This article discusses the question of how the EU member states deal with the prosecution of Foreign Terrorist Fighters (FTF). Since the rise of the so-called Islamic State, thousands of EU nationals have travelled or attempted to travel in conflict zones in Iraq and Syria to join Daesh or other terrorist groups. Many have already returned to their home countries and several have been prosecuted. However, most member states are reluctant to actively repatriate the thousands of FTF who are still in the conflict region. Some European countries would suggest the establishment of an international tribunal or a mixed national/international tribunal in Syria or Iraq. This paper deals with pros and cons of the different options available to prosecute FTF outside their home countries. [ABSTRACT FROM AUTHOR]
