Abstract

The article compares legal responses to hate speech in Europe with those in Australia. It cites an instrumental and symbolic role being played by the law in persuading society that racial defamation is not morally right. It stresses the need to balance the right of a person to be free from incitement to discrimination and the right to freedom of expression before constructing such responses in a democratic system. It says laws aimed at seeking to balance those rights have been developed on both continents.
