This article analyses the discourse of the Gazeta Nacional newspaper circulated in the city of Rio de Janeiro in the period prior to the signing of the Lei Áurea ["Golden Law"] abolishing slavery in Brazil. It considers how the publication presented the criteria for citizenship and also investigates the importance it attributed to liberalism. The newspaper was subtitled Órgão Republicano ["Republican Organ"] and relied on participation from leaders of the movement in the Court. Debates were published on different proposals for the procedure for abolishing slavery with monarchists and those defending the republic itself. Texts published in the Gazeta Nacional therefore reveal possible strategies for releasing slaves and organising the post-abolition society conceived by members of the 1870 generation. Considering newspapers' contribution to the formation of the memory of an event through serving as a space for the exercise of power, this study focuses on an object and a distinct source for an analysis of the end of the nineteenth century. The article discusses the regulation of the Cuban labor market after slavery was abolished there in 1886, specifically with regards to the former slaves working in the sugarcane industry. The author notes that the sugar mill workers were controlled by the mill owners -- formerly slave owners -- through the means of contracts, regulated wages and a judicial campaign against vagrancy. The relationship between the workers and owners is described, and it is noted that despite being legally freed from slavery, most workers found their labor and living conditions unchanged, as they were bound to their employers by laws against vagrancy, strict regulation of wages and a lack of other options for employment.

This article reflects on the meaning that the slavery as well as his abolition have in the formation of the public-political, understanding it as the common references that regulate the social relations and the criteria of legitimization, shared by those who are perceived as members of the society. It asks for the role of the enslaved population during the building process of the references of citizenship and of the Republic during the first half of the XIX century. The slavery system inhibited the participation of the slaves in the construction of the public. Despite the resistance of this population and, after the independence, in spite of the attempts of a sector of the elite for turning them into free and equal citizens allowing their access to the space of freedom of the republic, during the process of abolition, the interests and the social and racial prejudices of the slavers had the priority, thus, prolonging the formal abolition until the middle of the century. El presente artículo tiene como propósito presentar la revisión documental y contextual del reconocimiento de derechos en relación con grupos minoritarios, en especial y como objeto principal de la presente investigación, de la comunidad afrodescendiente esclavizada y asentada en el Pacífico colombiano entre los años de 1800 y 1851. El estudio histórico y jurídico del reconocimiento a la libertad de esclavos, a la luz de un periodo de tiempo muy específico en el contexto de la Nueva Granada, y del derecho de acceso a la propiedad, es la línea conductora del presente artículo. El trabajo es además el resultado de una revisión del estado de la cuestión que pretende motivar la generación de nuevas investigaciones sobre el reconocimiento de derechos en favor de un grupo social al que no se le permitía acceder con facilidad a la libertad ni a la propiedad privada. Se utiliza para el efecto, en particular, la referencia a fuentes primarias (expedientes judiciales) existentes en el Archivo Central del Cauca The purpose of this article is to present the documentary and contextual re-view of the recognition of rights in relation to minority groups, especially as the main object of the present investigation of the enslaved Afro-descendant community located in the Colombian Pacific between the years 1800 and 1851. The historical and legal study of the recognition of the freedom of slaves, in the light of a very specific period of time in the context of New Granada and of the right of access to property in the difficult tension that arose between the various groups of power that confronted the design au-thority of the new State model for Colombia at the beginning of the 19th century, is the driving line of this article. It is also the result of a review on the state of the matter that aims to motivate the generation of new research on the recognition of rights in favor of a social group who were not allowed to easily access their freedom and access of private property, using for this particular work the reference of primary sources (judicial files) existing in the Central Archive of Cauca

espanolEn 1886 llegaba a su fin el sistema de trabajo esclavo en la isla. La liberalizacion del mercado laboral comporto el establecimiento de un nuevo tipo de relaciones entre los duenos y los trabajadores, de manera que los segundos se integraran en la logica de las relaciones capitalistas. Las contratas y los salarios -como via de control y regulacion de la disciplina- habian asegurado la sujecion de la fuerza laboral durante la transicion. En la etapa posterior, la estrategia de los propietarios azucareros insistio en los mismos postulados, a las contratas y los salarios se anadio la lucha contra la vagancia y el bandolerismo. Las leyes contra la vagancia permitieron el control de los que no aceptasen las condiciones de trabajo y quedaran al margen de las reglas del sistema, mientras que los salarios continuaron actuando como mecanismos de sujecion y mantuvieron atados a los trabajadores al ingenio. Como resultado, a pesar de haber obtenido la libertad las condiciones de vida y trabajo de los antiguos esclavos apenas sufrieron variacion y continuaron ocupando un lugar subordinado en la sociedad. EnglishIn 1886, the system of slave labor came to an end on the island of Cuba. Liberalization of the labor market led to the establishment of a new type of relationship between owners and workers, in which the latter were absorbed into the logic of capitalist relations. Contracts and wages -as means of controlling and regulating discipline- had guaranteed the subjection of the work force during the transition, and in the ensuing period the strategies adopted by sugarcane plantation owners were still based on those postulates, but complemented by the judicial campaign against vagrancy and outlawry. The laws against vagrancy allowed owners to control men who refused to accept their working conditions and preferred to stay on the margins of the system and its rules, while wages continued to function as mechanisms of subjection that kept workers tied to the sugar mills. As a result, despite winning their freedom, slaves encountered living and working conditions that were little changed, while still occupying a subordinate place in society. francaisEn 1886 le systeme de travail esclave arriva a son terme dans l'ile. La liberalisation du marche de la main-d'œuvre entraina l'etablissement d'un nouveau type de relations entre les maitres et les travailleurs, de telle sorte que les seconds vont s'integrer a la logique des relations capitalistes. Les contratas et les salaires -comme moyens de controle et de regulation de la discipline- assurerent la sujetion de la force de travail pendant la transition. Pendant l'etape ulterieure, la strategie des proprietaires sucriers insista sur les memes procedes, et aux contratas et aux salaires s'ajouta la lutte contre les deracines (vagancia) et le banditisme. Les lois contre la vagancia leur permirent le controle sur ceux qui n'acceptaient pas les conditions de travail et restaient en marge des regles du systeme, alors que les salaires vont continuer a agir comme des mecanismes de sujetion et vont maintenir les travailleurs attaches au moulin a sucre (ingenio). Comme resultat, bien qu'ayant obtenu la liberte, les conditions de vie et de travail des anciens esclaves connurent a peine des changements, et ils continuerent a occuper une place subordonnee dans la societe.
