The article focuses on the tax treatment of the transfer of a company's registered office from France to another Member State of the European Union with a focus on corporate tax problems. A discussion is provided on the general principle of Article 221(2) of the French Tax Code and an exception to the principle. The taxation of profits gained before the seat transfer, the deferred taxation of capital gains and the taxation of latent capital gains when the seat is transferred are examined.
