This text unveils the ways in which gender violence is expressed in the legal structures of legal treatment to the complaints of women victims of abuse in intimate partner relationships in Colombia. Judicial actions and rulings in these cases result in actions of revictimization and ineffectiveness of justice, which perpetuate the logic of male domination and moral damage to women. As long as the Colombian normative system does not recognize that it constitutes one of the elemental structures of patriarchy, it will be ineffective in guaranteeing women a life free of violence. This paper analyzes the interactions between courts, experts and interest groups present in the sentence C 355/2006, through which abortion is partially decriminalized in Colombia. A detailed review of this paper allows to track the role that interest groups and social movements have in the mobilization of expert discourses in the high courts as a strategy to influence their decisions. The use of disciplines and fields of knowledge is articulated to the general structure of the sentence as literary technology that makes visible the role of the court as administrator of justice. In order to learn about the particular situation of women in the Cauca province in the framework of the implementation of the Policy of Democratic Security, it became indispensable to analyze the evolution of the human rights of women in the period 2000 to 2009, keeping in mind such aspects as sexual violence, intra-family violence, homicides and femicides, social control, and political violence. It was also necessary to examine the situation of women in terms of access to justice and the effects of the increased presence of the armed forces in the entire province on their daily activities and lives, in the context of the process of recovery of territorial control by the State, in place since 2002. Determining the impact of the Policy of Democratic Security on the lives, integrity and wellbeing of the women in the Cauca province forced us to review and analyze in a gender perspective the objectives of the policy and the efficacy and legitimacy of the strategies used, and to ascertain the extent to which this policy fostered a context that would guarantee human rights and the protection of women. This report is a result of investigation and it has like object to examine the legislative measures adopted by the Colombian State in development of the constitutional commands, consequence of the international obligations through the treaties that recognize the human rights of the women. This article intends to expose the reasons of why politics of the State should be the protection of the family, especially in the cases where violent treatments are breaking with the harmony and peace in the family nucleus. That's the reason of why I would like to develop and explain the penal type of violence intrafamiliar, like a form that has the State for avoiding these practices that have been reiterative in the history of our country.
