The granting of custody after the separation of couples is an increasingly common field of study. The literature shows that the interest in this topic has focused mainly on the separation of heterosexual couples. This article seeks to show how the granting of custody is distributed among the different models in the case of Spain, and the impact of specific variables on the granting of custody after the breakdown of same-sex marriages. A quantitative methodology was applied with multivariate descriptive analysis (through the elaboration of dependency analysis), using the Statistics of Nullities, Separations and Divorces (ENSD) of the National Institute of Statistics (INE). The main conclusion was that the joint custody model is more present than the sole custody in the case of same-sex couples, while the number of minors and dependent children of legal age are the variables that determine the custody model granted. Custody assignment after divorce is an increasingly recurrent area of study. The literature on this topic has tended to consider the dissolution of only heterosexual couples. Therefore, this article examines the influence of certain social variables and detects potential differences or similarities between heterosexual and homosexual couples in Spain. Quantitative methodology was used, along with descriptive and multivariate analyses, with data from the Annulments, Separations and Divorces Statistics (ENSD) of the Spanish National Statistics Institute (INE). The main conclusion reached is that shared custody is more commonly assigned in homosexual couples as compared to heterosexual ones. The number of children, the presence of conflict during the divorce proceedings and the specific Spanish autonomous community are variables that are key to understanding the assigned custody modality. This research focuses on an analysis of the sociological variables that affect the way that custody is awarded after a marital breakup, specifically after the divorce of married heterosexual couples. A quantitative methodology has been used based on Statistics on Annulments, Separations and Divorces and data for various rates in Autonomous Communities gathered from the Spanish National Statistics Institute (INE). This lesson corresponds with the master class given by Professor Rodríguez Mourullo at the Faculty of Law, Universidad Autónoma de Madrid, on the occasion of the completion of his teaching career, after 39 years as Professor of Criminal Law. In it, Professor Rodríguez Mourullo refers to his relationship with criminal law, interspersed with some memories, specially about the spanish transition, and current concerns related to the disrespect that the judicial practice shows sometimes for the rights and guarantees recognized in the Constitution. Has been done a study of 200 files about families in the region of Murcia, in which it has been asked for an expert psychological evaluation because of the request from both parents of the custody of their children. Through the analysis of the male parents petition it has been done a classification about the origin of their reasons to ask for the custody: • Petition of equal rights and care for the children. • It is alleged bad caring from the mothers to he children (because of mental problems, drugs abuse and physical abuse). • The children express their wish of living with him. • Existence of a PAS. • Economic interest. • With no reason. In each one of the requests it has been valued the age, the sex of the children and the opinion from the other parent. The problems involved in caring for individuals in custody, as well as deaths that occur during custody, are relevant aspects of legal and forensic medicine in terms of the possible criminal, civil and administrative responsibility of health professionals and/or public or private institutions that might hold individuals in custody and deprived of freedom. The rule of law should ensure that these cases comply with state law and international agreements and treaties related to human rights and the special treatment of individuals deprived of freedom in hospitals or detention centers. Of particular mention is the medical-forensic activity regarding deaths associated with the use of control holds and/or restraint during the detention of individuals by members of the armed forces or law enforcement or in healthcare centers by safety and healthcare personnel. In these cases, both the immediate healthcare treatment subsequent to the events and the medical-forensic study should be particularly careful.
