast cancer was consistent with the conclusions of the 2007 Expert Report. Further reports of updated SLRs will be published on other cancers. Once the SLRs for all the cancer sites have been updated, the database will be made publicly available, and the 2007 Expert Report recommendations reviewed. Conclusion The CUP will provide a unique resource synthesising epidemiological and other evidence on food, nutrition, physical activity and cancer, to facilitate related research, and underpin advice to public and policy-makers.

The present study draws from a previous research conducted in several Italian Courts. The present research explores how the expert reports are conducted on the sex reassignment. The Italian law 164/82 on the sex reassignment provides that the judge, where he considers appropriate, set an expert report. The expert can use several tools on the basis of his/her professional background. Objective The aim of this study is to highlight which psychological tests are used during the expert reports and to relate them with the different experts. For this aim Courts where request for sex reassignments were chosen and, in particular, those Courts where an expert report was present. Finally, the association between type of surgical interventionand type of test was examined. Design and method Archivial data collection was used. Commited Courts were identified as well as different experts who reported the assessment along with instruments adopted. Results Corrispondence analysis showed a different pattern of association among the several test and practitioners. The first dimension discriminated general personality tests from those specific, as well as psychiatrists and forensic scientist from psychologist. The second dimension separated qualitatively general personality tests from those with psychopatological framework. Conclusions Psychologists, forensic scientist and psychiatrists showed different profiles in using psychological tests for the issue. The analysis of spatial configuration highlighted that forensic scientist use more of psychopatological personality tests. Instead, psychiatrists seemed to use more general tests. Finally, psychologists, seemed to use more specific instruments related with the measurement of gender identity.

- Abstract
Communicating and interpreting genetic evidence in the administration of justice is currently a matter of great concern, due to the theoretical and technical complexity of the evaluative reporting and large difference in expertise between forensic experts and law professionals. A large number of initiatives have been taken trying to bridge this gap, contributing to the education of both parties. Results however have not been very encouraging, as most of these initiatives try to cope globally with the problem, addressing simultaneously theoretical and technical approaches which are in a quite heterogeneous state of development and validation. In consequence, the extension and complexity of the resulting documents disheartens their study by professionals (both jurists and geneticists) and makes a consensus very hard to reach even among the genetic experts' community. Here we propose a 'back-to-basics', example-driven approach, in which a model report for the two most common situations faced by forensic laboratories is presented. The 2 April article “Court views engineers as scientists” by Jeffrey Mervis (News of the Week, p. [21][1]) includes a curious quote from Richard Meserve, the attorney for the U.S. National Academy of Engineering (NAE), which filed a brief in the U.S. Supreme Court case Kumho v. Carmichael. The attorney states that experts “ought to be embarrassed if a judge finds their testimony not acceptable.” This presumes that judges are never biased and never misunderstand the scientific issues. Ironically, in struggling with issues of scientific evidence, some courts have promulgated pseudo-science, for instance, holding that it takes a doubling of epidemiological risk to imply that a toxic substance is more likely than not to have caused an individual's disease. This is scientifically false ([1][2]). The statement that a scientist should be embarrassed by a negative judge's ruling also presumes that other scientists would agree with the decision, and it presumes that higher courts will not overturn the decision. But most important, the statement ignores the fact that scientists are often barred from testifying for reasons having nothing to do with the reliability of their science. Instead, the judge rules that the expert's science is not relevant to the legal issues in the case. No judgment about a scientist's worth should be made merely on the basis of a statement that a judge barred his or her expert report from a proceeding. This paper discusses one procedure for examining technology policy objectives. A set of technology policy objectives was selected from a report prepared by a group of Commonwealth experts. These were then partially structured using Interpretive Structural Modeling (ISM) methodology. The resulting structure is presented and discussed. Deductions made from these are used to indicate a possible mode of efficiently implementing the main policy recommendations of the expert report consistent with the value system of the society concerned.

The Dialectical Inquiry System (DIS) and the Devil's Advocate (DA) have been recommended as strategic decision-making aids and as improvements on the traditional expert (E) approach in which strategic decisions are based on preliminary analyses and proposals by staff experts. Previous research on the effects of the DIS and DA has produced conflicting results. In the present study, subjects produced alternative strategies and recommendations for a company described in a case. They were given the E, DA, or DIS treatment either in written form or via videotape. In addition, some were assigned to a control (C) group and received no planning assistance. The results showed that the written DA, the videotape DI, and the videotape E treatment caused subjects to generate fewer functional area alternatives than the C subjects. Further, the subjects receiving the written DA generated more strategic alternatives than those receiving the written DIS or E. The DA also reduced the effects of an “expert report” on subjects' final recommendations while the DIS did not. Subjects given the DA and DIS reported greater satisfaction with the process than those given the E.

Devil's advocacy is designed to assist decision makers in questioning assumptions. Escalating commitment in organizations occurs in decisions involving ambiguous information which requires decision makers to make assumptions. In such decisions, experts often provide analysis and recommendations for action which may increase the tendency toward escalating commitment if decision makers uncritically accept the assumptions underlying the experts' recommendations. Devil's advocacy may be effective in this process. In this paper, Staw's (1976) escalating commitment task is used to examine the effects of an expert report and a devil's advocate treatment on the tendency to escalate commitment. Results show that an expert report increases dollar allocations to a failing project and subjects' estimates of the project's probability of success. A devil's advocate critique appeared to reduce the effects of the expert report though the results were only marginally significant. The results also suggest that, in their assessments of probability of success, females are less sensitive than males to the failure feedback but more sensitive to the devil's advocate treatment.

Purpose The needs and concerns of patients with advanced breast cancer are changing at every phase of the care intervention. Management and coordination of hospital resources and services are also steadily evolving. The objective of the present expert report is to define a new oncology nursing role specialising in advanced breast cancer, to help guide patients throughout the whole healthcare itinerary. Methods A group of eight experts in oncology nursing and medical oncology defined the content index of the curriculum document. A systematic review of bibliography was carried out, and the relevant contents were extracted. Based on these contents and the participants’ experience recommendations were formulated and validated through a Delphi questionnaire and a participative meeting. Results The advanced breast cancer clinical nurse (ABCCN) should develop a clinical, psychosocial role focused on coordinating patients in the healthcare network. The nurse would be in charge of evaluating and supervising the care administered and the healthcare resources used. The ABCCN should be aware and participate in the protocols and available resources, be able to solve conflicts, deal with burn-out signs and have clinical, coaching and team-working abilities. The proposed curriculum provides a specific process for the care of patients, as well as an implementation process. Conclusions The ABCCN’s role is crucial to assume the best care and the optimisation of available resources. U investiční výstavby se rozpočet sestavuje nejčastěji na základě některého stupně projektové dokumentace. U tvorby rozpočtu pro znalecké účely znalec ve většině případů nemá k dispozici kompletní projektovou dokumentaci, je vázán na podklady obsažené v soudním spise, na ústní sdělení zúčastněných osob a na podklady, které si vyžádá, nebo které si zajistí sám v rámci vlastního měření. Čím více kvalitních podkladů má znalec k dispozici, tím přesnější výstup v podobě rozpočtu bude moci vytvořit. V současné době neexistuje jednotný postup pro oceňování stavební produkce při vypracování znaleckého posudku. Z tohoto důvodu je hlavním cílem této disertační práce vypracování vývojového diagramu, ve kterém bude uveden přehled o možnostech získávání podkladů potřebných k tvorbě rozpočtu stavebních prací a bude znalci pomůckou a doporučením, jakým způsobem by měl postupovat při tvorbě takového typu znaleckého posudku.
