Social assistance as a general form of social protection must be differentiated from social assistance as a specific power exercised by Spain’s autonomous regions through the Social Security System. In addition, the exercise of regional powers in the area of social assistance is affected by other State powers, such as those recognised in Art. 149.1.1 of the Spanish Constitution (CE in Spanish) on the basic conditions that guarantee equal exercise of constitutional rights and in Art. 149.1.13 CE on the bases and coordination of general economic planning; or the State power regarding public expenditure. The latter, although not strictly a specific power, enables the State to use its funds for any purpose. Likewise, certain constitutional precepts, such as that contained in Art. 139.1 CE, can have an impact on the exercise of the autonomous communities’ powers in the area of social assistance, which could imply a substantive limitation on their exercise. Historical memory has become a really relevant topic in Spanish media and politics, particularly since the adoption in the Congress of Deputies of the law 52 of 2007, "by which rights are recognized and extended and there are measures established to benefit those who suffered persecution or violence during the civil war and dictatorship. " In this study we reflect on how the media propose a public debate on Francoism and the Spanish transition. We used 32 focus groups and analyzed how the media historization of the dictatorship and its socio-political legacy is assimilated in the social discourses of the audience. That is how we examined the mediated memory, the one that is built on the collective process in which historical events are negotiated. We also found empirically eight types of ideal memories in Spain, those whose memories are influenced by the sociopolitical environment, the generation and the degree of politicization. The constitutional regulation of the Spanish ombudsman, as well as the functions performed by the latter has generally been appraised in a positive way. This not withstanding should a Constitutional reform be undertaken, having in mind the strengthening of the Welfare (social) state, it may be advisable to reinforce the ombudsman as a warrant of social, economic rights. With this end in view, we suggest to undertake some changes in article 54 of our Constitution. These changes should concern the functions which it performs, its proceedings and its election. And last but not least, the necessary cooperation by authorities and civil servants, as well as the aftermath in case they break their duty to provide the ombudsman with the information required by it. The Constitutional reform made in Spain last summer has been discussed very deeply due to its content and to the way it has been made. It seems like concepts as sovereignty, democracy, constitutional moment, that are important in order to justify our political system, are secondary compared to the demands of Germany and the markets. In this paper, the reform is criticized from a constitutional view of the State, the Law and the democracy. It is argued that the reform of the article 135 goes against the agreements and the foundations of the constitutional model and, in addition, goes against the content of the Constitution of 1978 canceling the Social State. The approach to abortion recently adopted by Spanish law has important gender implications. It articulates the transit to a system that prefers prevention over repression, information over criminalisation and the harmonisation over the confrontation of the interests of pregnant women and unborn life. While the Report issued by the Spanish Consejo de Estado on the new legislation assumes the logic of prevention, it remains committed to the logic of confrontation that lies behind repressive approaches to abortion. The new preventive strategy requires, however, that the confrontational logic be abandoned and that the interests of pregnant women and unborn life be harmonized. This requires that the state alleviates the burdens pregnancy and parenthood place on women and distributes them among men, women and society at large. [ABSTRACT FROM AUTHOR]
