Abstract

The article discusses various changes in approach in relation to unjust contracts involving financial institutions, focusing on certainty, radical reforms, and analyses of the statutory provisions of New South Wales' (NSW's) Contracts Review Act 1980 which may apply to third party bank guarantees which are given with inadequate understanding or consent. English and Australian laws are mentioned, along with legal remedies and unconscionable contracts. Jurisdiction in NSW is also examined.
