El estudio y el análisis que se realizó, en el cual se describe y se discute como se involucra la responsabilidad estricta y legal en la falta, con un mayor rigor en las actividades o funciones que desempeñan los funcionarios y servidores públicos, contrario de la responsabilidad que se deriva por las actuaciones de los las personas que no se vinculan con la función del estado, razón por la cual se expide un código disciplinario, una ley anticorrupción y un régimen de inhabilidades para cumplir con la finalidad del correcto funcionamiento de la función pública, para garantiza los principios que la rigen, imponiendo lo que se describe como moralidad en la función pública, para que no se haga necesario un reproche de tipo sancionatorio y disciplinario con responsabilidades derivadas de faltas que impiden el funcionamiento de la administración y del estado dándole cumplimiento a preceptos constitucionales contenidos principalmente en los artículos 123, 124 y 209. La justicia disciplinaria, acarrea una responsabilidad personal tanto para el investigado como para el funcionario competente. Esta responsabilidad, va ligada a los principios garantistas del debido proceso en las actuaciones administrativas. Cuando los funcionarios competentes designados por la ley, adoptan decisiones de fondo de carácter disciplinario que se apartan de los lineamientos constitucionales garantistas, profieren fallos contrarios a derecho, los cuales son objeto de control de legalidad ante la jurisdicción contenciosa administrativa; luego de hacer el control de legalidad del acto administrativo, esta jurisdicción revoca las sanciones proferidas. La consecuencia lógica de esa revocatoria, desde la óptica de la sanción disciplinaria más severa, va ligada al reintegro del funcionario sancionado y por supuesto, al pago de las indemnizaciones por los perjuicios que ocasiono la administración, a través del funcionario que profirió la determinación de separar del cargo al servidor público. De allí se desprende la responsabilidad disciplinaria y pecuniaria del funcionario competente, que genera un detrimento patrimonial al Estado, ante el error del Juez Disciplinario. La hipótesis planteada se resume en el hecho que la revocatoria por la jurisdicción administrativa, viene implícita per se, la necesidad de adelantar un proceso disciplinario contra el funcionario competente, en busca de determinar su grado de responsabilidad y en pro de resarcir el perjuicio ocasionado a la administración con su actuar doloso o gravemente culposo en el caso de la acción de repetición y su conducta catalogada como delito. La sujeción que debe el derecho disciplinario a la Constitución implica que además de garantizar los fines del Estado Social de Derecho, debe reconocer los derechos fundamentales que rigen nuestro ordenamiento jurídico, siendo la culpabilidad uno de ellos según lo consagrado en el artículo 29 Superior en virtud del cual “Toda persona se presume inocente mientras no se le haya declarado judicialmente culpable”. Es decir, que en nuestro sistema jurídico ha sido proscrita la responsabilidad objetiva y, por lo tanto, la culpabilidad es “Supuesto ineludible y necesario de la responsabilidad y de la imposición de la pena lo que significa que la actividad punitiva del estado tiene lugar tan sólo sobre la base de la responsabilidad subjetiva de aquellos sobre quienes recaiga .
