Abstract

The article analyzes the problems in the patentability of inventions related to human embryonic stem cell (hESC) therapy in Estonia. The clinical trial of hESC-derived oligodendrocyte progenitor cells from Geron Corp. is highlighted. Patentability issues in the European Court of Justice (ECJ) case "Oliver Brüstle vs. Greenpeace eV" are addressed. The author recommends a public discussion among lawyers about the patentability of inventions related to hESCs. Controversies over the ethics of hESC-related inventions raised in the European Union (EU) are outlined.
