The article reports that a political compromise prevented the creation of a genuine one-stop shop merger filing system in Europe. The new procedure for pre-notification referrals of merger cases is burdensome, but the benefits of the one-stop shop can make it worthwhile. The European Commission (EC) Merger Regulation of May 1, 2004 introduced a system of so-called pre-notification referrals. These referrals, to be initiated by the parties to a transaction, are meant to increase the flexibility of case allocation between the EC and the competition authorities of the 25 European Union member states, the National Competition Authorities.
