Conflicts between police officers and justice workers are recurrent in studies on the Brazilian criminal justice system. On the other hand, studies that point out that one institution tends to ratify the work of another are also not rare. In Conflicts and Confluences between the Police and the Judiciary in Studies Published between 2011 and 2021 we carried out a literature review of the papers published in Brazil in the last ten years (2011-2021) which address the relationships between these two actors. In this text, we seek to comprehend: 1) how this relationship has been explored; 2) the basis of these conflicts and how they take place in the system and in the daily practices of these organizations; and 3) whether innovations implemented during this period have affected this relationship. Purpose: This study aims to analyze how the Brazilian National Communications Agency (Agência Nacional de Telecomunicações - Anatel) and cellular operators in Brazil used ceremonial and discursive practices to build enforcement and compliance actions, adopted during a period of crisis in the cellular sector industry in 2012 when the legitimacy of the respective regulatory model and the regulatory agent were challenged, shaping a compliance trap situation. Originality/value: The work fills a theoretical gap by associating the normative-cultural perspective of regulation associated with organizational institutionalism, based on the assertion that the relationship between regulator and regulated is interactive and not unidirectional, allowing that enforcement mechanisms represent political efforts, realigning the interests of the actors within their institutional environments. Design/methodology/approach: The case study research strategy with a qualitative approach is adopted, studying the 2012 crisis in the cellular sector industry, with the collection of data from documentary sources and semi-structured interviews with participants in the process. Findings: The results show that, in the compliance trap situation, symbolic criteria can appropriate the speeches, producing texts and practices in favor of legitimizing the enforcement mechanisms and the respective compliance responses in view of the audience. Therefore, the compliance trap risk on the regulatory agent is mitigated to the extent that ceremonial and discursive practices manifest themselves responsively and gain political and cultural support, reducing social pressure on the legitimacy of the regulation model. This paper exposes and analyzes some results of the research "Territorial Governance in Brazil: institutional specificities, spatial logics and development policies", guided by the following question: do governance structures reinforce institutional inertia or, on the contrary, are they signs of political modernization? Assuming that the basic function of structures is cooperation, the hypothesis can be expressed by following statement: institutional inertia and tendency to stability present in relations between actors hinder cooperation and participation by legitimizing relatively inadequate behaviors in search for sustainable territorial development. However, cooperation difficulties may also indicate a process of political modernization. The data analysis and development of hypothesis were made through a simplified reality model, the game, formed by the interactions between actors and institutions. Changes in institutional legitimacy modify actors' behavior and can be described as a process of political modernization. However, data collected indicate that cooperation and participation are truncated within the structures during the period studied (2002-2014), suggesting that their functioning can be characterized more by institutional inertia and less by political modernization. In this article, we use the notion of legitimacy to analyse shifts in global humanitarian interventions since the 1990s, culminating in the contested adoption of the Responsibility to Protect (R2P) framework under the United Nations umbrella in 2005. We assess how this important shift was disputed with narratives of protection and interference, and argue that the engagement of nonhegemonic actors (specifically Brazil and Russia) with the scope of humanitarian protection has influenced the substantive legitimacy of this global governance issue over the past three decades by creating a norm-making process in which the fundamental features of humanitarianism have been tested and challenged. The article discusses the concept of political rights in the election law of Brazil following Brazilian Federal Constitution, with a focus on the ideas of collective, diffuse, and individual rights. Topics addressed include the concept of collective rights; the definition of collective, diffuse, and individual rights in the consumer law; and political participation as defined by Brazilian Constitution.

