Introduction. This paper presents a qualitative research study which questions the discourse of normative texts regarding the principle of attention to diversity according to the academic and teaching experience of postgraduate students at a Spanish university. Objective. The aim is to go beyond the limits of the surface of the words used in legal texts and access their underlying meaning based on personal experiences narrated by the participants. Materials and methods. The research approach to be used is qualitative, given its flexible and open nature, as this type of design allows the study of problems in higher education to be addressed. Results. The findings reveal the existence of four unnoticed phenomena: the creation of the other as the prototype of their culture, the alienation of the other and the alienation of diversity, the elevation of one culture over the others and, finally, the demonization of these cultures. Conclusions. This paper affirms that the perception and treatment of diversity are afflicted by considerable cultural biases. The final proposition is an invitation to teachers to reflect on their own practice and its legal framework in order to be aware of the possible and unnoticed mismatches between them, because only by being aware of the gap between what is and what should be can actions be redirected to the creation of an atmosphere of respect for diversity.
