The article presents an economic assessment of damage caps in medical malpractice litigation imposed by state laws and the implications for federal policy and law in the U.S. Many states have enacted laws that serve to limit non-economic damage awards for medical liability claims. These laws were put into effect in the hope of controlling liability insurance costs, thereby reducing medical costs to consumers and preserving or increasing access to healthcare for individuals.