The many debates about capitalism within the context of the successive crises of neoliberal globalization, although overlooked by the field of strategic management (SM), are of central importance to strategists and academics from emerging economies. In response to the way SM in the US has been linked to discourses portraying neoliberal capitalism as the only option, European literature has embraced the perspective of varieties of capitalism and developed the strategy as practice approach. Through a dialogue with international studies, this article argues that the Euro-American contemporary hegemony in GE helps build the legitimate authority of strategists from large corporations and keep Euro-American state strategists invisible and delegitimizes strategists and organizations from the rest of the world that represent other types of capitalism or alternatives to the Occidentalist order. In the end, the authors posit that the strategy field in Brazil might foster a geopolitical perspective on GE that could overcome some of the restraints imposed by historic capitalism and enable the diffusion and legitimation of other types of capitalism and non-Occidentalist alternatives. This article aims to broaden understanding of the phenomenon of legitimacy of civil society organizations (CSOs), interpreting it in the light of the critical capacity theory, proposed by Boltanski and Thévenot (2006). More specifically, it identifies, by means of discourse analysis of representative actors from the field, which are the justifications supporting the action and existence of CSOs, providing them with legitimacy. Having as a basis the theoretical framework and an analysis of the trajectory of the field in Brazil, some hypotheses were formulated: 1) that several reasonings are used in the justifications; 2) that the meeting between these reasonings provokes disputes and conflicts; 3) that it enables constructing footbridges; and 4) that there are predominant reasonings isolating the existence of other ones. Through discourse content analysis of 46 representative actors of the field of CSOs in the Brazilian South region, the hypotheses were tested and we found out that the predominant legitimacy dimensions in these CSOs are the pragmatic and moral, which stimulate the adaptation of CSOs to externally set standards, making plurality and, thus, democracy in the field weaker. The aim of this study was to analyze the configuration of an organizational-administrative electricity distributor post-privatization process showing its structure and managerial aspects of legitimacy in the reflexive-multidimensional model proposed by Alves (2003). This is a basic qualitative study that adopts a descriptive-analytical perspective with data collection through semi-structured interviews, observation and document analysis. Based on the analysis, the data indicate that the organizational configuration-management company's post-privatization approaches the base type of model-equiparative adapter. This study reflects the need to establish a new face on the legal nature of condominiums edilicio in order to demonstrate the possibility of access to justice these entities , provided that plaintiffs , in actions for recovery of condominium shares , by way outlined by Law the Special Civil Courts (Law 9.099/95). It appears that the condominiums make up the quadrants defined by that Act This analysis was based on the logical - legal context in which it is part of the Special Courts Act, particularly in the guiding principles of systematic civil procedure in Brazil - the due process Legal and Access to Justice - behold, the evaluation of the standard should be given under the provisions in the Constitution authorizing their issue. The aim of this paper is to verify the nature of the relationship between the concept of legitimacy and the phenomenon of institutionalization of operational auditing at the Court of Auditors in a context of institutional isomorphism. A documental examination was conducted covering the period of 1987 to 2004 and 18 people involved in the aforementioned activity at the Court of Auditors were interviewed. The results suggest that there is a relationship between isomorphism and legitimacy but only concerning one type of legitimacy. The phenomenon of isomorphism acts in the sense of checking cognitive legitimacy while other factors are at work which are connected to the culture and institutional environment of the country, which interfere in the dimension of moral legitimacy, resulting in institutionalization of the activity at a secondary level in the analyzed organization. It was seen that the process of institutionalization, in this case, has a circular characteristic, in which the phases of innovation, diffusion, partial saturation and partial deinstitutionalization follow one another cyclically, modifying the activity of operational auditing over time at the Court of Auditors. Using data collected in nine countries -- Argentina, Brazil, Chile, Czech Republic, Poland, Russian Federation, Finland, Germany and the USA -- through the World Values Survey, the article analyses the validity of four variables with a supposed potential to evaluate the legitimacy level of the private sector vis-à-vis the public sector. This analysis in undertaken in the context of the discussions on the future of market reforms that were implemented in several countries in the past 20 years. The investigation adopted a two level strategy: first, the aggregated frequencies for the nine countries were analyzed, followed by a bivariate analysis aimed at verifying the internal consistency of the variables. The article concludes that the four variables under consideration do not compose a valid dimension capable of assessing the legitimacy of the public sector versus the private sector.
